The jury found that Monsanto \u201cengaged in conduct with malice, oppression or fraud committed by one or more officers, directors or managing agents of Monsanto.\u201d<\/span><\/p>\n<p style=\"-webkit-text-stroke-width: 0px; word-spacing: 0px;\"><span style=\"font-family: 'Georgia',serif; color: #333333;\">Plaintiffs Alva and Alberta Pilliod, a married couple in their seventies, used Roundup weed killer since the 1970s to maintain their yard and other owned properties. The couple did not wear protective gear when using Roundup because Monsanto marketed the product as \u201csafe.\u201d Alva was diagnosed with non-Hodgkin\u2019s lymphoma (NHL) in 2011; Alberta\u2019s diagnosis followed in 2015.<\/span><\/p>\n<p style=\"-webkit-text-stroke-width: 0px; word-spacing: 0px;\"><span style=\"font-family: 'Georgia',serif; color: #333333;\">The <em><span style=\"font-family: 'Georgia',serif;\">Pilliod v. Monsanto<\/span><\/em> jury came to their decision based on evidence, not only of the herbicide\u2019s carcinogenicity, but also of Monsanto\u2019s role in suppressing and discredit.ing independent findings regarding Roundup toxicity. In an interview with U.S. Right to Know&#8217;s Carey Gillam, co-lead trial counsel Michael Miller said, \u201cUnlike the first two Monsanto trials, where the judges severely limited the amount of plaintiffs\u2019 evidence, we were finally allowed to show a jury the mountain of evidence showing Monsanto\u2019s manipulation of science, the media and regulatory agencies to forward their own agenda despite Roundup\u2019s severe harm to the animal kingdom and humankind.\u201d<\/span><\/p>\n<p style=\"-webkit-text-stroke-width: 0px; word-spacing: 0px;\"><span style=\"font-family: 'Georgia',serif; color: #333333;\">That glyphosate-based herbicides cause cancer is by now a matter of scientific consensus. In 2015, the World Health Organization\u2019s International Agency for Research on Cancer (IARC) <a href=\"https:\/\/beyondpesticides.org\/dailynewsblog\/2015\/03\/glyphosate-classified-carcinogenic-by-international-cancer-agency-group-calls-on-u-s-to-end-herbicides-use-and-advance-alternatives\/\" target=\"_blank\" rel=\"noopener\">found glyphosate to be a probable human carcinogen<\/a>. In response to resistance from the European Food Safety Authority, 94 expert scientists published <a href=\"https:\/\/jech.bmj.com\/content\/70\/8\/741.long\">an article<\/a> in support of IARC\u2019s methodologies and findings. Since 2015, several more publications have added significant weight to the body of evidence supporting glyphosate\u2019s carcinogenicity. A <a href=\"https:\/\/beyondpesticides.org\/dailynewsblog\/2019\/02\/study-confirms-findings-on-carcinogenic-glyphosate-suggests-compelling-link\/\">2018 meta-analysis<\/a> of studies on glyphosate suggested \u201ca compelling link between exposures to GBH [glyphosate-based herbicides] and increased risk of NHL [non-Hodgkin lymphoma]. A <a href=\"https:\/\/beyondpesticides.org\/dailynewsblog\/2019\/02\/study-confirms-findings-on-carcinogenic-glyphosate-suggests-compelling-link\/\">2019 University of Washington study<\/a> found that glyphosate exposure increases the risk of non-Hodgkin lymphoma by as much as 41%. As of July 7, 2017, <a href=\"https:\/\/beyondpesticides.org\/dailynewsblog\/2018\/04\/court-affirms-listing-glyphosate-probable-carcinogen\/\" target=\"_blank\" rel=\"noopener\">glyphosate is listed<\/a> as a cancer-causing chemical under California\u2019s Safe Drinking Water and Toxic Enforcement Act of 1986 (Proposition 65). This requires cancer warning labels be placed on end-use glyphosate products in California.<\/span><\/p>\n<p style=\"-webkit-text-stroke-width: 0px; word-spacing: 0px;\"><span style=\"font-family: 'Georgia',serif; color: #333333;\">The Pilliod trial adds to the growing list of major wins for plaintiffs suffering from cancer caused by Monsanto\u2019s \u201cmalice, oppression or fraud.\u201d In the summer of 2018, California groundskeeper Dewayne Johnson <a href=\"https:\/\/beyondpesticides.org\/dailynewsblog\/2018\/08\/groundskeeper-used-monsantos-herbicide-roundup-contracted-cancer-non-hodgkin-lymphoma-nhl-wins-289-million-jury-verdict\/\" target=\"_blank\" rel=\"noopener\">won a $289 million jury verdict against Monsanto<\/a> for his development of NHL after consistent exposure to Roundup. The jury awarded him $39 million in compensatory damages, and $250 million in punitive damages, finding that Monsanto acted with \u201cmalice or oppression.\u201d <a href=\"https:\/\/beyondpesticides.org\/dailynewsblog\/2018\/10\/judge-reduces-award-but-upholds-verdict-in-roundup-case-against-bayers-monsanto\/\" target=\"_blank\" rel=\"noopener\">That amount was later amended<\/a> by the judge to a total $78 million. In the second federal court case, again in California, <a href=\"https:\/\/beyondpesticides.org\/dailynewsblog\/2019\/03\/a-second-jury-delivers-blow-to-monsantos-claim-that-glyphosate-roundup-is-safe\/\" target=\"_blank\" rel=\"noopener\">the jury found unanimously<\/a> that Edwin Hardeman\u2019s development of NHL was substantially caused by\u00a0Roundup.<\/span><\/p>\n<p style=\"-webkit-text-stroke-width: 0px; word-spacing: 0px;\"><span style=\"font-family: 'Georgia',serif; color: #333333;\">More so than previous trials, the Pilliod trial highlighted evidence for collusion between Monsanto and top EPA officials to defend against the onslaught of Roundup cancer trials. Jurors were presented with communications uncovered through a <a href=\"https:\/\/www.huffpost.com\/entry\/collusion-or-coincidence-records-show-epa-efforts_b_5994dad4e4b056a2b0ef02f1?guccounter=1&amp;guce_referrer=aHR0cHM6Ly91c3J0ay5vcmcvbW9uc2FudG8tcm91bmR1cC10cmlhbC10cmFja2VyLWluZGV4Lw&amp;guce_referrer_sig=AQAAAMWBYaq5qS_pTV0q7UIJfghI2dGm92VBUCwVGzgdBBczhpg9ptjb58YtqaJ2DRgTqV2hTo8AxJXLvnSH1vFu5zSl5_BHhMt3rzMNUhAahqODJjBRCtVO9xQBe7BWMCmZsjZvGqjU9UjobOGgmuT7C7B8-flCPSJegWhg8C15MlKI\" target=\"_blank\" rel=\"noopener\">2017 FOIA request<\/a>, in which EPA officials responded to requests from Monsanto to effect a delay in the 2015 Agency for Toxic Substances and Disease Registry review of glyphosate. The Pilliods&#8217; attorneys also presented new documents, including a report attached to a July 2018 email between the strategic intelligence firm Hayklut and Monsanto. As covered by U.S. Right to Know, the report includes the reassurance,<\/span><\/p>\n<p style=\"margin-left: .5in; -webkit-text-stroke-width: 0px; word-spacing: 0px;\"><span style=\"-webkit-text-stroke-width: 0px; cursor: text; float: none; word-spacing: 0px;\"><span style=\"font-family: 'Georgia',serif; color: #333333; background: white;\">\u201cA domestic policy adviser at the White House said, for instance: \u2018We have Monsanto\u2019s back on pesticides regulation. We are prepared to go toe-to-toe on any disputes they may have with, for example, the EU. Monsanto need not fear any additional regulation from this administration.\u201d<\/span><\/span><\/p>\n<p style=\"-webkit-text-stroke-width: 0px; word-spacing: 0px;\"><span style=\"font-family: 'Georgia',serif; color: #333333;\">In spite of mounting consensus on Roundup\u2019s carcinogenicity, on May 8,\u00a0EPA <a href=\"https:\/\/beyondpesticides.org\/dailynewsblog\/2019\/05\/contradicting-scientific-evidence-epa-releases-interim-decision-denying-glyphosate-carcinogenicity\/\" target=\"_blank\" rel=\"noopener\">released a proposed interim decision<\/a> for glyphosate\u2019s registration review stating that glyphosate is \u201cnot likely to be carcinogenic to humans.\u201d In a statement expressing its intent to appeal the case, Bayer referenced that the jury verdict \u201cconflicts directly with the U.S. Environmental Protection Agency\u2019s interim registration review decision released just last month.\u201d<\/span><\/p>\n<p style=\"-webkit-text-stroke-width: 0px; word-spacing: 0px;\"><span style=\"font-family: 'Georgia',serif; color: #333333;\">\u201cThe fact that multiple federal cases have found that Roundup caused plaintiffs\u2019 cancer is a testament to the weight of independent scientific evidence supporting the link between glyphosate-based herbicides and NHL,\u201d said Sarah Bluher, science and regulatory manager at Beyond Pesticides. &#8220;EPA&#8217;s failure to acknowledge that weight of evidence, and their active role in protecting Monsanto\u2019s financial interests, are a threat to national public health,\u201d Ms. Bluher continued.<\/span><\/p>\n<p style=\"-webkit-text-stroke-width: 0px; word-spacing: 0px;\"><em><span style=\"font-family: 'Georgia',serif; color: #333333;\">Pilliod v. Monsanto<\/span><\/em><span style=\"font-family: 'Georgia',serif; color: #333333;\"> is the first of more than 250 consolidated California Roundup cases to proceed to trial. The jury found that Monsanto \u201cengaged in conduct with malice, oppression or fraud committed by one or more officers, directors or managing agents of Monsanto.\u201d Plaintiffs Alva and Alberta Pilliod, a married couple in their seventies, used Roundup weed killer since the 1970s to maintain their yard and other owned properties. The couple did not wear protective gear when using Roundup because Monsanto marketed the product as \u201csafe.\u201d Alva was diagnosed with non-Hodgkin\u2019s lymphoma (NHL) in 2011; Alberta\u2019s diagnosis followed in 2015.
