The judge&#8217;s ruling comes in a lawsuit against Monsanto, charging that the company&#8217;s herbicide caused the plaintiffs&#8217; non-Hodgkin&#8217;s lymphoma.<\/p>\n<p>According to the <a href=\"https:\/\/www.nytimes.com\/2017\/03\/14\/business\/monsanto-roundup-safety-lawsuit.html?_r=1\">New York Times<\/a>, the court documents \u201cinclude Monsanto\u2019s internal emails and email traffic between the company and federal regulators [and] suggested that Monsanto had ghostwritten research that was later attributed to academics.\u201d The California lawsuit was brought on following the determination and <a href=\"http:\/\/beyondpesticides.org\/dailynewsblog\/2015\/03\/glyphosate-classified-carcinogenic-by-international-cancer-agency-group-calls-on-u-s-to-end-herbicides-use-and-advance-alternatives\/\">listing of glyphosate as a probable human carcinogen<\/a> by the World Health Organization\u2019s International Agency for Research on Cancer (IARC) in 2015.<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"alignright size-medium wp-image-19069\" src=\"http:\/\/beyondpesticides.org\/dailynewsblog\/wp-content\/uploads\/2016\/09\/sdaf-300x199.jpg\" alt=\"\" width=\"300\" height=\"199\" srcset=\"https:\/\/beyondpesticides.org\/dailynewsblog\/wp-content\/uploads\/2016\/09\/sdaf-300x199.jpg 300w, https:\/\/beyondpesticides.org\/dailynewsblog\/wp-content\/uploads\/2016\/09\/sdaf-768x510.jpg 768w, https:\/\/beyondpesticides.org\/dailynewsblog\/wp-content\/uploads\/2016\/09\/sdaf.jpg 1024w\" sizes=\"auto, (max-width: 300px) 100vw, 300px\" \/><\/p>\n<p>The\u00a0released files show that Monsanto was \u201ctipped off to the [IARC] determination by a deputy division director at the EPA, Jess Rowland, months beforehand. That led the company to prepare a public relations assault on the finding well in advance of its publication,&#8221; according to the released documents. According to Monsanto\u2019s internal emails, Mr. Rowland had promised to fend off efforts by the Department of Health and Human Services (HHS) to conduct a separate review of the chemical, which never ended up occurring. The documents show a refusal by both EPA and HHS to protect public health over industry interests and advance the science on issues such as carcinogenicity of chemicals. This revelation comes as the Trump administration adopts positions that undermine scientific reviews and funding of regulatory oversight.<\/p>\n<p>On Wednesday, Congressman Ted Lieu\u00a0issued the <a href=\"https:\/\/lieu.house.gov\/media-center\/press-releases\/rep-lieu-statement-new-glyphosate-safety-concerns\">following statement<\/a> regarding the released files and questions on glyphosate safety.<\/p>\n<p><em>\u201cNew questions about the safety of Monsanto weed killer Roundup are deeply troubling. I worked on the glyphosate issue last term and I believe consumers should immediately stop using Roundup, whose core ingredient glyphosate has been labeled a likely carcinogen and has been linked to non-Hodgkin\u2019s lymphoma by the International Agency for Research on Cancer. We need to find out if Monsanto or the Environmental Protection Agency misled the public.\u201d<\/em><\/p>\n<p><em>\u201cReports suggest that a senior official at the EPA worked to suppress a U.S. Department of Health and Human Services review of glyphosate, and may have leaked information to Monsanto. I believe that a Department of Justice investigation is warranted to look into any potential misconduct by employees of the EPA. I also believe a congressional hearing is immediately warranted.\u201d<\/em><\/p>\n<p>In addition to these released documents, a judge in another case in\u00a0California has ruled that California can require Monsanto to label any products containing glyphosate as cancer causing. The <a href=\"http:\/\/www.fresnobee.com\/news\/business\/agriculture\/article138261598.html\">final ruling<\/a> came on Friday, a year after Monsanto initially sued California&#8217;s\u00a0Environmental Protection Agency\u2019s Office of Environmental Health Hazard Assessment over its notice of intent to add glyphosate to the state&#8217;s Proposition 65 list of cancer-causing chemicals. Monsanto will now be required to place cancer warning label on its Roundup (glyphosate) products.<\/p>\n<p>The chemical at issue in both of these cases,\u00a0<a href=\"https:\/\/www.beyondpesticides.org\/gateway\/index.php?pesticideid=37\">glyphosate<\/a>,\u00a0has historically been touted as a \u201clow toxicity\u201d chemical and \u201csafer\u201d than other chemicals by EPA and industry and is widely used in food production and on lawns, gardens, parks, and children\u2019s playing fields. Glyphosate is one of the most widely used herbicides in the U.S., with more than <a href=\"http:\/\/enveurope.springeropen.com\/articles\/10.1186\/s12302-016-0070-0#Sec3\">276 million pounds<\/a> applied in 2014. Glyphosate has been\u00a0<a href=\"http:\/\/www.iarc.fr\/en\/media-centre\/iarcnews\/pdf\/MonographVolume112.pdf\">linked to cancer<\/a>\u00a0in the independent scientific literature and epidemiologic studies have found that exposure to glyphosate is significantly associated with an increased risk of non-Hodgkin\u2019s lymphoma, which is the same type of cancer that plaintiffs in the current lawsuit are suffering, or have lost someone who suffered, from.<\/p>\n<p>Since the release of the IARC determination, Monsanto has made several efforts to discredit the scientific findings of this well respected, international body, as detailed in the documents associated with this case. In a February 8 filing, Monsanto submitted\u00a0<a href=\"https:\/\/drive.google.com\/file\/d\/0B-pJR4cGo9ckQWY5eGE5a04tekE\/view\">a court brief\u00a0<\/a>arguing that, \u201cThe IARC classification of glyphosate as a probable human carcinogen is not relevant to the question of whether or not Roundup caused the plaintiffs\u2019 cancers.\u201d It goes on to claim that \u201cIARC\u2019s approach is \u201cless rigorous\u201d than EPA\u2019s in evaluating scientific evidence, and IARC\u2019s conclusions are \u201cscientifically unreliable,\u201d\u201d a conclusion that is unfounded, to say the least. In a separate document filed on February 10, Monsanto went a step further, claiming that there is no evidence that the products at issue are \u201cdefective or unreasonably dangerous,\u201d and \u201cno evidence of carcinogenicity in glyphosate or Roundup.\u201d<\/p>\n<p>The mounting evidence of glyphosate\u2019s hazards is piling up and environmental groups, like Beyond Pesticides, are urging localities to restrict or ban the use of the chemical.
