(Beyond Pesticides<\/em>, March 24, 2025) In establishing the Make America Healthy Again Commission<\/a> in February, the President tapped Secretary of the U.S. Department of Health and Human Services Robert F. Kennedy, Jr. to chair the interagency panel. The stated goal, as described in the founding proclamation, is \u201cdrastically lowering chronic disease rates and ending childhood chronic disease.\u201d The commission document states, \u201cOverall, the global comparison data demonstrates that the health of Americans is on an alarming trajectory that requires immediate action.\u201d<\/p>\r\n

In this context, on March 10, Secretary Kennedy\u00a0directed<\/a>\u00a0Food and Drug Administration (FDA) Acting Commissioner Sara Brenner, MD to take steps to explore potential rulemaking to revise its Substances Generally Recognized as Safe (GRAS) Final Rule and related guidance to eliminate the self-affirmed GRAS pathway\u2014allowing the food and chemical industry to assign GRAS status to food ingredients without oversight. This \u201cpathway\u201d to allowing food additives has long been recognized<\/a>\u00a0as a loophole that allows unidentified and potentially harmful additives in food, including by the 2010 U.S. General Accountability Office (GAO) report,\u00a0Food Safety: FDA Should Strengthen Its Oversight of Food Ingredients Determined to Be Generally Recognized as Safety<\/a>.\u00a0<\/p>\r\n

As a result of the adoption of the GRAS process, the\u00a0Center for Food Safety<\/a>\u00a0estimates that 3,000 chemicals that have never been scrutinized by the FDA are in use today. \u00a0<\/p>\r\n

In September 2024, U.S. Representative Rosa DeLauro (D-CT) re-introduced the\u00a0Toxic Free Foods Act<\/em><\/a>, to overhaul FDA’s process for determining the safety of chemicals used in the food supply. The\u00a0Toxic Free Food Act\u00a0<\/em>would require FDA to close the GRAS loophole and make the industry’s chemical food additives subject to FDA approval. The legislation failed to pass in the last (118th) Congress but should be reintroduced and passed in order to provide a more permanent solution to the problem.<\/p>\r\n
