Ignoring <a href=\"https:\/\/www.beyondpesticides.org\/resources\/pesticide-gateway?pesticideid=168\">documented<\/a> threats to pollinators, the U.S. Environmental Protection Agency (EPA) could finalize its interim approval for flonicamid, a bee-toxic pesticide. Separately, EPA may reapprove the disinfectant ethylene oxide (EtO), despite concerns over carcinogenicity. NYU Law is tracking these and other last-minute federal environmental decisions on its webpage <a href=\"https:\/\/www.law.nyu.edu\/center\/state-impact\/midnight-watch\/safety-toxics\">Midnight Watch<\/a>.<\/p>\r\n<p>EPA\u00a0<a href=\"https:\/\/www.govinfo.gov\/content\/pkg\/FR-2020-09-02\/pdf\/2020-19374.pdf\">proposed<\/a>\u00a0an interim reregistration decision for flonicamid in September 2020. California Attorney General Xavier Becerra has been highly and publicly critical of the agency\u2019s approach on this chemical. In <a href=\"https:\/\/oag.ca.gov\/sites\/default\/files\/FINAL%20Flonicamid%20PID%20Comment%20Letter.pdf\">a public comment<\/a>, Becerra wrote that EPA did not collect data from required follow-up studies regarding the impact of flonicamid on pollinators. EPA\u2019s own risk assessment states that a \u201cfull assessment of pollinator risk cannot be conducted until data are available.\u201d<\/p>\r\n<p>AG Becerra stated, \u201cThe Trump Administration&#8217;s EPA is failing at one of\u00a0its\u00a0most\u00a0basic jobs by plowing ahead with the\u00a0registration process for flonicamid\u00a0before receiving\u00a0additional data on its\u00a0impact to pollinators like bees.\u201d He continued, \u201cCalifornia relies on pollination from bees for\u00a0agriculture, a driving force of our state&#8217;s\u00a0economy. We cannot\u00a0ignore the environmental and economic implications of this decision\u00a0\u2013\u00a0and the EPA cannot ignore its responsibilities under\u00a0the law.\u00a0The EPA must do its homework\u00a0before it allows flonicamid to be used for another 15 years.\u201d<\/p>\r\n<p>EtO is used to fumigate some agricultural products and sterilize medical equipment. The Occupational Safety and Health Administartion (<a href=\"https:\/\/www.osha.gov\/ethylene-oxide\">OSHA<\/a>) lists its many concerning hazards: \u201cEtO is both flammable and highly reactive. Acute exposures to EtO gas may result in respiratory irritation and lung injury, headache, nausea, vomiting, diarrhea, shortness of breath, and cyanosis. Chronic exposure has been associated with the occurrence of cancer, reproductive effects, mutagenic changes, neurotoxicity, and sensitization.\u201d<\/p>\r\n<p>On November 20, EPA\u00a0<a href=\"https:\/\/www.govinfo.gov\/content\/pkg\/FR-2020-11-20\/pdf\/2020-25821.pdf\">released<\/a>\u00a0a\u00a0<a href=\"https:\/\/www.epa.gov\/sites\/production\/files\/2020-11\/documents\/d458706-eto-final-dra-nov-3-2020.pdf\">draft risk assessment<\/a> for ethylene oxide. The risk assessment fails to endorse a definitive method for evaluating cancer risks. Instead, some of the range of methods it provides suggest that EtO\u2019s potential to be carcinogenic is lower than what is estimated by EPA\u2019s independent Integrated Risk Information System (IRIS) program. EPA is accepting public\u00a0<a href=\"https:\/\/www.regulations.gov\/document?D=EPA-HQ-OPP-2013-0244-0022\">comments<\/a>\u00a0on the draft risk assessment until January 19, 2021.<\/p>\r\n<p>EPA\u2019s mission to protect human health and the environment has been compromised by an administration that rather blatantly prioritizes corporate gain, according to advocates. Some current EPA employees are <a href=\"https:\/\/www.nytimes.com\/2020\/11\/27\/climate\/epa-trump-biden.html\">holding the line against last minute changes<\/a> driven by EPA Administrator Andrew Wheeler et al. However, it is possible these decisions on toxics will be pushed through and there will be 15 more years before the public has a chance to stop them from continuing to harm pollinators and\/or people.<\/p>\r\n<p>Besides participating in the public comment period, there are some actions you can take as an advocate.
