{"id":36631,"date":"2024-10-10T00:01:18","date_gmt":"2024-10-10T04:01:18","guid":{"rendered":"https:\/\/beyondpesticides.org\/dailynewsblog\/?p=36631"},"modified":"2024-10-10T11:34:52","modified_gmt":"2024-10-10T15:34:52","slug":"epa-proposal-for-chlorpyrifos-use-after-court-decision-backtracks-on-safety-and-protection-of-children","status":"publish","type":"post","link":"https:\/\/beyondpesticides.org\/dailynewsblog\/2024\/10\/epa-proposal-for-chlorpyrifos-use-after-court-decision-backtracks-on-safety-and-protection-of-children\/","title":{"rendered":"EPA Proposal for Chlorpyrifos Use, After Court Decision, Backtracks on Safety and Protection of Children"},"content":{"rendered":"<p><i><span data-contrast=\"auto\">(Beyond Pesticides, <\/span><\/i><span data-contrast=\"auto\">October 10, 2024) On September 16, 2024, the <\/span><span data-contrast=\"auto\">U.S. Environmental Protection Agency (EPA) announced an <\/span><a href=\"https:\/\/www.federalregister.gov\/documents\/2024\/09\/16\/2024-21004\/chlorpyrifos-amendment-to-existing-stocks-provisions-in-kaizen-product-cancellation-orders\"><span data-contrast=\"none\">order<\/span><\/a> <span data-contrast=\"auto\">allowing Kaizen Technologies LLC to <\/span><span data-contrast=\"none\">sell off its <\/span><span data-contrast=\"auto\">chlorpyrifos-based insecticide product\u2014<\/span><span data-contrast=\"none\">Bifenchlor<\/span><span data-contrast=\"auto\">, a known <\/span><a href=\"https:\/\/www.beyondpesticides.org\/resources\/pesticide-gateway?pesticideid=17\"><span data-contrast=\"none\">neurotoxicant<\/span><\/a><span data-contrast=\"none\">. This reverses an <\/span><span data-contrast=\"auto\">existing stocks agreement that Kaizen voluntarily negotiated with EPA in August 2022 when the company withdrew Bifenchlor from use. The agency attributes this new order to a November 2023 <\/span><a href=\"https:\/\/beyondpesticides.org\/dailynewsblog\/2023\/11\/2021-ag-ban-of-deadly-pesticide-chlorpyrifos-reversed-by-court-despite-decades-of-review-and-litigation\/\"><span data-contrast=\"none\">Eighth Circuit Court of Appeals<\/span><\/a> <a href=\"https:\/\/earthjustice.org\/wp-content\/uploads\/rrvsga-v.-regan-complaint.pdf\"><span data-contrast=\"none\">decision<\/span><\/a><span data-contrast=\"auto\">, which vacated EPA\u2019s prior 2021 chlorpyrifos\u00a0<\/span><a href=\"https:\/\/www.federalregister.gov\/documents\/2021\/08\/30\/2021-18091\/chlorpyrifos-tolerance-revocations\"><span data-contrast=\"none\">ban<\/span><\/a><span data-contrast=\"auto\"> on food crops (see <\/span><a href=\"https:\/\/beyondpesticides.org\/dailynewsblog\/2023\/11\/2021-ag-ban-of-deadly-pesticide-chlorpyrifos-reversed-by-court-despite-decades-of-review-and-litigation\/\"><span data-contrast=\"none\">here<\/span><\/a><span data-contrast=\"auto\">). EPA\u2019s practice of permitting the sale and use of existing stocks of canceled pesticides has been a longstanding concern for public health and environmental advocates, as it <\/span><span data-contrast=\"auto\">enables the continued use of petrochemical pesticides that the agency has found to be dangerous. Chlorpyrifos, an organophosphate with adverse health effects on children (see <\/span><a href=\"https:\/\/www.beyondpesticides.org\/assets\/media\/documents\/bp-37.4-w17-Chlorpyrifos-cited.pdf\"><span data-contrast=\"none\">here<\/span><\/a><span data-contrast=\"auto\"> and <\/span><a href=\"https:\/\/www.beyondpesticides.org\/assets\/media\/documents\/Commentary--Abandoning%20Science.pdf\"><span data-contrast=\"none\">here<\/span><\/a><span data-contrast=\"auto\">), is now the latest example.<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335557856&quot;:16777215,&quot;335559740&quot;:259}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">In reporting on the almost unprecedented decision on August 7, 2024, to use its emergency authority to ban Dacthal\/DCPA, Beyond Pesticides argues that the \u201c<\/span><a href=\"https:\/\/beyondpesticides.org\/dailynewsblog\/2024\/08\/epas-momentous-decision-to-ban-a-pesticide-an-anomaly-or-a-precedent\/\"><span data-contrast=\"none\">Dacthal Standard<\/span><\/a><span data-contrast=\"auto\">\u201d is a positive precedent, a step forward in modern regulatory history; however, EPA\u2019s continued approval of chlorpyrifos\u2019s existing stock, complicated by the 2023 court decision, may suggest otherwise. <\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335557856&quot;:16777215,&quot;335559740&quot;:259}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">As demonstrated historically with <\/span><a href=\"https:\/\/beyondpesticides.org\/dailynewsblog\/2022\/10\/washington-dc-sues-for-damages-from-historical-pesticide-contamination-as-threats-persist\/\"><span data-contrast=\"none\">chlordane<\/span><\/a><span data-contrast=\"auto\">, <\/span><a href=\"https:\/\/beyondpesticides.org\/dailynewsblog\/2024\/02\/court-strikes-down-epas-allowance-of-weedkiller-dicamba-after-scathing-inspector-general-report\/\"><span data-contrast=\"none\">dicamba<\/span><\/a><span data-contrast=\"auto\">, <\/span><a href=\"https:\/\/beyondpesticides.org\/dailynewsblog\/2012\/11\/methyl-iodide-uses-to-formally-end-in-the-us\/\"><span data-contrast=\"none\">methyl iodide<\/span><\/a><span data-contrast=\"auto\">, <\/span><a href=\"https:\/\/beyondpesticides.org\/dailynewsblog\/2024\/08\/beyond-pesticides-rallies-public-to-ban-weed-killer-atrazine-with-standard-epa-used-earlier-to-ban-dacthal\/\"><span data-contrast=\"none\">atrazine<\/span><\/a><span data-contrast=\"auto\">, and other pesticides, <\/span><span data-contrast=\"auto\">EPA\u2019s decision making, delay tactics, and contradictory policies are not confined to chlorpyrifos. In fact, when <\/span><a href=\"https:\/\/www.beyondpesticides.org\/assets\/media\/documents\/pesticides\/factsheets\/LowDown%20on%20Dursban.pdf\"><span data-contrast=\"none\">EPA negotiated in 2000 a withdrawal<\/span><\/a><span data-contrast=\"auto\"> from the market residential uses of chlorpyrifos, based on the neurotoxic impacts on children, it allowed Dow Chemical to sell off all its existing stocks over a one-year period.\u00a0 \u201cChlorpyrifos, glyphosate, 2,4-D, atrazine, and many others are poster children for a failed regulatory system that props up chemical-intensive agriculture despite the availability of alternative organic practices not reliant on these toxic chemicals,\u201d says Jay Feldman, <\/span><a href=\"https:\/\/www.beyondpesticides.org\/about\/staff\"><span data-contrast=\"auto\">executive director<\/span><\/a><span data-contrast=\"auto\"> of Beyond Pesticides.<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335557856&quot;:16777215,&quot;335559740&quot;:259}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Ironically, as in the short interval between EPA\u2019s rule banning agricultural uses of chlorpyrifos and the Eighth Circuit\u2019s intervention, \u201cthe need for any use of chlorpyrifos has been refuted,\u201d as Earthjustice Senior Attorney Patti Goldman noted in a <\/span><a href=\"https:\/\/earthjustice.org\/press\/2023\/in-shocking-decision-8th-circuit-sends-chlorpyrifos-food-use-ban-back-to-epa\"><span data-contrast=\"none\">press release<\/span><\/a><span data-contrast=\"auto\">. \u201cCrops have been successfully grown in the two years since chlorpyrifos has been banned,\u201d Ms. Goldman said. <\/span><span data-contrast=\"auto\">Despite the growth of the $70 billion organic industry, organic agricultural methods and materials are <\/span><a href=\"https:\/\/beyondpesticides.org\/dailynewsblog\/2024\/08\/epas-momentous-decision-to-ban-a-pesticide-an-anomaly-or-a-precedent\/\"><span data-contrast=\"none\">still not considered by EPA<\/span><\/a><span data-contrast=\"auto\"> to be a legitimate alternative to chemicals when determining the \u201creasonableness\u201d or \u201cacceptability\u201d of adverse pesticide effects under federal pesticide law.\u00a0<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335557856&quot;:16777215,&quot;335559740&quot;:259}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">This most recent \u201cchlorpyrifos existing stock order notice\u201d by the agency is another footnote in an ongoing chapter of what environmental and health advocates see as regulatory failure by EPA under a weak federal statute, the <\/span><a href=\"https:\/\/www.epa.gov\/laws-regulations\/summary-federal-insecticide-fungicide-and-rodenticide-act\"><i><span data-contrast=\"none\">Federal Insecticide, Fungicide, and Rodenticide Act<\/span><\/i><\/a><span data-contrast=\"auto\"> (FIFRA). The current 2024 growing season allowed the use of chlorpyrifos pesticides on most food crops [except for five states that have stepped up, independent of EPA, to ban the insecticide to protect children: Hawaii, Maryland, New York, Oregon, and California]. (See <\/span><a href=\"https:\/\/beyondpesticides.org\/dailynewsblog\/2024\/02\/oregon-is-the-latest-state-to-step-in-and-ban-widely-used-neurotoxic-pesticide-chlorpyrifos-as-epa-stalls\/\"><span data-contrast=\"none\">here<\/span><\/a><span data-contrast=\"auto\"> and <\/span><a href=\"https:\/\/beyondpesticides.org\/dailynewsblog\/2023\/11\/commentary-and-action-court-decision-and-history-calls-into-question-value-of-pesticide-law\/\"><span data-contrast=\"none\">here<\/span><\/a><span data-contrast=\"none\">.) <\/span><span data-contrast=\"auto\">In 2000, EPA <\/span><a href=\"https:\/\/www.epa.gov\/ingredients-used-pesticide-products\/chlorpyrifos\"><span data-contrast=\"none\">discontinued<\/span><\/a><span data-contrast=\"auto\"> all uses of chlorpyrifos on tomatoes, restricting use on apples, and lowering the grape tolerances.<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335557856&quot;:16777215,&quot;335559740&quot;:259}\">\u00a0<\/span><\/p>\n<p><i><span data-contrast=\"auto\">Background<\/span><\/i><span data-contrast=\"auto\">\u00a0<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335557856&quot;:16777215,&quot;335559740&quot;:259}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">In 2021, EPA issued a rule that revoked food tolerances for chlorpyrifos, effectively banning its use on food crops. This decision, however, faced legal challenges from a chlorpyrifos manufacturer and several agricultural groups, which <\/span><a href=\"https:\/\/earthjustice.org\/wp-content\/uploads\/2023\/11\/8th-circuit-chlorpyrifos-opinion-11-2-23-1.pdf\"><span data-contrast=\"none\">filed a lawsuit<\/span><\/a><span data-contrast=\"auto\"> in the U.S. Court of Appeals for the Eighth Circuit. On November 2, 2023, the Eighth Circuit <a href=\"https:\/\/ecf.ca8.uscourts.gov\/opndir\/23\/11\/221422P.pdf\">vacated<\/a> EPA&#8217;s 2021 rule revoking all tolerances in <\/span><i><span data-contrast=\"auto\"><a href=\"https:\/\/ecf.ca8.uscourts.gov\/opndir\/23\/11\/221422P.pdf\">Red River Valley Sugarbeet Growers Associations, et al. v. Regan, 85 F.4th 881<\/a> (8th Cir. 2023)<\/span><\/i><span data-contrast=\"auto\"> and directed the agency to reconsider. <\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335557856&quot;:16777215,&quot;335559738&quot;:240,&quot;335559739&quot;:240,&quot;335559740&quot;:259}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">In response to this legal development, EPA published a notice in the <\/span><a href=\"https:\/\/www.federalregister.gov\/documents\/2024\/09\/16\/2024-21004\/chlorpyrifos-amendment-to-existing-stocks-provisions-in-kaizen-product-cancellation-orders\"><span data-contrast=\"none\">Federal Register<\/span><\/a><span data-contrast=\"auto\"> on February 5, 2024. This notice served as a technical correction to the Code of Federal Regulations, formally acknowledging the Eighth Circuit&#8217;s reinstatement of chlorpyrifos tolerances, and allowing its use for the 2024 growing season on all crops\u00a0<\/span><a href=\"https:\/\/www.federalregister.gov\/documents\/2024\/02\/05\/2024-02153\/chlorpyrifos-reinstatement-of-tolerances\"><span data-contrast=\"none\">effective<\/span><\/a><span data-contrast=\"auto\">\u00a0February 5, 2024. The Eighth Circuit&#8217;s decision also referenced EPA&#8217;s 2020 <\/span><a href=\"https:\/\/www.epa.gov\/sites\/default\/files\/2020-12\/documents\/chlorpyrifos_pid_signed_120320.pdf\"><span data-contrast=\"none\">Proposed Interim Registration (PID) Review Decision<\/span><\/a><span data-contrast=\"auto\"> for chlorpyrifos, which identified eleven specific crops for potential continued use of the pesticide. The crops include alfalfa, apples, asparagus, cherries, citrus, cotton, peaches, soybeans, strawberries, sugar beets, and wheat. Products that were cancelled or amended may be able to be used if use is consistent with the existing stocks provisions\u2026\u201d\u2014<\/span><a href=\"https:\/\/www.federalregister.gov\/documents\/2024\/09\/16\/2024-21004\/chlorpyrifos-amendment-to-existing-stocks-provisions-in-kaizen-product-cancellation-orders\"><span data-contrast=\"none\">Chlorpyrifos; Amendment to Existing Stocks Provisions in Kaizen Product Cancellation Orders<\/span><\/a><span data-contrast=\"auto\">, A Notice by the U.S. Environmental Protection Agency on September 16, 2024.<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335557856&quot;:16777215,&quot;335559740&quot;:259}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">When courts <\/span><a href=\"https:\/\/beyondpesticides.org\/dailynewsblog\/2024\/03\/epa-and-court-allow-violations-and-hazards-of-weed-killer-dicamba-under-existing-stocks-order\/\"><span data-contrast=\"none\">defer<\/span><\/a><span data-contrast=\"auto\"> to EPA\u2019s interpretation of the existing stock provision in the federal pesticide law, a pattern of \u201cexisting stock\u201d allowances permit hazards to continue well after a finding of harm or noncompliance. This process contrasts with the issuance of a product recall, which is typically done when pharmaceuticals are found to violate safety standards. In addition to chlorpyrifos, Beyond Pesticides has previously objected to the agency\u2019s expansion of existing stock use for <\/span><a href=\"https:\/\/beyondpesticides.org\/dailynewsblog\/2024\/03\/epa-and-court-allow-violations-and-hazards-of-weed-killer-dicamba-under-existing-stocks-order\/\"><span data-contrast=\"none\">dicamba<\/span><\/a><span data-contrast=\"auto\">, <\/span><a href=\"https:\/\/beyondpesticides.org\/dailynewsblog\/2024\/08\/epas-momentous-decision-to-ban-a-pesticide-an-anomaly-or-a-precedent\/\"><span data-contrast=\"none\">dacthal<\/span><\/a><span data-contrast=\"auto\">, and <\/span><a href=\"https:\/\/beyondpesticides.org\/dailynewsblog\/2019\/11\/epa-proposes-to-reduce-protections-from-neurotoxic-pyrethroid-insecticides\/\"><span data-contrast=\"none\">paraquat<\/span><\/a><span data-contrast=\"auto\">. As this latest example shows, manufacturers have found a short-term workaround to quickly return to selling and distributing chlorpyrifos. Their solution\u2014petitioning EPA for new or amended existing stock orders.\u00a0<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335557856&quot;:16777215,&quot;335559740&quot;:259}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">As of <\/span><a href=\"https:\/\/www.federalregister.gov\/documents\/2024\/09\/16\/2024-21004\/chlorpyrifos-amendment-to-existing-stocks-provisions-in-kaizen-product-cancellation-orders\"><span data-contrast=\"none\">September 16<\/span><\/a><span data-contrast=\"auto\">, chlorpyrifos can be <\/span><a href=\"https:\/\/www.epa.gov\/ingredients-used-pesticide-products\/frequently-asked-questions-about-current-status-chlorpyrifos\"><span data-contrast=\"none\">used on all food crops<\/span><\/a><span data-contrast=\"auto\"> that were previously subject to the formal revocation of tolerances. According to EPA\u2019s <\/span><a href=\"https:\/\/www.epa.gov\/ingredients-used-pesticide-products\/frequently-asked-questions-about-current-status-chlorpyrifos\"><i><span data-contrast=\"none\">Frequently Asked Questions<\/span><\/i><\/a> <a href=\"https:\/\/www.epa.gov\/ingredients-used-pesticide-products\/frequently-asked-questions-about-current-status-chlorpyrifos\"><i><span data-contrast=\"none\">about the Current Status of Chlorpyrifos and Anticipated Path Forward<\/span><\/i><\/a><span data-contrast=\"auto\">, the agency intends to issue a new rule to revoke the tolerances for all food commodities except for the 11 uses cited in the December 2020 PID. After providing an opportunity for public comments on PID-referenced crops\u2014\u2014anticipated updates are tentatively proposed for 2025. However, this will only apply to specific states under agency review with limits on application rates and methods.\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Meanwhile, in an analogous decision despite the finding of harm and EPA\u2019s <\/span><a href=\"https:\/\/beyondpesticides.org\/dailynewsblog\/2024\/03\/epa-and-court-allow-violations-and-hazards-of-weed-killer-dicamba-under-existing-stocks-order\/\"><span data-contrast=\"none\">violation of law in allowing harm associated with the herbicide dicamba\u2019s registration<\/span><\/a><span data-contrast=\"auto\">, the continued use of the weed killer through the 2024 growing season is also effectively authorized by the <\/span><a href=\"https:\/\/beyondpesticides.org\/dailynewsblog\/2024\/02\/court-strikes-down-epas-allowance-of-weedkiller-dicamba-after-scathing-inspector-general-report\/\"><span data-contrast=\"none\">U.S. District Court of Arizona<\/span><\/a><span data-contrast=\"auto\"> (which vacates EPA\u2019s 2021 authorization for <\/span><a href=\"https:\/\/beyondpesticides.org\/dailynewsblog\/2024\/02\/court-strikes-down-epas-allowance-of-weedkiller-dicamba-after-scathing-inspector-general-report\/\"><span data-contrast=\"none\">three over-the-top uses<\/span><\/a><span data-contrast=\"auto\"> of dicamba-based herbicide products). In response, EPA issued an <\/span><a href=\"https:\/\/www.epa.gov\/system\/files\/documents\/2024-02\/dicamba-notice-existing-stocks-order_02142024.pdf\"><span data-contrast=\"none\">existing stocks order<\/span><\/a><span data-contrast=\"auto\">, which means that dicamba will continue to be sold and used through 2024\u2014although it has been linked to environmental and health adverse effects.\u00a0<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335557856&quot;:16777215,&quot;335559739&quot;:180,&quot;335559740&quot;:259}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">As the agency continues to prioritize commercial interests and agricultural continuity over public safety and environmental protection by expanding existing stocks, Beyond Pesticides advocates for immediate discontinuation of pesticide use when risks are identified and emphasizes the availability of safer, profitable alternatives, such as USDA-certified organic farming practices. They advocate for these organic principles to be adopted more broadly to replace the reliance on harmful chemical pesticides like dicamba and chlorpyrifos.<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335557856&quot;:16777215,&quot;335559740&quot;:259}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">As clearly indicated by the evidence at hand, individual chemical bans are not the strategy for systemic change, nor are they an effective methodology for <\/span><a href=\"https:\/\/www.beyondpesticides.org\/assets\/media\/documents\/journal\/BP-TransformativeChange.2022.23.pdf\"><span data-contrast=\"none\">cultivating<\/span><\/a><span data-contrast=\"auto\"> a livable future for ourselves and future generations. Given the proven viability and profitability of cost-effective organic production practices, the solution must be the urgent adoption of <\/span><a href=\"https:\/\/www.beyondpesticides.org\/programs\/organic-agriculture\/overview\"><span data-contrast=\"none\">organic agriculture<\/span><\/a><span data-contrast=\"auto\"> and <\/span><a href=\"https:\/\/www.beyondpesticides.org\/resources\/lawns-and-landscapes\/overview\"><span data-contrast=\"none\">land care<\/span><\/a><span data-contrast=\"auto\"> that eliminates not just chlorpyrifos, but the pesticide treadmill that chemical manufacturers and chemical-intensive agriculture fuels.\u00a0<\/span><span data-ccp-props=\"{&quot;134233117&quot;:false,&quot;134233118&quot;:false,&quot;201341983&quot;:0,&quot;335551550&quot;:1,&quot;335551620&quot;:1,&quot;335557856&quot;:16777215,&quot;335559685&quot;:0,&quot;335559737&quot;:0,&quot;335559738&quot;:0,&quot;335559739&quot;:0,&quot;335559740&quot;:259}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Organic management practices build soil health, cycle nutrients naturally, enhance plant resiliency, reduce water use, and do not use petrochemical pesticides or fertilizers. The organic alternative is central to a commitment to both the elimination of practices and products that are petrochemical-based and the ability of organically managed soils to draw down (sequester) This reverses an existing stocks agreement that Kaizen voluntarily negotiated with EPA in August 2022 when the company withdrew Bifenchlor from use.
