Public Availability of Identities of Inert Ingredients in Pesticides
- Comments due February 22, 2010
In response to two petitions seeking disclosure of selected inert ingredients
on pesticide labels, based on hazard, EPA is initiating rulemaking to
increase public availability of the identities of the inert ingredients
in pesticide products. This action would assist consumers and users of
pesticides in making informed decisions and reduce the presence of potentially

Guidance for Pesticide Registrants on Pesticide Drift Labeling- Comments
due January 4, 2010

EPA is issuing proposed guidance for new pesticide labeling to reduce
off-target spray and dust drift. The actions detailed in EPA’s draft
Pesticide Registration (PR) Notice on Pesticide Drift Labeling will improve
the clarity and consistency of pesticide labels and help prevent harm
from pesticide drift. The Agency is announcing the availability of and
seeking public comment on two documents - a draft Pesticide Registration
Notice (draft PR Notice) entitled ``Pesticide Drift Labeling'' (PRN 2009-X)
and a draft explanatory document entitled ``Pesticide Drift Labeling Interpretation.''
This particular draft PR Notice provides guidance to the applicants and
registrants of certain pesticide products for revising labeling statements
intended to protect people and other non-target organisms and sites from
adverse effects that may be caused by off- target pesticide drift.

Registration Decisions Open for Public Comment: Cold Pressed Neem Oil
- Comments due November 14, 2009
A second public comment period for EPA's risk assessments and proposed
registration decision for Neem Oil is now open for public comment under
Docket ID: EPA-HQ-OPP-2007-0996. EPA is making its proposed registration
decision, called a "Biopesticides Registration Action Decision (BRAD),"
available for comment. The BRAD contains EPA's proposed registration decision
and risk assessment. In addtion, EPA is making the proposed product labels
available for comment. Comments will be available through November 14,
2009.

periodic review of pesticide registrations to ensure that each pesticide

Malathion
Registration Review Docket; Reopening of Comment Period- Comments
due October 5, 2009
EPA issued a notice in the Federal Register of June 24, 2009, concerning
the availability of multiple registration review dockets for public comment,
including malathion. This document reopens the comment period for the
malathion registration review docket, which closed on August 24, 2009,
until October 5, 2009.
The June
24,2009 notice announced EPA's decision to modify certain risk mitigation
measures that were specified in the 2006 Reregistration Eligibility Decision
for the pesticide malathion. EPA conducted this reassessment of the malathion
RED in response to public comments received during the comment period
and to new data submitted by the technical registrant, Cheminova, Inc.
Based on the new information received, the Agency has made certain modifications
to the 2006 malathion RED. Docket number EPA-HQ-OPP-2009-0317.

Ask EPA to Revoke Import Tolerances for 13 Pesticides to Protect Migratory
Birds- Comments due November 2, 2009
EPA is seeking public comment on a July 2009 petition from the American
Bird Conservancy (ABC) requesting that the Agency revoke certain tolerances,
or maximum residue limits in food, for 13 pesticides because the pesticides
present an unacceptable risk to migratory birds. The named pesticides
are: cadusafos, cyproconazole, diazinon, dithianon, diquat, dimethoate,
fenamiphos, mevinphos, methomyl, naled, phorate, terbufos, and dichlorvos.
The specific tolerances covered by the petition are tolerances associated
with pesticide uses for which there is no U.S. registration and thus application
of the pesticide is not permitted in this country. Such tolerances are
generally referred to as "import tolerances" because their sole
purpose is to legalize residues in foods being imported to the United
States. ABC claims that by
maintaining import tolerances for these pesticides, EPA allows Central
and South American countries to continue using the pesticides on crops
for which the U.S. has already determined there are unacceptable risks
for protected U.S. migratory birds. The crop uses include green coffee
beans, bananas, and other fruits and vegetables. ABC believes that revoking
import tolerances for these crops will protect U.S. migratory birds on
their wintering grounds in other countries and in the U.S. For more information

Review; Boll Weevil Attractants Opened for Review and Comment-Comments
due August 24, 2009
EPA has established a registration review docket for Boll Weevil Attractants
which is listed in the table in Unit III A. With this document, EPA is
opening the public comment period for this registration review. Submit
comments identified by the docket identification number for the pesticide
provided in the table in Unit III.A. Comments must be received on or before
August 24, 2009.
Comment Invited on Request for Azinphos-Methyl (AZM) Use Changes -
Comments due September 21, 2009
EPA is requesting public comment on a request from azinphos-methyl (AZM)
registrants to amend their registrations. These amendments would change
the rate reductions for some remaining uses of AZM, and would extend the
use of aerially applied AZM on blueberry crops in Michigan until the end
of the AZM phase out in 2012. The registrants have not requested to extend
use of AZM beyond the September 30, 2012, cancellation date for the remaining
uses of AZM. The public comment period will close on September 21, 2009.

Reregistration Performance Measures and Goals- Comments due
July 13, 2009.
This notice announces EPA's progress in meeting its performance measures
and goals for pesticide reregistration during fiscal year 2008. The Federal
Insecticide, Fungicide, and Rodenticide Act (FIFRA) requires EPA to publish
information about EPA's annual achievements in this area. This notice
discusses the integration of tolerance reassessment with the reregistration
process, and describes the status of various regulatory activities associated
with reregistration and tolerance reassessment. The notice gives total
numbers of chemicals and products reregistered, Data Call-Ins issued,
and products registered under the ``fast-track'' provisions of FIFRA.

Impact Assessments on Endosulfan; Request for Comments and Additional
Information on Importance of Use - Comments due July 6, 2009.
This notice requests public comment on the Agency's endosulfan impact
assessments for eight crops (potato, tomato, cotton, apple, cucumber,
squash, pumpkin and melons) and additional information on the importance
of endosulfan use in agriculture. For many years coalition groups have
been callinig on the EPA to ban endosulfan, which has already been banned
in many other countires. So far petitions, legal briefs, technical letters,
and some 13,000 individual signatures from concerned scientists and public
health professionals have been submitted to EPA to cancel all uses of
endosulfan on the grounds that it is a highly toxic, bioaccumulative,

Defense Council (NRDC) and the Pesticide Action Network North America
(PANNA) that EPA cancel all uses of the organochlorine pesticide endosulfan.

Endosulfan is a controversial organochlorine pesticide that is already
banned in numerous countries including the European Union. Environmental

Clomazone
and Fomesafen Ecological Risk Assessments Issued for Comment -Comments
due by June 22, 2009. **Comment period has been extended to August 21,
2009
EPA has completed and is requesting public comment on draft ecological
risk assessments for the pesticides clomazone and fomesafen. Public comment
on the clomazone and fomesafen draft ecological risk assessments is invited
through June 22, 2009.
At the same time, the Agency is initiating consultation with the U.S.
Fish and Wildlife Service and the National Marine Fisheries Service ("the
Services") regarding these pesticides' potential effects to species
listed as endangered or threatened under the Endangered Species Act. These
are the first two national ecological risk assessments and effects determinations
for conventional pesticides, conducted within the context of EPA's registration
review program. The Agency will review and consider both the public comments
received on the draft ecological risk assessments and information provided
in the Service's biological opinions, in developing proposed registration
review decisions for clomazone and fomesafen.
Clomazone
and fomesafen are herbicides used to control weeds and grasses in
a variety of crops and non-crop locations. EPA's draft ecological risk
assessments and endangered species effects determinations for both clomazone
and fomesafen indicate that the use of these pesticides is likely to adversely
affect a variety of listed species and may affect elements of designated
critical habitat influenced by effects to plants.

presented in the Revised N-methyl Carbamate (NMC) Cumulative Risk Assessment
(CRA) underestimate exposure to propoxur from pet collar uses.

Requests Comment on Pesticide Nanoscale Silver Petition -Comments

EPA has published in the Federal Register a notice requesting public comment
on a petition filed by the International Center for Technology Assessment
(ICTA) et al. The petition requests that the Agency classify nanoscale
silver as a pesticide, require formal pesticide registration, analyze
the potential human health and environmental risks of nanoscale silver,
and develop appropriate regulatory oversights for nanoscale silver products.
The Agency has determined that the petition raises issues that potentially
affect private and public sector stakeholders. Through this notice, EPA
is asking for public comment, which may be submitted through January 20,

Reregistration Eligibility Decision; Notice of Availability-
Comments due by December 29, 2008
This notice announces the availability of EPA's Reregistration Eligibility
Decision (RED) for the pesticide triclosan, and opens a public comment
period on this document. The Agency's risk assessments and other related
documents also are available in the triclosan Docket. Triclosan is regulated
by both the U.S. EPA and the U.S. Food and Drug Administration (FDA).
The EPA regulates the antimicrobial uses of triclosan when used as a bacteriostat,
fungistat, mildewstat, and deodorizer. Submit your comments, identified

Proposes to Terminate Special Review of Ethylene Oxide (ETO) - Comments
due November 28, 2008
EPA is proposing to terminate the Special Review of the pesticide uses
of ethylene oxide (ETO). The occupational risks that were the basis for
the Special Review have been evaluated and addressed during the pesticide
reregistration and tolerance reassessment process. EPA originally initiated
the ETO Special Review based on developmental toxicity, mutagenicity,
and neurotoxic effects in workers. Later, carcinogenicity concerns were
raised and were included in the review. Since then, additional data and
more comprehensive reviews of the potential risks associated with ETO
have been completed. Because the risks that prompted the Special Review
have been evaluated and regulatory decisions have been completed, the
Agency is proposing to close the ETO Special Review.
As a pesticide, ETO is used primarily in hospitals and at contract facilities
to sterilize medical and laboratory items and equipment. ETO treatment
is the principal method used to reduce bacterial levels in whole and ground
spices and other herbs and seasonings. Other ETO uses, which account for
less than one percent of its total annual pesticide use, include sterilization
of musical instruments, library and museum artifacts, and cosmetic ingredients,
and sterilization/fumigation of beekeeping equipment.

Proposes Revised Data Requirements for Antimicrobial, Wood Preservative,
and Antifoulant Pesticides - Comment period extended to April
6, 2008
EPA has announced in the Federal Register a proposed rule to revise and
update use patterns and associated data requirements for antimicrobial,
wood preservative, and antifoulant pesticide registrations. The proposed
revisions are needed to reflect current scientific knowledge and current
Agency regulatory practices, and to improve protection of the general
population as well as sensitive subpopulations. The proposed requirements
are intended to further enhance the Agency's ability to make regulatory
decisions about the human health and environmental fate and effects of
antimicrobial pesticide products.

UPDATE: EPA issued a proposed rule in the Federal
Register of October 8, 2008 proposing data requirements for antimicrobial
pesticides. EPA received two requests to extend the comment period on

to April 6, 2009.

Extends Public Comment Period for Soil Fumigants - On July 16, 2008,
the Environmental Protection Agency (EPA) announced the availability of
Reregistration Eligibility Decisions (REDs) for the soil fumigant pesticides
chloropicrin, dazomet, metam sodium/potassium, and methyl bromide and
opened a 60-day public comment period on these RED documents. Now, in
response to requests from groups representing manufacturers and users
of soil fumigants, EPA is extending the public comment period for these
REDs by an additional 45 days, from September 15, 2008 closing on October

Reregistration Eligibility Decision; Notice of Availability - This
notice announces the availability of EPA's Reregistration Eligibility
Decision (RED) for the pesticide siduron, and opens a public comment period
on this document. The Agency's risk assessments and other related documents
also are available in the siduron Docket. Siduron is a selective, systemic
preemergence herbicide used to control annual grassy weeds in stands of
cool season grasses, such as on lawns, on golf courses, and on sod farms.

Makes Available National Marine Fisheries Service Draft Endangered Species
Act Biological Opinions- EPA has received and posted to its Web site
a Draft Biological Opinion from the National Marine Fisheries Service
that responds to requests for consultation under the Endangered Species
Act for three pesticides' potential effects on Pacific salmon and steelhead.
EPA initiated consultation for diazinon, malathion, and chlorpyrifos on
November 29, 2002, May 29, 2002, and April 14, 2003, respectively.
In addition to posting the Draft to its Web site, EPA has established
a public docket [EPA-HQ-OPP-2008-0654] for this and future
Draft Biological Opinions related to pesticides and Pacific salmon and
steelhead. You may access the docket here.
Once NMFS develops any alternatives or measures it believes are necessary
to reduce risk, EPA will request public input on those alternatives and
measures. Comments on other aspects of the Draft will be forwarded to

Carbofuran; Proposed Tolerance Revocations - EPA is proposing to revoke
all tolerances for carbofuran. The Agency has determined that the risk
from aggregate exposure from the use of carbofuran does not meet the safety
standard of section 408(b)(2) of the Federal Food, Drug, and Cosmetic
Act (FFDCA). EPA is specifically soliciting comment on whether there is
an interest in retaining any individual tolerance, or group of tolerances,
and whether information exists to demonstrate that such tolerance(s) meet(s)
the FFDCA section 408(b)(2) safety standard. EPA encourages interested
parties to comment on the tolerance revocations proposed in this document
and on the proposed time frame for tolerance revocation. Issues not raised
during the comment period may not be raised as objections to the final

Reregistration Eligibility Decision - This notice announces the availability
of EPA's Reregistration Eligibility Decision (RED) for the pesticide tetramethrin.
The Agency's risk assessments and other related documents also are available
in the Tetramethrin Docket. Tetramethrin is a broad spectrum, synthetic
pyrethroid insecticide used to control flying and crawling insects in
a number of commercial, horticultural, and residential areas.EPA has established

Proceeds with Revoking Regulations Allowing Carbofuran Pesticide Residues
on Food - EPA is moving forward to implement the agency's May 2009
final rule revoking tolerances, or residue limits, for the pesticide carbofuran.
EPA continues to find that dietary exposures to carbofuran from all sources
combined are not safe.
EPA encourages growers to switch from carbofuran to safer pesticides or
other environmentally preferable pest control strategies. Since the tolerances
are being revoked, EPA reminds growers that carbofuran should not be applied
to any food crops after December 31, 2009. Use of carbofuran after this
date could result in adulterated food products, which would be subject
to enforcement by the U.S. Food and Drug Administration.
FMC Corporation, which manufactures carbofuran, and three grower associations
submitted objections to EPA's tolerance revocations and requested an administrative
hearing. EPA has concluded that the regulatory standard for holding an
evidentiary hearing has not been met. EPA's explanation about why a hearing
is not warranted, and the reasons for denying the objections are available
on the web and will be published soon in a Federal Register notice. As
part of the administrative process, FMC may appeal the revocation of the
carbofuran tolerances to a federal circuit court of appeals.
EPA's May 2009 action to revoke carbofuran tolerances was the culmination
of a regulatory process that began in 2006 when the agency published its
risk assessments for carbofuran and determined, in August 2006, that no
uses were eligible for reregistration. While FMC has voluntarily canceled
22 carbofuran uses, the elimination of these uses was not sufficient to
allow the agency to make a finding that combined dietary exposures to
carbofuran from food and water are safe. The process to cancel the remaining
carbofuran registrations is under way and will address unacceptable risks
to farmworkers during pesticide application and to birds in and around
treated fields.

Notice of Receipt of a Request to Voluntarily Cancel Pesticide Registrations
to Terminate Use of Certain Products- EPA is issuing a notice of receipt
of a request by the registrant to voluntarily cancel their registrations
to terminate uses of pet collar products containing the pesticide carbaryl.
The request would terminate carbaryl use in or on pet collars for domestic
pets, and would terminate the last carbaryl pet products registered for
use in the United States. EPA intends to grant this request at the close
of the comment period for this announcement unless the Agency receives
substantive comments within the comment period that would merit its further
review of the request, or unless the registrant withdraws its request
within the comment period. Upon acceptance of this request, any sale,
distribution, or use of products listed in this notice will be permitted
only if such sale, distribution, or use is consistent with the terms as
described in the final order.

EPA
Begins New Scientific Evaluation of Atrazine - EPA is launching a
comprehensive new evaluation of the pesticide atrazine to determine its
effects on humans. At the end of this process, the agency will decide
whether to revise its current risk assessment of the pesticide and whether
new restrictions are necessary to better protect public health. One of
the most widely used agricultural pesticides in the U.S., atrazine can
be applied before and after planting to control broadleaf and grassy weeds.
EPA will evaluate the pesticide's potential cancer and non-cancer effects
on humans. Included in this new evaluation will be the most recent studies
on atrazine and its potential association with birth defects, low birth
weight, and premature births.
During the new evaluation, EPA will consider the potential for atrazine
cancer and non-cancer effects, and will include data generated since 2003
from laboratory and population studies. To be certain that the best science
possible is used in its atrazine human health risk assessment and ensure
transparency, EPA will seek advice from the independent Scientific Advisory
Panel (SAP) established under the Federal Insecticide, Fungicide and Rodenticide

Opens Transparency Window into Pesticide Registration Decisions -
EPA is establishing a new transparent process that will allow the public
to review and comment on risk assessments and proposed registration decisions
for pesticides. This expanded process will apply to all new pesticide
active ingredients and first food uses, first outdoor uses, and first
residential uses. Starting October 1, 2009, for certain registration actions,
EPA's risk assessment and proposed decision will be added to the public
docket and made available for a 30-day public comment period. Following
the comment period, EPA will publish its decision and a response-to-comment
document. By focusing public access on new pesticide ingredients and first
food, outdoor, and residential uses, the public will have the opportunity
to comment on all major new exposure patterns for pesticide registration.
Stakeholders now will get information sooner on reduced-risk pesticides
being registered that can replace some of the older and often more toxic

Seeks to Disclose Hazardous Pesticide Inert Ingredients - EPA is moving
forward with a plan to disclose the identities of all inert ingredients
in pesticides including those that are potentially hazardous. This increased
transparency will assist consumers and users of pesticides in making informed
decisions and will better protect public health and the environment. Pesticide
manufacturers typically disclose their inert ingredients only to EPA.
The Agency anticipates publishing its proposed rulemaking in the Federal
Register within the next few months. In it, EPA will discuss ideas for
greater disclosure of inert ingredient identities, including inerts associated
with various hazards, as well as inerts in general. EPA believes one way
of discouraging the use of the more hazardous inert ingredients in pesticide
formulations is by making their identities public. In addition to pursuing
regulatory action for inert disclosure, EPA is considering encouraging
voluntary initiatives to achieve this broader disclosure.
On September 30, EPA responded to two petitions (one by Northwest Coalition
for Alternatives to Pesticides, and a second by certain State Attorneys
General), that identified over 350 inert pesticide ingredients as hazardous.
The petitioners asked EPA to require these inert ingredients be identified
on the labels of products that include them in their formulations. Copies

Disulfoton
and Methamidophos Voluntarily Cancelled - EPA has issued a final order
approving the voluntary cancellations, requested by the registrants, of
pesticide products containing disulfoton and methamidophos. The order
cancels the last disulfoton and methamidophos products registered for
use in the United States. These organophosphate insecticides are registered
for use on a variety of food crop and non-food sites, including disulfoton
use on residential ornamentals. EPA received no comments in response to
a July 22, 2009 Notice announcing the Agency's receipt of the requests
for voluntary cancellation.
For all methamidophos products and most disulfoton products, the cancellations
are effective December 31, 2009; two disulfoton products will be canceled
effective December 31, 2010. The registrants may sell and distribute existing
stocks of most disulfoton products and all methamidophos products until
December 31, 2010; two disulfoton products may be sold and distributed
by the registrant until June 30, 2011.

Program Dialogue Committee to Meet October 14-15, 2009 - On October
14-15, 2009, EPA's Office of Pesticide Programs (OPP) will hold a public
meeting of the Pesticide Program Dialogue Committee (PPDC). The meeting
will be held Wednesday, October 14, from 9:00 am to 5:30 pm, and Thursday,
October 15, from 9:00 am to 12:15 pm in OPP's first floor conference center
at One Potomac Yard South, 2777 South Crystal Drive, Arlington, VA 22202.
The meeting is open to the public.A draft agenda has been developed and
posted on OPP's

Agenda topics include sessions on National Pollutant Discharge Elimination
System (NPDES) issues, the Endangered Species Act, Plant Health Claims
on Pesticide Products, brief updates on pesticide-related issues, and
reports from and discussions about current issues from the following PPDC
work groups: 21st Century Toxicology/New Integrated Testing Strategies;
Web-Distributed Labeling; and Comparative Safety Statements for Pesticide
Product Labeling.
A Webcast in preparation for the PPDC meeting will describe Agency efforts
to develop a National Pollutant Discharge Elimination System (NPDES) general
permit for discharges from the application of pesticides in the few remaining
areas nationwide where EPA is the NPDES permitting authority. This event
is scheduled for October 7, 2009, from 1:00 to 3:00 pm, Eastern time.
Time will be allocated on both days of the PPDC meeting for public comment,
and outside statements by observers are encouraged and welcomed. Each
oral statement will, however, be limited to 3-5 minutes, and it is preferred
that only one person per organization present a statement. Any person
who wishes to file a written statement may do so before or after the meeting.

After over 20 years, the Office of Pesticide Programs' Special Review
and Reregistration Division (SRRD) is changing its name. As of September
13, 2009, SRRD will officially become the Pesticide Re-evaluation Division
(PRD). This new name is described as more accurately reflecting the nature
of the Division's present and future work responsibilities. Although the
Division and Branch names are changing, the Division's location, organization,
projects and chemical assignments stay the same. The Division is still
located on the 9th floor in Potomac Yard South. The mail code will remain

EPA Solicits Applications for Assistance to Support
the Pesticide Safety Program - EPA's Office of Pesticide
Programs (OPP) is seeking proposals to support the Pesticide Safety Program
for fiscal years 2010 through 2014. Under this program, OPP will provide
financial assistance on an annual basis to carry out the Pesticide Safety
Program for agricultural workers, pesticide handlers, pesticide applicators,
health providers, retailers, growers, and other members of the agricultural
community. The types of support needed to implement the Pesticide Safety
Program include developing model training and education programs and effective
communication and outreach programs to enhance pesticide risk reduction
to human health, communities, and ecosystems.
Those eligible to apply include states, U.S. territories or possessions,
federally recognized Indian tribal governments and Native American organizations,
public and private universities and colleges, hospitals, laboratories,
other public or private nonprofit institutions, local governments, and
individuals and international entities.

EPA Issues
Registration Review Final Work Plan for Imidacloprid - EPA has issued
a Final Work Plan (FWP) for the registration review of imidacloprid. A
neonicotinoid insecticide, imidacloprid is highly toxic to honeybees on
an acute exposure basis; however, potential chronic effects on honeybee
colonies are uncertain. As part of the registration review process, EPA
is requiring field-based data on imidacloprid to better understand its
potential impact on pollinators. The Agency also will be working with
Federal and State officials, as well as the international community and
other stakeholders, to develop data and help us understand the potential
impact of the neonicotinoid insecticides on pollinators. For additional

Testing Program Web Page Now Available - EPA has posted an Antimicrobial
Testing Program Web page to inform the public of post-registration efficacy
test results of disinfectant products on the market for use in hospitals
and other public health facilities. EPA must conducts post-registration
testing of public health antimicrobial products to ensure that marketed
products are effective against target microorganisms when used according
to their label directions. Products bearing claims to control organisms
that may pose a threat to human health, either directly or through transmission
of disease-causing organisms on environmental surfaces, are considered
public health-related antimicrobials and require efficacy data to support

Carbofuran;
Final Tolerance Revocations - EPA is revoking all tolerances for carbofuran.
The Agency has
determined that the risk from aggregate exposure from the use of carbofuran
does not meet the safety standard of section 408(b)(2) of the Federal
Food, Drug, and Cosmetic Act (FFDCA). This final rule is effective August
13, 2009. September 29, 2008, the sole registrant of carbofuran pesticide
products, FMC Corporation requested that EPA cancel certain registrations.
Consistent with the request, the registrant indicated that it no longer
seeks to maintain the tolerances associated with the domestic use of carbofuran
on the eliminated crops, and therefore no longer opposes the revocation
of those tolerances.

Arsenicals Amended RED Available - EPA has revised certain provisions
of the 2006 Reregistration Eligibility Decision (RED) for the organic
arsenical pesticides MSMA, DSMA, CAMA, and cacodylic acid. In the 2006
RED, EPA concluded that all uses of the inorganic arsenicals were ineligible
for reregistration primarily because of risks to drinking water resources.
Additional data received since 2006 supported a decision to allow reregistration
of MSMA for use on cotton only, contingent on the development of confirmatory
data. In February 2009 EPA reached an agreement in principle with the
technical registrants. That voluntary agreement steadily removes from
the market all organic arsenical pesticide uses, except the use of MSMA
on cotton, for which confirmatory data must be received by August 2010.
The agreement also implements new restrictions to protect drinking water
resources. Phasing out these uses is expected to accelerate the transition

Makes Available National Marine Fisheries Service Draft Endangered Species
Act Biological Opinion for Three Pesticides - EPA
has received and posted to its Web site a Draft Biological Opinion from
the National Marine Fisheries Service (NMFS) that responds to requests
for consultation under the Endangered Species Act for three pesticides'
potential effects on Pacific salmon and steelhead. EPA initiated consultation
for carbaryl and methomyl on April 1, 2003, and for carbofuran on December
1, 2004.
In addition to posting the Draft to its Web site, EPA has established
a public docket [EPA-HQ-OPP-2008-0654]
for this and other Draft Biological Opinions related to pesticides and
Pacific salmon and steelhead. EPA will consider public comment on the
Reasonable and Prudent Alternatives (RPAs) and Measures (RPMs) within
the Draft Biological Opinion in its comments to the National Marine Fisheries
Service. Input on RPAs and RPMs received after EPA has provided comments
to NMFS, will be considered by EPA as it determines how to implement the
final Biological Opinion. NMFS is scheduled to issue the final Biological
Opinion on April 20, 2009.

Bed Bug Summit - On April 14-15, 2009, EPA will host the National
Bed Bug Summit in Washington D.C. Meeting participants will share information
on topics including the expanding impact of bed bugs on the housing, hospitality,
and other sectors; factors contributing to the growing problem; and the
response of the public health community and government agencies. The meeting
will provide a venue to communicate with others in the diverse community
affected by the increasing problem of bed bugs. Participants will also
identify ideas and options for bed bug prevention, control, and management;
create strategies for outreach and education; and develop recommendations
for action.
EPA's National Bed Bug Summit meeting is open to the public. If you are
interested in attending, you do not need to register in advance of the
meeting, and there is no registration fee. Seating is limited and available
on a first-come basis. While no registration is necessary, it is encouraged
to RSVP so that EPA can better estimate attendance and provide meeting

Amending Product Registrations to Terminate Uses and Eliminate Certain
Application Methods - This notice announces EPA's order for the amendments
to terminate uses and eliminate certain application methods, voluntarily
requested by the registrants and accepted by the Agency, of products containing
the pesticide carbaryl. This order follows two Federal Register Notices
of Receipt of Requests dated August 20, 2008 and October 15, 2008, respectively,
from the carbaryl registrants to voluntarily terminate certain uses of
and eliminate certain application methods for their carbaryl product registrations.
These are not the last carbaryl products registered for use in the United
States. EPA issues in this notice an order granting the requested amendments
to terminate uses and eliminate certain application methods. Any distribution,
sale, or use of the carbaryl products subject to this order is permitted
only in accordance with the terms of this order, including any existing
stocks provisions.
The termination of uses and elimination of application methods for carbaryl
products specified in this notice are effective April 17, 2009. Docket

Voluntary
Cancellation of Carbofuran Uses - EPA has granted the request from
FMC Corporation to cancel certain uses of and products containing flowable
and granular carbofuran effective March 18, 2009. All federally registered
uses for carbofuran are being canceled except for field corn, sunflowers,
potatoes, pumpkins, pine seedlings, and spinach grown for seed. The artichoke
use will be canceled after a two-year phase out period. Certain additional
uses of carbofuran that had been requested by specific states under a
"special local needs" provision of Federal Insecticide, Fungicide,
and Rodenticide Act (FIFRA) are also being canceled. Existing stocks of
the canceled products may be used until they are depleted, or until the
effective date for revocation of the associated tolerances.

Issuance of Revised Reregistration Eligibility Decision - This notice
announces the availability of EPA's Revised Reregistration Eligibility
Decision (RED) for the pesticide para-dichlorobenzene. The Agency's risk
assessments and other related documents also are available in the Para-dichlorobenzene
Docket. Para-dichlorobenzene is an insecticide; the majority of its pesticidal
use is as a moth repellant to protect garments from insect damage and
in and around bird cages for the control of lice and ticks. A 60-day public
comment period was conducted with the publication of the para-dichlorobenzene
RED in December
2007. The comments received primarily concerned the episodic ingestion

Organic
Arsenicals Agreement- EPA has reached an agreement in principle with
the major manufacturers of the organic arsenicals MSMA, DSMA, CAMA, and
cacodylic acid and its sodium salt. This voluntary agreement steadily
removes all organic arsenical pesticide uses, except the use of MSMA on
cotton, from the market and implements new restrictions to better protect
drinking water resources. Phasing out these uses is expected to accelerate
the transition to new, lower risk herbicides. Under the agreement, many
uses, including use on residential lawns, will be canceled by the end
of this year. For products used on cotton and products phased out after
2009, new use restrictions and mitigation measures will be added to increase
protections to water resources.
In the Agency's 2006 Reregistration Eligibility Decision (RED), EPA concluded
that all uses of the organic arsenicals were ineligible for reregistration.
Following application, these pesticides convert over time to a more toxic
form in soil, inorganic arsenic, and potentially contaminate drinking
water through soil runoff. Stakeholders have submitted additional data
indicating that no residues of inorganic arsenic are likely to remain
in the meat and milk of animals fed cotton by-products that have been
grown in fields treated with MSMA, or in food crops that are rotated with
cotton that has been treated with MSMA. Cotton growers also have documented
the increasing spread of Palmer amaranth or pigweed, a glyphosate-resistant
and economically significant pest, which only MSMA controls at present.
In light of this new information, the agreement allows for reregistration
of MSMA use on cotton, contingent on the development of confirmatory data.
If these data are not submitted by the August 2010 due date, or if they
do not confirm the current scientific understanding, EPA will proceed
to cancel the cotton use. The Agency is also rescheduling the Registration
Review of MSMA to begin in 2013. At that time, MSMA's risks and benefits
will be reevaluated considering any new toxicity information and the availability
of new, lower-risk herbicides that should be entering the market.

Plans to Improve Pest Control in Schools by 2015 - Pest and pesticide-related
risks to children is tol be reduced in all U.S. public schools by 2015
as envisioned in a new plan released by the Environmental Protection Agency
and others. The plan, School IPM 2015: a Strategic Plan for Integrated
Pest Management in Schools in the United States, calls for a 70 percent
reduction in both pest complaints and pesticide use in schools.
Developed in cooperation with the U.S. Department of Agriculture Cooperative
State Research, Education, and Extension Service and Regional Integrated
Pest Management (IPM) Centers, and the IPM Institute of North America,
the plan provides a roadmap to understanding pest biology, inspection
and monitoring, and pest prevention that are key to successfully implementing
IPM. Pests and pest management can have long-term health effects and affect
school attendance. Schools that adopt IPM should have less pesticide residue,
fewer pest problems, and lower pest-related allergens. Studies show that
IPM reduces pest complaints and pesticide use in schools by 70 percent
to 90 percent, with no long-term increase in costs.

Eligibility Decisions Completed for Heavy Duty Wood Preservatives -
EPA has completed Reregistration Eligibility Decisions (RED) for the three
heavy duty wood preservatives: creosote, chromated arsenicals (e.g., chromated
copper arsenate [CCA]), and pentachlorophenol. These REDs include our
most current risk assessments for each chemical. The Agency assessed these
chemicals as part of its reregistration program for older pesticides.
The three wood preservatives are used primarily for industrial purposes
such as utility poles, pilings, and railroad ties. CCA was once the main
treatment against wood decay on decks, fences, and playground equipment;
however, these uses were voluntarily canceled effective December 31, 2003,
and the RED does not assess risks from these canceled uses.

Carbaryl
RED Amended; EPA Denies NRDC Petition to Cancel Uses and Revoke Tolerances
- EPA has amended the September 2007 Carbaryl Reregistration Eligibility
Decision (RED) and denied a petition from the Natural Resources Defense
Council (NRDC) to cancel all carbaryl registrations and revoke all tolerances.
In responding to the petition, EPA found that NRDC has neither provided
a basis for cancelling carbaryl uses nor demonstrated that carbaryl tolerances
are unsafe. The Agency continues to believe that carbaryl tolerances provide
a reasonable certainty of no harm.
EPA has amended the carbaryl RED to incorporate a revised occupational
exposure and risk assessment. The Agency reevaluated the occupational
risk assessment and regulatory decision for carbaryl to consider and incorporate
public comments on the RED, new worker monitoring and toxicology studies
submitted by the registrant, and new science and methodologies. For more

Publishes Final Rule Amending the Pesticide Container and Containment
Regulations - EPA has published a notice in the Federal Register to
amend the container and containment regulations in 40 CFR parts 156 and
165. The final amendments provide a one-year extension of the labeling
compliance date, change the phrase "sold or distributed" to
"released for shipment" as associated with all compliance dates,
provide for exceptions to the label language requirements for some specific
types of containers, allow for waivers of certain label requirements for
other refillable and nonrefillable containers on a case-by-case basis,
and correct typographical and other minor errors.
After the final rule titled "Pesticide
Management and Disposal; Standards for Pesticide Containers and Containment"
(Container and Containment Rule) was published in 2006, stakeholders
(primarily registrant groups and individual registrants) contacted the
Agency with significant concerns about the following topics: the compliance
date for the label requirements and whether there was adequate time to
make the required changes; problems that the registrants could face handling
pesticide products returned at the end of the 2009 use season because
returned products would likely no longer be in compliance and, if not,
would not be able to be resold or redistributed; and the scope of pesticide
products and containers for which some of the labeling statements are
required because the regulations required the statement "nonrefillable
container" on every container, including containers such as aerosol
cans and foil pouches that may be considered inherently nonrefillable.
The Agency generally agreed with the stakeholders' concerns and, after
investigating several options, concluded that an amendment to the container
and containment regulations was necessary.

EPA is convening a public workshop to explain the provisions of its recently

Will Discourage Cause Marketing and Third-Party Claims- After reviewing
public comments submitted in response to a draft Pesticide Registration
Notice (PR Notice) titled "Label
Statements Regarding Third-Party Endorsements & Cause Marketing",
the Agency has determined that the types of cause marketing claims and
third-party endorsements outlined in the draft PR Notice generally would
not contribute meaningfully to improving protection of human health and
the environment. The addition of such label statements is not likely to
better inform the user about how to use the product safely and effectively.
In fact, the addition of such statements could interfere with that goal.
In addition, EPA recognizes that its resources are limited and should
be targeted towards activities that will enhance protection of human health
and the environment from pesticides. EPA is now generally discouraging
the submission of applications to add cause marketing claims or third-party
endorsements.
Thus, EPA will not continue work on developing a framework to evaluate
such claims and will not issue guidance on what information is needed
to evaluate such applications. If it receives such an application, the
Agency expects to decide on a case-by-case basis both what information
would be necessary to carefully evaluate the proposed claims and whether
a product containing such a claim could meet the applicable statutory

Packaging Treated with a Pesticide- This final rule excepts food packaging
materials (e.g., paper and paperboard, coatings, adhesives, and polymers)
from the definitions of "pesticide chemical'" and "pesticide
chemical residue" under the Federal Food Drug and Cosmetic Act (FFDCA)
section 201(q), when such food packaging materials have been treated with
a pesticide regulated under the Federal Insecticide, Fungicide and Rodenticide
Act (FIFRA). This final rule expands the scope of the current exception
which applies only to food packaging impregnated with an insect repellent
-one type of pesticide. This final rule, as with the rule it amends, only
applies to the food packaging materials themselves; it does not otherwise
limit EPA's FFDCA jurisdiction over the pesticidal substances in or on
such products or limit FDA's jurisdiction over substances subject to FDA
regulation as food additives. This rule eliminates duplicative FFDCA jurisdiction
and economizes federal government resources while continuing to protect
human health and the environment.

Program to Provide Enhanced Email Response - The Pesticide Program
has implemented a new system for responding to e-mails from the public.
It relies on a database of questions that provide possible responses to
the individual's query, allowing the person to decide if enough information
has been provided. In many cases, there is no need to submit a question,
which provides improved response to public queries. This system is used
across EPA, including by the main EPA public access service, the Superfund
office, and others. The EPA will continue adding categories and questions
to the database from information we have in our existing internal query
response system, as well as based on new questions that come in from the
public or issues that arise in the program. To check out the system, go

DDVP Objections and Hearing Request Denied - In this order, EPA denies
objections to, and requests for hearing on, a prior order denying a petition
requesting that EPA revoke all pesticide tolerances for dichlorvos under
section 408(d) of the Federal Food, Drug, and Cosmetic Act. The objections
and hearing requests were filed on February 1, 2008, by the Natural Resources
Defense Council (NRDC). The Original petition was also filed by NRDC.

Soil Fumigant Pesticides Subject to New Safety Measures- New safety
measures for soil fumigant pesticides; methyl bromide, chloropicrin, dazomet,
metam sodium, and metam potassium, were released. EPA will require a suite
of new mitigation measures that will work together to protect human health.
Mitigation measures were designed to work together to protect bystanders
and workers and include:
* Buffer zones around treated fields will reduce the chances of immediate
harmful effects to bystanders from fumigant concentrations in air. Buffers
can be adjusted based on the use of other good management practices that
also reduce risks to bystanders.
* Posting requirements will inform bystanders and field workers about
the location and timing of fumigations and associated buffer zones so
people do not enter these areas.
* Fumigant registrants must adopt more stringent worker protection measures,
and develop training for fumigation handlers and workers to enhance their
knowledge and skills and to promote product stewardship.
* All soil fumigant products will be classified as restricted-use pesticides,
to ensure that only specially trained individuals can apply and oversee
fumigant operations.
EPA's decision will also halt the use of methyl bromide on sites where
alternatives are available. The newly registered fumigant iodomethane
will be reexamined later this year to determine what new mitigation or
restrictions are necessary. The soil fumigant 1,3-dichloropropene, which
was evaluated previously, may be subject to similar provisions when the
soil fumigants are evaluated together again in 2013. EPA is providing
60 days for public comments on implementation of these measures and will

National Organic Program (NOP); Sunset Review (2008)- This proposed
rule would amend the U.S. Department of Agriculture's (USDA) National
List of Allowed and Prohibited Substances (National List) regulations
to reflect recommendations submitted to the Secretary of Agriculture by
the National Organic Standards Board (NOSB) on November 30, 2007, and
May 22, 2008. The recommendations addressed in this proposed rule pertain
to the continued exemption (use) and prohibition of 12 substances in organic
production and handling. Consistent with the recommendations from the
NOSB, this proposed rule would renew the 11 exemptions and 1 prohibition
on the National List (along with any restrictive annotations) and correct
the Tartaric acid listings by adding annotations originally recommended
to the Secretary on November 1, 1995.

Fenvalerate;
Product Cancellation Order - This notice announces EPA's order for
the cancellations, voluntarily requested by the registrants and accepted
by the Agency, of products containing the pesticide fenvalerate, pursuant
to section 6(f)(1) of the Federal Insecticide, Fungicide, and Rodenticide
Act (FIFRA), as amended. This cancellation order follows an April 30,
2008 Federal Register Notice of Receipt of Requests from the fenvalerate
registrants to voluntarily cancel all their fenvalerate product registrations.
Fenvalerate is a synthetic pyrethroid insecticide which is used to control
insects and related organisms, invertebrates on agricultural, pet care,
domestic home and garden (domestic), and commercial/industrial/food and
non-food/mosquito abatement (commercial) sites. These are the last fenvalerate
products registered for use in the US. Any distribution, sale, or use
of the fenvalerate products subject to this cancellation order is permitted
only in accordance with the terms of this order, including any existing
stocks provisions.

16-18 FIFRA SAP to review Chlorpyrifos Toxicity Profile; Nominations Sought
- The Federal Insecticide, Fungicide, and Rodenticide Act Scientific Advisory
Panel (FIFRA SAP) will hold a 3-day meeting to consider and review the
Agency's evaluation of the toxicity profile of chlorpyrifos. The Agency
is focusing on studies that evaluate the effects of chlorpyrifos on infants
and children from in utero and/or post-natal exposures and on studies
that evaluate population variability with respect to response to chlorpyrifos.
This meeting, originally scheduled for July 15-18, 2008, has been rescheduled
for September 16-18, 2008 and will be held at Holiday Inn - Rosslyn at
Key Bridge, 1900 North Fort Myer Drive, Arlington, Virginia 22209.
The Agency is accepting additional nominations for candidates to serve

Rodenticides Final Risk Mitigation Decision; Notice of Availability
- This notice announces the availability of EPA's final risk mitigation
decision for 10 rodenticides, an addendum to the economic impact assessment,
responses to comments on the proposed risk mitigation decision, and other
supporting documents. The 10 rodenticides covered by this risk mitigation
decision are brodifacoum, bromadiolone, bromethalin, chlorophacinone,
cholecalciferol, difenacoum, difethialone, diphacinone (and its sodium
salt), warfarin (and its sodium salt), and zinc phosphide.
EPA's final decision on the rodenticides includes two major components.To
minimize children's exposure to rodenticide products used in homes, EPA
is requiring that in the future, all rodenticide bait products available
for sale to general consumers be sold only in bait stations. To reduce
wildlife exposures and ecological risks, the Agency intends to prevent
general consumers from purchasing bait products containing the rodenticides
that pose the greatest risk to wildlife (the second generation anticoagulants
- brodifacoum, bromadiolone, difethialone, and difenacoum) by requiring
various measures to control sales and distribution. The Agency's decision
will reduce rodenticide exposures to children and non-target wildlife,
while ensuring residential users, livestock producers, and professional
applicators access to a variety of effective and affordable rodent control
products.

Human Studies Review Board; Notice of Public Meeting- The U.S. Environmental
Protection Agency's (EPA or Agency) Office of the Science Advisor (OSA)
announces a public meeting of the Human Studies Review Board (HSRB) to
advise the Agency on EPA's scientific and ethical review of human subjects
research. The agenda includes:
(1) The Governing Document, the compilation of Standard Operating Procedures,
the scenario design document, and two associated protocols from the Agricultural
Handlers Exposure Task Force (AHETF), which collectively describe research
to monitor exposure of subjects whoapply an agricultural pesticide using
airblast equipment in closed cabs.
(2) A report from a completed laboratory study to evaluate the efficacy

Guidance for Pesticide Registrants on Environmental Hazard General Labeling
Statements on Outdoor Residential Use Products; Notice of Availability
- The Agency is announcing the availability of a Pesticide Registration
Notice (PR Notice) entitled "Environmental Hazard General Labeling
Statements on Outdoor Residential Use Products." This PR Notice was
issued by the Agency on May 9, 2008 and is identified as PR Notice 2008-1.This
particular PR Notice provides guidance to the registrant concerning new
environmental hazard statements that are designed to replace language
created for agricultural products with statements that are easier for
consumers to understand. The new environmental hazard statements are divided
by product type (e.g., liquid ready-to-use, broadcast granular), and recommends
specific language for each product type to minimize risks to the human
health and the environment, with emphasis on reducing risks to water.
Revisions to product labels using these new statements may be made by
notification.

Nicotine
Reregistration Eligibility Decision; Notice of Availability - This
notice announces the availability of EPA's Reregistration Eligibility

sole remaining nicotine registration, a restricted use insecticide registered
for use only on greenhouse ornamentals and effective against adult whiteflies,

Product Cancellation Order -This notice announces EPA's order for
the cancellation, voluntarily requested by the registrant and accepted
by the Agency, of products containing the pesticide sulfluramid, pursuant
to section 6(f)(1) of the Federal Insecticide, Fungicide, and Rodenticide
Act (FIFRA), as amended. This cancellation order follows a December 19,
2007 Federal Register Notice of Receipt of Request from the sulfluramid
registrant to voluntarily cancel the last remaning sulfluramid manufacturing-use
product (MUP) registration. Accordingly, EPA hereby issues in this notice
a cancellation order granting the requested cancellation. This cancellation
order does not cancel the remaining end-use sulfluramid products currently
registered for use in the United States. The cancellations are effective

Orders Scotts to Stop Selling Certain Pesticides - EPA is ordering
Scotts Miracle-Gro Co. to stop selling and distributing two pesticide
products that have not been properly registered with EPA. They may have
been sold under names such as "Garden Weed Preventer + Plant Food"
and "Scotts Lawn Service Fertilizer with .28 Halts" or other
names. These products have apparently been sold illegally, as they have
not been registered with EPA and are labeled with invalid EPA registration
numbers. Together with the Ohio Department of Agriculture, EPA is analyzing
samples of the products to determine their ingredients and will use this
information to better determine what additional steps should be taken.

the chloroneb registrants to voluntarily terminate certain uses of their
chloroneb product registrations. The requests would terminate chloroneb's
use on residential lawns and turf, as well as on lawns and turf at parks
and schools. These are the last chloroneb products with these uses registered

Program Dialogue Committee, Pesticide Registration Improvement Act Process
Improvement Workgroup; Notice of Public Meeting - EPA's Pesticide
Program Dialogue Committee (PPDC), Pesticide Registration Improvement
Act (PRIA) Process Improvement Workgroup will hold its tenth public meeting
on April 29, 2008. An agenda for this meeting is being developed. The
agenda will include recent process improvements to implement the Pesticide
Registration Improvement Renewal Act (PRIA 2), and will be posted on EPA's
website. The workgroup is developing advice and recommendations on topics
related to EPA's registration and as of this meeting, registration review
process. EPA has established a docket for this action under docket identification
number EPA-HQ-OPP-2007-0191. The meeting will be held on Tuesday, April
29, 2008, from 1 p.m. to 4 p.m. The meeting will be held at Conference

Pesticide Issues in the Works Explores Emerging Issues - EPA has a
new Web page entitled: Pesticide Issues in the Works. This site serves
to provide information about issues that are under consideration within
the EPA's pesticide program but that may be early in the development process
or for which information is currently limited. The first two issues are
colony collapse disorder and pesticide volatilization.

Issues Cancellation Order for Remaining Azinphos-methyl Uses - EPA
has published an order canceling and amending the registrations of pesticide
products containing azinphos-methyl (AZM) to terminate the remaining uses
of this pesticide by 2012, as voluntarily requested by the registrants.
Consistent with EPA's November 2006 final decision for the remaining uses
of AZM, the cancellation order published in the Federal Register on February
20, 2008, terminates the last AZM products registered for use in the United
States. Existing stocks provisions are detailed in the document. Further

Endocrine Disruptor Screening Program; Second Workshop to Discuss Draft
Policies and Procedures; Notice of Public Meeting - EPA is convening
a half-day public workshop to discuss the Agency's draft administrative
policies and procedures for completing the initial screening and testing
under EPA's Endocrine Disruptor Screening Program (EDSP). In the Federal
Register issue of December 13, 2007 (72 FR 70842) (FRL-8340-3), EPA announced
the availability for public review and comment of the draft policies and
procedures EPA is considering adopting for conducting the initial screening
and testing under EDSP. The purpose of the public workshop is to provide
another opportunity for the public to ask questions about the draft EDSP
policies and procedures.

Moves Forward To Propose a Rule Requiring Pesticide Container Recycling
- EPA is moving forward to propose regulations that once finalized, would
require registrants of agricultural and professional specialty pesticides
to recycle plastic pesticide containers. After careful deliberation and
consideration of all possible options, the Agency is moving forward with
a proposed pesticide container recycling rule.The Agency will provide
the public a 60-day comment period on the proposed rule by the fall of
2008.

Protectants; Potential Revisions to Current Production Regulations; Notice
of Public Meetings - The ANPRM announces EPA's intention to develop
and propose amendments to existing regulations affecting producers of
plant-incorporated protectants (PIPs), a type of pesticide. The Agency
is considering amendments to the existing regulations, which were written
primarily for producers of
"traditional'' pesticides, because PIPs are unlike other types of
pesticides currently regulated under the Federal Insecticide, Fungicide,
and Rodenticide Act (FIFRA).
