A <\/span><a href=\"https:\/\/apnews.com\/article\/weed-killer-roundup-philadelphia-verdict-cancer-6c777d7fd4e7c38ec8fe28a6f1566d24\"><span data-contrast=\"none\">jury award of $2.25 billion<\/span><\/a><span data-contrast=\"auto\">, the largest to-date, was handed down in Philadelphia in January. As <\/span><span data-contrast=\"auto\">Beyond Pesticides <\/span><a href=\"https:\/\/beyondpesticides.org\/dailynewsblog\/2022\/12\/denying-science-manufacturing-doubt-monsanto-bayers-promotion-and-defense-of-glyphosate-roundup\/\"><span data-contrast=\"none\">reported previously<\/span><\/a><span data-contrast=\"auto\">, <\/span><a href=\"https:\/\/beyondpesticides.org\/dailynewsblog\/category\/corporations\/monsanto\/\"><span data-contrast=\"none\">Monsanto<\/span><\/a><span data-contrast=\"auto\"> has a <\/span><a href=\"https:\/\/www.beyondpesticides.org\/assets\/media\/documents\/Monsanto.Decades.of.Deceipt.PAY.Summer.2018-3.pdf\"><span data-contrast=\"none\">long history<\/span><\/a><span data-contrast=\"auto\"> of challenging scientific findings on <\/span><a href=\"https:\/\/beyondpesticides.org\/dailynewsblog\/category\/chemicals\/glyphosate\/\"><span data-contrast=\"none\">Roundup\/glyphosate<\/span><\/a><span data-contrast=\"auto\"> and evidence of <\/span><a href=\"https:\/\/beyondpesticides.org\/dailynewsblog\/2024\/01\/study-shines-light-on-common-herbicides-24-d-and-glyphosate-impacts-on-behavioral-function\/\"><span data-contrast=\"none\">harm<\/span><\/a><span data-contrast=\"auto\"> to <\/span><a href=\"https:\/\/beyondpesticides.org\/dailynewsblog\/2023\/08\/study-cites-multiple-chemical-characteristics-strengthen-weed-killer-glyphosate-cancer-ranking\/\"><span data-contrast=\"none\">human health<\/span><\/a><span data-contrast=\"auto\">, the <\/span><a href=\"https:\/\/www.beyondpesticides.org\/assets\/media\/documents\/pesticides\/factsheets\/bp.glyphosate.082017.pdf\"><span data-contrast=\"none\">environment<\/span><\/a><span data-contrast=\"auto\">, and <\/span><a href=\"https:\/\/beyondpesticides.org\/dailynewsblog\/2023\/02\/glyphosate-weed-killers-reduce-crop-yields-and-hamper-climate-mitigation-efforts\/#:~:text=(Beyond%20Pesticides%2C%20February%2015%2C,the%20University%20of%20Turku%2C%20Finland.\"><span data-contrast=\"none\">crops<\/span><\/a><span data-contrast=\"auto\"> themselves (see resistant super weeds <\/span><a href=\"https:\/\/beyondpesticides.org\/dailynewsblog\/2017\/03\/environmental-farm-groups-challenge-toxic-pesticides-used-genetically-engineered-crops\/\"><span data-contrast=\"none\">here<\/span><\/a><span data-contrast=\"auto\"> and <\/span><a href=\"http:\/\/beyondpesticides.org\/dailynewsblog\/2012\/10\/increased-pesticide-use-and-resistant-weeds-the-troubling-legacy-of-ge-crops\/\"><span data-contrast=\"none\">here<\/span><\/a><span data-contrast=\"auto\">), as it seeks to <\/span><a href=\"https:\/\/beyondpesticides.org\/dailynewsblog\/2022\/06\/supreme-court-lets-stand-large-jury-verdicts-on-roundup-appeals-court-finds-epa-registration-unlawful\/#:~:text=%E2%80%9CIn%20rejecting%20Bayer's%20effort%20to,EPA%20regulators%20shrug%20off%20the\"><span data-contrast=\"none\">avoid liability claims<\/span><\/a><span data-contrast=\"auto\"> by those suffering from cancer.\u00a0<\/span><\/p>\n<p><strong><em>Bayer Looking to State Legislatures for Protection from Lawsuits\u00a0<\/em><\/strong><\/p>\n<p><span data-contrast=\"auto\">As result of its failure in quash lawsuits, Bayer has moved its case to state legislatures, where it is seeking the adoption of statutes that preempt liability claims by damaged parties.<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559740&quot;:240}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">As <\/span><a href=\"https:\/\/beyondpesticides.org\/dailynewsblog\/2024\/02\/state-legislation-popping-up-to-limit-liability-of-pesticide-manufacturers\/\"><span data-contrast=\"none\">reported<\/span><\/a><span data-contrast=\"auto\"> by Beyond Pesticides, a rash of state legislation has been introduced in Idaho, Iowa, Missouri, and Florida, which would block plaintiff liability claims when pesticide products, like Roundup, cause harm. The chemical industry pushes the notion that the registration of its pesticide products with the U.S. Environmental Protection Agency (EPA) is a mark of safety that should shield it from liability. The industry want immunity from legal redress for the \u201cfailure to warn\u201d those harmed from exposure to its products.\u00a0<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559740&quot;:240}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Successful verdicts against Bayer\/Monsanto are generally based on the \u201cfailure to warn\u201d principle and have withstood judicial appeals, including before the U.S. Supreme Court twice in the last couple of years. While Bayer\u00a0<a id=\"OWA659953a0-3e5c-6bfe-02d0-0c57c8bbc304\" class=\"Hyperlink BCX0 SCXW256775160 OWAAutoLink\" href=\"https:\/\/beyondpesticides.org\/dailynewsblog\/2021\/07\/commentary-will-playing-fields-parks-and-lawns-be-safe-after-glyphosate-in-roundup-residential-use-ends-in-2023\/\" target=\"_blank\" rel=\"noreferrer noopener\" data-loopstyle=\"linkonly\">announced a reformulation<\/a> of its residential Roundup product would remove glyphosate by January 2023, its widespread agricultural and public landscaping uses continue (ed. note: it is unclear whether Bayer has removed glyphosate from retail Roundup formulations).<span class=\"TextRun SCXW194281122 BCX0\" lang=\"EN\" xml:lang=\"EN\" data-contrast=\"auto\"><span class=\"NormalTextRun SCXW194281122 BCX0\">\u00a0<\/span><\/span><\/span><span data-contrast=\"auto\">Advocates point out that the proposed state legislation to limit liability, if passed into law, would release from liability all pesticide manufacturers responsibility for adverse effects associated with labeled product use. Tort liability claims rest on the manufacturers\u2019 \u201cfailure to warn\u201d consumers that when the company\u2019s pesticide products are used as labeled and directed they may cause harm, such as <\/span><a href=\"https:\/\/www.beyondpesticides.org\/assets\/media\/documents\/pesticides\/factsheets\/bp-fact-glyosphate.082017.pdf\"><span data-contrast=\"none\">non-Hodgkin lymphoma<\/span><\/a><span data-contrast=\"auto\"> in the case of glyphosate-based Roundup.\u00a0<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559740&quot;:240}\">\u00a0<\/span><\/p>\n<p><em><strong>Regulatory Failures Increase Need for Lawsuits Against Manufacturers\u00a0<\/strong><\/em><\/p>\n<p><span data-contrast=\"auto\">In December, f<\/span><span data-contrast=\"none\">armworker organizations and <\/span><a href=\"https:\/\/beyondpesticides.org\/dailynewsblog\/2023\/12\/groups-petition-epa-to-remove-from-the-market-the-weed-killer-glyphosate\/\"><span data-contrast=\"none\">Beyond Pesticides<\/span><\/a><span data-contrast=\"none\">, represented by the Center for Food Safety, filed a\u202f<\/span><a href=\"https:\/\/www.centerforfoodsafety.org\/files\/12-13-23_glycancelpet_final_85692.pdf\"><b><span data-contrast=\"none\">petition<\/span><\/b><\/a><span data-contrast=\"none\">\u202fwith EPA urging the agency to remove glyphosate from the market after having won a 2022 court decision forcing EPA to redo its science evaluation.<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559740&quot;:240}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">That 2022 court decision in the\u202f<\/span><a href=\"https:\/\/www.centerforfoodsafety.org\/press-releases\/6659\/federal-court-rejects-glyphosate-registration-decision-because-epa-ignored-cancer-risks-endangered-species-risks\">Court of Appeals for the Ninth Circuit ruled<\/a>\u202fthat EPA\u2019s 2020 approval of glyphosate was \u202f<a href=\"https:\/\/www.centerforfoodsafety.org\/files\/ca9_glyphosate-decision_82995.pdf\">unlawful.<\/a> The court voided EPA\u2019s\u202f<a href=\"https:\/\/beyondpesticides.org\/dailynewsblog\/2020\/02\/epa-set-to-reapprove-cancer-causing-glyphosate-and-bee-toxic-neonicotinoids\/\">\u201cinterim registration review\u201d decision approving the continued use of glyphosate, issued in early 2020<\/a>. \u201cEPA did not adequately consider whether glyphosate causes cancer and shirked its duties under the <i>Endangered Species Act<\/i> (ESA),\u201d the court wrote\u202f<a href=\"https:\/\/www.centerforfoodsafety.org\/files\/ca9_glyphosate-decision_82995.pdf\">in its opinion.<\/a> At the time of the decision, Beyond Pesticides said: <span data-contrast=\"auto\">&#8220;EPA&#8217;s failure to act on the science, as detailed in the litigation, has real-world adverse health consequences for farmworkers, the public, and ecosystems. Because of this lawsuit, the agency&#8217;s obstruction of the regulatory process will not be allowed to stand, and EPA should start shifting food production to available alternative non- and less-toxic practices and materials that meet its statutory duty.&#8221; As reported by the Center for Food Safety, counsel in the case, \u201c<\/span><span data-contrast=\"auto\">[T]he court struck down, or vacated the human health assessment. The court also required that EPA redo and\/or finish all remaining glyphosate determinations by an October 2022 deadline, or within four months. In other words, they claim that the manufacturer did not adequately warn about the risks associated with the product&#8217;s design. Successful actions of this sort may lead manufacturers to petition EPA to allow more detailed labelling of their products; alternatively, EPA itself may decide that revised labels are required in light of the new information that has been brought to its attention through common law suits. In addition, the specter of damage actions may provide manufacturers with added dynamic incentives to continue to keep abreast of all possible injuries stemming from use of their product so as to forestall such actions through product improvement.\u201d<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559740&quot;:240}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">As <\/span><a href=\"https:\/\/beyondpesticides.org\/dailynewsblog\/2022\/06\/supreme-court-lets-stand-large-jury-verdicts-on-roundup-appeals-court-finds-epa-registration-unlawful\/\"><span data-contrast=\"none\">previously reported <\/span><\/a><span data-contrast=\"auto\">by Beyond Pesticides, the U.S. Supreme Court spoke with clarity in <\/span><i><span data-contrast=\"auto\">Bates<\/span><\/i><span data-contrast=\"auto\">:<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559740&quot;:240}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">\u201cT<\/span><span data-contrast=\"auto\">he long history of tort litigation against manufacturers of poisonous substances adds force to the basic presumption against pre-emption. If Congress had intended to deprive injured parties of a long available form of compensation, it surely would have expressed that intent more clearly. See<\/span><i><span data-contrast=\"auto\"> Silkwood<\/span><\/i><span data-contrast=\"auto\"> v. <\/span><i><span data-contrast=\"auto\">Kerr-McGee Corp.<\/span><\/i><span data-contrast=\"auto\">, <\/span><a href=\"https:\/\/supreme.justia.com\/cases\/federal\/us\/464\/238\/\"><span data-contrast=\"none\">464 U. S. 238<\/span><\/a><span data-contrast=\"auto\">, 251 (1984).[<\/span><a href=\"https:\/\/supreme.justia.com\/cases\/federal\/us\/544\/431\/#F25\"><span data-contrast=\"none\">Footnote 25<\/span><\/a><span data-contrast=\"auto\">] Moreover, this history emphasizes the importance of providing an incentive to manufacturers to use the utmost care in the business of distributing inherently dangerous items. See <\/span><i><span data-contrast=\"auto\">Mortier<\/span><\/i><span data-contrast=\"auto\">, 501 U. S., at 613 (stating that the 1972 amendments\u2019 goal was to \u201cstrengthen existing labeling requirements and ensure that these requirements were followed in practice\u201d). Particularly given that Congress amended FIFRA to allow EPA to waive efficacy review of newly registered pesticides (and in the course of those amendments, made technical changes to \u00a7136v(b)), it seems unlikely that Congress considered a relatively obscure provision like \u00a7136v(b) to give pesticide manufacturers virtual immunity from certain forms of tort liability. Overenforcement of FIFRA\u2019s misbranding prohibition creates a risk of imposing unnecessary financial burdens on manufacturers; under-enforcement creates not only financial risks for consumers but risks that affect their safety and the environment as well.\u201d<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559685&quot;:720,&quot;335559740&quot;:240}\">\u00a0<\/span><\/p>\n<p><em><strong>Lawsuits Not Slowing Down \u00a0<\/strong><\/em><\/p>\n<p><span data-contrast=\"auto\">Beginning in October 2023, Bayer has racked up over $4 billion in verdicts and <\/span><a href=\"https:\/\/www.bloomberg.com\/news\/articles\/2024-01-29\/bayer-slumps-as-2-25-billion-roundup-loss-disrupts-turnaround\"><span data-contrast=\"none\">shareholders are punishing the company\u2019s stock price.<\/span><\/a><span data-contrast=\"auto\"> Bayer has slashed shareholder <\/span><a href=\"https:\/\/www.statnews.com\/2024\/02\/20\/biotech-news-bayer-rapt-sanofi-phage-sonata-cancer-amtagvi\/\"><span data-contrast=\"none\">dividends <\/span><\/a><a href=\"https:\/\/www.statnews.com\/2024\/02\/20\/biotech-news-bayer-rapt-sanofi-phage-sonata-cancer-amtagvi\/\"><span data-contrast=\"none\">by 95%<\/span><\/a><span data-contrast=\"none\">, part of an ongoing effort to conserve cash in the wake of its 2018 merger with Monsanto. <\/span><span data-contrast=\"auto\">According to Reuters, \u201cAround 165,000 claims have been made against the company for personal injuries allegedly caused by Roundup, which Bayer acquired as part of its $63 billion purchase of U.S. agrochemical company Monsanto in 2018.\u201d They report that in 2020, \u201c&#8230;Bayer settled most of the then-pending Roundup cases for up to $9.6 billion but failed to get a settlement covering future cases. More than 50,000 claims remain pending,\u201d as of December 2023. In addition, two new Roundup trials have started in Pennsylvania and Arkansas, with an ongoing trial in Delaware and a case coming up for trial in California. Court watchers note that Bayer\u2019s previous streak of earlier victories over plaintiffs may reflect a Bayer strategy of bringing the weakest plaintiff cases to trial first to deter others from filing lawsuits. FIFRA pre-emption is to be interpreted narrowly as affecting only the regulation by states of the wording of the label. Even failure to warn causes of action are allowed, on the theory that state actions can run in parallel with FIFRA regulation\u2026<\/span> <span data-contrast=\"auto\">If a plaintiff alleged that a pesticide product was negligently designed because it harmed a person even when applied according to the label, the court would rule that such a cause of action was really a \u201cfailure to warn\u201d disguised as \u201cdesign defect.\u201d In other words, if the EPA had decreed that the product was a good product when used according to the label, the judgment about whether it was properly designed had already been made. <\/span><b><span data-contrast=\"auto\">This created the anomalous situation that products could be legal and harmful even when used as directed.<\/span><\/b><span data-contrast=\"auto\"> Indeed, this is exactly the situation with cigarettes. But, after Bates, this is not the law as to pesticides. The Bates court was clear that it intended to allow state common law torts to be a parallel remedy to FIFRA regulation: Private remedies that enforce federal misbranding requirements would seem to aid, rather than hinder, the functioning of FIFRA. \u2026FIFRA contemplates that pesticide labels will evolve over time, as manufacturers gain more information about their products\u2019 performance in diverse settings. As one court explained, tort suits can serve as a catalyst in this process: \u201cBy encouraging plaintiffs to bring suit for injuries not previously recognized as traceable to pesticides such as [the pesticide there at issue], a state tort action of the kind under review may aid in the exposure of new dangers associated with pesticides. Successful actions of this sort may lead manufacturers to petition EPA to allow more detailed labeling of their products; alternatively, EPA itself may decide that revised labels are required in light of the new information that has been brought to its attention through common law suits. With the information provided by Beyond Pesticides, people may not only be able to make informed choices and adopt practices that protect themselves and their families from unnecessary exposure to pesticides, but they will be able to effect changes on community-wide pest management decisions and policies that govern pesticide use, such as pesticide uses in parks, schools, for community insect control and along roadsides.
