(Beyond Pesticides, 2nd October 2007) Target Corp. has been fined over $40,000 by the U.S. Environmental Protection Agency (EPA) for violating pesticide-labeling rules under the Federal Insecticide, Fungicide and Rodenticide Act (FIFRA). As part of the penalty, EPA (Region 5) filed a consent agreement and final order with Target to halt the distribution and sale of the products in violation. According to EPA, Target sold and distributed products from its stores and website that made pesticidal claims on their labels. Some product’s properties also made comparisons to other registered products sold by competitors. An inspector cited the company for violation in April and Target is now removing pesticidal claims from the products.The products identified were: Antimicrobial Toilet Seats, Home Ultimate Mattress Pads, Home Ultimate Pillows- which made “germ-killing” claims and Cleaner With Bleach, which compared its disinfectant properties with a competitor. Under FIFRA (Section 2(u)), any substance or product intended for “preventing, destroying, repelling, or mitigating any pest,” which includes germs and bacteria, is defined as a pesticide and must be registered with EPA prior to sale and distribution. (Beyond Pesticides, September 28, 2007) EPA is due to make a decision on methyl iodide, a highly reactive and carcinogenic chemical, for use in crop production as a soil fumigant. Scientists across the country are alarmed by the prospect of registering methyl iodide as a pesticide, and fifty-four chemists and physicians from across the country issued a letter to EPA Administrator Stephen Johnson Monday urging the Agency not to sanction the broad use of methyl iodide now or at any time.“[W]e are concerned that pregnant women and the fetus, children, the elderly, farm workers, and other people living near application sites would be at serious risk if methyl iodide is permitted for use in agriculture,” said the group in the letter. In the chemical community methyl iodide is a well-known cancer hazard due to its ability to mutate DNA, and the scientists are fearful that methyl iodide’s high volatility and water solubility will expose many people to harm if the chemical is used in agriculture. (Beyond Pesticides, September 26, 2007) In a Federal Register Notice issued on September 21, 2007, the U.S. EPA clarified the distinction between devices and pesticides by stating that ion-generating equipment will now be regulated under the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA) as a pesticide, if the equipment uses electrodes to emit ions (of silver or other substances) for pesticidal purposes. The notice outlines the timeline and process for manufacturers, sellers and other affected parties to come into compliance with the clarified requirements of FIFRA. In 2005, the EPA was made aware of equipment incorporating substances, such as silver and copper that, through the use of electrodes, release the ions of the substances for the purpose of preventing, destroying, repelling, or mitigating a pest (e.g., bacteria or algae). Since such devices incorporate substances that accomplish a pesticidal function, the agency has determined that they are to be considered a pesticide for the purposes of FIFRA and must therefore be registered prior to sale or distribution as outlined in the federal notice issued. Section 2(h) of FIFRA defines a device as “any instrument or contrivance (other than a firearm) which is intended for trapping, destroying, repelling or mitigating any pest.” […]

(Beyond Pesticides, September 24, 2007) Seven representatives wrote to the EPA last Thursday, urging the government agency to act promptly to identify and screen products for dangerous endocrine-disrupting chemicals. The letter asks EPA Administrator Stephen Johnson to provide definite deadlines in the testing and control of endocrine disruptors, which are substances that interfere with the normal functioning of the endocrine system, responsible for hormonal and developmental processes. EPA’s regulation of these substances that mimic or alter natural hormonal processes has been slow and lacks direction to meet set goals promptly, according to the U.S. Representatives. “To date, EPA’s efforts in this area have been characterized by missed deadlines, prolonged delays, and inadequate incorporation of public input,” according to the letter from the House Committee on Oversight and Government Reform, chaired by Rep. Henry Waxman (D-California). Ranking Minority Member on the Committee Tom Davis (R-Virginia); Representatives Elijah Cummings (D-Maryland), Chris Van Hollen (D-Maryland), Wayne Gilchrest (R-Maryland), and Jim Moran (D-Virginia); and Delegate Eleanor Holmes Norton (D-D.C.) also signed the letter to EPA. (Beyond Pesticides, August 24, 2007) The Wisconsin Natural Resources Defense Board recently passed stricter limits on allowable groundwater levels of alachlor-ESA, the breakdown product of the herbicide alachlor, cutting in half the standard to 20 parts per billion (ppb). The reduction from the previous standard of 40 ppb was prompted by the state Department of Natural Resources (DNR), which has tried to pass a similar measure in recent years, only to be blocked by the Republican-controlled Senate. Officials hope that a Democratic majority will ensure adoption of the new standard. The board voted 7-0 in favor of lowering the allowable groundwater level of alachlor-ESA, after DNR cited studies showing the chemical causes blood problems in rats. Department of Agriculture, Trade & Consumer Protection (DATCP) tests in 2001 showed alachlor-ESA in 28 percent of private wells tested, in spite of its declining use (on less than a quarter of the state’s 100,000 acres of corn). (Beyond Pesticides, August 21, 2007) Last week, The Cornucopia Institute announced that Aurora Organic Dairy, one of the largest organic dairies in the United States, could soon lose its organic certification. Based on a private investigation as well as United States Department of Agriculture (USDA) documents, Cornucopia claims the industry giant does not comply with organic regulations regarding pasture grazing and cattle procurement. Aurora has 12,000 milking cows on five farms in Colorado and Texas. The company claims that the cows have access to 5,700 acres of organic pasture land across those farms, and that all cows graze for at least 120 days per year. Among the brands Aurora supplies organic dairy products for are Target, Wal-Mart, Costco, Safeway, Wild Oats, Trader Joes, and other grocery chains. According to Cornucopia’s senior farm policy analyst Mark Kastel, “After personally inspecting some of Aurora’s dairies in Texas and Colorado, we found 98 percent of their cattle in feedlots instead of grazing on pasture as the law requires.” While USDA’s investigation is ongoing, Cornucopia expects to hear of other missteps. “Our sources tell us that the USDA’s investigators found many other violations when conducting their probe of Aurora,” said Mr. Kastel. (Beyond Pesticides, August 16, 2007) The Environmental Protection Agency’s (EPA) recent decision not to go through with a Special Review of 2,4-D’s carcinogenic properties is being touted by industry as the final word that the toxic chemical “has been found to have no human carcinogenic effects,” despite significant evidence to the contrary. The Special Review has been cancelled after an industry task force poured millions of dollars into industry funded research and a public relations campaign. The pesticide 2,4-D, or 2,4-Dichlorophenoxyacetic acid, was first slated by EPA for Special Review in 1986. A few years later in a unique move, several large pesticides companies with a common interest in keeping 2,4-D on the market formed the Industry Task Force II on 2,4-D Research Data. Since then, the task force reports it has funded nearly $30 million in new research on the chemical. Industry funded research is often biased and influential in the regulatory process. The results are reported to EPA, which provides a large portion of the data the agency relies on in order to make decisions under an inadequate risk assessment review process. (Beyond Pesticides, August 14, 2007) In an August 8, 2007 Federal Register Notice (72 FR 44510-44511), the Environmental Protection Agency (EPA) announced its decision to not initiate a Special Review for the commonly used herbicide 2,4-D, as well as the related herbicides 2,4-DB and 2,4-DP (dichlorprop). Despite evidence to the contrary, according to the FR notice, “Based on extensive scientific review of many epidemiology and animal studies, EPA find that the weight of the evidence does not support a conclusion that 2,4-D, 2,4-DB and 2,4-DP are likely human carcinogens.” Although a mounting body of evidence links 2,4-D to various cancers, particularly non-Hodgkin’s lymphoma, EPA has been reluctant to classify it as a carcinogen in the face of industry pressure. EPA lists the herbicide in class D for carcinogenicity. Chemicals in this class are considered to have inadequate evidence for carcinogenicity, or not enough data is available. However, the link between 2,4-D and non-Hodgkin’s lymphoma has been demonstrated in the United States, Italy, Canada, Denmark, and Sweden. A 1986 National Cancer Institute (NCI) study found that farmers in Kansas exposed to 2,4-D for 20 or more days per year had a six-fold higher risk of developing non-Hodgkin’s lymphoma than non-farmers. (Beyond Pesticides, August 9, 2007) China reports it is cracking down on the use of recently banned pesticides and is taking additional actions in an effort to counter concerns about the country’s food safety. The major exporter has been the subject of frequent reports of contaminated products, including several foods imported by the U.S. Reuters reports that according to a new poll, U.S. consumers are extremely wary of products made in China, and nearly two-thirds said they would support a boycott of Chinese goods. In reaction to the potential loss of export markets and the upcoming Beijing Olympics, China says it will spend more than $1 billion improving food and drug safety over the next three years. The Chinese government will specifically launch a campaign to crack down on the use of banned pesticides that are still being manufactured and remain in use. The campaign is in response to news reports that “a dozen or so” pesticide producers were still making highly poisonous pesticides such as methylamine and phosphamidon. (Beyond Pesticides, August 1, 2007) Farm workers and advocate groups, including Beyond Pesticides, filed a lawsuit yesterday against the Environmental Protection Agency (EPA) to stop the continued use of a deadly pesticide called chlorpyrifos. Chlorpyrifos is a highly neurotoxic insecticide developed from World War II-era nerve gas. Exposure can cause dizziness, vomiting, convulsions, numbness in the limbs, loss of intellectual functioning and death. “This pesticide puts thousands of workers at risk of serious illness every year,” said Erik Nicholson of the United Farm Workers. “It is inexcusable for the EPA to allow the use a pesticide they know to be damaging to people, especially children.” Luis Medellin, a Lindsay, California resident, suffered first hand exposure to chlorpyrifos. “I got sick, and my mother and younger sisters started throwing up, all this in our own home. It was a terrible feeling, the smell coming in through our air conditioner,” he said. “The government must not allow this dangerous chemical to be sprayed around our schools and communities.” Chlorpyrifos is used widely on corn, orchard, and vegetable row crops all over the country. (Beyond Pesticides, July 30, 2007) Following the release of a new national report, Ending Toxic Dependency: The State of IPM, environmental and health groups in New York state issued a letter to Governor Eliot Spitzer. In the letter, they requested that the Governor order all state agencies to phase out use of toxic pesticides in favor of less- and non-toxic products. Twenty-six groups signed the statement, which urges Mr. Spitzer to reduce the amount of pesticides used in the state, which, in 2004, included 2.7 million gallons applied by pest-control companies alone. “We should not be exposing state workers and the public to hazardous and unnecessary chemicals that can cause a range of serious health problems, from asthma attacks to birth defects and cancer, as well as contaminate our air and drinking water,” said Laura Haight of the New York Public Interest Research Group, one of the co-signing organizations. “It’s not rocket science; there are towns and counties and cities across the state doing just this on their own property.” The body of the letter, expanding Ms. Haight’s statement, reads: Our groups, which represent citizens from across the state, applaud you for your commitment to protecting the environment and public […]

(Beyond Pesticides, July 20, 2007) Dow Chemical Company has reached agreement with the Environmental Protection Agency (EPA) to begin cleanup of dioxin contamination downstream of its Midland, Michigan facility immediately. The teratogenic (i.e. ability to cause developmental malformations) and mutagenic compounds are not only byproducts of manufacturing processes but are contained in one of Dow’s most used herbicides. Last November, Dow identified dioxin hot spots along the Tittabawassee River, but corrective action “has taken too long” according to an EPA press release. “EPA has documented that dioxin contamination in soil poses risks to human health and the environment.” Dioxins are a family of chemicals that have been linked to cancer, weakened immune systems and reproductive problems. Terry Miller, a member of Lone Tree Council, an environmental group, told the Saginaw News that EPA’s decision confirmed his suspicions that Dow was “dragging their feet” in the cleanup efforts. “There’s been a lot of print suggesting the state has been too hard on the company when it appeared that Dow was being too slow,” he said. “The federal government would seem to support that contention.” Michelle Hurd-Riddick, a spokeswoman for the Lone Tree Council, was quoted by the Saginaw News saying that […]

(Beyond Pesticides, July 17, 2007) A study conducted by Canadian researchers show that high concentrations of POPs, or Persistent Organic Pollutants, can be observed in humans and other air-breathing animals even though they may not accumulate in fish. This suggests that current risk assessment methodologies need to be changed for identifying potential POPs in birds and mammals. POPs are synthetic, toxic chemicals that persist in the environment, bioaccumulate in food chains and are common contaminants in fish, dairy products and other foods. These compounds are generally accepted to be hydrophobic and fat-soluble. Screening for these bioaccumulative compounds is normally conducted with laboratory tests using fish. However researchers Barry C. Kelly, and Frank Gobas, Ph.D., at Simon Fraser University in Burnaby, British Columbia report that this methodology may overlook a significant number of pollutants that pose health risks to air-breathing animals. The study entitled “Food Web—Specific Biomagnification of Persistent Organic Pollutants” (Science 2007, v317, p236) examines the biomagnification of moderately hydrophobic compounds with octanol-water partition coefficients (Kow) between 100 and 100,000 (currently, compounds with Kow greater than 100,000 are generally categorized as bioaccumulative compounds and tend to be hydrophobic and fat-soluble) and compounds with high octanol-air partition coefficients (Koa). (Beyond Pesticides, July 13, 2007) A European Union (EU) court banned the toxic weedkiller paraquat Wednesday, accepting arguments from the Swedish government that it does not meet EU health standards. Paraquat is the main ingredient in Swiss-based Syngenta’s Gramoxone – one of the world’s three most widely used weedkillers. Paraquat has been linked to reproductive effects and to Parkinson’s disease. Although paraquat had already been banned in 13 countries, including Sweden, Denmark, and Austria, in 2003, the Commission of European Communities (CEC) had issued an order approving the use of paraquat. Sweden challenged this order and the judges, in a previous decision, ruled that the CEC’s action showed a “disregard” of proper procedures. In the new ruling, the Court of First Instance criticizes EU regulators for not checking more carefully whether paraquat could harm humans and animals before authorizing it for sale in 2003. (Beyond Pesticides, July 5, 2007) A new study showing that the order of exposure to multiple pesticides may be just as important as the dose, timing and length of exposure adds another dimension to the complex task of risk assessments. Using carbaryl and chlorpyrifos, University of York scientists have observed significant differences in mortality rates of freshwater invertebrates depending on the order of exposure to these frequently used agricultural chemicals. The study, Modeling Combined Effects of Pulsed Exposure to Carbaryl and Chlorpyrifos on Gammarus Pulex, suggests the sequence of pesticide exposure may be just as important of a variable as the dose, the timing of the dose and the length of exposure when factoring environmental and health endpoints. The researchers conducted the study by exposing the freshwater invertebrate Gammarus pulex — a tiny shrimp — to pulses of the two insecticides (both of which affect the nervous system through acetylcholinesterase inhibition) mimicking exposure to chemical mixtures in the environment — for example, farmers may apply several different pesticides over the growing season that run off into the aquatic environment. (Beyond Pesticides, July 3, 2007) A scientist at the Minnesota Pollution Control Agency (MPCA) has filed a whistleblower lawsuit in federal court, arguing that he was first not allowed to share his research with a legislative panel, and then fired for it. Hydrologist Paul Wotzka, who worked for the state Agriculture Department for sixteen years before leaving to join MPCA in October, had been slated to testify about the rise in atrazine levels in Whitewater State Park, which have exceeded recommended levels for several area species. Atrazine, which has been linked to cancer, birth defects, neurotoxicity, endocrine disruption and a variety of other health and environmental effects and has been banned by the European Union, is a widely used agricultural herbicide.. Mr. Wotzka said in his lawsuit, as well as publicly, that this rise in atrazine in Minnesota waterways was due to increased row-crop agriculture in the region and the the Agriculture Department’s support of corn for ethanol. (Beyond Pesticides, June 28, 2007) This week the European Commission’s Committee on the Environment, Public Health and Food Safety voted on elements of a proposed framework that fills in regulatory gaps on pesticides, and adopts stricter rules than originally proposed, including a ban on aerial spraying. European Union’s existing legislation on pesticides only deal with two stages of the life cycle of pesticide products: the “placing on the market” stage and the “end of life-cycle” stage. To deal with the period in between – when pesticides are actually being used – the Commission, in July 2006, put forward a report, Thematic Strategy on the Sustainable Use of Pesticides. The first piece of legislation generated by the strategy is a draft framework directive on the sustainable use of pesticides, on which the Environment Committee voted. (Beyond Pesticides, June 25, 2007) In a new report published by the David Suzuki Foundation, environmental lawyer David Boyd finds that over 6,000 Canadians are acutely poisoned by pesticides each year, and more than 46 percent of those cases are children under the age of six. Entitled Northern Exposure: Acute pesticide poisonings in Canada, the report analyzes records of poisonings that occurred immediately after exposure, rather than chronic symptoms, such as cancer and neurological diseases. Based on its results, the Suzuki Foundation has made recommendations for personal and municipal actions to reduce poisonings. While much of Canada has been active in reducing pesticide exposures through bans on the cosmetic use of lawn pesticides, including one spanning all of Quebec, the report’s announcement laments the country’s failure to accurately document poisonings. According to the Suzuki Foundation’s release, “This is only the tip of the iceberg: many poisonings are misdiagnosed or completely unreported. (Beyond Pesticides, June 21, 2007) Earlier this month the National Research Council (NRC) released the results of its analysis of current models used in the regulatory process by the Environmental Protection Agency (EPA). Recognizing that many regulatory decisions are based on data obtained from models, NRC sees room for improvement. The main recommendations of the report, Models in Environmental Regulatory Decision Making, lie within three areas of the modeling process: (1) model evaluation; (2) principles for model development, selection, and application; and (3) model management. Specific recommendations of the report include the need for the agency to be committed to ongoing model evaluations, a transparent peer review process, the goal of not using proprietary models, transparency of a model’s origin and history, and improving model accessibility for stakeholders and others. NRC also sees a future with more sophisticated toxicity testing that will be using cells, cell lines, or cellular components, preferably of human origin, replacing traditional animal testing over time. (Beyond Pesticides, June 14, 2007) State legislators in Massachusetts are working on a bill that would phase out the use of 10 toxic chemicals, create a system to study toxics and find safer alternatives. Many state, health, labor and environmental officials have long supported this bill, which attempts to remove many toxic components from products used in everyday materials. Chemicals like those used in pesticides, wood and those found in children’s products, are especially targeted in the Safer Alternatives Bill (H. 783 / S. 558). Organophosphates, a toxic class of pesticides developed circa World War II, have been targeted in the phase out. Commonly used against mosquitoes, organophosphates like malathion (Fyfanon), naled (Dibrom) and chlorpyrifos (Mosquitomist) have been shown to be dangerous, especially to vulnerable populations, and affect the central nervous, cardiovascular and respiratory systems. The other chemicals slated for phase out have all been linked to environmental and health concerns as well and include perchloroethylene, dioxins and furans, hexavalent chromium, polybrominated diphenyl ethers, di (2-ethylhexyl)phthalate (DEHP), 2,4-dichlorophenoxyacetic acid (2,4-D), trichloroethylene, formaldehyde and lead. (Beyond Pesticides, June 13, 2007) Proposed nonorganic additions to the U.S. Department of Agriculture’s (USDA) organic standards have experts raising their eyebrows about the integrity of the “USDA Organic” label. The nonorganic exceptions being considered involve common ingredients, such as hops and food coloring. Under the 1990 Organic Foods Protection Act, USDA is required to identify which nonorganic ingredients are allowed in organic food products. Current organic standards require products labeled “Organic” to be made up of at least 95 percent organic ingredients. The remaining five percent can come from the National List of Allowed and Prohibited Substances (NL), a list comprised of substances that are not otherwise commercially available as organic. The 38 new ingredients being proposed for permanent addition to the NL include hops, 19 food colorings, fish oil, and chipotle chili pepper. (Beyond Pesticides, June 12, 2007) More than 10 years after being directed to do so by Congress, the Environmental Protection Agency (EPA) has announced that it will test 73 pesticides for their potential to damage the endocrine system and disrupt the normal functioning of hormones in the body, the agency announced in a press release yesterday. EPA is seeking comments on the draft list of 73 pesticides to be evaluated under the new screening regimen. The 1996 Food Quality Protection Act (FQPA) set a 1999 deadline for EPA to develop a battery of assays with which pesticide manufacturers will be required to screen their products as possible endocrine (hormonal) disrupters, similar to tests required to determine whether chemicals cause cancer, birth defects, genetic mutations, or other problems. EPA has repeatedly pushed back the deadline and despite claims to be “a leader in endocrine disruptor research,” EPA has yet to test a single chemical under the protocol. EPA draft list of 73 pesticide ingredients, including both active and inert ingredients, were chosen based on their relatively high potential for human exposure. (Beyond Pesticides, June 5, 2007) On May 26, a Montreal-bound train derailed near Lake Champlain, New York. Twelve of 33 cars jumped the tracks, including one carrying methylene chloride, a paint remover, and methyl bromide, a fumigant that has been banned in much of the world under the Montreal Protocol on Substances that Deplete the Ozone Layer. The county HazMat response team arrived two hours after the accident, putting out a small fire on the locomotive and determining within another two hours that the chemical tanks were unharmed, ending the threat of a chemical spill. Essex County Emergency Services Deputy Director Don Jaquish noted that the tankers were around ten percent full when they derailed, calling the scene one of “moderate risk,” although “for people working on the train, it could be a severe risk.” While this incident fortunately did not result in compromise of human health or the environment, the continued use of methyl bromide on fruits and vegetables across the country does compromise both public health and the environment by exposing many to a chemical that is carcinogenic, according to California’s Proposition 65.
