Beyond Pesticides, along with allied organizations and organic advocates, is urging USDA to use this process to clarify the need for USDA to collect key information needed to verify compliance with key language in OFPA (<a href=\"https:\/\/www.govinfo.gov\/content\/pkg\/USCODE-2022-title7\/pdf\/USCODE-2022-title7-chap94-sec6513.pdf\">Section 6513(b)<\/a>)\u2014a provision that requires farming practices that \u201cfoster soil fertility.\u201d<\/p>\r\n<p>Advocates maintain that information on organic farmers\u2019 practices to foster soil fertility, required in the law, is critical to organic integrity, public trust in the organic label, and certifier responsibility. As USDA states, \u201cThe Organic Foods Production Act of 1990 (OFPA), as amended (<a href=\"https:\/\/www.govinfo.gov\/link\/uscode\/7\/6501\">7 U.S.C. 6501\u20136524<\/a>), authorized the Secretary of Agriculture to establish the National Organic Program (NOP) and accredit certifying agents to certify that farms and businesses meet national organic standards. Under OFPA, the purpose of the NOP is to: (1) establish national standards governing the marketing of certain agricultural products as organically produced products; (2) assure consumers that organically produced products meet a consistent standard; and (3) facilitate interstate commerce in fresh and processed food that is organically produced (<a href=\"https:\/\/www.govinfo.gov\/link\/uscode\/7\/6501\">7 U.S.C. 6501<\/a>).\u201d<\/p>\r\n<p>Advocates cite a failure of NOP to consistently require the collection of information on soil-building practices for certification of organic farms, which they say presents a serious threat to organic integrity and compliance with organic law. As a result of this failure, some growers using hydroponic and other practices that do not build the soil are allowed to sell produce as organic. And, consumers are not able to distinguish growing practices because produce is not required to be labeled as \u201chydroponic\u201d or \u201ccontainer-grown.\u201d<\/p>\r\n<p><a href=\"https:\/\/beyondpesticides.org\/dailynewsblog\/2020\/01\/study-highlights-lasting-benefits-of-organic-practices-on-soil-health-and-crop-productivity\/\">Organic farming and soil<\/a> are inextricably linked. The microorganisms in healthy soils interact in a symbiotic manner with plant roots, strengthening the plant, enabling it to resist diseases and facilitating water and mineral uptake. The essence of organic production is maintaining and enhancing the organic matter content of soil by relying on environmentally beneficial methods such as green manure, crop rotation, and biological pest management.<\/p>\r\n<p><strong><a href=\"https:\/\/secure.everyaction.com\/edeIiqf_ME6xRA6PWuCreA2?contactdata=Y5tXAtRfR0rfuqmDuvK0jsGJEfrISPql+FR4ut%2f6dLjsKC1Lz2heqd5o7GgskuYvxUpDKkOtVoEH8ChJVP140lNZJaf%2fru8wCDWgsHmxvbOH1YioWA8H1aoPtZwtzEAEZ1YgRI9lucIw7ZL5Z%2fylEBPyqSmrXPmLELqca5duql4k87MG3oDp1Cx+vHUqhdE5fklEsS7%2fEtwrsAy9Yz8Uho2g7Osp+AQ9L45ZynvL56RobNcyFKgyNnYg%2fOJOHQretaa02a6T2VX%2fwTdHhJL00Q%3d%3d&amp;quick=true&amp;emci=bf5c8416-f4b6-ee11-bea1-0022482237da&amp;emdi=982f3412-16b7-ee11-bea1-0022482237da&amp;ceid=76623\">Tell USDA to protect organic integrity and follow organic law by fostering soil fertility for ALL organic labeled products<\/a>.<\/strong><\/p>\r\n<p>The Earth needs many more real organic farms that support <a href=\"https:\/\/beyondpesticides.org\/dailynewsblog\/2023\/01\/epa-usda-and-interior-challenged-to-incorporate-in-all-decisions-impact-on-climate-crisis-from-soil-to-pesticides\/\">soil health<\/a>, help sequester carbon dioxide, and avoid the use of materials like <a href=\"https:\/\/beyondpesticides.org\/dailynewsblog\/2023\/12\/upcoming-epa-review-of-nitrates-in-waterways-raises-health-and-environmental-questions-about-synthetic-nitrogen-fertilizer-use\/\">soluble nitrogen fertilizers<\/a> that contribute many times as much warming potential as carbon dioxide. By a decisive vote in 2010, the USDA National Organic Standards Board determined that hydroponic and aquaponic operations are inconsistent with OFPA and do not qualify for organic certification.<\/p>\r\n<p>At the present time, the NOP accredits certifying agents that certify soil-based crop producers who comply with the soil fertility requirements of OFPA and regulations. Simultaneously, the NOP accredits certifying agents that certify hydroponic, container, and other soilless crop production systems that do not comply with the soil fertility requirements of OFPA and NOP regulations.<\/p>\r\n<p>Soil-based organic production systems sequester carbon, fix nitrogen, build soil health, increase the water-holding capacity of soils, prevent soil erosion, foster the cycling of resources, promote ecological balance, conserve biodiversity and provide numerous ecological services. Hydroponic, aquaponic, and other soilless container growing systems do not sequester carbon, fix nitrogen, increase the water-holding capacity of soils, recycle nutrients, prevent erosion, enhance biological diversity, or protect ecological balance, yet the USDA currently allows such operations to be certified \u201corganic.\u201d<\/p>\r\n<p>There are significant differences between soil-based and soilless crop production systems, but there is no data available to determine how much of the U.S. organic market is comprised of the products from these two different production systems, since the products of both systems are labeled \u201corganic\u201d and allowed to carry the \u201cUSDA Organic\u201d logo. USDA\u2019s failure to require information to ensure consistent application of the Organic Foods Production Act (OFPA) threatens the integrity of organic products upon which I depend.<\/p>\r\n<p>At 6513(b)(1), OFPA states, \u201cAn organic plan shall contain provisions designed to foster soil fertility, primarily through the management of the organic content of the soil through proper tillage, crop rotation, and manuring.\u201d OFPA 6513(g) states, \u201cAn organic plan shall not include any production or handling practices that are inconsistent with this chapter.\u201d<\/p>\r\n<p>NOP now accredits certifying agents that certify soil-based crop producers who comply with the soil fertility requirements of OFPA 6513(b)(1) and 7 CFR sections 205.2, Natural Resource Protection; 205.203 Soil Fertility and Nutrient Management; and 205.205 Crop Rotation. NOP also accredits certifying agents that certify hydroponic, container, and other soilless crop producers who do not comply with those same requirements.<\/p>\r\n<p>Soil-based organic production systems sequester carbon, fix nitrogen, build soil health, increase the water-holding capacity of soils, prevent soil erosion, foster the cycling of resources, promote ecological balance, conserve biodiversity, and provide numerous ecological services, while hydroponic, aquaponic, and other soilless container growing systems do not, yet USDA allows such operations to be certified \u201corganic.\u201d<\/p>\r\n<p>Despite significant differences between soil-based and soilless crop production systems, USDA has no data to determine or research how much of the U.S. organic market is comprised of the products from these two different production systems, since the products of both systems are labeled \u201corganic\u201d and allowed to carry the \u201cUSDA Organic\u201d logo and compare the environmental and health impacts of these systems.<\/p>\r\n<p>NOP must collect data on the type of production system used by certified organic crop producers to determine the number of soil-based vs soilless crop production operations and products, both foreign and domestic, that are being certified as \u201corganic\u201d under NOP.
