The action follows a slew of developments related to <a href=\"https:\/\/www.beyondpesticides.org\/assets\/media\/documents\/journal\/bp-37.2-su17%20Glysophate-final.pdf\">the herbicide<\/a>, including: the 2015 International Agency for Research on Cancer\u2019s <a href=\"https:\/\/beyondpesticides.org\/dailynewsblog\/2015\/03\/glyphosate-classified-carcinogenic-by-international-cancer-agency-group-calls-on-u-s-to-end-herbicides-use-and-advance-alternatives\/\">declaration of its carcinogenicity<\/a>; <a href=\"https:\/\/beyondpesticides.org\/dailynewsblog\/2019\/05\/jury-awards-2-billion-for-damages-in-third-federal-roundup-cancer-case\/\">legal judgments and massive rewards<\/a> to victims who developed cancers after chronic exposures; advocate efforts to get EPA to recognize the dangers of, and curtail, its use; and pushback from industry \u2014 most of the latter two coming in the form of litigation. The withdrawal of that Interim Decision means, on the ground that this harmful compound can continue to be used until a next regulatory review decision by EPA. Beyond Pesticides has long been engaged in education on and advocacy against glyphosate use, and <a href=\"https:\/\/beyondpesticides.org\/dailynewsblog\/2020\/03\/farmworkers-and-conservationists-sue-epa-for-re-approving-monsanto-bayers-cancer-causing-pesticide-glyphosate-roundup\/\">was a plaintiff in the 2020 lawsuit<\/a>, with the Center for Food Safety (CFS), et al., against EPA for this <a href=\"https:\/\/beyondpesticides.org\/dailynewsblog\/2019\/05\/contradicting-scientific-evidence-epa-releases-interim-decision-denying-glyphosate-carcinogenicity\/\">2020 Interim Decision<\/a> (ID).<\/p>\r\n<p>Under <a href=\"https:\/\/www.epa.gov\/laws-regulations\/summary-federal-insecticide-fungicide-and-rodenticide-act#:~:text=The%20Federal%20Insecticide%2C%20Fungicide%2C%20and%20Rodenticide%20Act%20(FIFRA),registered%20(licensed)%20by%20EPA.\">FIFRA<\/a> (the Federal Insecticide, Fungicide and Rodenticide Act) each pesticide must be reviewed by EPA every 15 years \u201cto ensure that existing pesticide products continue to perform their intended function without unreasonable adverse effects on human health or the environment.\u201d Glyphosate\u2019s review was begun in 2009. Such reviews have multiple aspects, which is why <a href=\"https:\/\/www.epa.gov\/pesticides\/epa-withdraws-glyphosate-interim-decision\">EPA says, in its press release<\/a>, that it \u201cis announcing its withdrawal of all remaining portions of the interim registration review decision.\u201d<\/p>\r\n<p>Comprehensive coverage, by Beyond Pesticides, of the risks associated with the use of glyphosate (Roundup) herbicides can be found <a href=\"https:\/\/www.beyondpesticides.org\/assets\/media\/documents\/journal\/bp-37.2-su17%20Glysophate-final.pdf\">here<\/a>, <a href=\"https:\/\/www.beyondpesticides.org\/assets\/media\/documents\/bp-38.1-sp18-Glysophate.pdf\">here<\/a>, and <a href=\"https:\/\/beyondpesticides.org\/dailynewsblog\/category\/chemicals\/glyphosate\/\">here<\/a>. <a href=\"https:\/\/www.epa.gov\/ingredients-used-pesticide-products\/glyphosate\">EPA\u2019s webpage on glyphosate<\/a> offers multiple assertions and justifications for its ongoing allowance of use of glyphosate-based herbicides, as well as a history of EPA actions and regulations. Among its claims, based on \u201cindependent evaluation of available data for glyphosate\u201d are these findings related to human health: (1) no risks of concern to human health from current uses of glyphosate; (2) no indication that children are more sensitive to glyphosate; and (3) no evidence that glyphosate causes cancer in humans.<\/p>\r\n<p><a href=\"https:\/\/www.epa.gov\/ingredients-used-pesticide-products\/glyphosate\">EPA\u2019s Interim Decision on glyphosate likewise asserted<\/a> that \u201cthere are no risks of concern to human health when glyphosate is used in accordance with its current label. EPA also found that glyphosate is unlikely to be a human carcinogen.\u201d It did assert that there are \u201cpotential ecological risks to non-target organisms, primarily non-target plants through spray drift,\u201d and pointed to anemic text changes as a fix \u2014 \u201cinterim risk mitigation measures in the form of label changes, including spray drift management language, herbicide resistance management language, a non-target organism advisory, and certain label consistency measures.\u201d The ID came down, <a href=\"https:\/\/beyondpesticides.org\/dailynewsblog\/2021\/07\/epa-agenda-undermined-by-its-embrace-of-industry-influence-article-documents\/\">once again, on the side of industry<\/a> and the status quo in concluding that \u201cthe benefits of glyphosate outweigh the potential ecological risks when glyphosate is used in accordance with labels.\u201d<\/p>\r\n<p><a href=\"https:\/\/beyondpesticides.org\/dailynewsblog\/2020\/02\/epa-set-to-reapprove-cancer-causing-glyphosate-and-bee-toxic-neonicotinoids\/\">As Beyond Pesticides wrote at the time<\/a>, \u201cEPA reapproval of\u00a0<a href=\"https:\/\/beyondpesticides.org\/dailynewsblog\/2015\/03\/glyphosate-classified-carcinogenic-by-international-cancer-agency-group-calls-on-u-s-to-end-herbicides-use-and-advance-alternatives\/\">human carcinogens<\/a>\u00a0and\u00a0<a href=\"https:\/\/beyondpesticides.org\/programs\/bee-protective-pollinators-and-pesticides\/bee-protective\">chemicals contributing to the pollinator crisis<\/a>\u00a0is disappointing for health and environmental advocates, but not surprising to those watchdogging the agency. . . . \u2018This is how a captured agency behaves,\u2019 said Beyond Pesticides community resource and policy director Drew Toher. \u2018When EPA\u2019s decision making repeatedly reflects the exact wishes of the chemical industry, public trust erodes, and we must look to new policy mechanisms that support the protection of health and the environment.\u2019\u201d<\/p>\r\n<p>The final Interim Decision was challenged in 2020 by the <a href=\"https:\/\/beyondpesticides.org\/dailynewsblog\/2020\/03\/farmworkers-and-conservationists-sue-epa-for-re-approving-monsanto-bayers-cancer-causing-pesticide-glyphosate-roundup\/\">lawsuit brought by CFS, Beyond Pesticides<\/a>, and several farmworker organizations to the U.S. Court of Appeals for the Ninth Circuit. <a href=\"https:\/\/beyondpesticides.org\/dailynewsblog\/2020\/03\/farmworkers-and-conservationists-sue-epa-for-re-approving-monsanto-bayers-cancer-causing-pesticide-glyphosate-roundup\/\">Plaintiffs argued that<\/a>:<br \/>\r\n\u2022 EPA\u2019s finding that \u201cglyphosate is not likely to be carcinogenic to humans\u201d flies in the face of both IARC and independent scientific research, as well as the <a href=\"https:\/\/beyondpesticides.org\/dailynewsblog\/2021\/11\/ca-supreme-court-upholds-87m-award-in-glyphosate-damage-lawsuit-bayer-monsanto-challenge-fails\/\">tens of thousands of lawsuits<\/a>, some extremely successful, brought by glyphosate victims.<\/p>\r\n<ul>\r\n\t<li>The agency has failed to evaluate thoroughly the <a href=\"https:\/\/www.beyondpesticides.org\/assets\/media\/documents\/pesticides\/factsheets\/bp.glyphosate.082017.pdf\">endocrine and hormone-disrupting impacts<\/a> of exposures to glyphosate.<\/li>\r\n\t<li>EPA violated the <a href=\"https:\/\/www.fisheries.noaa.gov\/national\/endangered-species-conservation\/endangered-species-act#:~:text=The%20Endangered%20Species%20Act%20of,habitats%20both%20domestically%20and%20abroad.\">Endangered Species Act<\/a> (ESA) by failing to conduct effective assessment of the effects of the compound on threatened and endangered species and their habitats, as is required under FIFRA and ESA.<\/li>\r\n\t<li>EPA has not done adequate analysis of human health impacts, e.g., it has not gathered and evaluated data on the ingestion (via skin or inhalation) of glyphosate \u2014 the most common exposure vectors among farmworkers and others who work with or around the herbicide. (<a href=\"https:\/\/beyondpesticides.org\/dailynewsblog\/2022\/07\/four-out-of-five-people-in-u-s-contaminated-with-glyphosate\/\">Beyond Pesticides noted the ubiquity<\/a> of the compound\u2019s presence in humans when it covered research showing that more than 80% of people in the U.S. above the age of six have detectable levels in their urine.)<\/li>\r\n<\/ul>\r\n<p>In 2021, EPA sought, in response, the somewhat unusual \u201cwork-around\u201d of a partial voluntary \u201cremand without vacatur\u201d \u2014 a judicial remedy that permits agency orders or rules to remain in effect after they are remanded by the reviewing court for further agency proceedings \u2014 for the ecological portion of the ID. In June 2022, the <a href=\"https:\/\/beyondpesticides.org\/dailynewsblog\/2022\/06\/supreme-court-lets-stand-large-jury-verdicts-on-roundup-appeals-court-finds-epa-registration-unlawful\/\">Ninth Circuit vacated the portion of the ID<\/a> related to human health, finding that EPA\u2019s cancer analysis was flawed.<\/p>\r\n<p><a href=\"https:\/\/beyondpesticides.org\/dailynewsblog\/2022\/06\/supreme-court-lets-stand-large-jury-verdicts-on-roundup-appeals-court-finds-epa-registration-unlawful\/\">The court commented<\/a>, \u201cEPA did not adequately consider whether glyphosate causes cancer.\u201d Beyond Pesticides, in covering that development, <a href=\"https:\/\/beyondpesticides.org\/dailynewsblog\/2022\/06\/supreme-court-lets-stand-large-jury-verdicts-on-roundup-appeals-court-finds-epa-registration-unlawful\/\">wrote<\/a>, \u201cThe court criticized EPA for its \u2018disregard of tumor results\u2019; its use of \u2018bare assertions\u2019 that \u2018fail to account coherently for the evidence\u2019; making conclusions that do not \u2018withstand scrutiny under the agency\u2019s own framework\u2019; and \u2018fail[ing] to abide by\u2019 its cancer guidelines. In sum, the court noted EPA\u2019s \u2018inconsistent reasoning\u2019 made its decision on cancer \u2018arbitrary,\u2019 and struck it down.\u201d<\/p>\r\n<p>The court also ruled that EPA\u2019s Interim Decision triggered obligations under the ESA, and granted the request for remand without vacatur for the ecological portion, but gave EPA a deadline of October 1, 2022 for issuance of a new ecological section. In August, the court denied EPA\u2019s \u201crequest for relief\u201d from that deadline. The agency now maintains that it could not possibly meet the deadline, and thus, has withdrawn the Interim Decision.<\/p>\r\n<p><a href=\"https:\/\/www.epa.gov\/pesticides\/epa-withdraws-glyphosate-interim-decision\">EPA now says<\/a> it plans to \u201crevisit and better explain its evaluation of the carcinogenic potential of glyphosate and to consider whether to do so for other aspects of its human health analysis. For the ecological portion, EPA intends to address the issues for which it sought remand, including: to consider whether additional or different risk mitigation may be necessary based on the outcome of ESA consultation for glyphosate, prepare an analysis of in-field effects of glyphosate on monarch butterfly habitat, consider whether there are other aspects of its analysis of ecological risks and costs to revisit, and consider what risk mitigation measures may be necessary to reduce potential risk following completion of analyses left outstanding in the ID. EPA also intends to complete ESA consultation with the Services [the U.S. Fish and Wildlife Service and the National Oceanic and Atmospheric Administration\u2019s National Marine Fisheries Service], make a determination under the Endocrine Disruptor Screening Program, and respond to an administrative petition regarding glyphosate before issuing a final registration review decision.\u201d<\/p>\r\n<p>The agency\u2019s registration review of glyphosate began in 2009; in its memorandum on withdrawal of the ID, <a href=\"https:\/\/www.regulations.gov\/document\/EPA-HQ-OPP-2009-0361-14447\">EPA wrote that it<\/a> \u201canticipates issuing a final registration review decision for glyphosate in 2026.\u201d That represents, potentially, a 17-year period in which use of a harmful herbicide would have continued to be allowed because of EPA\u2019s relative intransigence. This begs the question: how many additional non-Hodgkin Lymphoma cases, or other harms might EPA\u2019s inability and\/or unwillingness to act timely and protectively have allowed? The appellate court\u2019s rejection of the ID <a href=\"https:\/\/beyondpesticides.org\/dailynewsblog\/2022\/06\/after-court-finds-epa-inaction-unlawful-its-time-for-the-agency-to-ban-glyphosate\/\">should have impelled EPA<\/a> to cancel glyphosate\u2019s registration. But there is currently no indication that EPA will respond protectively to the documented threats to <a href=\"https:\/\/beyondpesticides.org\/dailynewsblog\/2022\/03\/epa-overlooks-glyphosate-and-roundup-ingredients-cancer-dna-damage-and-multigenerational-effects\/\">human health<\/a>, <a href=\"https:\/\/www.beyondpesticides.org\/assets\/media\/documents\/journal\/bp-37.2-su17%20Glysophate-final.pdf\">pollinators<\/a>, <a href=\"https:\/\/beyondpesticides.org\/dailynewsblog\/2021\/01\/long-term-roundup-exposure-found-to-harm-keystone-wildlife-species\/\">wildlife<\/a>, and <a href=\"https:\/\/beyondpesticides.org\/dailynewsblog\/2021\/10\/glyphosate-kills-microorganisms-beneficial-to-plants-animals-and-humans\/\">ecosystems<\/a>, and ultimately \u2014 years from now \u2014 take that action.<\/p>\r\n<p>Beyond Pesticides believes that EPA should acknowledge the significant risks of glyphosate use, as shown repeatedly by science, affirmed in some respects by the courts, and recognized by juries who have penalized industry for harms to human health. A responsible way to do that would be to issue a final registration review decision <a href=\"https:\/\/beyondpesticides.org\/dailynewsblog\/2022\/06\/after-court-finds-epa-inaction-unlawful-its-time-for-the-agency-to-ban-glyphosate\/\">canceling the use of this noxious compound<\/a> \u2014 the sooner the better.<\/p>\r\n<p><a href=\"https:\/\/beyondpesticides.org\/dailynewsblog\/2022\/06\/after-court-finds-epa-inaction-unlawful-its-time-for-the-agency-to-ban-glyphosate\/\">Beyond Pesticides wrote in June<\/a>: \u201cEvidence is mounting against glyphosate, with research showing disruption of bumblebee reproduction, negative impacts on the gut microbiome, increased greenhouse gas emissions, oxidative stress and DNA damage, body burdens, threats to endangered species, and more. If EPA is to convince citizens that it is worthy of the job entrusted to it and not captured by the pesticide industry \u2014 in particular, Bayer\/Monsanto \u2014 it must do a thorough review of all the evidence that finds glyphosate to be carcinogenic. The action follows a slew of developments related to the herbicide, including: the 2015 International Agency for Research on Cancer\u2019s declaration of its carcinogenicity; legal judgments and massive rewards to victims who developed cancers after chronic exposures; advocate efforts to get EPA to recognize the dangers of, and curtail, its use; and pushback from industry \u2014 most of the latter two coming in the form of litigation. The withdrawal of that Interim Decision means, on the ground that this harmful compound can continue to be used until a next regulatory review decision by EPA. Beyond Pesticides seeks to protect healthy air, water, land, and food for ourselves and future generations. By forging ties with governments, nonprofits, and people who rely on these natural resources, we reduce the need for unnecessary pesticide use and protect public health and the environment. Beyond Pesticides provides hands-on services to the public and supports local action by: identifying and interpreting hazards; and, designing safe pest management programs. With the information provided by Beyond Pesticides, people may not only be able to make informed choices and adopt practices that protect themselves and their families from unnecessary exposure to pesticides, but they will be able to effect changes on community-wide pest management decisions and policies that govern pesticide use, such as pesticide uses in parks, schools, for community insect control and along roadsides.
