The suit cites widespread presence of neonics in the environment which presents serious risks to wildlife across large portions of the country. It contends that they pose significant adverse consequences to threatened and endangered species. According to the lawsuit, because of toxicity and pervasive environmental contamination, NRDC is now challenging EPA\u2019s registrations of pesticide products containing one of three main neonic active ingredients\u2014acetamiprid, dinotefuran, and imidacloprid\u2014and seeks vacatur of those registrations until EPA complies with the law.<\/p>\n<p>\u201cThe EPA ignored endangered bees, butterflies, and birds when it approved the widespread use of neonics,\u201d said\u00a0Rebecca Riley, a senior attorney in NRDC\u2019s Land &amp; Wildlife program. \u201cMassive pollinator die-offs across the country show that these pesticides cause serious harm to wildlife.\u201d<\/p>\n<p>NRDC identified 26 species listed under the Endangered Species Act (ESA) that are at risk from neonic pesticides. They include the federally endangered\u00a0rusty patched bumblebee, Karner blue butterfly, Hines\u2019 emerald dragonfly, black-capped vireo, and\u00a0pallid sturgeon, as well as the federally threatened vernal pool fairy shrimp.<\/p>\n<p>This lawsuit follows <a href=\"http:\/\/beyondpesticides.org\/dailynewsblog\/2017\/05\/judge-rules-epa-neonicotinoid-registrations-violated-endangered-species-act\/\">a decision earlier this year<\/a> by a federal judge in\u00a0California who ruled\u00a0that EPA violated the ESA when it issued 59 neonicotinoid insecticide registrations between 2007 and 2012 for pesticide products containing\u00a0<a href=\"http:\/\/beyondpesticides.org\/resources\/pesticide-gateway?pesticideid=121\"><strong>clothianidin<\/strong><\/a>\u00a0and\u00a0<a href=\"http:\/\/beyondpesticides.org\/resources\/pesticide-gateway?pesticideid=289\"><strong>thiamethoxam<\/strong><\/a>.\u00a0That lawsuit, first filed in 2013, focused on the EPA\u2019s failure to protect pollinators from pesticides and challenged EPA\u2019s oversight of the neonic pesticides, clothianidin and thiamethoxam, as well as the agency\u2019s practice of \u201cconditional registration\u201d and labeling deficiencies.<\/p>\n<p>Neonicotinoid pesticides are highly toxic to bees and\u00a0<a href=\"https:\/\/www.beyondpesticides.org\/pollinators\/research.php\"><strong>a growing body of scientific literature<\/strong><\/a>\u00a0has linked them to\u00a0<a href=\"http:\/\/beyondpesticides.org\/dailynewsblog\/2015\/11\/french-researchers-solve-discrepancy-in-bee-killing-neonic-studies\/\"><strong>pollinator decline in general<\/strong><\/a>. Neonicotinoids are associated with decreased\u00a0<a href=\"https:\/\/www.beyondpesticides.org\/dailynewsblog\/2014\/02\/near-infinitesimal-exposure-to-neonicotinoids-reduces-bees-ability-to-gather-food\/\"><strong>foraging<\/strong><\/a>\u00a0\u00a0and navigational ability, as well as increased vulnerability to pathogens and parasites as a result of suppressed bee immune systems. \u00a0In addition to toxicity to bees, neonicotinoids have been shown to also adversely affect\u00a0<a href=\"https:\/\/www.beyondpesticides.org\/dailynewsblog\/2014\/07\/bird-population-declines-linked-to-neonicotinoid-pesticides-adding-to-previous-science\/\"><strong>birds<\/strong><\/a>,\u00a0<a href=\"https:\/\/www.beyondpesticides.org\/dailynewsblog\/2013\/06\/new-study-exposes-widespread-harm-from-neonicotinoid-pesticides\/\"><strong>aquatic organisms, and contaminate soil<\/strong><\/a>\u00a0and\u00a0<a href=\"https:\/\/www.beyondpesticides.org\/dailynewsblog\/2014\/07\/midwest-waterways-contaminated-with-persistent-neonicotinoid-pesticides\/http:\/www.beyondpesticides.org\/dailynewsblog\/2014\/07\/midwest-waterways-contaminated-with-persistent-neonicotinoid-pesticides\/\"><strong>waterways<\/strong><\/a>, and\u00a0<a href=\"https:\/\/www.beyondpesticides.org\/dailynewsblog\/2015\/04\/neonicotinoids-adversely-affect-biodiversity-according-to-new-report\/\"><strong>overall biodiversity<\/strong><\/a>. An overwhelming number of studies have shown that neonicotinoids can impact a wide-rage of non-target species. This summer, the <a href=\"http:\/\/beyondpesticides.org\/dailynewsblog\/2017\/07\/largest-field-study-finds-neonicotinoids-decimate-bees\/\">results of a two-year long study <\/a>conducted at 33 sites in multiple European countries to assess the effects of neonics confirms that these pesticides have a deleterious effect on bee survival.<\/p>\n<p>EPA\u2019s own assessment also finds that neonics like imidacloprid pose risks to aquatic organisms, and has concentrations in U.S. waters that threaten sensitive species. Other preliminary pollinator assessment conducted by the agency for the other neonics- clothianidin, thiamethoxam, and dinotefuran, finds that they\u00a0<a href=\"http:\/\/beyondpesticides.org\/dailynewsblog\/2017\/01\/epa-finds-risks-bees-neonicotinoid-insecticides-fails-act-accordingly\/\"><strong>present \u201cno significant risks\u201d to honey bees<\/strong><\/a>, despite finding multiple instances where bees are at risk of toxic exposure, and overwhelming independent data to the contrary.<\/p>\n<p>In light of the shortcomings of federal action in the U.S. to protect these beneficial organisms, it is left up to us to act. The lawsuit, filed in the U.S. District Court for the District of Columbia, challenges the failure of the federal government to evaluate the impacts of neonicotinoid pesticides (\u201cneonics\u201d) on threatened and endangered species, like the rusty patched bumble bee, the black-capped vireo, and the San Bruno elfin butterfly. The suit cites widespread presence of neonics in the environment which presents serious risks to wildlife across large portions of the country. It contends that they pose significant adverse consequences to threatened and endangered species.
