However, petitioners can file a lawsuit claiming unreasonable delay if the petitioner finds that EPA has not responded within what the petitioner considers a reasonable amount of time. Of the 40 public petitions received by OPP from Fiscal Year 2005 through 2014, nearly a quarter of them are \u00a0associated with unreasonable delay lawsuits. The specific issues contributing to these delays involve:<\/p>\n<ul>\n<li>Petition documentation not being readily accessible;<\/li>\n<li>Some of the petition data were inaccurate, leading to more work being required to confirm data;<\/li>\n<li>Lack of guidance on how to submit petitions directly to OPP, leading to weeks of delay in petitions arriving at the correct office for action; and<\/li>\n<li>OPP does not provide public guidance on how to submit complete petitions, which resulted in petitioners providing supplemental information, and increased the time and resources to reach petition decisions.<\/li>\n<\/ul>\n<p>In August, a federal appeals court judge <a href=\"http:\/\/beyondpesticides.org\/dailynewsblog\/2015\/08\/epa-gives-mandated-deadline-for-chlorpyrifos-ruling\/\">mandated that EPA respond to a petition<\/a> filed nearly nine years ago that seeks to force the agency to restrict the dangerous insecticide <a href=\"http:\/\/beyondpesticides.org\/resources\/pesticide-gateway?pesticideid=17\">chlorpyrifos<\/a> (an organophosphate also known as Dursban). U.S. Court of Appeals Judge for the Ninth Circuit, M. Margaret McKeown, stated that federal agencies should never practice the \u201cvenerable tradition\u201d of putting off statutory requirements when it comes to human health. Another recent instance of egregious delay involves <a href=\"http:\/\/beyondpesticides.org\/dailynewsblog\/2015\/05\/groups-petition-to-ban-harmful-antibacterial-pesticide-rejected-by-epa\/\">EPA\u2019s issuance this summer<\/a> of a <a href=\"https:\/\/www.beyondpesticides.org\/antibacterial\/documents\/EPA-HQ-OPP-2010-0548-0787-1.pdf\">long-awaited response<\/a> \u00a0to a \u00a0<a href=\"https:\/\/www.beyondpesticides.org\/antibacterial\/triclosan-epa-petition.pdf\">Citizen Petition<\/a> \u00a0filed by Beyond Pesticides and Food and Water Watch in 2010, denying the request to cancel registered products that contain the antibacterial pesticide <a href=\"https:\/\/www.beyondpesticides.org\/antibacterial\/triclosan.php\">triclosan<\/a>. In 2014, Beyond Pesticides joined Center for Food Safety in filing \u00a0<a href=\"http:\/\/www.centerforfoodsafety.org\/files\/2014-12-16-dkt-1--pls--complaint_78869.pdf\">a lawsuit<\/a> against EPA over the agency\u2019s failure to regulate novel <a href=\"https:\/\/beyondpesticides.org\/assets\/media\/documents\/antibacterial\/factsheet%20nanosilver.pdf\">nanomaterial<\/a> pesticides. The lawsuit challenged the agency for its failure to answer a <a href=\"http:\/\/www.centerforfoodsafety.org\/files\/cta_nano-silver-petition__final_5_1_08.pdf\">2008 petition<\/a> filed by <a href=\"https:\/\/www.beyondpesticides.org\/dailynewsblog\/?p=340\">more than 13 organizations<\/a>.<\/p>\n<p>The report recommended that the Assistant Administrator for Chemical Safety and Pollution Prevention \u201cdevelop policies and procedures to manage public petitions in a transparent, effective, and efficient manner; communicate directly with petitioners; train staff to adhere to the Records Management Policy; implement an effective tracking system for public petitions; and provide guidance to the public on how to submit petitions with sufficient data for review.\u201d<\/p>\n<p>Beyond Pesticides believes that local and grassroots action is one of the best ways to reduce pesticide use and its harmful effects in communities.
