Louisiana

History of Failure-to-Warn in this State

A bill is likely to be introduced in the Louisiana state legislature to eliminate failure-to-warn liability claims for Louisiana residents who are exposed to toxic pesticides and are seeking justice.

On August 7, 2024, the Attorney General of Louisiana jointly filed a petition to EPA with 10 other states requesting the agency promulgate rulemaking to prevent states like California to from adding additional warning labels to pesticide and chemical products that go beyond the pesticide registration warning label requirement pursuant to federal pesticide law. Advocates, including regenerative organic farmers, farmworkers, public health professionals, and community leaders, view this move as an attack on the rights of pesticide exposure victims amidst a failed regulatory system that unnecessarily permits the use of toxic petrochemical-based pesticides.

According to federal campaign finance data collected by the Federal Election Commission, U.S. Representative Troy Carter (D-LA) cumulatively received $6,500 in campaign contributions from pesticide manufacturer-related PACs in the 2024 election cycle.
