The research by an independent citizen has uncovered dozens of violations of the county\u2019s own law until as recently as 2007. Local groups have called for an investigation by the Board of Supervisors, as well as more protective wording put into a revision of the county\u2019s pesticide policy.<\/p>\n<p>The county law states that no department may use \u201cany ingredient classified by the U.S. Environmental Protection Agency as a human carcinogen, probable human carcinogen, possible human carcinogen, reproductive toxin, or developmental toxin.\u201d According to a report by Corte Madera resident Paul Apfel, county employees violated that law at least 92 times between 1999 and 2007, using thousands of gallons of chemicals.<\/p>\n<p>\u201cWe have verified that the county has used a class of chemicals that the IPM [Integrated Pest Management] ordinance identifies should only be used under the exemption process,\u201d said County Administrator Matthew Hymel. \u201cPart of the confusion is that these chemicals were not on the state list but they were on the EPA list of possible carcinogens.\u201d Fred Crowder, the county\u2019s deputy agricultural commissioner, said he recommended pesticides based on the California Proposition 65 list, rather than EPA\u2019s larger list of carcinogens. While Mr. Crowder admitted his mistake, he also tried to justify it by saying they are \u201calso available at the local garden store and there is nothing there that is not available to the public.\u201d (To see which pesticides have been linked to carcinogenic, reproductive, and developmental effects, visit the <a href=\"https:\/\/www.beyondpesticides.org\/gateway\/index.htm\">Pesticide Gateway<\/a>.)<\/p>\n<p>\u201cIt shouldn\u2019t have been done and the citizens of Marin are entitled to a public hearing on this,\u201d Mr. Apfel said. \u201cIt can\u2019t be swept under the rug. It was the citizens who were wronged.\u201d<\/p>\n<p>\u201cI want to find out what happened with the misreporting to us about what was used and why the process wasn\u2019t followed,\u201d Supervisor Susan Adams said. \u201cThe error was not because we sprayed illegal pesticides but we didn\u2019t follow the process in the ordinance to allow that use.\u201d<\/p>\n<p>Local environmental and health activists disagreed with the county\u2019s assessment of the violation. \u201cThe county law states that a limited use exemption is granted on an emergency basis,\u201d said Carolyn Cohen of Mothers of Marin Against the Spray. \u201cThat Does not mean every month, except for the rainy season, for 10 years. Beyond Pesticides believes that people must have a voice in decisions that affect them directly. We believe decisions should not be made for us by chemical companies or by decision-makers who either do not have all of the facts or refuse to consider them. Beyond Pesticides provides hands-on services to the public and supports local action by: identifying and interpreting hazards; and, designing safe pest management programs. With the information provided by Beyond Pesticides, people may not only be able to make informed choices and adopt practices that protect themselves and their families from unnecessary exposure to pesticides, but they will be able to effect changes on community-wide pest management decisions and policies that govern pesticide use, such as pesticide uses in parks, schools, for community insect control and along roadsides.
