The groups allege that PMRA failed to ensure that it had the data necessary to determine the environmental risks, particularly those concerning pollinators, posed by the chemicals. \u201cThe PMRA has taken a see-no-evil, hear-no-evil, speak-no-evil approach by repeatedly registering these neonicotinoid pesticides without important scientific information on their risks to pollinators,\u201d said Charles Hatt, staff lawyer at Ecojustice.<\/p>\n<p>Under Canada\u2019s Pest Control Products Act, PMRA must have \u201creasonable certainty\u201d that a pesticide will not cause harm to the environment before it is registered. The groups also note that several thiamethoxam-based products have been registered by the agency for years without a mandated public consultation period.<\/p>\n<p>\u201cPollinators are key players in our ecosystems, and their declines are extremely concerning. A stunning variety of plants \u201d\u201d including fruits, vegetables, nuts, and 90 per cent of flowering plants \u201d\u201d need pollinators to reproduce and thrive,\u201d said Anne Bell, PhD, Director of Conservation and Education at Ontario Nature.<\/p>\n<p>Although PMRA has not taken substantial action to restrict neonicotinoids, certain Canadian provinces and cities have begun eliminating significant uses of these chemicals. Last year, Ontario became <a href=\"http:\/\/beyondpesticides.org\/dailynewsblog\/2015\/06\/ontario-first-in-north-america-to-limit-bee-killing-insecticides\/\">the first jurisdiction in North America to restrict the use of neonicotinoid coated seeds<\/a>, limiting acreage planted with these toxic seeds by 80% by 2017. \u201cThe Province of Ontario recently \u00a0brought in strong \u00a0restrictions on the \u00a0use of \u00a0dangerous \u00a0neonicotinoid pesticides in agriculture,\u201d said Faisal Moola, PhD, Director General of Ontario and Northern Canada at the David Suzuki Foundation. \u201cWe&#8217;re hoping that our \u00a0court case will \u00a0compel the federal government to take similar action \u00a0in response to widespread public concern over the fate of pollinators in Canada.\u201d Neonicotinoid coated seeds have been implicated in massive bee kills as a result of \u201cfugitive dust\u201d that sloughs off and drifts during planting, contaminating bee-attractive plants nearby. A <a href=\"http:\/\/abcbirds.org\/wp-content\/uploads\/2015\/05\/Neonic_FINAL.pdf\">report by the American Bird Conservancy<\/a> found that a single neonic-coated corn kernel was enough to kill a songbird. A study by the U.S. Environmental Protection Agency (EPA) found that neonicotinoid soybean seed treatments offered <a href=\"http:\/\/beyondpesticides.org\/dailynewsblog\/2014\/10\/epa-finds-neonicotinoid-seed-treatments-to-be-of-little-or-no-benefit\/\">little to no benefit<\/a> to farmers in terms of pest control or increased economic well-being.<\/p>\n<p>Late last year, the Quebec city of Montreal moved to <a href=\"http:\/\/beyondpesticides.org\/dailynewsblog\/2015\/12\/montreal-canada-proposes-complete-ban-on-neonics\/\">completely ban the use of neonicotinoids<\/a> within the city, following similar moves in the U.S., where local governments in <a href=\"http:\/\/beyondpesticides.org\/dailynewsblog\/2015\/08\/minneapolis-mn-passes-organic-pollinator-friendly-resolution\/\">Minneapolis, MN, <\/a><a href=\"http:\/\/beyondpesticides.org\/dailynewsblog\/2015\/09\/city-of-lafayette-colorado-restricts-bee-toxic-neonicotinoids\/\">Lafayette<\/a> and <a href=\"http:\/\/beyondpesticides.org\/dailynewsblog\/2015\/05\/boulder-city-co-passes-bee-safe-resolution-restricting-use-of-bee-toxic-neonicotinoids\/\">Boulder, CO<\/a>, <a href=\"http:\/\/beyondpesticides.org\/dailynewsblog\/2015\/04\/portland-or-to-protect-pollinators-bans-use-of-bee-toxic-pesticides\/\">Portland, OR<\/a>, <a href=\"http:\/\/beyondpesticides.org\/dailynewsblog\/2015\/10\/maryland-county-bans-cosmetic-lawn-pesticides-on-all-land-in-county-one-million-people-affected\/\">Montgomery County, MD<\/a>, and <a href=\"https:\/\/www.beyondpesticides.org\/assets\/media\/documents\/infoservices\/pesticidesandyou\/documents\/BeeProtectiveUpdateFall2014.pdf\">numerous other locations<\/a> have restricted or eliminated the use of neonicotinoids on public and\/or private property.<\/p>\n<p>Federal action in the U.S to restrict neonicotinoids has been equally as lackluster as Canada\u2019s response. Although federal agency have announced some pollinator protective measures as part of the <a href=\"http:\/\/beyondpesticides.org\/dailynewsblog\/2015\/05\/white-house-plan-does-little-to-take-the-sting-out-of-pollinator-declines\/\">National Pollinator Health Strategy<\/a>, and EPA has acknowledged the <a href=\"http:\/\/beyondpesticides.org\/dailynewsblog\/2016\/01\/epa-data-confirms-honey-bee-exposure-to-hazardous-pesticides\/\">neonicotinoid imidacloprid presents acute risks to pollinators<\/a>, these moves have largely been seen as inadequate.  \u00a0The agency continues to approve other bee-toxic pesticides, <a href=\"http:\/\/beyondpesticides.org\/dailynewsblog\/2016\/06\/public-comment-needed-on-epas-plans-to-allow-bee-toxic-sulfoxaflor-despite-elevated-bee-losses\/\">like sulfoxaflor<\/a>, despite evidence showing unacceptable adverse impacts to pollinators, and court cases to back up these claims.<\/p>\n<p>In 2013, Beyond Pesticides joined with beekeepers and environmental allies in a lawsuit similar to the one recently launched in Canada, challenging EPA&#8217;s approval of thiamethoxam and clothianidin. These highly toxic, persistent and systemic chemicals have been widely implicated as leading factors in pollinator declines. The move comes amid growing awareness, action, and scientific evidence linking this widely used class of insecticides to the global decline of pollinator populations. The lawsuit, filed \u00a0by Ecojustice on behalf of \u00a0The David Suzuki Foundation, Friends of the Earth Canada, Ontario Nature, and the Wilderness Committee, argues that pesticide products containing two neonicotinoids, clothianidin and thiamethoxam, are unlawfully registered in Canada. The groups allege that PMRA failed to ensure that it had the data necessary to determine the environmental risks, particularly those concerning pollinators, posed by the chemicals. \u201cThe PMRA has taken a see-no-evil, hear-no-evil, speak-no-evil approach by repeatedly registering these neonicotinoid pesticides without important scientific information on their risks to pollinators,\u201d said Charles Hatt, staff lawyer at Ecojustice.
