A bill is likely to be introduced in the Montana state legislature to eliminate failure-to-warn liability claims for Montana residents who are exposed to toxic pesticides and are seeking justice.
On August 7, 2024, the Attorney General of Montana jointly filed a petition to EPA with 10 other states requesting the agency promulgate rulemaking to prevent states like California to from adding additional warning labels to pesticide and chemical products that go beyond the pesticide registration warning label requirement pursuant to federal pesticide law. Advocates, including regenerative organic farmers, farmworkers, public health professionals, and community leaders, view this move as an attack on the rights of pesticide exposure victims amidst a failed regulatory system that unnecessarily permits the use of toxic petrochemical-based pesticides.
According to state campaign finance data provided by the Montana Commissioner of Political Practices (Search Bayer US LLC PAC), Bayer is in the process of registering its PAC in the state. Additionally, there are currently no public records indicating pesticide manufacturer lobbyists are registered for 2023-2024 period or 2025-2026 period according to Montana's Principal and Lobbyist Online Reporting System.
