U.S. Senator Tom Carper (D-DE)<\/a>, Ranking Minority Member of the Senate Committee on Environment and Public Works, said, \u201cDr. Dourson\u2019s consistent endorsement of chemical safety standards that not only match industry\u2019s views, but are also significantly less protective than EPA and other regulators have recommended, raises serious doubts about his ability to lead those efforts. This is the first time anyone with such clear and extensive ties to the chemical industry has been [nominated] to regulate that industry.\u201d<\/u><\/u><\/p>\n

Dr. Dourson\u2019s professional history provides important context for considering his nomination. He did a turn at EPA from 1980 to 1994, starting as a staff toxicologist, and then leading a pesticide and toxics group that supports EPA\u2019s regulatory work. However, in 1995, Dr. Dourson started the consulting group, Toxicology Excellence for Risk Assessment (TERA), which has done contract work for chemical companies, producing research and reports that often \u201cdownplayed the health risks posed by their compounds<\/a>.\u201d<\/u><\/u><\/p>\n

TERA\u2019s clients have included<\/a>\u00a0Dow Chemical Company, Koch Industries Inc., Monsanto, Chevron Corporation, and the industry lobby group, the American Chemistry Council \u2013companies that make pesticides, processed foods, cigarettes, plastics, and other chemical products. The\u00a0<\/i>Associated Press reports<\/a>\u00a0that Dr. Dourson has, for some time, received payments for his critical assessments of peer-reviewed studies that identified concerns with the safety of his clients\u2019 products. According to the\u00a0New York Times<\/i><\/a>,\u00a0Adam Finkel<\/a>,\u00a0executive director of the Penn Program on Regulation at University of Pennsylvania Law School, who worked as a partner on a project with Dr. Dourson, said, \u201cMost of what he has done over time is to rush headlong to exonerate chemicals.\u201d Four controversial toxic chemicals \u20131,4-dioxane<\/a>,\u00a01-bromopropane<\/a>,\u00a0trichloroethylene<\/a>\u00a0and\u00a0chlorpyrifos<\/a>\u2013 currently under EPA review are manufactured by Dow, a company that Dr. Dourson represented. If confirmed, he would oversee the regulation of these chemicals, which are associated with severe health issues, including cancer, birth defects, and developmental problems in children.<\/u><\/u><\/p>\n

The\u00a0Associated Press<\/a>\u00a0cites the example of Dr. Dourson\u2019s Dow-sponsored review of chlorpyrifos (a neurotoxic pesticide that\u00a0harms children\u2019s brains<\/a>,\u00a0even at very low exposure levels), which claimed flaws in peer-reviewed studies linking delays in fetal development with exposure to the chemical.\u00a0The credibility of EPA\u2019s regulation of chlorpyrifos is already in question<\/a>\u00a0due to EPA Administrator Scott Pruitt\u2019s decision to overrule the recommendation of agency scientists that would have banned the chemical. Mr. Pruitt\u00a0claims the science is \u201cunresolved<\/a>\u201d and has delayed a decision on chlorpyrifos until 2022.<\/u><\/u><\/p>\n

Dr. Dourson is a recent example of the \u201crevolving door\u201d phenomenon \u2013the movement of people between roles as agency regulators or legislators, and positions in the industries that are regulated by those government roles. The door revolves in both directions, with regulators leaving government to join industry, and vice versa. This ready switching of roles creates unavoidable conflicts of interest. Indeed,\u00a0ethics experts say<\/a>\u00a0that, if confirmed, Dr. Dourson\u2019s work on behalf of industry could constitute significant conflicts of interest.<\/u><\/u><\/p>\n

Industry has a\u00a0long history of using the revolving door<\/a>. When people are allowed to move from industry to regulatory agency (or the reverse) without constraint, the resultant conflicts of interest not only unduly shape policy or ratchet up industry influence, but cast huge doubt on the individual\u2019s ability to act independent of industry\u2019s interests, and in the best interest of the public and an agency\u2019s charge.<\/p>\n
