It was slated to be banned for food uses by the U.S. Environmental Protection Agency (EPA) last year, but the decision was reversed by the Trump administration.<\/p>\n<p><a href=\"https:\/\/www.cdpr.ca.gov\/docs\/pressrls\/2018\/111518.htm\">The interim measures in California include:<\/a> banning aerial application of chlorpyrifos; ending its use on many crops \u2014 except for those determined to be \u201ccritical\u201d by virtue of there being few, if any, alternatives (as determined by the University of California Cooperative Extension and listed on DPR&#8217;s website); establishing a quarter-mile buffer zone for 24 hours after any application of the pesticide; and requiring a 24\/7\/365, 150-foot application setback from houses, businesses, schools, and other sensitive sites. The CDPR, it should be noted, is <em>recommending,<\/em> rather than <em>requiring,<\/em> implementation of the temporary restrictions beginning January 1, 2019 (note the \u201cno weight of law\u201d and \u201ctoothless\u201d commentary, below).<\/p>\n<p>Chlorpyrifos is a widely used organophosphate pesticide used on approximately 60 different crops, and <a href=\"https:\/\/beyondpesticides.org\/assets\/media\/documents\/bp-37.4-w17-Chlorpyrifos-cited.pdf\">most intensively on<\/a> almonds, cotton, citrus fruits, grapes, corn, broccoli, sugar beets, peaches, and nectarines. It is also commonly used for mosquito-borne disease control, and on golf courses. Exposure to the pesticide has been <a href=\"https:\/\/beyondpesticides.org\/assets\/media\/documents\/bp-37.4-w17-Chlorpyrifos-cited.pdf\">identified repeatedly as problematic.<\/a><\/p>\n<p><a href=\"https:\/\/beyondpesticides.org\/dailynewsblog\/2018\/08\/u-s-court-tells-epa-ban-chlorpyrifos\/\">There is a broader context for the CDPR\u2019s announcement.<\/a> In 2015 the EPA proposed to revoke food residue tolerances of chlorpyrifos, which would effectively have banned use of the pesticide in agriculture; all residential uses had previously been withdrawn from the market in 2000. Then, early in 2017, with a new administration in place, then-EPA Administrator Scott Pruitt reversed the agency\u2019s own proposal to ban the pesticide \u2014 a decision that happened just weeks after Mr. Pruitt\u00a0<a href=\"https:\/\/apnews.com\/2350d7be5e24469ab445089bf663cdcb\">met<\/a>\u00a0with the head of Dow Chemical Company, maker of the compound. Mr. Pruitt then falsely claimed the science on chlorpyrifos was\u00a0\u201c<a href=\"https:\/\/www.epa.gov\/sites\/production\/files\/2017-03\/documents\/chlorpyrifos3b_order_denying_panna_and_nrdc27s_petitition_to_revoke_tolerances.pdf\">unresolved<\/a>\u201d and said EPA would study the issue \u2014 with no planned action \u2014 until 2022.<\/p>\n<p>Next, in the summer of 2018, the U.S. Court of Appeals for the Ninth Circuit issued its decision in a suit, brought by a plethora of health, environmental, and labor groups represented by <a href=\"https:\/\/earthjustice.org\/\">Earthjustice,<\/a> asking that the 2017 Pruitt EPA order reversing the ban be vacated. (The attorneys general of New York, California, Washington, Massachusetts, Maine, Maryland, and Vermont also filed their own appeal calling for a ban.) <a href=\"https:\/\/beyondpesticides.org\/dailynewsblog\/2018\/08\/u-s-court-tells-epa-ban-chlorpyrifos\/\">The court ordered EPA to finalize its proposed ban on chlorpyrifos<\/a>.<\/p>\n<p>The Trump administration said it would appeal the court\u2019s decision and, indeed, in the fall of 2018, the EPA and its new administrator, Andrew Wheeler, <a href=\"http:\/\/pesticideblog.lawbc.com\/entry\/epa-petitions-for-en-banc-and-panel-rehearing-in-ninth-circuit-chlorpyrifos\">requested that the Ninth Circuit Court rehear the chlorpyrifos case in an <em>en banc<\/em> proceeding<\/a> \u2014 one in which a case is heard\u00a0before all the judges of a court rather than by a selected panel of them. (In the Ninth Circuit, this would typically mean 11 of its 29 judges.) EPA\u2019s request is based primarily on challenges to that court\u2019s authority in the matter.<\/p>\n<p>Amid all this, states have begun to step up on the issue, with chlorpyrifos ban or restriction bills introduced in California, Hawaii, Maryland, and New Jersey. In June 2018, <a href=\"https:\/\/www.apnews.com\/4af87a8210474f1a97d2dc6e73ba9344\">Hawaii became the first state to enact a ban<\/a> on any use of chlorpyrifos. As of winter 2017\u20132018, there were some federal legislative efforts afoot: Senators Tom Udall (D-NM), Richard Blumenthal (D-CT), and eight cosponsors introduced the <a href=\"https:\/\/www.congress.gov\/bill\/115th-congress\/senate-bill\/1624\">Protect Children, Farmers and Farmworkers from Nerve Agent Pesticides Act of 2017, S. 1624.<\/a> Representatives Nydia Vel\u00e1zquez (D-NY) and 49 cosponsors introduced a companion bill, <a href=\"https:\/\/www.congress.gov\/bill\/115th-congress\/house-bill\/3380\">Pesticide Protection Act of 2017, H.R. 3380<\/a>.<\/p>\n<p>After the CDPR announced its intention to work toward a classification of chlorpyrifos as a \u201ctoxic air pollutant,\u201d <a href=\"https:\/\/beyondpesticides.org\/dailynewsblog\/2018\/10\/take-action-tell-california-department-of-pesticide-regulation-to-ban-chlorpyrifos\/\">Beyond Pesticides put out the call<\/a> for people to weigh in during the public comment period, encouraging them to insist on cancellation of the registration of the toxic pesticide altogether in the state. Beyond Pesticides noted, at the time, that the <a href=\"https:\/\/beyondpesticides.org\/dailynewsblog\/2018\/10\/take-action-tell-california-department-of-pesticide-regulation-to-ban-chlorpyrifos\/\">state\u2019s Office of Environmental Health Hazard Assessment (OEHHA) had found that<\/a> \u201cthose exposed to chlorpyrifos during 2004\u20132014 most often reported systemic symptoms (including headache, nausea, and dizziness), eye irritation, and respiratory complaints (breathing difficulties, cough, and throat irritation). Almost 90% of those reporting such symptoms were bystanders [rather than applicators, e.g.]. . . . Many studies link exposure to chlorpyrifos to developmental neurotoxicity at very low rates of exposure,\u201d as was confirmed by the state\u2019s <a href=\"https:\/\/oehha.ca.gov\/proposition-65\/developmental-and-reproductive-toxicant-identification-committee-darticmembers\">Proposition 65 Developmental and Reproductive Toxicant Identification Committee<\/a>.<\/p>\n<p>Given the <a href=\"https:\/\/beyondpesticides.org\/assets\/media\/documents\/bp-37.4-w17-Chlorpyrifos-cited.pdf\">plentiful evidence of the toxicity of Dow\u2019s chlorpyrifos<\/a> to humans (especially babies and young children), the public health and environmental communities have criticized this temporary set of restrictions as wholly inadequate. <a href=\"https:\/\/abcnews.go.com\/Health\/wireStory\/apnewsbreak-california-aims-restrict-popular-pesticide-59219027\">Pesticide Action Network (PAN) called<\/a> the interim measures \u201ctoothless,\u201d and insists that the compound should be removed from the market entirely. <a href=\"https:\/\/abcnews.go.com\/Health\/wireStory\/apnewsbreak-california-aims-restrict-popular-pesticide-59219027\">PAN\u2019s Paul Towers said,<\/a> \u201cUnfortunately, these are voluntary recommendations for local officials that have no weight of law behind them. . . . Instead of taking this brain-harming pesticide off the market, California officials are again passing the buck.&#8221;<\/p>\n<p><a href=\"http:\/\/www.calhealthreport.org\/2018\/09\/05\/state-weighs-pesticide-restrictions-californias-farmworkers-students-continue-exposed\/\">Mark Weller, co-director of Californians for Pesticide Reform, has said,<\/a> \u201cThis dragged-out process . . . is just confirming everything that we already knew, and that decades of scientists have already shown: that very small amounts, tiny amounts of chlorpyrifos exposure, especially prenatal exposure[s], lead to extremely concerning outcomes.\u201d<\/p>\n<p>On the ground, the impacts of continuing to \u201ckick the can down the road\u201d are real. <a href=\"https:\/\/www.cdpr.ca.gov\/docs\/pressrls\/2018\/111518.htm\">The CDPR website notes:<\/a> \u201cIn September 2018, following extensive scientific review and public comment, DPR proposed designating chlorpyrifos as a \u2018toxic air contaminant,\u2019 which California law defines as an air pollutant that may cause or contribute to increases in serious illness or death, or that may pose a present or potential hazard to human health. A 45-day public comment period on the proposed designation closed on Nov. 9. Following designation of chlorpyrifos as a toxic air contaminant, DPR is required to consult with other state and local agencies \u2014 including the Office of Environmental Health Hazard Assessment, the California Air Resources Board, CAC\u2019s and local air districts \u2014 to determine what permanent mitigation measures are needed. This regulatory process could take <em>up to two years to complete<\/em> [<em>italic<\/em> emphasis ours].\u201d<\/p>\n<p>Scientists and many regulators understand that chlorpyrifos (and other organophosphate pesticides) need to come off the market, for food and non-food uses, altogether. It is particularly important that California, home to the country\u2019s largest agricultural sector, take robust action. But now, for at least two more years and likely longer, the state\u2019s children will be exposed \u2014 dietarily, or in air or water by virtue of where they live or engage in activities \u2014 to this harmful chemical. The CDPR\u2019s anemic \u2014 and non-compulsory \u2014 interim measures will <a href=\"https:\/\/beyondpesticides.org\/dailynewsblog\/2018\/03\/pesticide-chlorpyrifos-linked-brain-damage-advocates-call-ban\/\">further endanger populations already disproportionately affected<\/a> by pesticide exposures \u2014 low-income, African-American, and Latino people. This is a public health and <a href=\"https:\/\/beyondpesticides.org\/assets\/media\/documents\/bp-37.4-w17-Chlorpyrifos-cited.pdf\">environmental justice issue<\/a> on which California should be taking the lead.<\/p>\n<p>The public can advocate against the continued use of chlorpyrifos by contacting Representatives and Senators to urge their support of the legislation mentioned above, as well as by supporting state-level legislation. Regulators at the California Department of Pesticide Regulation (CDPR) issued interim restrictions on the compound while the agency works on a formal regulatory process to list chlorpyrifos as a \u201ctoxic air contaminant\u201d and develop permanent restrictions on its use.\u00a0A neurological toxicant, chlorpyrifos damages the brains of young children: impacts of exposure, even at very low levels, include decreased cognitive function, lowered IQ, attention deficit disorder, and developmental and learning delays. It was slated to be banned for food uses by the U.S. Environmental Protection Agency (EPA) last year, but the decision was reversed by the Trump administration.
