In preparation for these new requirements, the New York State Department of Environmental Conservation (DEC) released <a href=\"http:\/\/www.dec.ny.gov\/docs\/materials_minerals_pdf\/drftguidch85.pdf\">draft guidance<\/a> on October 27. This guidance is intended to instruct schools and day care centers on compliance with the new law, by providing information on its requirements and on allowable alternatives to pesticides for grounds maintenance.<\/p>\n<p>The <em><a href=\"http:\/\/open.nysenate.gov\/legislation\/bill\/S4983C\">Child Safe Playing Field Act<\/a><\/em>, which was enacted in <a href=\"https:\/\/www.beyondpesticides.org\/dailynewsblog\/?p=3637\">May 2010<\/a>, requires that all schools, preschools, and day care centers both public and private to stop using pesticides on any playgrounds or playing fields. The law allows for emergency application of pesticides for infestations if the County Health Department, the Commissioner of Health, the Commissioner of Environmental Conservation or the school board deems it an emergency. Containerized nonvolatile bait stations are also permitted for insect and rodent control. \u201cThe archaic practice of poisoning children\u2019s playgrounds is coming to an end in New York State. We will now raise a generation of healthier, safer children because of this legislation,\u201d said Adrienne Esposito, Executive Director, Citizens\u2019 Campaign for the Environment. <\/p>\n<p>The draft guidance addresses five subjects, to provide information on the new requirements and how to comply:<br \/>\nA. Summary of requirements of Chapter 85 and identification of involved State agencies.<br \/>\nB. Information on how to maintain child-safe playing fields and turf without pesticides, to assist in complying with the new pesticide prohibition, including an introduction to alternative approaches to grounds maintenance and pest management and concepts about soil and plant health.<br \/>\nC. Brief description of the types of pesticide products allowed under the new law and ways to identify them.<br \/>\nD. Identification of agencies that schools and day care centers should contact to request an emergency pesticide application determination, as well as the basic framework for situations which will be considered an emergency by the NYS DOH and NYS DEC.<br \/>\nE. Federal legislation, the <em>School Environment Protection Act of 2009 <\/em>(SEPA), has been introduced by Rep. Rush Holt and would protect school children from pesticides used both indoors and on all school grounds nationwide. The legislation also bans the use of synthetic fertilizers. Beyond Pesticides believes that people must have a voice in decisions that affect them directly. We believe decisions should not be made for us by chemical companies or by decision-makers who either do not have all of the facts or refuse to consider them. Beyond Pesticides provides hands-on services to the public and supports local action by: identifying and interpreting hazards; and, designing safe pest management programs. With the information provided by Beyond Pesticides, people may not only be able to make informed choices and adopt practices that protect themselves and their families from unnecessary exposure to pesticides, but they will be able to effect changes on community-wide pest management decisions and policies that govern pesticide use, such as pesticide uses in parks, schools, for community insect control and along roadsides.
