As a result, the Natural Resources Defense Council (NRDC) is suing the Administration\u2019s Department of the Interior (DOI) for failing to designate locations where additional protections could help restore the endangered bumblebee\u2019s population. Advocates say DOI\u2019s failure to comply with requirements under the Endangered Species Act (ESA) is consistent with the Trump Administration\u2019s <a href=\"https:\/\/beyondpesticides.org\/dailynewsblog\/2017\/02\/trump-administration-reverses-endangered-species-designation-bumblebee-pending-review\/\">continued disregard for ongoing pollinator declines<\/a> and <a href=\"https:\/\/www.nrdc.org\/onearth\/pro-extinction-policies-do-not-sit-well-americans-whatever-their-stripe\">environmental protections in general<\/a>.<\/p>\n<p>Under ESA, DOI is required to determine \u201ccritical habitat\u201d that contains physical and biological requirements a listed species needs in order to recover. That area must be designated within one year of placing a species on the endangered list, using best available scientific data. But the Trump Administration\u2019s DOI, under both former Director Ryan Zinke and Acting Director David Bernhardt, has failed to do so, in violation of ESA. NRDC\u2019s legal director Rebecca Riley notes that this lack of follow-through \u201cleaves this highly endangered bee\u2019s habitat at risk of destruction and decreases the species\u2019 chance for survival.\u201d<\/p>\n<p>The rusty patched bumblebee has a historical range that included habitat throughout the Northeast and Midwest United States. The <a href=\"https:\/\/www.washingtonpost.com\/news\/animalia\/wp\/2017\/03\/21\/the-endangered-listing-for-the-rusty-patched-bumblebee-is-finally-given-wings\/?utm_term=.528022786fc5\">Washington Post<\/a> notes that, \u201cThe rusty patched bumblebee was so prevalent 20 years ago that pedestrians in Midwestern cities had to shoo them away.\u201d However, pesticide use, climate change, disease, and habitat loss led to significant declines over the last several decades. Since then, their populations have dwindled and their overall decline is estimated at\u00a091 percent.<\/p>\n<p>The Trump Administration has dragged its feet on protecting the rusty patched bumblebee since the beginning of its term. The species was proposed for ESA listing <a href=\"https:\/\/beyondpesticides.org\/dailynewsblog\/2016\/09\/fws-proposes-listing-rusty-patched-bumble-bee-endangered-species\/\">under the Obama Administration in 2016,<\/a> and <a href=\"https:\/\/beyondpesticides.org\/dailynewsblog\/2017\/01\/rusty-patch-bumblebee-officially-listed-endangered-species\/\">finalized in 2017 only a week before<\/a> the new Administration took power. However, on his first day in office, President Trump directed federal agencies to postpone the effective date of any regulations that had been published to the federal register, but not yet put into effect. This move effectively reversed the ESA listing of the rusty patched. However, <a href=\"https:\/\/beyondpesticides.org\/dailynewsblog\/2017\/02\/trump-administration-sued-reversal-endangered-species-designation-rusty-patched-bumblebee\/\">NRDC quickly launched at lawsuit<\/a> to reinstate the designation, arguing that the delay in rulemaking illegally denied the species essential protections under the law.<\/p>\n<p>In <a href=\"https:\/\/beyondpesticides.org\/dailynewsblog\/2017\/03\/rusty-patched-bumblebee-listed-endangered\/\">March 2017, the species was finally placed onto the endangered list<\/a>, leading to NRDC dropping its initial lawsuit. This new court case responds to a lack of action after the initial designation. \u201cLimiting [the rusty patched bumblebee] to just a tiny sliver of the habitat where they once thrived not only limits the likelihood that the bees persist,\u201d <a href=\"https:\/\/www.nrdc.org\/media\/2018\/181218-0\">said<\/a> Daniel Raichel, a staff attorney for the Pollinator Initiative at NRDC. \u201cIt also fails to live up to the obligations of the Endangered Species Act.\u201d<\/p>\n<p>Unfortunately the Trump Administration\u2019s actions in this case are more of the norm rather than the exception. In August of last year, <a href=\"https:\/\/beyondpesticides.org\/dailynewsblog\/2018\/08\/trump-administration-reverses-ban-bee-toxic-pesticides-national-wildlife-refuges-california-confirms-neonicotinoid-pesticides-harm-bees\/\">DOI reversed a long-standing policy<\/a> that prohibited the use of systemic, bee-toxic <a href=\"https:\/\/www.beyondpesticides.org\/programs\/bee-protective-pollinators-and-pesticides\/what-the-science-shows\">neonicotinoid insecticides<\/a> on National Wildlife Refuges.
