Public Availability of Identities of Inert Ingredients in Pesticides - *Comment Period extended to April 23, 2010*
In response to two petitions seeking disclosure of selected inert ingredients on pesticide labels, based on hazard, EPA is initiating rulemaking to increase public availability of the identities of the inert ingredients in pesticide products. This action would assist consumers and users of pesticides in making informed decisions and reduce the presence of potentially hazardous ingredients in pesticides. Draft Guidance for Pesticide Registrants on Pesticide Drift Labeling- Comments due January 4, 2010
*Comment period extended to March 5, 2010.*
EPA is issuing proposed guidance for new pesticide labeling to reduce off-target spray and dust drift. The actions detailed in EPA’s draft Pesticide Registration (PR) Notice on Pesticide Drift Labeling will improve the clarity and consistency of pesticide labels and help prevent harm from pesticide drift. The Agency is announcing the availability of and seeking public comment on two documents - a draft Pesticide Registration Notice (draft PR Notice) entitled ``Pesticide Drift Labeling'' (PRN 2009-X) and a draft explanatory document entitled ``Pesticide Drift Labeling Interpretation.''
This particular draft PR Notice provides guidance to the applicants and registrants of certain pesticide products for revising labeling statements intended to protect people and other non-target organisms and sites from adverse effects that may be caused by off- target pesticide drift.

Proposed Registration Decisions Open for Public Comment: Cold Pressed Neem Oil - Comments due November 14, 2009
A second public comment period for EPA's risk assessments and proposed registration decision for Neem Oil is now open for public comment under Docket ID: EPA-HQ-OPP-2007-0996. EPA is making its proposed registration decision, called a "Biopesticides Registration Action Decision (BRAD)," available for comment. The BRAD contains EPA's proposed registration decision and risk assessment. In addtion, EPA is making the proposed product labels available for comment. Comments will be available through November 14, 2009.

Registration Review; Dichlorvos Docket Reopened for Review and Comment- Comments due November 13, 2009
EPA is opening an additional 30-day public comment period for the registration review of dichlorvos (DDVP). Registration review dockets contain information that will assist the public in understanding the types of information and issues that the Agency may consider during the course of registration review.

Registration review is EPA's periodic review of pesticide registrations to ensure that each pesticide continues to satisfy the statutory standard for registration. Malathion Registration Review Docket; Reopening of Comment Period- Comments due October 5, 2009
EPA issued a notice in the Federal Register of June 24, 2009, concerning the availability of multiple registration review dockets for public comment, including malathion. This document reopens the comment period for the malathion registration review docket, which closed on August 24, 2009, until October 5, 2009.
The June 24,2009 notice announced EPA's decision to modify certain risk mitigation measures that were specified in the 2006 Reregistration Eligibility Decision for the pesticide malathion. EPA conducted this reassessment of the malathion RED in response to public comments received during the comment period and to new data submitted by the technical registrant, Cheminova, Inc. Based on the new information received, the Agency has made certain modifications to the 2006 malathion RED. Docket number EPA-HQ-OPP-2009-0317.

Petitioners Ask EPA to Revoke Import Tolerances for 13 Pesticides to Protect Migratory Birds- Comments due November 2, 2009
EPA is seeking public comment on a July 2009 petition from the American Bird Conservancy (ABC) requesting that the Agency revoke certain tolerances, or maximum residue limits in food, for 13 pesticides because the pesticides present an unacceptable risk to migratory birds. The named pesticides are: cadusafos, cyproconazole, diazinon, dithianon, diquat, dimethoate, fenamiphos, mevinphos, methomyl, naled, phorate, terbufos, and dichlorvos. The specific tolerances covered by the petition are tolerances associated with pesticide uses for which there is no U.S. registration and thus application of the pesticide is not permitted in this country. Such tolerances are generally referred to as "import tolerances" because their sole purpose is to legalize residues in foods being imported to the United States. ABC claims that by
maintaining import tolerances for these pesticides, EPA allows Central and South American countries to continue using the pesticides on crops for which the U.S. has already determined there are unacceptable risks for protected U.S. migratory birds. The crop uses include green coffee beans, bananas, and other fruits and vegetables. ABC believes that revoking import tolerances for these crops will protect U.S. migratory birds on their wintering grounds in other countries and in the U.S. For more information read the Daily News Blog.

EPA has established a registration review docket for Boll Weevil Attractants which is listed in the table in Unit III A. Comment Invited on Request for Azinphos-Methyl (AZM) Use Changes - Comments due September 21, 2009
EPA is requesting public comment on a request from azinphos-methyl (AZM) registrants to amend their registrations. These amendments would change the rate reductions for some remaining uses of AZM, and would extend the use of aerially applied AZM on blueberry crops in Michigan until the end of the AZM phase out in 2012. The registrants have not requested to extend use of AZM beyond the September 30, 2012, cancellation date for the remaining uses of AZM. The public comment period will close on September 21, 2009. Pesticide Reregistration Performance Measures and Goals- Comments due July 13, 2009.
This notice announces EPA's progress in meeting its performance measures and goals for pesticide reregistration during fiscal year 2008. The Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA) requires EPA to publish information about EPA's annual achievements in this area. This notice discusses the integration of tolerance reassessment with the reregistration process, and describes the status of various regulatory activities associated with reregistration and tolerance reassessment. The notice gives total numbers of chemicals and products reregistered, Data Call-Ins issued, and products registered under the ``fast-track'' provisions of FIFRA. EPA Impact Assessments on Endosulfan; Request for Comments and Additional Information on Importance of Use - Comments due July 6, 2009.
This notice requests public comment on the Agency's endosulfan impact assessments for eight crops (potato, tomato, cotton, apple, cucumber, squash, pumpkin and melons) and additional information on the importance of endosulfan use in agriculture. For many years coalition groups have been callinig on the EPA to ban endosulfan, which has already been banned in many other countires. So far petitions, legal briefs, technical letters, and some 13,000 individual signatures from concerned scientists and public health professionals have been submitted to EPA to cancel all uses of endosulfan on the grounds that it is a highly toxic, bioaccumulative, and persistent chemical. Endosulfan; Petitions Requesting Cancellation of All Uses- Comments due June 29, 2009
This notice asks the public to comment on requests from the Natural Resources Defense Council (NRDC) and the Pesticide Action Network North America (PANNA) that EPA cancel all uses of the organochlorine pesticide endosulfan. Submit your comments, identified by docket identification number EPA-HQ-OPP-2008-0615 no later than June 29, 2009.

Clomazone and Fomesafen Ecological Risk Assessments Issued for Comment -Comments due by June 22, 2009. **Comment period has been extended to August 21, 2009
EPA has completed and is requesting public comment on draft ecological risk assessments for the pesticides clomazone and fomesafen. Public comment on the clomazone and fomesafen draft ecological risk assessments is invited through June 22, 2009.
At the same time, the Agency is initiating consultation with the U.S. Fish and Wildlife Service and the National Marine Fisheries Service ("the Services") regarding these pesticides' potential effects to species listed as endangered or threatened under the Endangered Species Act. These are the first two national ecological risk assessments and effects determinations for conventional pesticides, conducted within the context of EPA's registration review program. The Agency will review and consider both the public comments received on the draft ecological risk assessments and information provided in the Service's biological opinions, in developing proposed registration review decisions for clomazone and fomesafen.

Clomazone and fomesafen are herbicides used to control weeds and grasses in a variety of crops and non-crop locations. EPA's draft ecological risk assessments and endangered species effects determinations for both clomazone and fomesafen indicate that the use of these pesticides is likely to adversely affect a variety of listed species and may affect elements of designated critical habitat influenced by effects to plants.

EPA has published in the Federal Register a notice requesting public comment on a petition filed by the International Center for Technology Assessment (ICTA) et al. The petition requests that the Agency classify nanoscale silver as a pesticide, require formal pesticide registration, analyze the potential human health and environmental risks of nanoscale silver, and develop appropriate regulatory oversights for nanoscale silver products. The Agency has determined that the petition raises issues that potentially affect private and public sector stakeholders. Triclosan; Reregistration Eligibility Decision; Notice of Availability- Comments due by December 29, 2008
This notice announces the availability of EPA's Reregistration Eligibility Decision (RED) for the pesticide triclosan, and opens a public comment period on this document. The Agency's risk assessments and other related documents also are available in the triclosan Docket. Triclosan is regulated by both the U.S. EPA and the U.S. Food and Drug Administration (FDA). The EPA regulates the antimicrobial uses of triclosan when used as a bacteriostat, fungistat, mildewstat, and deodorizer. EPA Proposes to Terminate Special Review of Ethylene Oxide (ETO) - Comments due November 28, 2008
EPA is proposing to terminate the Special Review of the pesticide uses of ethylene oxide (ETO). The occupational risks that were the basis for the Special Review have been evaluated and addressed during the pesticide reregistration and tolerance reassessment process. EPA originally initiated the ETO Special Review based on developmental toxicity, mutagenicity, and neurotoxic effects in workers. Later, carcinogenicity concerns were raised and were included in the review. Since then, additional data and more comprehensive reviews of the potential risks associated with ETO have been completed. Because the risks that prompted the Special Review have been evaluated and regulatory decisions have been completed, the Agency is proposing to close the ETO Special Review.
As a pesticide, ETO is used primarily in hospitals and at contract facilities to sterilize medical and laboratory items and equipment. ETO treatment is the principal method used to reduce bacterial levels in whole and ground spices and other herbs and seasonings. Other ETO uses, which account for less than one percent of its total annual pesticide use, include sterilization of musical instruments, library and museum artifacts, and cosmetic ingredients, and sterilization/fumigation of beekeeping equipment.

EPA Proposes Revised Data Requirements for Antimicrobial, Wood Preservative, and Antifoulant Pesticides - Comment period extended to April 6, 2008
EPA has announced in the Federal Register a proposed rule to revise and update use patterns and associated data requirements for antimicrobial, wood preservative, and antifoulant pesticide registrations. The proposed revisions are needed to reflect current scientific knowledge and current Agency regulatory practices, and to improve protection of the general population as well as sensitive subpopulations. The proposed requirements are intended to further enhance the Agency's ability to make regulatory decisions about the human health and environmental fate and effects of antimicrobial pesticide products.

UPDATE: EPA issued a proposed rule in the Federal Register of October 8, 2008 proposing data requirements for antimicrobial pesticides. EPA received two requests to extend the comment period on the proposed rule. A new Federal Registrar notice, published December 12, 2008, extends the comment period for 90 days, from January 6, 2009 to April 6, 2009.

EPA Extends Public Comment Period for Soil Fumigants - On July 16, 2008, the Environmental Protection Agency (EPA) announced the availability of Reregistration Eligibility Decisions (REDs) for the soil fumigant pesticides chloropicrin, dazomet, metam sodium/potassium, and methyl bromide and opened a 60-day public comment period on these RED documents. Now, in response to requests from groups representing manufacturers and users of soil fumigants, EPA is extending the public comment period for these REDs by an additional 45 days, from September 15, 2008 closing on October 30, 2008. Siduron Reregistration Eligibility Decision; Notice of Availability - This notice announces the availability of EPA's Reregistration Eligibility Decision (RED) for the pesticide siduron, and opens a public comment period on this document. The Agency's risk assessments and other related documents also are available in the siduron Docket. Siduron is a selective, systemic preemergence herbicide used to control annual grassy weeds in stands of cool season grasses, such as on lawns, on golf courses, and on sod farms. EPA Makes Available National Marine Fisheries Service Draft Endangered Species Act Biological Opinions- EPA has received and posted to its Web site a Draft Biological Opinion from the National Marine Fisheries Service that responds to requests for consultation under the Endangered Species Act for three pesticides' potential effects on Pacific salmon and steelhead. EPA initiated consultation for diazinon, malathion, and chlorpyrifos on November 29, 2002, May 29, 2002, and April 14, 2003, respectively.
In addition to posting the Draft to its Web site, EPA has established a public docket [EPA-HQ-OPP-2008-0654] for this and future Draft Biological Opinions related to pesticides and Pacific salmon and steelhead. You may access the docket here.
Once NMFS develops any alternatives or measures it believes are necessary to reduce risk, EPA will request public input on those alternatives and measures. Comments on other aspects of the Draft will be forwarded to NMFS for its consideration. For more information, read our Daily News Blog.

Carbofuran; Proposed Tolerance Revocations - EPA is proposing to revoke all tolerances for carbofuran. The Agency has determined that the risk from aggregate exposure from the use of carbofuran does not meet the safety standard of section 408(b)(2) of the Federal Food, Drug, and Cosmetic Act (FFDCA). EPA is specifically soliciting comment on whether there is an interest in retaining any individual tolerance, or group of tolerances, and whether information exists to demonstrate that such tolerance(s) meet(s) the FFDCA section 408(b)(2) safety standard. EPA encourages interested parties to comment on the tolerance revocations proposed in this document and on the proposed time frame for tolerance revocation. Issues not raised during the comment period may not be raised as objections to the final rule, or in any other challenge to the final rule.  Chromated Copper Arsenate Revised Risk Assessments; Notice of Availability and Solicitation of Risk Reduction Options - This notice announces the availability of EPA's revised risk assessments for the restricted use antimicrobial pesticide chromated copper arsenate (CCA).   • Captan Amended RED; Cancer Classification Changed. The fungicide captan currently is used to control diseases on orchard crops, ornamentals, and turf, and also is used for seed treatments and as an in-can preservative in adhesives and paint. Until recently captan was classified as a probable human carcinogen (B2). The Agency's new conclusion is that captan is a potential carcinogen only at prolonged high doses that are greater than those likely to be consumed in the diet or encountered in occupational or residential settings. The Agency has concluded that captan is not likely to be a human carcinogen or to pose cancer risks of concern when used in accordance with approved product labeling. Docket ID# OPP- 2004-0296.   • MCPA Reregistration Eligibility Decision (RED) available for comment. MCPA (4-chloro-2- methylphenoxyacetic acid) is a phenoxy herbicide typically used in formulation with other phenoxy class chemicals, such as 2,4-D, 2,4-DB, MCPP-p, and MCPB. MCPA is used for control of broadleaf weeds on several food and feed crops. It is also used on grass grown for seed, turf, lawns, vines, rights-of-way, and in forestry. Docket ID# OPP-2004-0239.   • Thiophanate-methyl RED Available. Thiophanate-methyl is a fungicide registered for use on a variety of agricultural food and feed crops.     Reregistration Eligibility Decisions Completed for Heavy Duty Wood Preservatives - EPA has completed Reregistration Eligibility Decisions (RED) for the three heavy duty wood preservatives: creosote, chromated arsenicals (e.g., chromated copper arsenate [CCA]), and pentachlorophenol. These REDs include our most current risk assessments for each chemical. The Agency assessed these chemicals as part of its reregistration program for older pesticides. The three wood preservatives are used primarily for industrial purposes such as utility poles, pilings, and railroad ties. CCA was once the main treatment against wood decay on decks, fences, and playground equipment; however, these uses were voluntarily canceled effective December 31, 2003, and the RED does not assess risks from these canceled uses.

    Naphthalene Reregistration Eligibility Decision-This notice announces the availability of EPA's Reregistration Eligibility Decision (RED) for the pesticide naphthalene. The Agency's risk assessments and other related documents also are available in the naphthalene Docket. Naphthalene is an insecticide used primarily as a moth repellant. EPA has reviewed naphthalene through the public participation process that the Agency uses to involve the public in developing pesticide reregistration and tolerance reassessment decisions. EPA has established a docket for this action under docket identification number EPA-HQ-OPP-2008-0343.

    Carbaryl RED Amended; EPA Denies NRDC Petition to Cancel Uses and Revoke Tolerances - EPA has amended the September 2007 Carbaryl Reregistration Eligibility Decision (RED) and denied a petition from the Natural Resources Defense Council (NRDC) to cancel all carbaryl registrations and revoke all tolerances. In responding to the petition, EPA found that NRDC has neither provided a basis for cancelling carbaryl uses nor demonstrated that carbaryl tolerances are unsafe. The Agency continues to believe that carbaryl tolerances provide a reasonable certainty of no harm.
    EPA has amended the carbaryl RED to incorporate a revised occupational exposure and risk assessment. The Agency reevaluated the occupational risk assessment and regulatory decision for carbaryl to consider and incorporate public comments on the RED, new worker monitoring and toxicology studies submitted by the registrant, and new science and methodologies.     EPA Publishes Final Rule Amending the Pesticide Container and Containment Regulations - EPA has published a notice in the Federal Register to amend the container and containment regulations in 40 CFR parts 156 and 165. The final amendments provide a one-year extension of the labeling compliance date, change the phrase "sold or distributed" to "released for shipment" as associated with all compliance dates, provide for exceptions to the label language requirements for some specific types of containers, allow for waivers of certain label requirements for other refillable and nonrefillable containers on a case-by-case basis, and correct typographical and other minor errors.
    After the final rule titled "Pesticide Management and Disposal; Standards for Pesticide Containers and Containment" (Container and Containment Rule) was published in 2006, stakeholders (primarily registrant groups and individual registrants) contacted the Agency with significant concerns about the following topics: the compliance date for the label requirements and whether there was adequate time to make the required changes; problems that the registrants could face handling pesticide products returned at the end of the 2009 use season because returned products would likely no longer be in compliance and, if not, would not be able to be resold or redistributed; and the scope of pesticide products and containers for which some of the labeling statements are required because the regulations required the statement "nonrefillable container" on every container, including containers such as aerosol cans and foil pouches that may be considered inherently nonrefillable.
    The Agency generally agreed with the stakeholders' concerns and, after investigating several options, concluded that an amendment to the container and containment regulations was necessary.

    EPA Will Discourage Cause Marketing and Third-Party Claims- After reviewing public comments submitted in response to a draft Pesticide Registration Notice (PR Notice) titled "Label Statements Regarding Third-Party Endorsements & Cause Marketing", the Agency has determined that the types of cause marketing claims and third-party endorsements outlined in the draft PR Notice generally would not contribute meaningfully to improving protection of human health and the environment. The addition of such label statements is not likely to better inform the user about how to use the product safely and effectively. In fact, the addition of such statements could interfere with that goal. In addition, EPA recognizes that its resources are limited and should be targeted towards activities that will enhance protection of human health and the environment from pesticides. EPA is now generally discouraging the submission of applications to add cause marketing claims or third-party endorsements.
    Thus, EPA will not continue work on developing a framework to evaluate such claims and will not issue guidance on what information is needed to evaluate such applications. If it receives such an application, the Agency expects to decide on a case-by-case basis both what information would be necessary to carefully evaluate the proposed claims and whether a product containing such a claim could meet the applicable statutory and regulatory standards for approval.     Food Packaging Treated with a Pesticide- This final rule excepts food packaging materials (e.g., paper and paperboard, coatings, adhesives, and polymers) from the definitions of "pesticide chemical'" and "pesticide chemical residue" under the Federal Food Drug and Cosmetic Act (FFDCA) section 201(q), when such food packaging materials have been treated with a pesticide regulated under the Federal Insecticide, Fungicide and Rodenticide Act (FIFRA). This final rule expands the scope of the current exception which applies only to food packaging impregnated with an insect repellent -one type of pesticide. This final rule, as with the rule it amends, only applies to the food packaging materials themselves; it does not otherwise limit EPA's FFDCA jurisdiction over the pesticidal substances in or on such products or limit FDA's jurisdiction over substances subject to FDA regulation as food additives. This rule eliminates duplicative FFDCA jurisdiction and economizes federal government resources while continuing to protect human health and the environment.

The meeting will be held Tuesday, October 7, from 9:00 am to 5:00 pm, and Wednesday, October 8, from 9:00 am to 12:00 noon in OPP's first floor conference center at One Potomac Yard, 2777 Crystal Drive, Arlington, VA 22202.

    Pesticide Program to Provide Enhanced Email Response - The Pesticide Program has implemented a new system for responding to e-mails from the public. It relies on a database of questions that provide possible responses to the individual's query, allowing the person to decide if enough information has been provided. In many cases, there is no need to submit a question, which provides improved response to public queries. This system is used across EPA, including by the main EPA public access service, the Superfund office, and others. The EPA will continue adding categories and questions to the database from information we have in our existing internal query response system, as well as based on new questions that come in from the public or issues that arise in the program.     DDVP Objections and Hearing Request Denied     - In this order, EPA denies objections to, and requests for hearing on, a prior order denying a petition requesting that EPA revoke all pesticide tolerances for dichlorvos under section 408(d) of the Federal Food, Drug, and Cosmetic Act. The objections and hearing requests were filed on February 1, 2008, by the Natural Resources Defense Council (NRDC). The Original petition was also filed by NRDC.     * Buffer zones around treated fields will reduce the chances of immediate harmful effects to bystanders from fumigant concentrations in air. Buffers can be adjusted based on the use of other good management practices that also reduce risks to bystanders.
    * Posting requirements will inform bystanders and field workers about the location and timing of fumigations and associated buffer zones so people do not enter these areas.
    * Fumigant registrants must adopt more stringent worker protection measures, and develop training for fumigation handlers and workers to enhance their knowledge and skills and to promote product stewardship.
    * All soil fumigant products will be classified as restricted-use pesticides, to ensure that only specially trained individuals can apply and oversee fumigant operations.

    EPA's decision will also halt the use of methyl bromide on sites where alternatives are available. The newly registered fumigant iodomethane will be reexamined later this year to determine what new mitigation or restrictions are necessary. The soil fumigant 1,3-dichloropropene, which was evaluated previously, may be subject to similar provisions when the soil fumigants are evaluated together again in 2013. EPA is providing 60 days for public comments on implementation of these measures and will refine the measures as needed.     National Organic Program (NOP); Sunset Review (2008)    - This proposed rule would amend the U.S. Department of Agriculture's (USDA) National List of Allowed and Prohibited Substances (National List) regulations to reflect recommendations submitted to the Secretary of Agriculture by the National Organic Standards Board (NOSB) on November 30, 2007, and May 22, 2008. The recommendations addressed in this proposed rule pertain to the continued exemption (use) and prohibition of 12 substances in organic production and handling. Consistent with the recommendations from the NOSB, this proposed rule would renew the 11 exemptions and 1 prohibition on the National List (along with any restrictive annotations) and correct the Tartaric acid listings by adding annotations originally recommended to the Secretary on November 1, 1995.

    Fenvalerate; Product Cancellation Order - This notice announces EPA's order for the cancellations, voluntarily requested by the registrants and accepted by the Agency, of products containing the pesticide fenvalerate, pursuant to section 6(f)(1) of the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA), as amended. This cancellation order follows an April 30, 2008 Federal Register Notice of Receipt of Requests from the fenvalerate registrants to voluntarily cancel all their fenvalerate product registrations. Fenvalerate is a synthetic pyrethroid insecticide which is used to control insects and related organisms, invertebrates on agricultural, pet care, domestic home and garden (domestic), and commercial/industrial/food and non-food/mosquito abatement (commercial) sites. These are the last fenvalerate products registered for use in the US. Any distribution, sale, or use of the fenvalerate products subject to this cancellation order is permitted only in accordance with the terms of this order, including any existing stocks provisions.

    September 16-18 FIFRA SAP to review Chlorpyrifos Toxicity Profile; Nominations Sought - The Federal Insecticide, Fungicide, and Rodenticide Act Scientific Advisory Panel (FIFRA SAP) will hold a 3-day meeting to consider and review the Agency's evaluation of the toxicity profile of chlorpyrifos. The Agency is focusing on studies that evaluate the effects of chlorpyrifos on infants and children from in utero and/or post-natal exposures and on studies that evaluate population variability with respect to response to chlorpyrifos. This meeting, originally scheduled for July 15-18, 2008, has been rescheduled for September 16-18, 2008 and will be held at Holiday Inn - Rosslyn at Key Bridge, 1900 North Fort Myer Drive, Arlington, Virginia 22209.

    The Agency is accepting additional nominations for candidates to serve as ad hoc members of the FIFRA SAP for this meeting.     EPA Publishes Proposed Rule Amending the Pesticide Container and Containment Regulations     -
    EPA has published a notice in the Federal Register proposing a rule to amend the container and containment regulations in 40 CFR part 156 and 165. The public has 30 days to provide comments to the Agency.
    The proposed amendment, which applies to all registrants, would provide a one year extension of the labeling compliance date; change the phrase "sold or distributed" to "released for shipment" as associated with all compliance dates; provide for exceptions to the language requirements for some specific nonrefillable packages; allow for waivers of certain label requirements for other refillable and nonrefillable containers on a case-by-case basis; and correct typographical and other minor errors.
    The Agency is proposing to amend the container and containment regulations because stakeholders (primarily registrant groups and individual registrants) contacted the Agency with significant concerns after the final rule titled "Pesticide Management and Disposal; Standards for Pesticide Containers and Containment" was published in 2006. Stakeholders expressed concerns about:
    1. the compliance date for the label requirements and whether there would be adequate time to make the required changes;
    2. problems that the registrants could face handling pesticide products that are returned at the end of the 2009 use season because returned products would likely no longer be in compliance and, if not, would not be able to be resold or redistributed; and
    3. the scope of pesticide products and containers for which some of the labeling statements are being required because the regulations currently require the statement "nonrefillable container" on every container, including containers like aerosol cans and foil pouches that may be considered inherently nonrefillable.
    The Agency generally agrees with these concerns and, after investigating several options, concluded that an amendment to the container and containment rule is necessary.     Rodenticides Final Risk Mitigation Decision; Notice of Availability     - This notice announces the availability of EPA's final risk mitigation decision for 10 rodenticides, an addendum to the economic impact assessment, responses to comments on the proposed risk mitigation decision, and other supporting documents. The 10 rodenticides covered by this risk mitigation decision are brodifacoum, bromadiolone, bromethalin, chlorophacinone, cholecalciferol, difenacoum, difethialone, diphacinone (and its sodium salt), warfarin (and its sodium salt), and zinc phosphide.
    EPA's final decision on the rodenticides includes two major components.To minimize children's exposure to rodenticide products used in homes, EPA is requiring that in the future, all rodenticide bait products available for sale to general consumers be sold only in bait stations. To reduce wildlife exposures and ecological risks, the Agency intends to prevent general consumers from purchasing bait products containing the rodenticides that pose the greatest risk to wildlife (the second generation anticoagulants - brodifacoum, bromadiolone, difethialone, and difenacoum) by requiring various measures to control sales and distribution. The Agency's decision will reduce rodenticide exposures to children and non-target wildlife, while ensuring residential users, livestock producers, and professional applicators access to a variety of effective and affordable rodent control products.

    Human Studies Review Board; Notice of Public Meeting    - The U.S. Environmental Protection Agency's (EPA or Agency) Office of the Science Advisor (OSA) announces a public meeting of the Human Studies Review Board (HSRB) to advise the Agency on EPA's scientific and ethical review of human subjects research. The agenda includes:
    (1) The Governing Document, the compilation of Standard Operating Procedures, the scenario design document, and two associated protocols from the Agricultural Handlers Exposure Task Force (AHETF), which collectively describe research to monitor exposure of subjects whoapply an agricultural pesticide using airblast equipment in closed cabs.
    (2) A report from a completed laboratory study to evaluate the efficacy in repelling mosquitoes of the genus Culex of two registered products containing picaridin.
    (3) The Board may also be reviewing its draft April 9-10, 2008 meeting report for subsequent Board approval. In addition, the HSRB may also discuss planning for future HSRB meetings.

    Final Guidance for Pesticide Registrants on Environmental Hazard General Labeling Statements on Outdoor Residential Use Products; Notice of Availability - The Agency is announcing the availability of a Pesticide Registration Notice (PR Notice) entitled "Environmental Hazard General Labeling Statements on Outdoor Residential Use Products." This PR Notice was issued by the Agency on May 9, 2008 and is identified as PR Notice 2008-1.This particular PR Notice provides guidance to the registrant concerning new environmental hazard statements that are designed to replace language created for agricultural products with statements that are easier for consumers to understand. The new environmental hazard statements are divided by product type (e.g., liquid ready-to-use, broadcast granular), and recommends specific language for each product type to minimize risks to the human health and the environment, with emphasis on reducing risks to water. Revisions to product labels using these new statements may be made by notification.

    Nicotine Reregistration Eligibility Decision; Notice of Availability - This notice announces the availability of EPA's Reregistration Eligibility Decision (RED) for the pesticide nicotine. The Agency's risk assessments and other related documents are available in the nicotine Docket. The sole remaining nicotine registration, a restricted use insecticide registered for use only on greenhouse ornamentals and effective against adult whiteflies, aphids, and thrips, is being voluntarily cancelled by the registrant. EPA has reviewed nicotine through the reregistration eligibility decision-making process, which is used by the Agency to ensure that all pesticides meet current health and safety standards.      Sulfluramid; Product Cancellation Order -This notice announces EPA's order for the cancellation, voluntarily requested by the registrant and accepted by the Agency, of products containing the pesticide sulfluramid, pursuant to section 6(f)(1) of the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA), as amended. This cancellation order follows a December 19, 2007 Federal Register Notice of Receipt of Request from the sulfluramid registrant to voluntarily cancel the last remaning sulfluramid manufacturing-use product (MUP) registration. Accordingly, EPA hereby issues in this notice a cancellation order granting the requested cancellation. This cancellation order does not cancel the remaining end-use sulfluramid products currently registered for use in the United States. The cancellations are effective May 16, 2008.

    EPA Orders Scotts to Stop Selling Certain Pesticides - EPA is ordering Scotts Miracle-Gro Co. to stop selling and distributing two pesticide products that have not been properly registered with EPA. They may have been sold under names such as "Garden Weed Preventer + Plant Food" and "Scotts Lawn Service Fertilizer with .28 Halts" or other names. These products have apparently been sold illegally, as they have not been registered with EPA and are labeled with invalid EPA registration numbers. Together with the Ohio Department of Agriculture, EPA is analyzing samples of the products to determine their ingredients and will use this information to better determine what additional steps should be taken.     Chloroneb; Termination of Certain Uses -This notice announces EPA's cancellation order for the termination of certain uses, voluntarily requested by the registrants and accepted by the Agency, of products containing the pesticide chloroneb, pursuant to section 6(f)(1) of the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA), as amended. This cancellation order follows a December 28, 2007 Federal Register Notice of Receipt of Requests from the chloroneb registrants to voluntarily terminate certain uses of their chloroneb product registrations. The requests would terminate chloroneb's use on residential lawns and turf, as well as on lawns and turf at parks and schools.     EPA Issues Cancellation Order for Remaining Azinphos-methyl Uses - EPA has published an order canceling and amending the registrations of pesticide products containing azinphos-methyl (AZM) to terminate the remaining uses of this pesticide by 2012, as voluntarily requested by the registrants. Consistent with EPA's November 2006 final decision for the remaining uses of AZM, the cancellation order published in the Federal Register on February 20, 2008, terminates the last AZM products registered for use in the United States.     Endocrine Disruptor Screening Program; Second Workshop to Discuss Draft Policies and Procedures; Notice of Public Meeting     - EPA is convening a half-day public workshop to discuss the Agency's draft administrative policies and procedures for completing the initial screening and testing under EPA's Endocrine Disruptor Screening Program (EDSP). In the Federal Register issue of December 13, 2007 (72 FR 70842) (FRL-8340-3), EPA announced the availability for public review and comment of the draft policies and procedures EPA is considering adopting for conducting the initial screening and testing under EDSP. The purpose of the public workshop is to provide another opportunity for the public to ask questions about the draft EDSP policies and procedures.

    EPA Moves Forward To Propose a Rule Requiring Pesticide Container Recycling - EPA is moving forward to propose regulations that once finalized, would require registrants of agricultural and professional specialty pesticides to recycle plastic pesticide containers. After careful deliberation and consideration of all possible options, the Agency is moving forward with a proposed pesticide container recycling rule.The Agency will provide the public a 60-day comment period on the proposed rule by the fall of 2008.
