The <a href=\"https:\/\/drive.google.com\/file\/d\/0B-pJR4cGo9ckUU1OQjJjcVQ4aUU\/view\">filing <\/a>states that EPA\u00a0made an effort \u201cto protect Monsanto\u2019s interests and unfairly aid <img loading=\"lazy\" decoding=\"async\" class=\"alignright size-medium wp-image-19465\" src=\"http:\/\/beyondpesticides.org\/dailynewsblog\/wp-content\/uploads\/2016\/11\/glyphosate-roundup-300x224.jpg\" alt=\"\" width=\"300\" height=\"224\" srcset=\"https:\/\/beyondpesticides.org\/dailynewsblog\/wp-content\/uploads\/2016\/11\/glyphosate-roundup-300x224.jpg 300w, https:\/\/beyondpesticides.org\/dailynewsblog\/wp-content\/uploads\/2016\/11\/glyphosate-roundup-768x574.jpg 768w, https:\/\/beyondpesticides.org\/dailynewsblog\/wp-content\/uploads\/2016\/11\/glyphosate-roundup-1024x765.jpg 1024w\" sizes=\"auto, (max-width: 300px) 100vw, 300px\" \/>the agrichemical industry.\u201dGlyphosate has been <a href=\"http:\/\/www.iarc.fr\/en\/media-centre\/iarcnews\/pdf\/MonographVolume112.pdf\"><strong>linked to cancer<\/strong><\/a>\u00a0 in the independent scientific literature and is listed as a probable human carcinogen by the World Health Organization&#8217;s <a href=\"http:\/\/beyondpesticides.org\/dailynewsblog\/2015\/03\/glyphosate-classified-carcinogenic-by-international-cancer-agency-group-calls-on-u-s-to-end-herbicides-use-and-advance-alternatives\/\">International Agency for Research on Cancer<\/a>\u00a0(IARC). Issues of suppression have also been uncovered, as Monsanto&#8217;s lawyers have filed claims to prevent information \u00a0turned over to plaintiffs&#8217; lawyers during discovery\u00a0from inclusion on the public record.<\/p>\n<p>This is just the latest development in a variety\u00a0of lawsuits aimed at Monsanto, including a <a href=\"http:\/\/beyondpesticides.org\/dailynewsblog\/2016\/12\/bader-farms-v-monsanto-epic-duel-illegal-spraying-herbicide-dicamba\/\">challenge by a peach farmer<\/a> over the illegal spraying of the herbicide <a href=\"https:\/\/www.beyondpesticides.org\/resources\/pesticide-gateway?chemfind=dicamba\">Dicamba<\/a> and the recent victory by the state of California to <a href=\"http:\/\/beyondpesticides.org\/dailynewsblog\/2017\/01\/judge-rules-monsanto-allows-california-list-glyphosate-products-cancer-causing\/\">list glyphosate products as cancer causing<\/a>. In the current case, a <a href=\"http:\/\/beyondpesticides.org\/dailynewsblog\/2015\/10\/monsanto-faces-lawsuits-on-cancers-linked-to-roundup\/\">multitude of personal injury claims<\/a> made by those suffering from, or that have lost loved ones to, NHL\u00a0have been condensed into a class action suit that will be tried in the U.S. District Court for the Northern District of California.\u00a0This allows discovery to move forward as one large class.<\/p>\n<p><a href=\"https:\/\/drive.google.com\/file\/d\/0B-pJR4cGo9ckUU1OQjJjcVQ4aUU\/view\">The filing<\/a>, made last week by plaintiffs\u2019 attorneys, asks the court to compel the deposition of Jess Rowland, who served as deputy division director in EPA\u2019s Office of Pesticide Programs (OPP) and directly managed the work of scientists charged with assessing the human health effects of exposure to pesticides, including glyphosate. The motion accuses Mr. Rowland of playing \u201cpolitical conniving games with science\u201d in favor of Monsanto\u2019s interests, and argues\u00a0the agency\u2019s willingness to promote industry interests over protecting public health. According to the motion, \u201cThe Plaintiffs have a pressing need for Mr. Rowland\u2019s testimony to confirm his relationship with Monsanto and EPA\u2019s substantial role in protecting the Defendant\u2019s business.\u201d It goes on to\u00a0claim that, \u201cMr. Rowland operated under Monsanto\u2019s influence to cause EPA\u2019s position and publications to support Monsanto\u2019s business\u2026\u201d During Mr. Rowland&#8217;s tenure at EPA, the agency issued its finding that glyphosate meets its acceptable risk standards, despite IARC&#8217;s position to the contrary based on the scientific literature. Up until last year, Mr. Rowland \u00a0also chaired the EPA\u2019s Cancer Assessment Review Committee (CARC), which determined glyphosate was \u201cnot likely to be carcinogenic to humans.\u201d<\/p>\n<p>Based on Monsanto\u2019s previous efforts to keep documents in this case from being released publicly, it is likely that the agrichemical company will file a motion in opposition to Mr. Rowland\u2019s deposition. Monsanto has already sought\u00a0to keep documents associated with this case secret, having asked the federal judge presiding over the case to block plaintiffs\u2019 attorneys from including documents they receive during the discovery process from being used as exhibits in court filings, so as to keep them out of the hands of the public and the media. Monsanto claims that releasing these documents may be an effort to \u201ctry this case in the court of public opinion,\u201d an act the company claims \u201cis not in the public interest.\u201d This, despite the fact that millions of people around the world are exposed to glyphosate on a daily basis, and advocates maintain that they have a right to know what kind of relationship the company has with the government agency that is supposed to look out for its health and safety.<\/p>\n<p>The chemical at issue in this case, <a href=\"https:\/\/www.beyondpesticides.org\/gateway\/index.php?pesticideid=37\"><strong>glyphosate<\/strong><\/a>,\u00a0has historically been touted as a \u201clow toxicity\u201d chemical and \u201csafer\u201d than other chemicals by EPA and industry and is widely used in food production and on lawns, gardens, parks, and children\u2019s playing fields. IARC\u2019s classification of glyphosate as a Group 2A \u201cprobable\u201d carcinogen indicates that glyphosate is anything but safe, as the ranking represents the highest order carcinogen when no human data is available \u2014and since chemicals are not tested on humans, a higher ranking \u00a0is rare. According to IARC, Group 2A means that the chemical is probably carcinogenic to humans based on sufficient evidence of carcinogenicity in experimental animals. In its report, the agency did note that glyphosate has been linked DNA and chromosomal damage in human cells. Further, epidemiologic studies have found that exposure to glyphosate is significantly associated with an increased risk of non-Hodgkin\u2019s lymphoma, which is the same type of cancer that plaintiffs in the current lawsuit are suffering, or have lost someone who suffered, from.<\/p>\n<p>Since the release of the IARC determination, Monsanto has made several efforts to discredit the scientific findings of this well respected, international body, as detailed in the documents associated with this case. In a February 8 filing, Monsanto submitted\u00a0<a href=\"https:\/\/drive.google.com\/file\/d\/0B-pJR4cGo9ckQWY5eGE5a04tekE\/view\" data-beacon=\"{&quot;p&quot;:{&quot;mnid&quot;:&quot;entry_text&quot;,&quot;lnid&quot;:&quot;citation&quot;,&quot;mpid&quot;:12,&quot;plid&quot;:&quot;https:\/\/drive.google.com\/file\/d\/0B-pJR4cGo9ckQWY5eGE5a04tekE\/view&quot;}}\">a court brief\u00a0<\/a>arguing that, \u201cThe IARC classification of glyphosate as a probable human carcinogen is not relevant to the question of whether or not Roundup caused the plaintiffs\u2019 cancers.\u201d It goes on to claim that \u201cIARC\u2019s approach is \u201cless rigorous\u201d than EPA\u2019s in evaluating scientific evidence, and IARC\u2019s conclusions are \u201cscientifically unreliable,\u201d\u201d a conclusion that is unfounded, to say the least.<\/p>\n<p>In a separate document filed on February 10, Monsanto went a step further, claiming that there is no evidence that the products at issue are \u201cdefective or unreasonably dangerous,\u201d and \u201cno evidence of carcinogenicity in glyphosate or Roundup.\u201d<\/p>\n<p>Ms.\u00a0Gillam, Research Director for U.S. Right to Know, uncovers more to the story, pointing out that, as the evidence against Monsanto continues to mount, Congress may be stepping in to curtail\u00a0class action lawsuits. Just last week,\u00a0<a href=\"https:\/\/usrtk.org\/wp-content\/uploads\/2017\/02\/Bill-to-block-MDL.pdf\">legislation<\/a> was introduced by House Judiciary Chairman Bob Goodlatte (R-VA) to limit the ability of individuals to challenge powerful corporations in court with the stated goal of \u201cdiminish[ing] abuses in class action and mass tort litigation.\u201d Entitled the\u00a0\u201cFairness in Class Action Litigation Act of 2017,\u201d the bill will apply to pending as well as future class action lawsuits. Joanne Doroshow, executive director of the Center for Justice and Democracy, believes that the bill will have terrible ramifications when it comes to protecting individual interests, as it \u201cis designed to ensure that no class action could ever be brought or litigated for anyone.\u201d She continues, claiming that the legislation \u201cwould obliterate civil rights, antitrust, consumer, essentially every class action in America.\u201d<\/p>\n<p>The mounting evidence of glyphosate\u2019s hazards is piling up and environmental groups, like Beyond Pesticides, are urging localities to restrict or ban the use of the chemical.
