Legislation to quash lawsuits against chemical manufacturers because of their \u201cfailure to warn\u201d about the hazards of their pesticide products is being pushed through state legislatures. Failure-to-warn claims serve as the basis for the overwhelming majority of pesticide injury litigation of the past decade, according to legal professionals, including Brigit Rollins, JD, staff attorney at the\u202f<a href=\"https:\/\/nationalaglawcenter.org\/states-introduce-pesticide-liability-limitation-bills-in-2025-legislative-session\/\" target=\"_blank\" rel=\"noreferrer noopener\">National Agriculture Law Center<\/a>. The litigation is also an important check on the chemical industry in a national climate of deregulation and the Trump Administration&#8217;s dismantling of\u00a0<a href=\"https:\/\/www.latimes.com\/environment\/story\/2025-04-05\/trump-is-gutting-the-nations-environmental-programs-heres-how-much-it-will-cost-americans\" target=\"_blank\" rel=\"noreferrer noopener\">environmental and public health programs.<\/a>\u00a0&#8220;Failure-to-warn&#8221; is a legal argument grounded in the common law of state court systems across the nation. \u201cAlmost every pesticide injury lawsuit filed in the past ten years has included a claim that the pesticide manufacturer failed to warn the plaintiff of the health risks associated with using their product and that such failure caused the plaintiff&#8217;s injury,\u201d says Ms. Rollins.\u00a0<\/p>\n<p><strong>[See below for action steps advocated by Beyond Pesticides and local state-based organizations.]<\/strong><\/p>\n<p>Attacks on \u201cfailure-to-warn\u201d liability claims are taking place in the wake of extraordinary jury verdicts against Bayer\/Monsanto for harm caused by Roundup(TM) glyphosate and the company&#8217;s failure to have its case heard by the U.S. Supreme Court after losing in the lower courts. The latest numbers indicate that\u00a0<a href=\"https:\/\/www.lawsuit-information-center.com\/roundup-lawsuit.html\" target=\"_blank\" rel=\"noreferrer noopener\">Bayer-Monsanto alone has had to settle $11 billion for glyphosate<\/a>\u00a0use and exposure, prompting the industry to attack the right of those harmed to sue for the company&#8217;s failure to warn them about the product&#8217;s hazards.\u00a0\u00a0<\/p>\n<p>Pesticide exposure contributes to heightened risk of severe health conditions, including, but not limited to, various cancers, neurological disorders, reproductive disorders, immunological disorders, and obesity.\u00a0<\/p>\n<p>According to the\u00a0<a href=\"https:\/\/gis.cdc.gov\/cancer\/USCS\/#\/AtAGlance\/\" target=\"_blank\" rel=\"noreferrer noopener\">U.S. Centers for Disease Control and Prevention<\/a>,\u00a0<strong>1,777,566<\/strong>\u00a0new cancer cases were reported in 2021 (the latest year of available incidence data). Not all cancer cases are directly related to pesticides;\u00a0however, the\u00a0<a href=\"https:\/\/www.cancer.gov\/about-cancer\/understanding\/statistics#:~:text=Approximately%2040.5%25%20of%20men%20and,on%202017%E2%80%932019%20data).\" target=\"_blank\" rel=\"noreferrer noopener\">National Cancer Institute<\/a>\u00a0notes, &#8220;[a]pproximately\u00a0<strong>40.5% of men and women<\/strong>\u00a0will be diagnosed with cancer at some point during their lifetimes (based on 2017\u20132019 data).&#8221; Given that up to\u00a0<strong>93% of cancer diagnoses<\/strong>\u00a0can be attributed to non-hereditary, environmental factors (<a href=\"https:\/\/pmc.ncbi.nlm.nih.gov\/articles\/PMC3521879\/#:~:text=DNA%2Dmismatch%20repair%20genes%2C%204,cancers%20are%20hereditary%20(8).\" target=\"_blank\" rel=\"noreferrer noopener\">National Institutes of Health<\/a>), we must raise the question of the long-term viability of pesticide dependence given the availability of organic land management and safer structural practices. A 2022 study commissioned by the\u00a0<a href=\"https:\/\/www.parkinson.org\/understanding-parkinsons\/statistics\/prevalence-incidence#:~:text=Parkinson's%20Incidence,rate%20of%2060%2C000%20diagnoses%20annually.\" target=\"_blank\" rel=\"noreferrer noopener\">Parkinson&#8217;s Foundation<\/a>\u00a0found there was a<strong>\u00a050% increase<\/strong>\u00a0in expected annual diagnoses for Parkinson&#8217;s Disease, with<strong>\u00a090,000 new individuals<\/strong>\u00a0diagnosed each year. Data from the CDC-led\u00a0<a href=\"https:\/\/www.cdc.gov\/nchs\/products\/databriefs\/db508.htm\" target=\"_blank\" rel=\"noreferrer noopener\">National Health and Nutrition Examination Survey<\/a>\u00a0(2021-2023) indicates that approximately\u00a0<strong>four in ten Americans are obese.<\/strong>\u00a0<\/p>\n<p>Amidst the corresponding surges in chronic illnesses and severe health diagnoses of the past decades, alongside the unprecedented increases in pesticide use around the nation, the long-term viability of pesticide dependence must be questioned.\u00a0<\/p>\n<p>State legislation to quash lawsuits against chemical manufacturers who fail to warn users about the hazards of their pesticide products is moving forward in the state legislatures of\u00a0<a href=\"https:\/\/secure.everyaction.com\/vddGGssl-0etkkcTPMZueA2\">Florida<\/a>,\u00a0<a href=\"https:\/\/secure.everyaction.com\/OZqsI6m4sEOnXHhDt6HwfQ2\" target=\"_blank\" rel=\"noreferrer noopener\">Iowa<\/a>,\u00a0<a href=\"https:\/\/secure.everyaction.com\/pg8x6P0FKEOhewfJozqUKA2##anchor\" target=\"_blank\" rel=\"noreferrer noopener\">Missouri<\/a>, and\u00a0<a href=\"https:\/\/secure.everyaction.com\/mUbj-5aJjUu0T6TZbnSKBQ2\">North Carolina<\/a>, having just been passed in\u00a0<a href=\"https:\/\/secure.everyaction.com\/Bh5kEE1hP0y2gsQyZg-jBg2\" target=\"_blank\" rel=\"noreferrer noopener\">North Dakota<\/a>. After six bills failed to pass in <a href=\"https:\/\/secure.everyaction.com\/Kn7capf4nE-Gg-tqt6m4kA2\">Idaho<\/a>, <a href=\"https:\/\/secure.everyaction.com\/Ghjl8y_7-U6qFMmgKeeDrA2\">Oklahoma<\/a>, <a href=\"https:\/\/secure.everyaction.com\/TDetFslJwEeDu0U1itGOAw2\" target=\"_blank\" rel=\"noreferrer noopener\">Mississippi<\/a>, <a href=\"https:\/\/secure.everyaction.com\/nFFfFLv9LEOfGGqBPmH5Ww2\" target=\"_blank\" rel=\"noreferrer noopener\">Montana<\/a>, <a href=\"https:\/\/secure.everyaction.com\/Z2Jv_JHzPEOP6q352aMRQg2\">Tennessee<\/a>, and <a href=\"https:\/\/secure.everyaction.com\/46z_823DIkWw51GIsn0iDA2\" target=\"_blank\" rel=\"noreferrer noopener\">Wyoming<\/a>, one bill is awaiting signature into law by the Governor&#8217;s Office (<a href=\"https:\/\/secure.everyaction.com\/J3gblYw7i0mR1JsM6DibUA2\" target=\"_blank\" rel=\"noreferrer noopener\">Georgia<\/a>). <strong>Meanwhile,\u00a0<a href=\"https:\/\/www.beyondpesticides.org\/resources\/failure-to-warn\" target=\"_blank\" rel=\"noreferrer noopener\">Beyond Pesticides<\/a>, working with a broad coalition, is pushing back.<\/strong><\/p>\n<p>If adopted, the legislation would set a dangerous precedent granting \u201cimmunity from litigation\u201d for state common law claims against any manufacturers of products with toxic ingredients. Currently, pesticide labels under federal and state law generally warn of acute effects, such as rashes, headaches, stinging eyes, but do not warn of potential chronic effects, including cancer, reproductive effects, infertility, birth defects, Alzheimer&#8217;s and Parkinson&#8217;s disease, diabetes, and cardiovascular damage.\u00a0<em>S<\/em><em>ee the\u00a0<a href=\"https:\/\/www.beyondpesticides.org\/resources\/pesticide-induced-diseases-database\/overview\" target=\"_blank\" rel=\"noreferrer noopener\">Pesticide-Induced Diseases Database<\/a>.<\/em>\u00a0<\/p>\n<p>After years of large jury awards, preemptive settlements, and lost appeals in cases involving exposure to the weedkiller glyphosate,\u00a0<a href=\"https:\/\/beyondpesticides.org\/dailynewsblog\/category\/corporations\/bayer\/\" target=\"_blank\" rel=\"noreferrer noopener\">Bayer<\/a>\/<a href=\"https:\/\/beyondpesticides.org\/dailynewsblog\/category\/corporations\/monsanto\/\" target=\"_blank\" rel=\"noreferrer noopener\">Monsanto<\/a>\u00a0is trying to stop the company&#8217;s financial hemorrhaging with a state-by-state strategy to deny victims access to the courts. To accomplish this, Bayer has founded, along with agribusiness groups including State Farm Bureaus, a coalition to stop \u201cfailure-to-warn\u201d lawsuits with state legislation. Bayer&#8217;s coalition,\u00a0<a href=\"https:\/\/modernagalliance.org\/\" target=\"_blank\" rel=\"noreferrer noopener\">Modern Ag Alliance<\/a>, says it is fighting what they describe as \u201cscientifically unsound lawsuits\u201d on the weedkiller glyphosate. The alliance says,\u00a0<strong>\u201cIf we don&#8217;t act, the future of glyphosate and other valuable crop protection tools and critical innovations may be at stake.\u201d As has been reported widely,\u00a0<a href=\"https:\/\/beyondpesticides.org\/dailynewsblog\/2024\/02\/bayer-monsanto-in-roundup-glyphosate-case-stung-with-largest-multi-billion-dollar-jury-award-turns-to-state-houses-to-stop-litigation\/\" target=\"_blank\" rel=\"noreferrer noopener\">Bayer\/Monsanto has lost<\/a>\u00a0numerous multimillion-dollar lawsuits because of its \u201cfailure to warn\u201d of its product&#8217;s hazards\u00a0to those who have been harmed. The company&#8217;s defeats include a\u00a0<a href=\"https:\/\/beyondpesticides.org\/dailynewsblog\/2022\/06\/supreme-court-lets-stand-large-jury-verdicts-on-roundup-appeals-court-finds-epa-registration-unlawful\/\" target=\"_blank\" rel=\"noreferrer noopener\">U.S. Supreme Court denial<\/a>\u00a0(denial of certiorari) to hear their appeal. With this, Bayer has taken its campaign to the states to strip away\u202fthe people&#8217;s\u00a0(including farmers&#8217;) ability to hold corporations accountable through a common law duty to warn claims associated with pesticide products.\u00a0<\/strong><\/p>\n<p>Despite decades of lobbying by the agrichemical industry to ensure an extremely weak and unprotective federal pesticide registration law, under the\u00a0<em>Federal Insecticide, Fungicide, and Rodenticide Act<\/em>\u00a0(FIFRA), the industry argues that federal law should preempt people&#8217;s right to sue and communities&#8217; right to restrict pesticides more stringently than the ineffective federal and state laws that the industry has a hand in writing. So far, the U.S. Supreme Court in\u00a0<em><a href=\"https:\/\/www.beyondpesticides.org\/assets\/media\/documents\/BatesvDow.2025.pressrelease.2.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">Bates et al. v Dow Agrosciences<\/a><\/em>\u00a0(544 U.S. 431, 2005) has found that citizens damaged by pesticides have the right to sue producers of toxic products, saying that federal pesticide law does not offer adequate protection from \u201cmanufacturers of poisonous substances.\u201d Importantly, \u201cfailure-to-warn\u201d claims serve as the de facto legal backstop to hold pesticide companies accountable, given the limitations of the federal and state regulatory systems. Litigation not only holds chemical manufacturers accountable but also incentivizes more responsible corporate behavior across the board, resulting in safer products.\u00a0<\/p>\n<p>The U.S. Supreme Court has also upheld the right of communities to restrict pesticides more stringently than the federal government in\u00a0<em><a href=\"https:\/\/beyondpesticides.org\/dailynewsblog\/2023\/07\/take-action-dont-allow-the-pesticide-lobby-to-strip-local-and-states-authority-to-restrict-pesticide-use\/\" target=\"_blank\" rel=\"noreferrer noopener\">Wisconsin Public Intervenor \u202fv. Mortier<\/a><\/em>\u00a0(501 U.S. 597, 1991), but that victory for local democratic process to protect residents&#8217; and ecosystems&#8217; health has been thwarted by laws in at least 44 states that preempt the authority of their local municipalities. The question now is whether the chemical industry playbook will yield a similar result and preempt people&#8217;s right to sue in cases of \u201cfailure-to-warn.\u201d\u00a0<\/p>\n<p>In the U.S. Congress, pesticide immunity language has been included in previous Farm Bill language and the Fiscal Year 2025 Appropriations bill (<em>see Daily News\u00a0<a href=\"https:\/\/beyondpesticides.org\/dailynewsblog\/2024\/06\/gop-senate-farm-bill-framework-similar-to-house-bill-cited-as-elevated-threats-to-health-biodiversity-and-climate\/\" target=\"_blank\" rel=\"noreferrer noopener\">here<\/a><\/em>), as well as in\u00a0ongoing Environmental Protection Agency (EPA) rulemaking, advanced by\u00a0<a href=\"https:\/\/beyondpesticides.org\/dailynewsblog\/2025\/02\/beyond-pesticides-calls-for-public-comment-to-stop-prohibitions-on-state-pesticide-hazard-warnings\/\" target=\"_blank\" rel=\"noreferrer noopener\">11 Republican Attorneys General<\/a>. <em>Although the public hearing comment period ended on March 24, see the Action of the Week\u00a0<a href=\"https:\/\/secure.everyaction.com\/t3qWtPA-MUOT38FxDea8bA2##anchor\" target=\"_blank\" rel=\"noreferrer noopener\">here<\/a> for more background.<\/em>\u00a0So, the industry campaign is aggressively playing out at the state and federal levels.\u00a0<\/p>\n<p><strong>Public opinion does not support the chemical industry.<\/strong>\u00a0<a href=\"https:\/\/s3.amazonaws.com\/membercentralcdn\/sitedocuments\/ia\/ia\/0666\/2673666.pdf?AWSAccessKeyId=AKIAIHKD6NT2OL2HNPMQ&amp;Expires=1745949870&amp;Signature=E4TUF40smovSk2EXbI%2BHX9XEiM4%3D&amp;response-content-disposition=inline%3B%20filename%3D%22IOWA%20PESTICIDE%20POLLING%20RESULTS%2Epdf%22%3B%20filename%2A%3DUTF%2D8%27%27IOWA%2520PESTICIDE%2520POLLING%2520RESULTS%252Epdf&amp;response-content-type=application%2Fpdf\" target=\"_blank\" rel=\"noreferrer noopener\">Accountable Iowa<\/a>\u00a0conducted a survey of 875 Iowa voters in the 2024 election cycle on their views on the pesticide immunity bill, and the results do not support the industry&#8217;s position. Across all surveyed voters, regardless of political affiliation or demographic makeup, the public overwhelmingly distrusts chemical corporations and opposes giving them legal shields from lawsuits. This opposition is built upon shared concerns about the corrupt entanglements and history of EPA and Bayer\/Monsanto. Voters also shared a preference to hold chemical companies accountable for causing serious health issues. Failure to warn the plaintiff of the health risks associated with using the product has been the basis for almost all pesticide injury lawsuits.<\/p>\n<p>Attacks on \u201cfailure-to-warn\u201d liability claims are taking place in the wake of extraordinary jury verdicts against Bayer\/Monsanto for harm caused by Roundup(TM) glyphosate and the company\u2019s failure to have its case heard by the U.S. Supreme Court after losing in the lower courts. The latest numbers indicate that Bayer-Monsanto alone has had to settle $11 billion for glyphosate use and exposure, prompting the industry to attack the right of those harmed to sue for the company\u2019s failure to warn them about the product\u2019s hazards.<\/p>\n<p>After years of large jury awards, preemptive settlements, and lost appeals in cases involving exposure to the weedkiller glyphosate, Bayer\/Monsanto is trying to stop the company\u2019s financial hemorrhaging with a state-by-state strategy to deny victims access to the courts. To accomplish this, Bayer has created a coalition to stop \u201cfailure-to-warn\u201d lawsuits with state legislation. Bayer\u2019s coalition, Modern Ag Alliance, says it is fighting what they describe as \u201cscientifically unsound lawsuits\u201d on the weedkiller glyphosate. The alliance says, \u201cIf we don\u2019t act, the future of glyphosate and other valuable crop protection tools and critical innovations may be at stake.\u201d As has been reported widely, Bayer\/Monsanto has lost numerous multimillion-dollar lawsuits because of its \u201cfailure to warn\u201d of its product\u2019s hazard by those who have been harmed. The company\u2019s defeats include a U.S. Supreme Court denial (denial of certiorari) to hear their appeal. With this, Bayer has taken its campaign to the states to strip away\u202fthe ability of people (including farmers) to hold corporations accountable through a common law duty to warn claims associated with pesticide products.<\/p>\n<p>Pesticide exposure contributes to heightened risk of severe health conditions, including but not limited to, various cancers, neurological disorders, reproductive disorders, immunological disorders, and obesity, none of which are mentioned on pesticide labels. When pesticide manufacturers hold back information about severe harms, they must be held accountable.<\/p>\n<p>Please reject efforts of the pesticide industry to deny people the right to compensation. With the information provided by Beyond Pesticides, people may not only be able to make informed choices and adopt practices that protect themselves and their families from unnecessary exposure to pesticides, but they will be able to effect changes on community-wide pest management decisions and policies that govern pesticide use, such as pesticide uses in parks, schools, for community insect control and along roadsides.
