In February 2018, the case, brought by a beekeeper, was allowed to proceed to trial by the Quebec Superior Court.<\/p>\n<p>Quebec queen bee breeder, Steve Martineau, conducted tests on water and his dead and dying bees and found traces of neonicotinoids. His suit alleges that Bayer and Syngenta were negligent in the manufacture and sale of neonicotinoids in Quebec, and are responsible for damages that he and other class members suffered under Article 1457 of the Quebec Civil Code. Bayer and Syngenta challenged the application on a number of grounds including the assumption that they had manufactured the neonicotinoids which killed Martineau&#8217;s bees. The class in this case was authorized for all persons in Quebec who own or owned bees in the affected area since 2006. Mr. Martineau estimates he has lost about $20,000 a year to present due to the effects of neonicotinoids\u00a0on his bee population (Martineau v. Bayer CropScience Inc. <a href=\"http:\/\/getlink.quicklaw.com\/find.php?QLINK=DyMz2KFMAUZzn1me679797HyzlfInn5gNoAAi%2F9DCQRndpLBFR87PKSUUiNL26%2BWz2tg1SoiOwJcb7Ye2O2pAk7oct7%2FeTDno%2FOP4M2ZQ2n1z4ARZ%2BdMencRuCa7RV2o6uzGMFJjqRT6tSor3FdyDPFVSF3YbW8MtDsbSW6pENQq6rYSqtITPQgz\">CALN\/2018-007<\/a>)<\/p>\n<p>&#8220;We&#8217;re\u00a0suing on behalf of Quebec beekeepers whose\u00a0bees\u00a0were non-productive or killed,&#8221;\u00a0Mr. Martineau\u2019s lawyer, Samy\u00a0Elnemr\u00a0said. In addition to the Quebec class-action suit, a Canada-wide lawsuit against neonicotinoid\u00a0manufacturers is also being prepared to be filed and will be put before the courts soon.<\/p>\n<p>On February 19, 2018,\u00a0the provincial government\u00a0<a href=\"https:\/\/beyondpesticides.org\/dailynewsblog\/2018\/02\/quebec-tightening-restrictions-highly-toxic-pesticides\/\">introduced new restrictions\u00a0on pesticides<\/a> considered harmful to honey bees, including\u00a0neonicotinoids. Under the changes, farmers will have to get permission from a certified agronomist before using certain pesticides on crops.\u00a0 The restricted pesticides include three types of neonicotinoids, as well as chlorpyrifos and atrazine, which has been banned in Europe for more than a decade. To ensure the implementation of these new regulations goes smoothly, the Environment Ministry will establish a monitoring committee to oversee the process. The province has already allocated $14 million over five years to assist farmers in reducing pesticide risks and adapting to the new measures. Advocates say the new rules represent a compromise. These chemicals may continue to be used, but inserting agronomic experts with an eye for both the economic and health concerns surrounding the use of highly toxic pesticides into the process may be a strategy to significantly reduce pesticide use. The good news is that by also improving recordkeeping, Quebec\u2019s strategy can be closely evaluated to ensure the approval process is not simply a rubber stamp for pesticide use.<\/p>\n<p><a href=\"https:\/\/www.beyondpesticides.org\/programs\/bee-protective-pollinators-and-pesticides\/what-the-science-shows\"><strong>Numerous scientific studies<\/strong><\/a>\u00a0implicate neonicotinoid pesticides as key contributors to the global decline of pollinator populations. Research on neonicotinoids has been consistent in linking their use to\u00a0<a href=\"https:\/\/beyondpesticides.org\/dailynewsblog\/2015\/02\/neonics-harm-bees-brain-cells-according-to-researchers\/\"><strong>reduced learning<\/strong><\/a>\u00a0in bees, as well as other impacts, such as those on\u00a0<a href=\"https:\/\/beyondpesticides.org\/dailynewsblog\/2016\/10\/neonicotinoid-insecticide-exposure-reduces-bumblebee-colony-size\/\"><strong>colony size<\/strong><\/a>, and\u00a0<a href=\"https:\/\/beyondpesticides.org\/dailynewsblog\/2016\/07\/neonicotinoid-insecticides-reproductive-effects-bees\/\"><strong>reproductive success<\/strong><\/a>. Studies looking at effects on birds reports that songbirds exposed to widely used insecticides, like neonicotinoids,\u00a0<a href=\"https:\/\/beyondpesticides.org\/dailynewsblog\/2017\/11\/research-shows-common-insecticides-harm-songbird-migration-raises-concerns-new-silent-spring\/\"><strong>fail to properly orient themselves for migration<\/strong><\/a>, the first such study that adds weight to arguments that\u00a0<a href=\"https:\/\/beyondpesticides.org\/dailynewsblog\/2013\/02\/pesticides-not-crop-intensification-the-primary-cause-of-bird-declines\/\"><strong>pesticides are a likely cause in the decline of migratory bird populations<\/strong><\/a>. \u00a0U.S. beekeepers lost an unsustainable 33% of their hives between 2016 and 2017.<\/p>\n<p>Neonicotinoids are also detected regularly in the\u00a0<a href=\"https:\/\/beyondpesticides.org\/dailynewsblog\/2014\/07\/midwest-waterways-contaminated-with-persistent-neonicotinoid-pesticides\/\"><strong>nation\u2019s waterways<\/strong><\/a>\u00a0at concentrations that exceed acute and chronic toxicity values for sensitive organisms. A new report from the U.S. Geologic Survey (USGS) finds\u00a0<a href=\"https:\/\/beyondpesticides.org\/dailynewsblog\/2018\/01\/new-study-finds-neonics-pervasive-great-lakes\/\"><strong>neonicotinoid contamination of the Great Lakes<\/strong><\/a>\u00a0that threatens aquatic life.The most recent\u00a0<a href=\"https:\/\/org2.salsalabs.com\/dia\/track.jsp?key=-1&amp;url_num=3&amp;url=https%3A%2F%2Fwww.regulations.gov%2Fdocument%3FD%3DEPA-HQ-OPP-2008-0844-1086\"><strong>aquatic assessment for imidacloprid<\/strong><\/a> finds that imidacloprid threatens the health of U.S. waterways with significant risks to aquatic insects and cascading effects on aquatic food webs. As a result of risks to aquatic organisms, the Canadian pesticide regulatory agency has\u00a0<a href=\"http:\/\/www.hc-sc.gc.ca\/cps-spc\/pest\/part\/consultations\/_prvd2016-20\/prvd2016-20-eng.php\"><strong>recommended banning imidacloprid<\/strong><\/a>, a decision on which has been delayed. In Europe, a recent survey finds that\u00a0<a href=\"https:\/\/beyondpesticides.org\/dailynewsblog\/2017\/12\/uk-rivers-contaminated-neonicotinoids-eu-delays-decision-extend-ban\/\"><strong>streams across the United Kingdom (UK)<\/strong><\/a>\u00a0are contaminated with neonicotinoids. The European Commission met on December 12 and 13, 2017 to decide on<a href=\"https:\/\/beyondpesticides.org\/dailynewsblog\/2017\/03\/european-commission-urges-full-ban-neonicotinoids\/\"><strong>\u00a0a proposal<\/strong><\/a>\u00a0to extend the\u00a0<a href=\"https:\/\/beyondpesticides.org\/dailynewsblog\/2013\/04\/victory-in-europe-eu-votes-to-ban-bee-killing-pesticides\/\"><strong>2013 neonicotinoid ban<\/strong><\/a>\u00a0to all outdoor crops, but this decision was delayed. In February 2018, the case, brought by a beekeeper, was allowed to proceed to trial by the Quebec Superior Court. Quebec queen bee breeder, Steve Martineau, conducted tests on water and his dead and dying bees and found traces of neonicotinoids. His suit alleges that Bayer and Syngenta were negligent in the manufacture and sale of neonicotinoids in Quebec, and are responsible for damages that he and other class members suffered under Article 1457 of the Quebec Civil Code. Bayer and Syngenta challenged the application on a number of grounds including the assumption that they had manufactured the neonicotinoids which killed Martineau&#8217;s bees. The class in this case was authorized for all persons in Quebec who own or owned bees in the affected area since 2006. Mr. Martineau estimates he has lost about $20,000 a year to present due to the effects of neonicotinoids\u00a0on his bee population (Martineau v. Bayer CropScience Inc.
