Syngenta Seeds, LLC is facing over $4.8 million in fines from EPA for allegedly violating multiple federal pesticide regulations meant to protect agricultural workers. At the time of the incident, 19 agricultural workers went to work on fields freshly sprayed with the insecticide <a href=\"http:\/\/beyondpesticides.org\/assets\/media\/documents\/pesticides\/factsheets\/Chlorpyrifos.pdf\">chlorpyrifos<\/a>, an organophosphate insecticide.\u00a0The incident with this highly neurotoxic chemical sent 10 workers to the hospital for medical treatment.<\/p>\n<p>EPA\u2019s complaint states that Syngenta Hawaii LLC misused the pesticide \u201cLorsban Advanced\u201d and that violated EPA&#8217;s\u00a0worker protection standard.\u00a0Due to its neurotoxicity, EPA banned chlorpyrifos for residential uses in 2000, but <a href=\"https:\/\/www.beyondpesticides.org\/assets\/media\/documents\/pesticides\/factsheets\/LowDown%20on%20Dursban.pdf\">retained most\u00a0agricultural use<\/a>.\u00a0EPA maintains that Syngenta failed to provide a waiting period for the workers to re-enter the fields. Additionally, Syngenta did not provide workers with personal protective equipment, as well as proper decontamination supplies once the exposure had occurred.<img loading=\"lazy\" decoding=\"async\" class=\"alignright size-medium wp-image-19490\" src=\"http:\/\/beyondpesticides.org\/dailynewsblog\/wp-content\/uploads\/2016\/11\/Hawaje-NoRedLine-300x233.jpg\" alt=\"\" width=\"300\" height=\"233\" align=\"right\" srcset=\"https:\/\/beyondpesticides.org\/dailynewsblog\/wp-content\/uploads\/2016\/11\/Hawaje-NoRedLine-300x233.jpg 300w, https:\/\/beyondpesticides.org\/dailynewsblog\/wp-content\/uploads\/2016\/11\/Hawaje-NoRedLine-768x597.jpg 768w, https:\/\/beyondpesticides.org\/dailynewsblog\/wp-content\/uploads\/2016\/11\/Hawaje-NoRedLine-1024x796.jpg 1024w\" sizes=\"auto, (max-width: 300px) 100vw, 300px\" \/><\/p>\n<p>At the time of the incident, an inspector from the Hawaii Department of Agriculture (HDOA) was present on the Syngenta farm, which triggered an immediate investigation from the state.\u00a0In March, HDOA notified EPA of the matter, which led to a follow-up investigation from the agency later in April that resulted in\u00a0the civil fines. Residents living on the Hawaiian Islands are subject to\u00a0ongoing pesticide exposure from experimental farms because of the state\u2019s pristine growing conditions that make\u00a0it a prime area for agrichemical companies to test new, experimental chemicals and crops, including\u00a0new genetically engineered (GE) crops. Data released last year reveals that\u00a0<a href=\"http:\/\/grist.org\/business-technology\/gmo-companies-are-dousing-hawaiian-island-with-toxic-pesticides\/\"><strong>high levels of restricted use pesticides<\/strong><\/a>, in some cases almost double the pounds per acre average of other states, are being used in Kauai County. According to the Center for Food Safety, in\u00a0<a href=\"http:\/\/www.isb.vt.edu\/\"><strong>2014 alone<\/strong><\/a>\u00a0there were 1,381 field test sites in Hawaii, compared to only 178 sites in California <span style=\"margin: 0px; line-height: 107%; font-family: 'Calibri',sans-serif; font-size: 11pt;\"><span style=\"color: #000000;\">\u2013<\/span><\/span>a large agricultural state. Most of these crops are engineered to tolerate applications of herbicides and other pesticides. Testing these crops means repeated spraying of hazardous chemicals near neighborhoods, schools, and waterways. Residents of the Hawaiian Islands that live, work, or go to school near these fields are\u00a0<a href=\"https:\/\/www.beyondpesticides.org\/dailynewsblog\/?p=11184\"><strong>subject to incessant\u00a0<\/strong><\/a><a href=\"https:\/\/www.beyondpesticides.org\/dailynewsblog\/?p=11184\"><strong>pesticide<\/strong><\/a><a href=\"https:\/\/www.beyondpesticides.org\/dailynewsblog\/?p=11184\"><strong>\u00a0spraying<\/strong><\/a>, as the climate provides a year-round growing season for GE crops.\u00a0<a href=\"https:\/\/www.beyondpesticides.org\/dailynewsblog\/?p=13344\"><strong>A May 2014 report<\/strong><\/a>\u00a0found 25 herbicides, 11 insecticides, and 6 fungicides in Hawaii\u2019s waterways, underscoring resident concerns for both the land and human health.<\/p>\n<p>Worrisome pesticide poisoning incidents are common in Hawaii.\u00a0In August 2016, Earthjustice\u00a0sent EPA a <a href=\"http:\/\/earthjustice.org\/sites\/default\/files\/files\/2016-8-4-complaint-EPA-rescind-HDOA-primacy.pdf\">letter<\/a> to EPA requesting that the agency notify HDOA of its chronic failure to carry out its regulatory and enforcement responsibility under federal law, the Federal Insecticide, Fungicide and Rodenticide Act (FIFRA).\u00a0Earthjustice urged EPA to\u00a0rescind HDOA\u2019s primary enforcement authority (the authority delegated to the state under FIFRA) unless corrective action was taken. Problems identified by Earthjustice\u00a0include a failure to enforce pesticide use violations and a large backlog of pesticide complaints and investigations dating back to as early as 2008.\u00a0Had the HDOA inspector not been onsite at the time of the exposure, this incident could have been another incident left to be determined and added to the backlogged incident reports.<\/p>\n<p>EPA has been warning HDOA repeatedly since 2012 that it has failed to adequately enforce pesticide laws and has allowed an unacceptable backlog of inspection files to grow. Instead of increasing its staff, HDOA\u2019s enforcement staff has been steadily shrinking, and\u00a0the number of inspections and enforcements have been decreasing every year. EPA\u2019s most recent annual review of HDOA\u2019s performance noted there were approximately 700 inspection files in\u00a0need of review, some dating back to 2008. Syngenta Seeds, LLC is facing over $4.8 million in fines from EPA for allegedly violating multiple federal pesticide regulations meant to protect agricultural workers. At the time of the incident, 19 agricultural workers went to work on fields freshly sprayed with the insecticide chlorpyrifos, an organophosphate insecticide.\u00a0The incident with this highly neurotoxic chemical sent 10 workers to the hospital for medical treatment. EPA\u2019s complaint states that Syngenta Hawaii LLC misused the pesticide \u201cLorsban Advanced\u201d and that violated EPA&#8217;s\u00a0worker protection standard.\u00a0Due to its neurotoxicity, EPA banned chlorpyrifos for residential uses in 2000, but retained most\u00a0agricultural use.\u00a0EPA maintains that Syngenta failed to provide a waiting period for the workers to re-enter the fields. Additionally, Syngenta did not provide workers with personal protective equipment, as well as proper decontamination supplies once the exposure had occurred.
