{"id":21471,"date":"2017-10-26T00:00:10","date_gmt":"2017-10-26T04:00:10","guid":{"rendered":"http:\/\/beyondpesticides.org\/dailynewsblog\/?p=21471"},"modified":"2017-10-26T10:38:44","modified_gmt":"2017-10-26T14:38:44","slug":"epa-curtails-publics-ability-make-agency-obey-law","status":"publish","type":"post","link":"https:\/\/beyondpesticides.org\/dailynewsblog\/2017\/10\/epa-curtails-publics-ability-make-agency-obey-law\/","title":{"rendered":"EPA Curtails Public\u2019s Ability to Make the Agency Obey the Law"},"content":{"rendered":"<p>(Beyond Pesticides, October 26, 2017)\u00a0In mid-October, EPA Administrator Scott Pruitt announced another action in his effort to remake the agency by <a href=\"http:\/\/www.reuters.com\/article\/us-usa-epa-lawsuits\/epa-head-seeks-to-avoid-settlements-with-green-groups-idUSKBN1CL2HK\">issuing a directive<\/a> that aims <img loading=\"lazy\" decoding=\"async\" class=\"alignright size-full wp-image-21478\" src=\"http:\/\/beyondpesticides.org\/dailynewsblog\/wp-content\/uploads\/2017\/10\/download-3.jpg\" alt=\"\" width=\"291\" height=\"173\" \/>to stop the practice \u2014 often referred to as \u201csue and settle\u201d \u2014 of settling lawsuits with outside (often, environmental) groups. It\u2019s the Administrator\u2019s contention that such groups have had undue influence on regulation. <a href=\"https:\/\/www.washingtonpost.com\/politics\/epa-administrator-pruitt-issues-directive-to-curb-settlements-with-outside-groups\/2017\/10\/16\/b62967ba-b280-11e7-be94-fabb0f1e9ffb_story.html?utm_term=.e5c9797ca708\">He has indicated<\/a> that his action will not prevent EPA from reaching settlements with \u201coutside litigants,\u201d but that he does want to disallow agreements that would change a discretionary duty to a nondiscretionary duty. However, responding to Administrator Pruitt\u2019s comment about the days of \u201cregulation through litigation\u201d being over, the <a href=\"https:\/\/www.nrdc.org\/trump-watch\/epa-chief-wants-prevent-public-forcing-his-agency-do-its-job\">Natural Resources Defense Council (NRDC) notes,<\/a> \u201cThat\u2019s really just a twisted way of saying that the days of holding the EPA accountable are over.\u00a0<a href=\"https:\/\/www.nrdc.org\/experts\/nrdc\/pruitt-wants-make-epa-less-accountable-public\">The effect<\/a>\u00a0won\u2019t just be the EPA wasting taxpayer money as it fights unwinnable lawsuits, but also prolonging delays that allow polluters to keep on polluting.\u201d<\/p>\n<p><a href=\"https:\/\/www.epa.gov\/newsreleases\/administrator-pruitt-issues-directive-end-epa-sue-settle\">The agency\u2019s press release quotes Mr. Pruitt:<\/a> \u201c\u2018The days of regulation through litigation are over. . . . We will no longer go behind closed doors and use consent decrees and settlement agreements to resolve lawsuits filed against the Agency by special interest groups where doing so would circumvent the regulatory process set forth by Congress. Additionally, gone are the days of routinely paying tens of thousands of dollars in attorney\u2019s fees to these groups with which we swiftly settle.\u2019\u201d<\/p>\n<p><a href=\"https:\/\/www.epa.gov\/newsreleases\/administrator-pruitt-issues-directive-end-epa-sue-settle\">The release adds,<\/a> \u201c\u2018Sue and settle\u2019 cases establish Agency obligations without participation by states and\/or the regulated community; foreclose meaningful public participation in rulemaking; effectively force the Agency to reach certain regulatory outcomes; and, cost the American taxpayer millions of dollars. . . With today\u2019s directive, Administrator Pruitt is ensuring the Agency increase[s] transparency, improve[s] public engagement, and provide[s] accountability to the American public when considering a settlement agreement or consent decree.\u201d Read the full directive here: <a href=\"https:\/\/www.epa.gov\/newsroom\/directive-promoting-transparency-and-public-participation-consent-decrees-and-settlement\">https:\/\/www.epa.gov\/newsroom\/directive-promoting-transparency-and-public-participation-consent-decrees-and-settlement<\/a>.<\/p>\n<p>The directive says it wants to make EPA more transparent by providing more disclosure related to potential settlements: publishing any notice of intent to sue within 15 days of receipt of such notice, notifying states (or other entities) that might be affected, and publishing possible settlements or consent decrees for public comment for 30 days. It also intends to forbid the practice of agreeing to settlements that \u201cexceed the authority of courts,\u201d and to exclude plaintiff\u2019s attorney\u2019s fees and litigation costs in settling suits.<\/p>\n<p>This practice of bringing pressure on the EPA (or other agencies) via lawsuit has been an important tool for the public in ensuring accountability of federal agencies, i.e., making sure the feds follow their own rules. During the last decade or so, when EPA (or other agencies) delayed rulemaking, citizens \u2014 typically through non-governmental organizations (NGOs) \u2014 would sometimes use litigation to get the agencies to act, and EPA often arrived at settlements or consent decrees to resolve the matters. When, for example, EPA misses a deadline that results in polluters violating regulations that protect public health and the environment, the public has been able to take the agency to court for remedy. <a href=\"http:\/\/www.reuters.com\/article\/us-usa-epa-lawsuits\/epa-head-seeks-to-avoid-settlements-with-green-groups-idUSKBN1CL2HK\">According to <em>Reuters<\/em> coverage of the issue,<\/a> \u201cMost lawsuits by green groups . . . seek to push the agency to speed up regulation on issues such as climate and air and water pollution.\u201d<\/p>\n<p>This directive is the latest example of how Administrator Pruitt is acting to change the very federal policies he challenged in court as Oklahoma Attorney General. In that role, he sued EPA more than a dozen times and has long criticized the practice of \u201csue and settle.\u201d Beyond that, <a href=\"https:\/\/www.washingtonpost.com\/politics\/epa-administrator-pruitt-issues-directive-to-curb-settlements-with-outside-groups\/2017\/10\/16\/b62967ba-b280-11e7-be94-fabb0f1e9ffb_story.html?utm_term=.e5c9797ca708\">this move appears to be part of a larger pattern<\/a> in the Trump administration to rein in the disbursement of federal funds to external entities in litigation. In June 2017, <a href=\"https:\/\/www.washingtonpost.com\/world\/national-security\/sessions-prohibits-settlement-agreements-that-donate-money-to-outside-groups\/2017\/06\/06\/c0b2e700-4b02-11e7-bc1b-fddbd8359dee_story.html?utm_term=.ee5dcc9df015\">Attorney General Jeff Sessions issued a memo\u00a0<\/a>to block payments to third-party, not-for-profit groups\u00a0as part of environmental settlements. <a href=\"https:\/\/www.washingtonpost.com\/politics\/epa-administrator-pruitt-issues-directive-to-curb-settlements-with-outside-groups\/2017\/10\/16\/b62967ba-b280-11e7-be94-fabb0f1e9ffb_story.html?utm_term=.7c0027dc3b57\">The <em>Washington Post<\/em> reported his comment:<\/a> \u201c\u2018Instead of allowing defendants to fund environmental measures as a way of meeting their obligations for violating the law, such penalties should go directly to the U.S. Treasury,\u2019 Sessions said. \u2018The attorney general is \u201ckeenly interested and supportive of what we\u2019re doing,\u2019\u201d adding that \u2018other agencies are taking notice as well.\u2019\u201d<\/p>\n<p>Ending the practice of \u201csue and settle\u201d has long been high on the to-do lists of business groups and conservatives. <a href=\"http:\/\/www.reuters.com\/article\/us-usa-epa-lawsuits\/epa-head-seeks-to-avoid-settlements-with-green-groups-idUSKBN1CL2HK\">As <em>Reuters<\/em> reports,<\/a> \u201cDaren Bakst, a research fellow in agricultural policy at the [conservative] Heritage Foundation think tank, said sue and settle has led to \u2018egregious antics\u2019 that have \u2018effectively handed over the setting of agency priorities to environmental pressure groups,\u2019 and has led to rushed rulemaking by the agency.\u201d<\/p>\n<p>Environmental groups quickly weighed in on the issuance of the directive. <a href=\"https:\/\/www.washingtonpost.com\/politics\/epa-administrator-pruitt-issues-directive-to-curb-settlements-with-outside-groups\/2017\/10\/16\/b62967ba-b280-11e7-be94-fabb0f1e9ffb_story.html?utm_term=.e5c9797ca708\">Pat Gallagher, legal director for the Sierra Club, says,<\/a> \u201cThere\u2019s a general hostility to citizen enforcement of environmental laws, and [the directive] reflects the fact that Pruitt doesn\u2019t want these laws enforced.\u201d<\/p>\n<p><a href=\"https:\/\/www.ecowatch.com\/pruitt-epa-lawsuits-2497715655.html?xrs=RebelMouse_fb&amp;ts=1508271028\">Ecowatch<\/a> says that the directive \u201cwill likely result in prolonged violations, delayed protection, and waste of government resources fighting lawsuits against which the EPA has no defense.\u201d<\/p>\n<p><a href=\"http:\/\/www.reuters.com\/article\/us-usa-epa-lawsuits\/epa-head-seeks-to-avoid-settlements-with-green-groups-idUSKBN1CL2HK\">Pat Parenteau, an environmental law professor at the Vermont Law School, said<\/a> that \u201cPruitt\u2019s directive would be \u2018counterproductive\u2019 and costly because in the end courts could fine the agency if it does not meet compliance dates for issuing regulations. \u2018He can fight it if he wants as long as he wants, and spend as much money as he wants,\u2019 Mr. Parenteau said. \u2018But in the end if you\u2019ve missed a statutory deadline, you are going to be ordered (by a court) to comply and then you are going to be ordered to pay fees.\u2019\u201d<\/p>\n<p><a href=\"https:\/\/www.washingtonpost.com\/politics\/epa-administrator-pruitt-issues-directive-to-curb-settlements-with-outside-groups\/2017\/10\/16\/b62967ba-b280-11e7-be94-fabb0f1e9ffb_story.html?utm_term=.e5c9797ca708\">Government watchdog groups suggest that the directive may not have much impact,<\/a> given that many environmental laws, including the Clean Air Act, provide \u201cbroad latitude to sue the EPA when it is failing to meet statutory deadlines, and the judge handling such cases typically determines the amount of legal fees the government must pay as part of any consent decree. \u2018That\u2019s not his decision to make,\u2019 said John Walke, director of the NRDC\u2019s Clean Air Project. . . A judge can impose attorney fees when an agency violates the law and citizens file suit to hold the government accountable.\u2019\u201d<\/p>\n<p>Groups have also noted that a <a href=\"https:\/\/www.gao.gov\/products\/GAO-15-34\">2014 report by the Government Accountability Office (GAO)<\/a> on the EPA practice of settling with outside groups found that the Impact of such litigation on EPA&#8217;s rulemaking process is limited; similarly, a <a href=\"http:\/\/www.gao.gov\/assets\/690\/683058.pdf\">February 2017 GAO report on endangered species\u2013related litigation found<\/a> that \u201cthe settlement agreements did not affect the substantive basis or procedural rule-making requirements the Services were to follow in completing the actions.\u201d<\/p>\n<p>Mr. Walke\u00a0<a href=\"https:\/\/www.ecowatch.com\/pruitt-epa-lawsuits-2497715655.html?xrs=RebelMouse_fb&amp;ts=1508271028\">said<\/a>,\u201c\u2018Pruitt&#8217;s doing nothing more than posturing about a nonexistent problem and political fiction. His targeting of legal settlements, especially where EPA has no defense to breaking the law, will just allow violations to persist, along with harms to Americans. . . . The irony is that polluters don&#8217;t even have to sue Pruitt to get what they want. They just pick up the phone and ask. It\u2019s the Administrator\u2019s contention that such groups have had undue influence on regulation. He has indicated that his action will not prevent EPA from reaching settlements with \u201coutside litigants,\u201d but that he does want to disallow agreements that would change a discretionary duty to a nondiscretionary duty. However, responding to Administrator Pruitt\u2019s comment about the days of \u201cregulation through litigation\u201d being over, the Natural Resources Defense Council (NRDC) notes, \u201cThat\u2019s really just a twisted way of saying that the days of holding the EPA accountable are over.\u00a0The effect\u00a0won\u2019t just be the EPA wasting taxpayer money as it fights unwinnable lawsuits, but also prolonging delays that allow polluters to keep on polluting.\u201d The agency\u2019s press release quotes Mr. Pruitt: \u201c\u2018The days of regulation through litigation are over. . . .
