Brian Fitzpatrick (R-PA), will restore protections against an \u201cincidental take.\u201d Beyond Pesticides is calling for the protection of migratory birds and the restitution of funds to implement the law. This is <a href=\"https:\/\/beyondpesticides.org\/dailynewsblog\/2020\/01\/take-action-help-restore-protections-for-migratory-birds\/\">not the first time<\/a> that President Trump has reduced protection for migratory birds. MBTA originally resulted from the loss of birds due to a number of threats\u2014notably at the time, the collection of bird feathers. It prohibits the take (including killing, capturing, selling, trading, and transport) of protected migratory bird species without prior authorization by the U.S. Department of the Interior&#8217;s U.S. Fish and Wildlife Service (FWS). \u201cTake\u201d has been understood to include not only purposeful killing of birds or stealing their eggs, but also an \u201cincidental take,\u201d which occurs as a result of activities not intended to kill birds. Incidental take is controlled by FWS <a href=\"https:\/\/www.ecfr.gov\/current\/title-50\/chapter-I\/subchapter-B\">regulations<\/a> and <a href=\"https:\/\/abcbirds.org\/wp-content\/uploads\/2015\/06\/MBTA_MOU_OPP_7_March_2014.pdf\">memoranda of understanding<\/a> with regulatory agencies like the U.S. Environmental Protection Agency (EPA). MBTA protects these <a href=\"https:\/\/www.federalregister.gov\/documents\/2023\/07\/31\/2023-15551\/general-provisions-revised-list-of-migratory-birds\">native birds<\/a>.\u00a0 <\/p>\n<p>Until 2017, MBTA protected migratory birds from such incidental taking as oil and gas operations, which account for 90% of migratory bird deaths, industrialization, and pesticide use. In that year, the Trump administration&#8217;s interpretation removed protection from unintentional killing. A lawsuit by environmental groups resulted in <a href=\"https:\/\/www.federalregister.gov\/documents\/2023\/07\/31\/2023-15551\/general-provisions-revised-list-of-migratory-birds\">rulemaking by the Biden administration<\/a> in 2021 reestablishing the protections taken away by the 2017 action. The reinstatement defies a 2020 federal <a href=\"https:\/\/www.bloomberglaw.com\/document\/X10378RPG000N\">court ruling<\/a> that vacated the 2017 solicitor&#8217;s opinion because it failed to align with the MBTA&#8217;s intent to protect migratory birds from accidental killings.\u201d \u00a0 <\/p>\n<p>According to the <a href=\"https:\/\/abcbirds.org\/news\/mbta-april-2025\/\">American Bird Conservancy<\/a>, \u201cEach year, around one billion birds are lost to industrial activity. Over its century-long history, the MBTA has protected millions, if not billions, of birds by prohibiting the sale, possession, and killing of migratory birds without a permit\u2014including through incidental take, defined as the foreseeable and predictable killing of birds from industrial sources.\u201d \u00a0<\/p>\n<p>Many scientific studies tie <a href=\"https:\/\/www.beyondpesticides.org\/programs\/wildlife\/birds\">impacts on bird species<\/a> to the interconnected issues of pesticide exposure, habitat loss, and <a href=\"https:\/\/beyondpesticides.org\/dailynewsblog\/category\/climate-change\/\">climate change<\/a>. From higher insecticide levels in <a href=\"https:\/\/beyondpesticides.org\/dailynewsblog\/2025\/02\/study-finds-increased-offspring-mortality-in-pesticide-laden-birds-nests\/\">pesticide-laden nests<\/a> linked to increased offspring mortality to the <a href=\"https:\/\/beyondpesticides.org\/dailynewsblog\/2023\/07\/study-confirms-continued-bird-decline-as-epa-fails-to-restrict-neonicotinoid-insecticides\/\">threats to seed-eating birds<\/a> from neonicotinoid-treated seeds, agricultural intensification harms bird species within the U.S. and <a href=\"https:\/\/beyondpesticides.org\/dailynewsblog\/2023\/05\/agricultural-pesticide-use-the-primary-driver-of-bird-declines-in-europe\/\">throughout the world<\/a>. The decline in bird populations reflects overall <a href=\"https:\/\/beyondpesticides.org\/dailynewsblog\/2024\/11\/study-reinforces-importance-of-biodiversity-in-agriculture-and-ecosystem-health\/\">ecosystem health<\/a>, which is directly impacted by harmful agricultural practices. These issues have been of concern for decades, back to when Rachel Carson warned in <em>Silent Spring<\/em> how insidious pesticide use can be. The <a href=\"https:\/\/www.stateofthebirds.org\/2025\/download-pdf-report\/\">State of the Birds 2025 report<\/a> finds, \u201cDespite ample evidence that conservation can work, the status quo approach to conservation is not turning bird populations around.\u201d Thus, it is time to strengthen, not weaken, the protection for birds.\u00a0 <\/p>\n<p>MBPA will restore protection against incidental take, but alone, it only returns to a status quo approach.
