{"id":37225,"date":"2024-12-13T00:01:31","date_gmt":"2024-12-13T05:01:31","guid":{"rendered":"https:\/\/beyondpesticides.org\/dailynewsblog\/?p=37225"},"modified":"2024-12-13T08:45:57","modified_gmt":"2024-12-13T13:45:57","slug":"epas-registration-of-herbicide-under-new-framework-puts-endangered-species-at-elevated-risk-advocates-say","status":"publish","type":"post","link":"https:\/\/beyondpesticides.org\/dailynewsblog\/2024\/12\/epas-registration-of-herbicide-under-new-framework-puts-endangered-species-at-elevated-risk-advocates-say\/","title":{"rendered":"EPA\u2019s Registration of Herbicide under New Framework Puts Endangered Species at Elevated Risk, Advocates Say"},"content":{"rendered":"<p>(<em>Beyond Pesticides<\/em>, December 13, 2024) In October, the U.S. Environmental Protection Agency (EPA) <span style=\"color: #0000ff;\"><a style=\"color: #0000ff;\" href=\"https:\/\/www.epa.gov\/pesticides\/epa-proposes-register-new-herbicide-active-ingredient-glufosinate-p\">approved<\/a><\/span> the <span style=\"color: #0000ff;\"><a style=\"color: #0000ff;\" href=\"https:\/\/www.regulations.gov\/document\/EPA-HQ-OPP-2020-0250-0049\">registration<\/a><\/span> applications of BASF Corporation and Mitsui Chemicals Crop &amp; Life Solutions, Inc. for the use of different formulations of the L-isomer of <span style=\"color: #0000ff;\"><a style=\"color: #0000ff;\" href=\"https:\/\/www.beyondpesticides.org\/resources\/pesticide-gateway?pesticideid=190\">glufosinate<\/a><\/span> (also known as \u201cL-glufosinate\u201d and \u201cglufosinate-P\u201d) as new active herbicidal ingredients. This decision marks one of the first times that EPA has employed its new <span style=\"color: #0000ff;\"><a style=\"color: #0000ff;\" href=\"https:\/\/beyondpesticides.org\/dailynewsblog\/2024\/04\/epa-draft-herbicide-strategy-update-further-weakens-plan-to-protect-endangered-species\/\">Herbicide \u00a0Strategy\u00a0Framework<\/a><\/span> to determine the level of mitigation necessary to protect listed species and critical habitat under the <span style=\"color: #0000ff;\"><a style=\"color: #0000ff;\" href=\"https:\/\/www.fws.gov\/law\/endangered-species-act\"><em>Endangered Species Act<\/em><\/a><\/span> (ESA). <span style=\"color: #0000ff;\"><a style=\"color: #0000ff;\" href=\"https:\/\/www.beyondpesticides.org\/assets\/media\/documents\/GlufosinateChemWatch.pdf\">Glufosinate<\/a><\/span> is an organophosphate, with <span style=\"color: #0000ff;\"><a style=\"color: #0000ff;\" href=\"https:\/\/beyondpesticides.org\/dailynewsblog\/category\/chemicals\/organophosphate\/\">known<\/a> <\/span>neurotoxic, reproductive\/developmental effects, toxic to aquatic life, and mobile in soils (see <span style=\"color: #0000ff;\"><a style=\"color: #0000ff;\" href=\"https:\/\/www.beyondpesticides.org\/resources\/pesticide-gateway?pesticideid=190\">Beyond Pesticides Gateway<\/a><\/span>). Scientists have <a href=\"https:\/\/assets.nationbuilder.com\/ncap\/pages\/26\/attachments\/original\/1428423375\/glufosinate.pdf?1428423375\"><span style=\"color: #0000ff;\">found<\/span><\/a> that formulated glufosinate is generally more toxic to aquatic and terrestrial animals than the technical grade active ingredient.<\/p>\n<p>Manufacturers are introducing newer <span style=\"color: #0000ff;\"><a style=\"color: #0000ff;\" href=\"https:\/\/www.beyondpesticides.org\/assets\/media\/documents\/GlufosinateChemWatch.pdf\">glufosinate<\/a><\/span> products as alternatives for glyphosate-based herbicides, like Bayer\/Monsanto\u2019s <span style=\"color: #0000ff;\"><a style=\"color: #0000ff;\" href=\"https:\/\/cen.acs.org\/environment\/pesticides\/Replacing-glyphosate-garden-wont-easy\/99\/i45\">\u2018<span style=\"color: #0000ff;\">Roundup\u2019<\/span><\/a><\/span> and <span style=\"color: #0000ff;\"><a style=\"color: #0000ff;\" href=\"https:\/\/beyondpesticides.org\/dailynewsblog\/2024\/07\/call-for-epa-to-reject-harmful-weed-killer-politicized-supreme-court-takes-the-reins-from-agencies\/\">dicamba<\/a><\/span>. The Center for Biological Diversity <a href=\"https:\/\/www.regulations.gov\/comment\/EPA-HQ-OPP-2020-0250-0035\"><span style=\"color: #0000ff;\">notes<\/span><\/a> in <span style=\"color: #0000ff;\"><a style=\"color: #0000ff;\" href=\"https:\/\/www.regulations.gov\/comment\/EPA-HQ-OPP-2020-0250-0035\">comments<\/a> <\/span>submitted to EPA on this decision, \u201cL-glufosinate has the potential to be used on tens of millions acres of land every year given the crops EPA has proposed to register it on. The scale of potential use is far above most new active ingredients.\u201d<\/p>\n<p>This first significant application of the Framework demonstrates, according to advocates, that the herbicide registration process remains insufficient to protect endangered species, public health, the environment, and biodiversity. As advocates, as well as Beyond Pesticides, have\u00a0<span style=\"color: #0000ff;\"><a style=\"color: #0000ff;\" href=\"https:\/\/beyondpesticides.org\/dailynewsblog\/2024\/04\/epa-draft-herbicide-strategy-update-further-weakens-plan-to-protect-endangered-species\/\">observed<\/a><\/span>, the agency presupposes that farmers must use toxic chemicals, an assumption that clouds and undermines the regulatory process, trapping farmers on a toxic pesticide treadmill.\u00a0Fundamental change requires EPA\u2014in every pesticide registration and registration review\u2014to examine whether there are practices that can eliminate harm, not substitute one toxic conventional pesticide for another.<\/p>\n<p><span style=\"color: #0000ff;\"><a style=\"color: #0000ff;\" href=\"https:\/\/www.regulations.gov\/document\/EPA-HQ-OPP-2020-0250-0010\">Glufosinate-P<\/a><\/span> is an enriched isomer of glufosinate, a broad-spectrum herbicide registered in the U.S. that targets glutamine synthetase to inhibit photosynthesis and poison plants. While the currently registered active ingredient glufosinate contains both D- and L-isomers, only the L-isomer (glufosinate-P) is herbicidally active. Two forms\u2014glufosinate-P and its ammonium salt, glufosinate-P-ammonium\u2014are being registered as functionally equivalent, and EPA <span style=\"color: #0000ff;\"><a style=\"color: #0000ff;\" href=\"https:\/\/downloads.regulations.gov\/EPA-HQ-OPP-2020-0250-0028\/content.pdf\">states<\/a><\/span>, \u201cGlufosinate-P-ammonium is the ammonium salt of glufosinate-P and shares all the herbicidal properties for glufosinate-P,&#8221; as mentioned in the <span style=\"color: #0000ff;\"><a style=\"color: #0000ff;\" href=\"https:\/\/www.regulations.gov\/docket\/EPA-HQ-OPP-2020-0533\">document<\/a><\/span> entitled Memorandum Supporting Final Decision to Approve Registration for the New Active Ingredient Isomer, Glufosinate-P (Docket ID: EPA-HQ-OPP-2020-0533). Both are nonselective, postemergence contact herbicides. To <span style=\"color: #0000ff;\"><a style=\"color: #0000ff;\" href=\"https:\/\/downloads.regulations.gov\/EPA-HQ-OPP-2020-0250-0026\/content.pdf\">align<\/a><\/span> with the International Organization for Standardization (ISO) naming conventions, EPA is establishing tolerances for glufosinate-P, the ISO standard name for L-glufosinate-free acid.\u00a0<\/p>\n<p>For years, EPA failed to comply with ESA by not accounting for impacts to threatened and endangered species (<span style=\"color: #0000ff;\">\u201c<a style=\"color: #0000ff;\" href=\"https:\/\/www.epa.gov\/endangered-species\/epas-workplan-and-progress-toward-better-protections-endangered-species\">listed species<\/a>\u201d<\/span>) when <span style=\"color: #0000ff;\"><a style=\"color: #0000ff;\" href=\"https:\/\/www.epa.gov\/endangered-species\/epas-workplan-and-progress-toward-better-protections-endangered-species\">approving pesticide usage<\/a> <\/span>under the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA) (see <a href=\"https:\/\/beyondpesticides.org\/dailynewsblog\/2020\/08\/court-decision-highlights-systemic-failure-of-federal-pesticide-law-to-protect-health-and-the-environment-despite-a-silver-lining-and-a-must-read-powerful-dissenting-opinion\/\">here<\/a>, <span style=\"color: #0000ff;\"><a style=\"color: #0000ff;\" href=\"https:\/\/beyondpesticides.org\/dailynewsblog\/2024\/06\/epa-mitigation-menu-called-complex-raising-doubts-about-required-endangered-species-protection\/\">here<\/a><\/span> and <span style=\"color: #0000ff;\"><a style=\"color: #0000ff;\" href=\"https:\/\/beyondpesticides.org\/dailynewsblog\/category\/wildlifeenvironment\/endangered-species-act-esa\/\">here<\/a><\/span>). Prior to the Herbicide Strategy Framework, EPA leveraged a chemical-by-chemical, species-by-species approach to meet its ESA obligations: an extremely slow process resulting in less than a five percent completion rate. The reactivity found EPA responding to legal challenges rather than proactively addressing endangered species concerns, and by early 2021 the agency faced nearly <a href=\"https:\/\/www.epa.gov\/endangered-species\/endangered-species-litigation-and-associated-pesticide-limitations\"><span style=\"color: #0000ff;\">two dozen lawsuits<\/span><\/a> covering thousands of pesticide products directly related to this <span style=\"color: #0000ff;\"><a style=\"color: #0000ff;\" href=\"https:\/\/beyondpesticides.org\/dailynewsblog\/2022\/12\/federal-court-sets-deadline-for-epa-to-implement-endangered-species-protections-from-toxic-insecticide\/\">failure<\/a>.<\/span> \u00a0As a result, the agency acknowledged its failure to properly assess impacts on threatened and endangered species and, in the following year, <span style=\"color: #0000ff;\"><a style=\"color: #0000ff;\" href=\"https:\/\/www.epa.gov\/newsreleases\/epa-announces-plan-protect-endangered-species-and-support-sustainable-agriculture\">released a work plan<\/a><\/span> to guide program improvements, including strategies for EPA\u2019s pesticide program to meet its ESA obligations. In August 2024, EPA published the Final Draft of its new <span style=\"color: #0000ff;\"><a style=\"color: #0000ff;\" href=\"https:\/\/www.regulations.gov\/document\/EPA-HQ-OPP-2023-0365-1137\">Herbicide Strategy Framework<\/a><\/span> to \u201cassess potential impacts and identify mitigations to reduce potential population-level impacts to listed species from the use of agricultural herbicides.\u201d<\/p>\n<p>The agency\u2019s Herbicide Strategy Framework utilizes a three-step decision-making process for determining appropriate <span style=\"color: #0000ff;\"><a style=\"color: #0000ff;\" href=\"https:\/\/www.epa.gov\/pesticides\/mitigation-menu\">mitigation <span style=\"color: #0000ff;\">measures<\/span><\/a>:<\/span><\/p>\n<ol>\n<li>Determine the potential for population-level impacts to listed species as \u201cnot likely,\u201d \u201clow,\u201d \u201cmedium,\u201d or \u201chigh,\u201d based on environmental fate and toxicity data submitted by registrants and EPA\u2019s standard models.<\/li>\n<li>Identify required mitigation requirements to reduce drift and runoff to non-target species to reduce exposure levels for listed species: three points of mitigation for \u201clow\u201d impacts, six points for \u201cmedium impacts,\u201d and nine points for \u201chigh\u201d impacts.<\/li>\n<li>Identify where geographically the mitigation measures identified in Step 2 will apply (i.e., some mitigation measures will be required everywhere while others may only be applied in specific geographic regions).<\/li>\n<\/ol>\n<p>In a notable change from an earlier <span style=\"color: #0000ff;\"><a style=\"color: #0000ff;\" href=\"https:\/\/www.epa.gov\/pesticides\/epa-releases-draft-strategy-better-protect-endangered-species-herbicide-use\">draft<\/a><\/span> of the Framework, <span style=\"color: #0000ff;\"><a style=\"color: #0000ff;\" href=\"https:\/\/www.epa.gov\/newsreleases\/epa-finalizes-first-its-kind-strategy-protect-900-endangered-species-herbicides\">EPA now allows<\/a><\/span> pesticide applicators to reduce buffer zones around herbicide applications by implementing additional measures to control spray drift. The mitigation options vary based on the method of application and include using specialized equipment, lowering the application rate, adding physical barriers like windbreaks or hedgerows, adjusting the treated area\u2019s width, and considering relative humidity. Each measure has an assigned percentage value by which the buffer can be reduced. For example, a 100-foot buffer could be lowered to 80 feet if a mitigation measure with a 20% reduction is applied.<\/p>\n<p><span style=\"color: #0000ff;\"><a style=\"color: #0000ff;\" href=\"https:\/\/www.epa.gov\/newsreleases\/epa-finalizes-first-its-kind-strategy-protect-900-endangered-species-herbicides\">According<\/a> <\/span>to EPA Deputy Assistant Administrator for Pesticide Programs for the Office of Chemical Safety and Pollution Prevention Jake Li, \u201cBy identifying protections earlier in the pesticide review process, we are far more efficiently protecting listed species from the millions of pounds of herbicides applied each year and reducing burdensome uncertainty for the farmers that use them.\u201d However, EPA also notes that the strategy itself does not impose immediate requirements or restrictions on pesticide use. Instead, it &#8216;requires\u2019 pesticide users to research and consider implementing possible and various mitigation options, depending on their geographical location and guidance available online, linked to pesticide labels.<\/p>\n<p>EPA\u2019s decision on glufosinate employs the Herbicide Strategy Framework to identify mitigation measures for potential impacts on endangered species\u2014before completing the <span style=\"color: #0000ff;\"><a style=\"color: #0000ff;\" href=\"https:\/\/www.epa.gov\/pesticides\/epa-registers-new-herbicide-active-ingredient-glufosinate-p\">required formal consultation<\/a><\/span> with the U.S. Fish and Wildlife Service (USFWS) or the National Marine Fisheries Service (NMFS). This approach aims to streamline the process by addressing likely impacts in advance. However, advocates <span style=\"color: #0000ff;\"><a style=\"color: #0000ff;\" href=\"https:\/\/www.regulations.gov\/comment\/EPA-HQ-OPP-2020-0250-0035\">argue<\/a><\/span> that this framework will certainly undermine ESA protections, as it relies on assumptions about species impacts without fully consulting USFWS and NMFS. They are concerned that the EPA\u2019s preliminary mitigation measures may not fully address or protect endangered species due to the limited input from these agencies before the final consultation is complete.<\/p>\n<p><em>Glufosinate mitigation requirements<\/em><\/p>\n<p>EPA\u2019s <a href=\"https:\/\/www.epa.gov\/pesticides\/epa-registers-new-herbicide-active-ingredient-glufosinate-p\"><span style=\"color: #0000ff;\">registration<\/span><\/a> <span style=\"color: #0000ff;\"><a style=\"color: #0000ff;\" href=\"https:\/\/www.epa.gov\/pesticides\/epa-registers-new-herbicide-active-ingredient-glufosinate-p\">decision<\/a><\/span> on glufosinate-P requires \u201cthe implementation of the following mitigation measures to address on- and off-field effects to nontarget species, including listed species:<\/p>\n<ul>\n<li>Prohibiting application during rainfall and when soils are saturated or above field capacity;<\/li>\n<li>Requiring users to visit EPA\u2019s <span style=\"color: #0000ff;\"><a style=\"color: #0000ff;\" href=\"https:\/\/www.epa.gov\/pesticides\/mitigation-menu\">Mitigation Menu Website<\/a><\/span> before application and determine an appropriate strategy for meeting or exceeding the required number of mitigation points as specified on the label;<\/li>\n<li>Maintaining a downwind buffer between the last spray row and the protection area of 50 feet for aerial application and 10 feet for ground application; and,<\/li>\n<li>Instructing users to access and follow any applicable endangered species bulletins for the two listed species&#8211;the Spring Creek bladderpod plant and the whorled sunflower plant&#8211;from \u2018<span style=\"color: #0000ff;\"><a style=\"color: #0000ff;\" href=\"https:\/\/www.epa.gov\/endangered-species\/bulletins-live-two-view-bulletins\">Bulletins Live! Two\u2019<\/a><\/span> web-based system in English for all additional directions and restrictions.\u201d<\/li>\n<\/ul>\n<p>Advocates argue that EPA\u2019s Framework has effectively substituted one problematic and insufficient process for another. Even once a mitigation requirement is identified after a new or renewed pesticide registration, compliance by a pesticide applicator, farmer, or worker operates under a \u201cself-service, honor system,\u201d relying on users to proactively seek information online and then simply consider mitigation steps from a still complex menu of possible choices. EPA <span style=\"color: #0000ff;\"><a style=\"color: #0000ff;\" href=\"https:\/\/www.epa.gov\/newsreleases\/epa-finalizes-first-its-kind-strategy-protect-900-endangered-species-herbicides\">notes<\/a><\/span>: \u201cThe final strategy itself does not impose any requirements or restrictions on pesticide use. Rather, EPA will use the strategy to inform mitigations for new active ingredient registrations and registration review of conventional herbicides.\u201d \u00a0Therefore, with this Framework, EPA does not appear to establish clear and specific use and site restrictions communicated through a pesticide label, which has historically been established as a set of enforceable legal restrictions under federal pesticide law.<\/p>\n<p>Critics observe that EPA does not possess the scientific expertise, nor the statutory authority, to accurately determine the potential for \u201cpopulation level\u201d impacts to \u201clisted species.\u201d They are obligated to rely on the USFWS and NMFS through a consultation process to make such assessments of the potential effects on species that inhabit such complex ecological systems. Therefore, any pesticide that has not gone through a complete ESA consultation cannot have been properly evaluated. (The Center for Biological Diversity argued this in its June 2024 <span style=\"color: #0000ff;\"><a style=\"color: #0000ff;\" href=\"https:\/\/www.regulations.gov\/comment\/EPA-HQ-OPP-2020-0250-0035\">comments<\/a><\/span>.)<\/p>\n<p>For <span style=\"color: #0000ff;\"><a style=\"color: #0000ff;\" href=\"https:\/\/www.regulations.gov\/comment\/EPA-HQ-OPP-2020-0250-0035\">example<\/a><\/span>, there is a significant overlap (20-75%) between the habitats of some terrestrial invertebrate pollinators, such as bees and butterflies, and the areas where this pesticide is most likely to be employed. Moreover, L-glufosinate is considered \u201cmobile\u201d to \u201chighly mobile\u201d in soil and can reasonably be expected to be applied in areas of the U.S. with \u201chigh\u201d runoff potential. Thus, the requirements of only a 50-foot buffer and one point of runoff mitigation are expected to be insufficiently protective. Migration of toxic chemicals into adjacent habitats could imperil not just listed plant species, but the habitats of listed animal species.<\/p>\n<p>Beyond Pesticides and fellow changemakers\u2014including organic and regenerative organic farmers and advocates\u2014have long argued that the failure of EPA to consider the viability, productivity, and profitability of organic practices and product alternatives to conventional pesticides means the agency\u2019s registration and reregistration of toxic pesticides, including glufosinate-P, have not been subject to a complete assessment. In this context and given the availability of less and nontoxic alternatives, EPA has failed in its responsibility to ensure that pesticides registered for use under FIFRA will not cause <span style=\"color: #0000ff;\"><a style=\"color: #0000ff;\" href=\"https:\/\/www.epa.gov\/laws-regulations\/summary-federal-insecticide-fungicide-and-rodenticide-act\">unreasonable adverse effects<\/a><\/span>. In fact, EPA notes in an <span style=\"color: #0000ff;\"><a style=\"color: #0000ff;\" href=\"https:\/\/www.regulations.gov\/document\/EPA-HQ-OPP-2008-0190-0055\">interim decision<\/a><\/span> on glufosinate from 2016, \u201cThe (EPA) registration review program is intended to make sure that, as the ability to assess and reduce risk evolves and as policies and practices change, all registered pesticides continue to meet the statutory standard of no unreasonable adverse effects.\u201d<\/p>\n<p>The planet is facing an urgent <span style=\"color: #0000ff;\"><a style=\"color: #0000ff;\" href=\"https:\/\/beyondpesticides.org\/dailynewsblog\/2020\/04\/one-quarter-of-global-insect-population-lost-since-1990\/\">biodiversity<\/a><\/span> crisis, with more species approaching extinction than ever before (see<span style=\"color: #0000ff;\"> <a style=\"color: #0000ff;\" href=\"https:\/\/www.beyondpesticides.org\/resources\/journals\">here<\/a> <\/span>and <span style=\"color: #0000ff;\"><a style=\"color: #0000ff;\" href=\"https:\/\/beyondpesticides.org\/dailynewsblog\/2024\/08\/elevating-the-urgent-need-to-take-action-drawing-on-the-epas-emergency-ban-of-the-weed-killer-dacthal-dcpa\/\">here<\/a><\/span>). The purpose of ESA is to <span style=\"color: #0000ff;\"><a style=\"color: #0000ff;\" href=\"https:\/\/beyondpesticides.org\/dailynewsblog\/2023\/10\/confronting-dramatic-biodiversity-loss-on-50th-anniversary-of-endangered-species-act\/#:~:text=and%20their%20habitats.-,Pesticide%20use%20is%20a%20major%20cause%20of%20declining%20biodiversity%2C%20which,habitat%20fragmentation%2C%20and%20toxic%20chemicals.\">address<\/a><\/span> this <a href=\"https:\/\/beyondpesticides.org\/dailynewsblog\/2023\/10\/confronting-dramatic-biodiversity-loss-on-50th-anniversary-of-endangered-species-act\/#:~:text=and%20their%20habitats.-,Pesticide%20use%20is%20a%20major%20cause%20of%20declining%20biodiversity%2C%20which,habitat%20fragmentation%2C%20and%20toxic%20chemicals.\"><span style=\"color: #0000ff;\">loss of biodiversity<\/span><\/a> by protecting habitats critical to the survival of the most at-risk species. Pesticide use is a major driver of biodiversity decline, contributing to extinctions and elevating species\u2019 vulnerability to environmental challenges such as climate change, habitat fragmentation, and exposure to toxic chemicals. To protect biodiversity, EPA is charged with examining how its <span style=\"color: #0000ff;\"><a style=\"color: #0000ff;\" href=\"https:\/\/beyondpesticides.org\/dailynewsblog\/2024\/08\/beyond-pesticides-rallies-public-to-ban-weed-killer-atrazine-with-standard-epa-used-earlier-to-ban-dacthal\/\">decis<span style=\"color: #0000ff;\">ions<\/span><\/a><\/span> may exacerbate this crisis. Pesticides are a leading factor in the decline of insect populations and diversity, often referred to as the \u201c<span style=\"color: #0000ff;\"><a style=\"color: #0000ff;\" href=\"https:\/\/beyondpesticides.org\/dailynewsblog\/tag\/insect-apocalypse\/\">insect apocalypse<\/a><\/span>,\u201d which threatens ecosystems across the planet. This decision marks one of the first times that EPA has employed its new Herbicide \u00a0Strategy\u00a0Framework to determine the level of mitigation necessary to protect listed species and critical habitat under the Endangered Species Act (ESA). Glufosinate is an organophosphate, with known neurotoxic, reproductive\/developmental effects, toxic to aquatic life, and mobile in soils (see Beyond Pesticides Gateway). Scientists have found that formulated glufosinate is generally more toxic to aquatic and terrestrial animals than the technical grade active ingredient. Manufacturers are introducing newer glufosinate products as alternatives for glyphosate-based herbicides, like Bayer\/Monsanto\u2019s \u2018Roundup\u2019 and dicamba. The Center for Biological Diversity notes in comments submitted to EPA on this decision, \u201cL-glufosinate has the potential to be used on tens of millions acres of land every year given the crops EPA has proposed to register it on.
