In reference to widespread community bans of Roundup\/glyphosate, Cary Gillam, author of <em>Whitewash<\/em>, told last year\u2019s Beyond Pesticides\u2019 Forum, \u201cGlyphosate is the poster child for the bigger pesticide problem.\u201d She continues, \u201cIf it goes away tomorrow, we are not okay.\u201d Because of this, Beyond Pesticides has strategically sought to transform our country\u2019s approach to pest management, both agricultural and residential\/structural, by eliminating a reliance on pesticides and advancing organic management practices that do not rely on toxic inputs. This <a href=\"https:\/\/www.beyondpesticides.org\/resources\/daily-news\">Daily News Blog<\/a> post offers updates on progress in the European Union (EU), in the U.S. Congress, and in communities and sates nationwide.<\/p>\n<p>The EU is poised to ban <a href=\"https:\/\/www.beyondpesticides.org\/assets\/media\/documents\/pesticides\/factsheets\/Chlorothalonil.pdf\">clorothalanil,<\/a> a commonly used \u2014 and highly toxic \u2014 organochlorine fungicide, <em>The Guardian reported<\/em><em>,<\/em> in mid-to-late May 2019. After a <a href=\"https:\/\/efsa.onlinelibrary.wiley.com\/doi\/pdf\/10.2903\/j.efsa.2018.5126\">review by the European Food Safety Authority (EFSA),<\/a> EU states voted to approve a ban. EFSA identified as a chief safety concern the possibility that breakdown products (metabolites) of the compound may cause damage to DNA. The group also reported that for all identified uses, there is \u201ca high risk to amphibians.\u201d It further noted that recent research points to chlorothalonil (and other fungicides) as primary contributors to the alarming decline in bumblebee populations. The ban comes shortly after the <a href=\"https:\/\/beyondpesticides.org\/dailynewsblog\/2018\/01\/eu-set-special-oversight-committee-pesticides\/\">European Parliament\u2019s Special Committee<\/a>\u00a0(the PEST Committee) <a href=\"https:\/\/beyondpesticides.org\/dailynewsblog\/2019\/01\/eu-committee-of-parliament-calls-for-stiffer-pesticide-restrictions-total-overhaul-to-protect-health\/\">approval<\/a> of a\u00a0<a href=\"http:\/\/www.europarl.europa.eu\/sides\/getDoc.do?pubRef=-\/\/EP\/\/NONSGML+COMPARL+PE-627.625+01+DOC+PDF+V0\/\/EN&amp;language=EN\">draft report<\/a> recommending significant strengthening of pesticide restrictions.<\/p>\n<p><a href=\"https:\/\/archive.epa.gov\/pesticides\/reregistration\/web\/pdf\/0097red.pdf\">Chlorothalonil,<\/a> sold commercially under the names Bravo, Echo, and Daconil, is a broad- spectrum, non-systemic fungicide used to control fungal foliar diseases of vegetable, field, and ornamental crops; it is also deployed as a wood protectant, anti-mold and antimildew agent, bactericide, microbiocide, algaecide, insecticide, and acaricide. Its <a href=\"https:\/\/beyondpesticides.org\/dailynewsblog\/2017\/12\/fungicides-tied-declining-bumblebee-populations-united-states\/\">impacts on bumblebee<\/a> and <a href=\"https:\/\/beyondpesticides.org\/dailynewsblog\/2018\/01\/honey-bees-attracted-glyphosate-common-fungicide\/\">other bee populations<\/a> have been chronicled by Beyond Pesticides and others; the mechanism of action is strongly suspected to involve <a href=\"https:\/\/beyondpesticides.org\/dailynewsblog\/2016\/08\/pesticides-used-beekeepers-alter-honey-bee-microbiome\/\">disruption of the organisms\u2019 gut biomes<\/a>. The chemical is also regarded as a <a href=\"https:\/\/www.beyondpesticides.org\/assets\/media\/documents\/pesticides\/factsheets\/Chlorothalonil.pdf\">likely human carcinogen<\/a>.<\/p>\n<p>The United Kingdom\u2019s <a href=\"https:\/\/www.nfuonline.com\/\">National Farmers Union<\/a> reacted to this EU move by calling it \u201coverly precautionary,\u201d and warning that such a ban fails \u201cto consider the particular importance of this [pesticide] in the control of critical fungal diseases and in managing disease resistance. As a result, we believe sectors of UK agricultural and horticultural production will be put at significant risk.\u201d<\/p>\n<p>However, Mark Shardlow, director of the <a href=\"https:\/\/www.buglife.org.uk\/\">nonprofit Buglife,<\/a> supported the ban, saying that the fact that established links to bumblebee harm had not led to safety tests for wild bees showed the inadequacy of the EU\u2019s regulatory system. <a href=\"https:\/\/www.theguardian.com\/environment\/2019\/mar\/29\/eu-bans-widely-used-pesticide-over-safety-concerns\">He added,<\/a> \u201c[T]he EU process failed to apply the\u00a0<a href=\"https:\/\/www.efsa.europa.eu\/en\/press\/news\/130704\">EFSA guidance on assessing risk to bees<\/a>, so there were no bumblebee safety tests. When will regulators learn the lessons, [and] stop kowtowing to the demands of the pesticide manufacturers?\u201d<\/p>\n<p>A spokeswoman for the European Commission (EC), the executive branch of the EU, <a href=\"https:\/\/www.theguardian.com\/environment\/2019\/mar\/29\/eu-bans-widely-used-pesticide-over-safety-concerns\">defended the action, saying,<\/a> \u201cThe [chlorothalonil ban] is based on EFSA\u2019s\u00a0scientific assessment,\u00a0which concluded that the approval criteria do not seem to be satisfied for a wide range of reasons. Great concerns are raised in relation to contamination of groundwater by metabolites of the substance.\u201d<\/p>\n<p>Back across the pond, in the ongoing \u201cchlorpyrifos saga,\u201d Senator Tom Udall of New Mexico <a href=\"https:\/\/earthjustice.org\/news\/press\/2019\/sen-udall-senate-leaders-introduce-bill-to-ban-chlorpyrifos-nationwide\">introduced a bill in the U.S. Senate<\/a> on March 28, just one day after the current Environmental Protection Agency (EPA) once again argued to delay the agency\u2019s own 2016 ban on the compound, to ban the use of the toxic pesticide, chlorpyrifos. If passed and enacted, the <a href=\"https:\/\/www.tomudall.senate.gov\/imo\/media\/doc\/CPF%20Ban%20Bill%20Orgs.pdf\">Protect Children, Families and Farmworkers from Nerve Agent Pesticides Act of 2019<\/a> (S.921) would ban the compound, <a href=\"https:\/\/beyondpesticides.org\/assets\/media\/documents\/bp-37.4-w17-Chlorpyrifos-cited.pdf\">widely recognized as a dangerous neurotoxin that imperils human health, and puts children and farmworkers at particular risk.<\/a> <a href=\"https:\/\/beyondpesticides.org\/dailynewsblog\/category\/chemicals\/chlorpyrifos\/\">Chlorpyrifos<\/a> has impacts beyond its neurotoxicity; it is also associated with harmful effects on human endocrine, reproductive, hepatic, and renal function, is a skin and eye irritant, and distorts development. Cosponsors of the Senate bill include Senators Blumenthal, Booker, Cardin, Feinstein, Gillibrand, Harris, Leahy, Markey, Merkley, Sanders, Van Hollen, and Whitehouse.<\/p>\n<p>The chlorpyrifos saga began as far back as 2000, with an agreement between EPA and Dow AgroSciences, maker of the pesticide, to stop the sale of the chemical for most home, lawn, and garden uses because of its health risks to children, which proscription did happen. <a href=\"https:\/\/beyondpesticides.org\/dailynewsblog\/2015\/11\/epa-takes-long-awaited-action-to-eliminate-neurotoxic-chlorpyrifos-in-agriculture\/\">Fast forward to 2015,<\/a> when EPA proposed to eliminate all food tolerances for the compound \u2014 functionally, a ban \u2014 although other non-food uses, for landscape and turf management (especially golf courses), and for greenhouse and mosquito control were not affected by the decision. This proposal was made public on the very day that a U.S. Court of Appeals judge in the Ninth Circuit ordered the agency to respond, finally, to a suit filed nine years earlier petitioning for a ban on all uses of chlorpyrifos, given the established health risks of exposure. EPA dithered, ultimately promising to release a final rule in December 2016.<\/p>\n<p>In 2016, the agency did develop a regulation banning the compound. Then, in March 2017, Trump EPA Administrator Scott Pruitt, <a href=\"https:\/\/beyondpesticides.org\/dailynewsblog\/2017\/06\/dow-chemical-influence-epa-administrators-decision-reverse-chlorpyrifos-ban\/\">just three weeks after meeting \u201cprivately\u201d with the CEO of Dow chemical<\/a>, <a href=\"https:\/\/beyondpesticides.org\/dailynewsblog\/2017\/03\/epa-reverses-course-allows-continued-use-highly-neurotoxic-pesticide-chlorpyrifos\/\">rejected the conclusions of EPA\u2019s own scientists<\/a> and <a href=\"https:\/\/beyondpesticides.org\/dailynewsblog\/2017\/03\/epa-reverses-course-allows-continued-use-highly-neurotoxic-pesticide-chlorpyrifos\/\">announced that EPA would reverse course and not ban<\/a> the use of chlorpyrifos on food crops. Last August, the Ninth Circuit Court once again weighed in, <a href=\"https:\/\/beyondpesticides.org\/dailynewsblog\/2019\/01\/help-get-neurotoxic-pesticide-chlorpyrifos-out-of-agriculture\/\">ordering EPA to implement its previous proposed ban<\/a> of the chemical in the U.S.<\/p>\n<p>Andrew Wheeler, the EPA Administrator who followed Mr. Pruitt, soon after asked the court to rehear the chlorpyrifos case in an <em>en banc<\/em> proceeding \u2014 one in which a case is heard before all the judges of a court rather than by a selected panel of them. (The request is based primarily on challenges to that court\u2019s authority in the matter.) In February 2019, <a href=\"https:\/\/earthjustice.org\/news\/press\/2019\/wheeler-s-epa-keeps-brain-damaging-chlorpyrifos-in-food-for-now\">the court granted the request,<\/a> meaning that public health, labor, and science advocates will have to re-argue, again, that chlorpyrifos should be banned from all food uses. In the wake of this protracted delay, legislators such as Senator Udall have begun to pick up the mantle, given EPA\u2019s failure to protect the public from this toxic and dangerous compound.<\/p>\n<p>Over on the U.S. House side, <a href=\"https:\/\/beyondpesticides.org\/dailynewsblog\/2019\/01\/help-get-neurotoxic-pesticide-chlorpyrifos-out-of-agriculture\/\">Representative Nydia Vel\u00e1zquez of New York filed a bill in January, the Ban Toxic Pesticides Act (HR.230),<\/a> which would ban chlorpyrifos from any commerce in the state. These Senate and House bills follow on previous iterations filed by Sen. Udall and Rep. Vel\u00e1zquez, as well as other legislative initiatives, chronicled <a href=\"https:\/\/beyondpesticides.org\/dailynewsblog\/2019\/01\/help-get-neurotoxic-pesticide-chlorpyrifos-out-of-agriculture\/\">here.<\/a> <a href=\"https:\/\/beyondpesticides.org\/dailynewsblog\/2019\/01\/help-get-neurotoxic-pesticide-chlorpyrifos-out-of-agriculture\/\">Rep. Vel\u00e1zquez said of the bill,<\/a> \u201cIt\u2019s unconscionable for EPA to turn a blind eye as children and workers are exposed to this poison. If the EPA won\u2019t do its job when it comes to chlorpyrifos, then Congress needs to act \u2014 and do so quickly. As long as there are efforts underway in the courts or administratively to undo the ban on this toxic pesticide, I\u2019ll be working to see chlorpyrifos removed from commerce through the legislative process.\u201d<\/p>\n<p>Momentum is growing for better protection from pesticide use, as these examples and others demonstrate. But ultimately, the widespread adoption of <a href=\"https:\/\/www.beyondpesticides.org\/organicfood\/index.php\">organic management<\/a>\u00a0practices is what will provide genuine and long-term protection of human and environmental health from compounds like chlorpyrifos and chlorothalonil.
