Lawsuit Challenges EPA on Toxic Herbicide Cocktail for GE Crops

(Beyond Pesticides, October 27, 2015) Late Friday,  a coalition of public health, conservation and food safety groups filed their opening brief in the ongoing legal challenge to the U.S. Environmental Protection Agency’s (EPA) approval of the herbicide Enlist Duo for use on genetically engineered corn and soybeans. Enlist Duo, a blend of glyphosate and 2,4-D, was approved on October 15 for use on genetically engineered (GE) crops, despite concerns for human and environmental contamination. The challenge was originally brought in November 2014, shortly after the EPA approved the controversial herbicide for 6 Midwest states. Since then, EPA has expanded its approval to a total of 15 states, with more expected. Counsel from the Center for Food Safety (CFS) and Earthjustice are jointly representing Beyond Pesticides, Center for Biological Diversity, CFS, the Environmental Working Group, the National Family Farm Coalition, and Pesticide Action Network North America. “The Enlist Duo approval violated the laws protecting our communities, land, and farms,” said George Kimbrell, Center for Food Safety senior attorney, counsel in the case. “Regulators bowed to the chemical industry, but we are committed to holding them accountable.” The groups argue that in its approval of Enlist Duo, a combination of the herbicides […]

Agricultural Crop Density Linked to Childhood Cancer in Midwest

(Beyond Pesticides, October 16, 2015) According to a new study, living in crop-dense regions is linked to increased leukemia and central nervous system cancers in children. Although there is a litany of scientific literature that highlights the link between pesticide exposure and childhood illness, this study is one of few that examines the relationship between residential exposures to agricultural pesticides via crop density and adverse health outcomes, and may serve as a basis for further investigation into childhood cancer rates in areas where agricultural pesticides are highly used. The study, titled Agricultural crop density and the risk of childhood cancer in the Midwestern United States: an ecologic study,  was published in the journal Environmental Health. Using crop density as a surrogate for residential exposure to agricultural pesticides, the study linked county-level agricultural census data and cancer incidence data for children between the ages 0 to 4 in six Midwestern states and found evidence of an association between childhood cancer incidence and the production of crops such as dry beans, oats, and sugar beets. Researchers found statistically significant exposure-response relationships for dry beans and total leukemias and acute lymphoid leukemias, oats and acute myeloid leukemias, and sugar beets and total leukemias. Medical Journal Article Identifies Hazards of Pesticides in GE Crops

(Beyond Pesticides, August 27, 2015) Last week, Philip J. Landrigan, M.D., and Charles Benbrook, Ph.D., released a perspective article, GMOs, Herbicides, and Public Health, in the New England Journal of Medicine  that outlines  the hazards associated with food residues of  elevated pesticide use in the production  of genetically engineered (GE) crops. While mainstream media continuously misses the central issue  in the GE debate by asserting that these crops are merely an extension of selective breeding and effect a reduction in pesticide use, the authors  focus on  the significance of the actual increase in herbicide use and weed resistance in herbicide-tolerant crops. Drs. Landrigan and Benbrook offer two main recommendations in their article: the U.S. Environmental Protection Agency (EPA) should delay implementation of its decision to permit the use of Enlist Duo (the 2,4-D herbicide used with  Monsanto-engineered GE herbicide-tolerant  crop), and  the U.S. Food and Drug Administration (FDA) should  require labeling of GE foods and couple it with adequately funded, long-term postmarketing surveillance. USDA Allows Introduction of 2,4-D-Tolerant GE Cotton in Response to Roundup Resistance

(Beyond Pesticides, July 30, 2015) Despite concerns for human and environmental contamination, the U.S. Department of Agriculture (USDA) adds 2,4-D-tolerant cotton, a genetically engineered (GE) crop, to the list of unregulated GE crops, joining 2,4-D resistant corn and soybeans. Last week, the Animal and Plant Health Inspection Service (APHIS) division of USDA released its decision on Dow AgroSciences’ petition to deregulate the 2,4-D resistant GE cotton. The decision was signed off by Michael J. Firko, the Deputy Administrator of Biotechnology Regulatory Services. In September of last year, Deputy Firko also signed the determination paperwork that deregulated GE corn and soybean. The deregulation essentially releases the GE organism from the regulatory requirements of 7 CFR part 340 or the plant pest provisions of the Plant Protection Act. Dow’s GE cotton, part of the Enlist Weed Control System, is resistant to 2,4-D choline, glufosinate, and glyphosate. Growers in the cotton industry have been vying for the GE cotton to enter the market in order to combat herbicide-resistant weeds due to the broad scale use of Monsanto’s RoundUp (glyphosate), which continues to fail across the agricultural industry due to weed resistance. EPA at Odds with Scientists on Endocrine System Effects of Weedkillers Atrazine and 2,4-D

(Beyond Pesticides, July 6, 2015) With the release of its  Tier 1 screening results  for the first 52 pesticide chemicals (active and inert ingredients) evaluated under  the Endocrine Disruptor Screening Program (EDSP), the U.S. Environmental Protection Agency (EPA) is at odds with a large body of scientific evidence worldwide that identifies many of these chemicals, most notably the herbicides  2,4-D  and  atrazine,  as interacting with the endocrine system or acting as endocrine disruptors. Independent scientific data has shown these chemicals to interfere with the hormone system. EPA’s EDSP is a multi-step process used to ensure that exposure to chemicals does not result in adverse human health and environmental effects that canoccur from the disruption of hormones. The two-tiered screening and testing system requires that EPA identify which chemicals are able to interact with the endocrine system, specifically with three hormonal pathways — estrogen, androgen, and thyroid — in Tier 1. Popular Weed Killer 2,4-D and Lice Treatment Lindane Classified as Carcinogens

(Beyond Pesticides, June 24, 2015) The International Agency for Research on Cancer (IARC) has found that there is some evidence in experimental animals that the popular herbicide, 2,4-D, is linked to cancer and now classifies it as a Group 2B, “possibly carcinogenic to humans.” IARC also classified lindane, used commonly in the U.S. as a topical lice treatment, in Group 1,“carcinogenic to humans” based on sufficient evidence in humans with the onset of non-Hodgkin lymphoma (NHL). These latest cancer findings come just months after the agency classified the world’s most widely used herbicide, glyphosate (Roundup), as “probably carcinogenic to humans,” raising public concerns on the lack of action from U.S. regulators. This month, 26 experts from 13 countries met at the World Health Organization’s (WHO) IARC in Lyon, France to assess the carcinogenicity of the insecticide lindane, the herbicide 2,4-D, and insecticide DDT. The findings are published in the Lancet. Air Force Veterans Who Used Agent Orange Contaminated Aircraft May Be Compensated

(Beyond Pesticides, June 23, 2015) After years of denial and obstruction, Air Force and Air Force Reserve veterans now have the chance to receive compensation for their exposure to the highly toxic herbicide Agent Orange on contaminated aircraft used after the Vietnam War. Affected veteran’s health issues stem from their time spent on UC-123 transport planes, which during the war were outfitted with spray equipment in the American military’s attempt to eliminate forest cover for Vietcong fighters. After the war, these aircraft were returned to use in the United States for basic transport operations such as cargo shipping and medical evacuation missions. However, these planes never underwent any form of decontamination or testing before being repurposed. Though the Agent Orange Act of 1991 stipulated medical care and disability coverage for sick veterans who  served in the Vietnam War and were exposed to Agent Orange, those who flew in contaminated post-war planes were deemed ineligible. Chipotle Removes Genetically Engineered Food from Its Menu

(Beyond Pesticides, April 28, 2015) Beginning this week, Chipotle Mexican Grill will stop serving food containing genetically engineered (GE) ingredients. The restaurant’s announcement is the first of any major fast food chain, and fits with the company’s long-held mission of providing its customers “food with integrity.” In 2013, Chipotle also became the first major restaurant chain to label foods it sold that contained GE ingredients, and in 2010 the company announced its support for organic production practices by increasing the percentage of organic ingredients it serves, and committing to eventually transition the entire menu to organic. “Just because food is served fast doesn’t mean it has to be made with cheap raw ingredients, highly processed with preservatives and fillers and stabilizers and artificial colors and flavors,” said Steve Ells, Chipotle’s founder and co-chief executive to The New York Times. Although the meat and dairy served at the chain will still come from animals fed GE grain, the company indicates it will continue to work on the issue. EPA’s Expansion of 2,4-D Enlist Duo Challenged

(Beyond Pesticides, April 22, 2015) A coalition of conservation, food safety, and public health groups filed a motion Monday challenging the U.S. Environmental Protection Agency (EPA)’s decision to expand the use of “Enlist Duo” on genetically engineered (GE) corn and soybean crops to nine additional states: Arkansas, Kansas, Louisiana, Minnesota, Missouri, Mississippi, Nebraska, Oklahoma, and North Dakota. Enlist Duo, which contains the toxic herbicide, 2,4-D, was approved by EPA to be used on 2,4-D-resistant crops, despite concerns for human and environmental contamination. The motion was filed in the United States Ninth Circuit Court of Appeals by Earthjustice and Center for Food Safety on behalf of Beyond Pesticides, Center for Biological Diversity, Center for Food Safety, Environmental Working Group, the National Family Farm Coalition, and Pesticide Action Network North America. Pesticide Residues on Foods Shown to Affect Sperm Quality

(Beyond Pesticides, April 1, 2015) According to a new study from Harvard University researchers, eating fruit and vegetables containing pesticide residues adversely affect men’s fertility, leading to fewer and poorer quality sperm. The study, published online in the journal,  Human Reproduction, adds to a growing body of research that finds pesticide exposures give rise to impaired reproductive function, including reduced sperm counts, sperm quality and reduced fertility in exposed men. The results of this study also underscore the importance of an organic diet in reducing pesticide exposures. The study, “Fruit and vegetable intake and their pesticide residues in relation to semen quality among men from a fertility clinic,” believed to be the first to  look into the consumption of fruits and vegetables with high levels of pesticide residue in relation to semen quality, and conducted by researchers at Harvard University’s TH Chan School of Public Health, found that men who ate the greatest amount of fruit and vegetables with high levels of pesticide residue had a 49% lower sperm count and a 32% fewer normally formed sperm than those who consumed the least. Common Herbicides Linked to Antibiotic Resistance

(Beyond Pesticides, March 30, 2015) Last week, following the World Health Organization’s (WHO) declaration that glyphosate is carcinogenic to humans  based on animal studies, a new study was published in the American Society of Microbiology’s journal, mBio, linking glyphosate, 2,4-D and dicamba to antibiotic resistance after testing the sub-lethal effects of these pesticides in certain bacteria. The new mBio study finds  that when bacteria, specifically Salmonella and E. coli, are exposed to the herbicides described above, they responded differently to the common antibiotics ampicillin, ciprofloxacin, chloramphenicol, kanamycin, and tetracycline. Researchers replicated real-world scenarios by purchasing weed killers from a local store and using the exact levels that are specified on the product label. This provided researchers with the opportunity to observe how the bacteria reacted when exposed to the herbicides at sublethal levels; that is, those that did not kill them. When the bacteria are exposed to the herbicides and the antibiotics at the same time, the exposure to the herbicides trigger a defense mechanism that otherwise would not have been triggered solely by the antibiotics. House Panel Rejects Hawai’i Bill to Impose Pesticide Buffer Zones

(Beyond Pesticides, February 23, 2015) A Hawaii state House agriculture committee rejected a bill Thursday that sought to impose buffer zones for large agricultural companies that spray restricted-use pesticides near schools and other sensitive areas. The proposal, House Bill 1514, introduced by Rep. Chris Lea, stemmed from concerns about  the impact of genetically-engineered (GE) farming and its inherent dependency on increasing  pesticide use. The measure sought  to require companies’  disclosure of the pesticides used and the volume of use. The bill had strong support from the Hawaii chapter of the national nonprofit Center for Food Safety (CFS), as well as a strong backing from neighbor island residents. Maui, Kauai, and the Big Island have all passed laws recently to regulate the seed industry, but a federal  district  court judge  has ruled  that Hawaii counties do not have that power. Industry has been especially effective in obstructing the bill. 2,4-D and Atrazine Effects on Endangered Species Focus of Another Lawsuit

(Beyond Pesticides, February 17, 2015) The Center for Biological Diversity filed a lawsuit in federal court in California February 12 against the U.S. Fish and Wildlife Service (FWS) for failing to ensure that three widely used pesticides ””atrazine, 2,4-D and alachlor”” do not jeopardize the survival of two Bay Area endangered species, the delta smelt and Alameda whipsnake. FWS has yet to act on a request from the U.S. Environmental Protection Agency (EPA) to determine whether measures are needed to protect the delta smelt and Alameda whipsnake from exposure to these pesticides. “These pesticides are known to harm wildlife even in miniscule amounts, so it’s long past time that we start taking commonsense steps to protect endangered species, our water and ourselves,” said Brett Hartl, endangered species policy director at the Center. “Putting off any analysis of the harms caused by pesticides for six years is simply unacceptable, and has set back the recovery of these two species substantially.” Scientific research has shown that atrazine can harm the development of amphibians at exposures of just a few parts per billion, is toxic to fish, reptiles, mammals and birds, and may elevate risks of birth defects in people. EPA Sued for Violating Endangered Species Act with Allowance of New 2,4-D/Roundup Pesticide

(Beyond Pesticides, February 13, 2015) With the U.S. Environmental Protection Agency’s (EPA)  nod to the pesticide industry on expanded uses of the herbicides 2,4-D and glyphosate, environmental groups are charging that the agency violated the Endangered Species Act (ESA).  Repeating a pattern of putting the environment in harm’s way through violations of  federal endangered species  law, a lawsuit filed Friday  documents   EPA’s  failure to consult with the U.S. Fish and Wildlife Service (FWS) regarding the impact of the herbicide on two endangered species —the whooping crane and the Indiana bat— with the recent approval of Dow AgroSciences’ herbicide, Enlist Duo, for use on genetically engineered (GE) crops in six midwestern states. Bill Introduced to Protect Oregonians from Forestry Pesticide Use

(Beyond Pesticides, February 12, 2015) Oregon Senator Michael Dembrow (D-Portland) and Representative Ann Liniger (D-Lake Oswego) introduced a bill on Tuesday targeting the loosely regulated aerial pesticide spraying practices of the Oregon timber industry. The bill will establish residential, school, drinking water, and fish habitat buffers zones, require timely notification of spraying and controlled burns for nearby residents, increase record keeping requirements, establish protected areas where pesticide spraying is prohibited, and grant investigative and enforcement authority to the Oregon Health Authority in cases of human pesticide exposure. Development of the bill grew out of a series of incidents across Oregon involving residential pesticide exposure and poisoning from aerial spraying of forest lands. The main incident, which spurred state-wide outrage and investigations into the pesticide regulation and enforcement practices of the Oregon Department of Agriculture (ODA), involved Curry County residents who complained of pesticide exposure after witnessing aerial spraying near their homes. Maui Decision Not to Defend GE Moratorium Disappoints Activists

(Beyond Pesticides, February 4, 2015)    In the face of a challenge from the chemical industry, Hawaii’s Maui County will not defend a moratorium on genetically engineered (GE) farming that was passed by county voters last fall. Seeking to have the moratorium thrown out, industry giants Monsanto, Dow-owned Agrigenetics and others sued Maui days after the measure was passed.   It was expected that the county would defend the law in the courts, but to the disappointment of many, attorneys for Maui County filed a single sentence brief with the court, stating that it “is taking no position.” In November 2014, Maui residents passed a ballot initiative prohibiting the growth, testing or cultivation of GE crops in Maui County until an environmental and public health study can show that the planting operations are safe for the community. Now residents and local groups supporting the new law are expressing outrage and disappointment over the decision by Maui County to disregard its duty to defend a law passed by its citizens, despite earlier assurances that county will implement the moratorium. Member EU States Authorized to Plant GE Crops

(Beyond Pesticides, January 15, 2015) Yesterday, the European Union (EU) passed legislation meant to bridge a long-standing divide amongst EU nations (and the United States) on the planting of genetically-engineered (GE) crops by granting individual countries the authority to opt-out of EU crop approval and institute country-based legislative and regulatory restrictions. Makers of GE crops (like Monsanto) and proponents of GE crop cultivation have faced staunch and successful opposition in getting the required EU permission to plant GE crops. Opposition comes from both EU citizens and certain member states, like France, Italy, and Germany. By giving opposing countries an EU-sanctioned means to opt-out and establish individual member state restrictions, the new law may accelerate  opt-outs in those countries that do not oppose GE crop planting. GAO Report Sounds Alarm Again on Poor Pesticide Controls

(Beyond Pesticides, November 10, 2014) According to a new Government Accountability (GAO) report, the U.S. Food and Drug Administration (FDA) does not test food for several commonly used pesticides with established tolerance levels —including glyphosate, one of the most commonly used pesticides in the U.S. This and other disturbing findings documented in GAO’s report,  Food Safety: FDA and USDA Should Strengthen Pesticide Residue Monitoring Programs and Further Disclose Monitoring Limitations,  issued last Thursday, sounds an alarm that GAO began sounding  in the 1980’s in several reports that identify shocking limitations of  FDA’s approach to monitoring for pesticide residue violations in food. GAO sharply criticizes FDA for not using statistically valid methods consistent with Office of Management and Budget (OMB) standards to collect information on the incidence and level of pesticide residues. Oregon Legislators Working to Introduce Herbicide Spray Policy

(Beyond Pesticides, October 30, 2014) After concerns have been raised about the poor oversight of aerial herbicide spraying on Oregon forests, and the subsequent pesticide contamination of residents living nearby, policy makers are working to introduce legislation to better protect local residents from pesticide and environmental contamination. An investigation, which began in 2013 into allegations of improper pesticide spraying on timberland near residential areas in Southern Oregon, has since confirmed that residents of the small towns were unwillingly sprayed with pesticides. The investigation was launched after residents filed complaints after they experienced rashes, headaches, asthma, and stomach cramps directly after pesticide applications. Earlier this year, the investigation led by the Oregon Department of Agriculture (ODA) indicated multiple violations by the pesticide operator and applicator responsible for the spraying, as well as evidence of the presence of pesticides on properties in Cedar Valley, near Gold Beach, Oregon. The aerial applicator, the investigation uncovered, allowed pesticide deposition on properties other than the intended application site, applied one product at a rate above the maximum allowed by the label instructions, and provided multiple false records that misled ODA about the actual products used. Farmers and Environmental Groups to Challenge EPA over Herbicide Approval

(Beyond Pesticides, October 23, 2014) Lawsuit filed against Environmental Protection Agency for approval of 2,4-D use on genetically engineered corn, soy crops in six Midwest states.A coalition of farmers and environmental groups filed a lawsuit to sue the U.S. Environmental Protection Agency (EPA) today on behalf of six Midwest states where a toxic herbicide cocktail called Dow’s Enlist Duo, a blend of glyphosate and 2,4-D, was approved on October 15 for use on genetically engineered (GE) crops. Approved for use on GE corn and soybeans that are engineered to withstand repeated applications of the herbicide, the creation of 2,4-D-resistant crops and EPA’s approval of Enlist Duo is the result of an overuse of glyphosate, an ingredient in Monsanto’s Roundup. The misuse resulted in an infestation of glyphosate-resistant super weeds which can now be legally combatted with the more potent 2,4-D. EPA Launches Voluntary Rating Program on Pesticide Drift

(Beyond Pesticides, October 22, 2014) The U.S. Environmental Protection Agency (EPA) has announced a new voluntary Drift Reduction Technology (DRT) program to encourage the use of spray technologies scientifically verified to significantly reduce pesticide drift. But with the recent approval of increased uses of toxic pesticides, such as 2,4-D, and the general lack of compliance with pesticide labels, many believe that this new program may not go far enough to protect non-target sites and vulnerable communities from drift until serious efforts to reduce widespread use of toxic, highly volatile pesticides are undertaken. Pesticide drift is an inevitable consequence of pesticide use, and has been a problem for communities adjacent to agricultural areas and non-target sites for decades. Many pesticide products are released as foliar sprays into the air, or volatilize from surfaces where particles can travel for miles from their application site. This means that on a windy day pesticide residues can drift far distances, affecting  downwind, vulnerable communities, organic farms and other environments. GMO Labeling Movement Marches Forward with Vermont Release of Draft Rules

(Beyond Pesticides, October 17, 2014) The Vermont Attorney General’s Office, as part of a continuous effort to label genetically modified organisms (GMO) and increase transparency for consumers, released a draft of the rules written to govern the state’s law to require the labeling of food produced with genetic engineering. The nine page rulemaking, describe a range of issues, from the definition of “food” and “genetic engineering” to the required disclosures that will read “Produced with Genetic Engineering” or “Partially Produced with Genetic Engineering.” The attorney general’s office has scheduled three public hearings for next week to give the public the opportunity to comment on the law. Members of the public can also submit a comment via email. Attorney General William Sorrell said his office is moving to write the rules as quickly as possible so that the industry can prepare before the law takes effect in 2016. The law, which was signed by Governor Peter Shumlin in May and is the first of its kind in the nation, has been met with substantial backlash. EPA Approves Enlist Duo®, Opens Gate to New Wave of GE Woes

(Beyond Pesticides, October, 16, 2014) Despite a massive outpouring of public opposition, the U.S. Environmental Protection Agency (EPA) announced yesterday that it has registered Enlist Duo ®, officially putting the rubber stamp of approval on the sale and use of a new wave of genetically-engineered (GE) 2,4-D tolerant crops. Developed by Dow AgroSciences, Enlist Duo ® is an herbicide that incorporates a mix of glyphosate and a new formulation of 2,4-D, intended for use on GE Enlist-Duo ®-tolerant corn and soybean crops. While registration of the herbicide was anticipated by most of the public since the U.S. Department of Agriculture (USDA)’s approval of the Enlist Duo ®-tolerant crops in mid-September, the announcement still comes as a disappointing shock, demonstrating the failings of the U.S. pesticide and agricultural regulatory system to put people and the environment before economic incentives and industry bottom lines. “EPA approval of this herbicide sets a dangerous precedent,” says Jay Feldman, executive director of Beyond Pesticides. “Instead of looking to alternatives, regulators are signaling that the answer to widespread weed resistance is more toxic products that endanger farmworkers and farming communities.” As Beyond Pesticides noted in its comments submitted to EPA in June of this year, the […]
