This is especially true with the current diminished federal regulatory authority and Bayer\/Monsanto\u2019s <a href=\"https:\/\/beyondpesticides.org\/dailynewsblog\/2026\/01\/u-s-supreme-court-will-decide-if-chemical-manufacturers-can-be-sued-for-failure-to-disclose-pesticide-hazards\/\">U.S. Supreme Court challenge<\/a> of chemical manufacturers\u2019 responsibility to warn users of their products of hazards like cancer.<\/p>\r\n<p><strong>Actions Being Taken<\/strong><\/p>\r\n<ol>\r\n\t<li>In response to the chemical industry campaign to deny people the right to sue under longstanding failure to warn law, groups are calling for public support of U.S Senator Cory Booker\u2019s (D-NJ) bill, <a href=\"https:\/\/www.booker.senate.gov\/imo\/media\/doc\/pesticideinjuryaccountabilityact.pdf\"><em>Pesticide Injury Accountability Act<\/em><\/a>(S. 2324)\u00a0seeks to uphold this right\u00a0 to sue. The groups are calling on the public to \u201c<a href=\"https:\/\/secure.everyaction.com\/nweX86S_G0S7gYEoS0n-ng2##anchor\"><strong>Tell your U.S. Senator to co-sponsor S. 2324, the\u00a0<em>Pesticide Injury Accountability Act<\/em><\/strong><\/a>.\u201d This bill will amend the\u00a0<em>Federal Insecticide, Fungicide, and Rodenticide Act of 1972<\/em>\u00a0(FIFRA) to create a federal right of action for anyone who is harmed by a toxic pesticide.\u00a0<\/li>\r\n\t<li>In an additional action in honor of Martin Luther King, Jr., Beyond Pesticides is calling on the public to \u201c<a href=\"https:\/\/secure.everyaction.com\/alpJr4PnmkqsxrjgJRn--w2##anchor\"><strong>Tell members of Congress to ensure that with the termination of environmental justice programs at EPA,\u00a0they must uphold the right of those at the highest risk\u00a0of\u00a0harm\u00a0to sue manufacturers responsible\u00a0for their failure to warn about\u00a0their\u00a0products&#8217;\u00a0hazards.<\/strong><\/a>\u201d<\/li>\r\n<\/ol>\r\n<p>A 2025 study\u00a0published in\u00a0<em>International Journal of Environmental Research and Public Health<\/em>,\u00a0\u201c<a href=\"https:\/\/www.mdpi.com\/1660-4601\/22\/11\/1683\">Environmental and Human Health Impacts of Agricultural Pesticides on BIPOC Communities in the United States: A Review from an Environmental Justice Perspective<\/a>,\u201d\u00a0in analyzing 128 peer-reviewed articles, books, and reports on pesticides, environmental justice, and\u00a0[Black,\u00a0Indigenous, and People of Color]\u00a0BIPOC communities in the U.S., finds \u201cuneven distribution of pesticide-related health and environmental burdens along racial, ethnic, and socioeconomic\u00a0lines.\u201d\u00a0This finding confirms a <a href=\"https:\/\/www.beyondpesticides.org\/resources\/disproportionate-risks\/overview\">long history documenting disproportionate risk<\/a> of chemical hazards to people of color and their communities. (See also <a href=\"https:\/\/beyondpesticides.org\/dailynewsblog\/2024\/02\/disproportionate-pesticide-hazards-to-farmworkers-and-people-of-color-documented-again\/\">here<\/a>.)<\/p>\r\n<p>Without a\u00a0rigorous regulatory system to\u00a0restrict toxic chemicals, including pesticides,\u00a0from poisoning people, the courts provide a critical\u00a0vehicle for constraining the behavior of corporations\u00a0responsible for harm. Since chemical manufacturers know this, and after over\u00a0$10 billion\u00a0in\u00a0jury verdicts and settlements\u00a0over the last several years\u00a0in cases involving\u00a0the\u00a0weed killer\u00a0glyphosate\/Roundup<sup>TM<\/sup>, they are\u00a0seeking to be shielded from litigation.\u00a0Aware of the termination of regulatory programs that are\u00a0intended to\u00a0protect\u00a0those at greatest risk of harm, the companies, led by\u00a0<a href=\"https:\/\/beyondpesticides.org\/dailynewsblog\/2026\/01\/bayer-monsanto-legislation-to-stop-lawsuits-for-failing-to-disclose-product-hazards-stalls-in-house\/\">Bayer\/Monsanto<\/a>, say publicly that\u00a0their compliance with\u00a0EPA regulations\u00a0should protect them from\u00a0disclosing the hazards of their products and even\u00a0immunize them from\u00a0accountability for\u00a0the harm that they cause.\u00a0<\/p>\r\n<p>Martin Luther King, Jr.\u2019s work to pass the\u00a0landmark\u00a0<a href=\"https:\/\/www.archives.gov\/milestone-documents\/civil-rights-act\">1964\u00a0<em>Civil Rights Act<\/em><\/a>\u00a0advanced\u00a0the principle of racial equality,\u00a0which extends\u00a0to economic and environmental justice. However, when\u00a0the\u00a0<a href=\"https:\/\/www.whitehouse.gov\/presidential-actions\/2025\/01\/ending-radical-and-wasteful-government-dei-programs-and-preferencing\/\">Trump administration<\/a> announced the dismantling of diversity, equity, and inclusion (DEI) programs\u00a0in January 2025,\u00a0ending government-wide efforts to\u00a0address \u201c<a href=\"https:\/\/www.federalregister.gov\/documents\/2021\/01\/25\/2021-01753\/advancing-racial-equity-and-support-for-underserved-communities-through-the-federal-government\">entrenched disparities in our laws and public policies<\/a>,\u201d\u00a0it did not take long for\u00a0the\u00a0U.S. Environmental Protection\u00a0Agency&#8217;s\u00a0(EPA) administrator\u00a0<a href=\"https:\/\/www.epa.gov\/newsreleases\/epa-terminates-bidens-environmental-justice-dei-arms-agency\">Lee Zeldin\u00a0to\u00a0\u201cterminate\u201d<\/a>\u00a0the agency&#8217;s environmental justice program.\u00a0This put the federal government on a path to reject\u00a0the principles\u00a0intended to address\u00a0elevated risk factors\u00a0associated with\u00a0chemical, and specifically pesticide,\u00a0induced illnesses\u00a0for people of color.\u00a0<\/p>\r\n<p>The science\u00a0establishes\u00a0the disproportionate risk associated with pesticide use under current law.\u00a0The authors of a\u00a02022 study,\u00a0\u201c<a href=\"https:\/\/link.springer.com\/article\/10.1186\/s12889-022-13057-4#Abs1\">Pesticides and environmental injustice in the USA: root causes, current regulatory reinforcement and a path forward<\/a>,\u201d\u00a0assert that the disparities identified continue via current regulations and statutes that (1) inadequately protect workers, (2) operate with a pesticide safety \u201cdouble standard,\u201d and (3) permit the export of toxic pesticides to \u201cdeveloping\u201d countries,\u00a0including\u00a0specific findings\u00a0such as:\u00a0<\/p>\r\n<ul>\r\n\t<li><strong>Disproportionate exposures to harmful pesticides:<\/strong>\u202fbiomarkers for 12 dangerous pesticides, tracked over the past 20 years, were found in the blood and urine of\u00a0Mexican-American\u00a0and Black people at average levels up to five times those in white people.\u202f\u00a0<\/li>\r\n\t<li><strong>Weaker protections for agricultural workers:<\/strong>\u202falthough\u202f10,000\u201320,000, largely Latinx, farmworkers are sickened annually from\u202fpesticide exposure, such workers are not covered by the\u202fsame regulatory\u202fpesticide protections provided to the general public.\u202f<\/li>\r\n\t<li><strong>Unequal risks:<\/strong>\u202fpeople of color comprise 38% of the\u202faggregate population of California, Georgia,\u202fArkansas, Tennessee, Missouri,\u202fSouth Carolina, and Louisiana, but that 38% represents 63% of those\u202fliving\u202fnearby to 31 pesticide manufacturing facilities that are in violation of\u202fenvironmental laws (such\u202fas the\u00a0<em>Clean Air Act<\/em>\u00a0and the\u00a0<em>Clean Water Act<\/em>).<\/li>\r\n\t<li><strong>Poor enforcement:<\/strong>\u202fbased on available data for a\u202frecent five-year period, approximately 1% of\u202fagricultural operations that use pesticides\u202fhad any annual inspections for violations of worker\u202fprotections \u2014 despite\u202fviolations found at nearly half of inspected facilities; further, enforcement\u202factions proceeded against only 19% of the violators.<\/li>\r\n\t<li><strong>Toxic housing:<\/strong>\u202f80% of low-income housing sites in\u202fNew York State, for example, regularly apply\u202fpesticides indoors; a home air quality\u202fmonitoring study found that 30% of pregnant African American\u202fand Dominican\u202fwomen in New York City had at least eight pesticides in their bodies, and 83% had\u202fat\u202fleast one pesticide in umbilical cord samples.<\/li>\r\n\t<li><strong>Export of harm:<\/strong>\u202fpesticides banned in the U.S. are nevertheless allowed to be produced here and exported; the study notes that organophosphate and carbamate pesticides banned domestically were sold to 42 countries between 2015 and 2019, and 78% of importing countries report more than 30% of their workforce members are poisoned by pesticides annually.\u00a0<\/li>\r\n<\/ul>\r\n<p>After the termination of EPA&#8217;s environmental justice program\u00a0in March,\u00a0<a href=\"https:\/\/juliabrownley.house.gov\/wp-content\/uploads\/2025\/05\/Rep.-Lee-Letter-to-EPA-Opposing-Elimination-of-Environmental-Justice-Offices-03-27-2025-1.pdf\">109 members of Congress wrote\u00a0a\u00a0letter<\/a>\u00a0to the agency, which\u00a0states,\u00a0<\/p>\r\n<p>&#8220;We write to demand that you reverse your plans to\u00a0terminate\u00a0all U.S. Environmental Protection Agency (EPA) environmental justice regional offices and programs. This action would cause extraordinary and disproportionate harm and constitute a complete dereliction of the EPA&#8217;s statutory responsibility to protect human health and the environment. On February 4, 2025, you released a statement affirming that all Americans deserve access to clean air, water, and land. You must honor this commitment and reject any effort that weakens public health protections or rolls back decades of EPA&#8217;s work\u2014under both Republican and Democratic administrations\u2014to support communities unfairly burdened by pollution.&#8221;<\/p>\r\n<p>The Trump administration\u00a0maintains\u00a0a commitment to\u00a0eliminate\u00a0environmental justice programs as part of a larger effort to curtail regulations\u00a0that protect\u00a0health and the environment. As Martin Luther King, Jr. wrote in\u00a0his\u00a0<a href=\"https:\/\/www.africa.upenn.edu\/Articles_Gen\/Letter_Birmingham.html\">Letter from Birmingham Jail<\/a>\u00a0in 1963: &#8220;Injustice anywhere is a threat to justice everywhere. We are caught in an inescapable network of mutuality, tied in a single garment of destiny. Whatever affects one directly, affects all indirectly.\u201d\u00a0<\/p>\r\n<p><strong>Letter to Congress on Honoring Martin Luther King, Jr.<\/strong><\/p>\r\n<p><a href=\"https:\/\/secure.everyaction.com\/alpJr4PnmkqsxrjgJRn--w2##anchor\"><strong>Tell members of Congress to ensure that with the termination of environmental justice programs at EPA,\u00a0they must uphold the right of those at the highest risk\u00a0of\u00a0harm\u00a0to sue manufacturers responsible\u00a0for their failure to warn about\u00a0their\u00a0products&#8217;\u00a0hazards.<\/strong><\/a><\/p>\r\n<p>On the day marking the memory of Martin Luther King, Jr. and his legacy of embracing racial, economic, and environmental justice, we urge you to preserve a basic right of protection from the harm caused by toxic chemicals, including pesticides\u2014especially those who suffer disproportionately elevated harm, people of color. With deregulation of the chemical industry and termination of environmental justice and other EPA programs intended to protect health and the environment, chemical manufacturers are seeking to shield themselves from lawsuits filed by those who have been harmed, but not warned, about toxic hazards.<\/p>\r\n<p>Without a rigorous regulatory system to restrict toxic chemicals, including pesticides, from poisoning people, the courts provide the only vehicle for constraining the behavior of corporations responsible for harm. Since chemical manufacturers know this, and after over $10 billion in jury verdicts and settlements over the last several years in cases involving their pesticide glyphosate\/Roundup<sup>TM<\/sup>, they are seeking to be shielded from litigation. While it has been reported that bill language shielding chemical manufacturers has been dropped from the FY2026 funding bill moving through Congress, you know that the legislative process is unpredictable in the current Congress. This summer, a provision passed by the House Appropriations Committee that would have denied farmers, farmworkers, landscapers, gardeners, and consumers generally the right to sue companies that do not disclose on their product labels and in marketing information potential hazards associated with their products\u2019 use.<\/p>\r\n<p>The chemical industry is pursuing all possible legislative vehicles to move its legislation, which has a disproportionate adverse effect on people of color, especially those who grow and harvest our food.<\/p>\r\n<p>As Martin Luther King, Jr. wrote in his Letter from Birmingham Jail in 1963: &#8220;Injustice anywhere is a threat to justice everywhere. We are caught in an inescapable network of mutuality, tied in a single garment of destiny. The language removes the incentive for chemical manufacturers, under threat of accountability for compensatory and punitive damages, to develop safer products or remove products altogether, slowing the critically necessary shift to less- and non-toxic land and building management practices to protect health and the environment.\u202fLegislative history added to the bill in the committee will do little to ensure\u202fa fully functioning EPA and court redress.\u202f\u00a0\u00a0<\/p>\r\n<p>As Bayer\/Monsanto leads the charge, the chemical industry successfully lobbied for a weak federal pesticide law,\u00a0FIFRA,\u00a0and then tried to hide behind the law when sued for damages, telling the courts that their products are in compliance with pesticide registration standards and therefore they are not liable for harm. Juries have ruled that chemical manufacturers failed to provide adequate warning through their product labeling, given the independent peer-reviewed science, including what the company knew or should have known, and a clinical assessment of the harm caused to the plaintiff.\u00a0\u00a0\u00a0<\/p>\r\n<p>However, the Interior and Environment Subcommittee\u202fin the U.S. House of Representatives Appropriations Committee voted July 22 to support a bill that includes language (Sec. 453) providing total pesticide immunity language, blocking farmers and consumers from suing chemical manufacturers when they fail to disclose the harm that their products cause and blocking states from providing information on product harm beyond EPA-approved language.\u00a0\u00a0\u00a0<\/p>\r\n<p>Chemical companies\u2014many foreign-owned\u2014seek liability shields because they know the harm their products have already caused. Actions Being Taken In response to the chemical industry campaign to deny people the right to sue under longstanding failure to warn law, groups are calling for public support of U.S Senator Cory Booker\u2019s (D-NJ) bill, Pesticide Injury Accountability Act(S. 2324)\u00a0seeks to uphold this right\u00a0 to sue. The groups are calling on the public to \u201cTell your U.S. Senator to co-sponsor S. 2324, the\u00a0Pesticide Injury Accountability Act.\u201d This bill will amend the\u00a0Federal Insecticide, Fungicide, and Rodenticide Act of 1972\u00a0(FIFRA) to create a federal right of action for anyone who is harmed by a toxic pesticide.\u00a0 In an additional action in honor of Martin Luther King, With the information provided by Beyond Pesticides, people may not only be able to make informed choices and adopt practices that protect themselves and their families from unnecessary exposure to pesticides, but they will be able to effect changes on community-wide pest management decisions and policies that govern pesticide use, such as pesticide uses in parks, schools, for community insect control and along roadsides.
