USGS Documents Threat of Pesticides to Waterways; Farm Bill Amendment Undermines Clean Water Act

(Beyond Pesticides, May 20, 2013) The U.S. Geological Survey (USGS) released a national assessment that shows the distribution and trends of pesticide use from 1992-2009, providing visible evidence that contamination of pesticides in our nation’s water is clearly a continuing threat. Meanwhile, U.S. Senators are gearing up to put their version of the Farm   Bill on the table that would eliminate common sense protections from pesticide applications into our nation’s waterways. These highly controversial  amendments would undermine the Clean Water Act and put our health and the environment at risk. Tell your Senators to oppose any efforts to undermine the Clean Water Act. The USGS maps provide, for the first time, a visible depiction of the agricultural use of 459 pesticides for each year during 1992-2009. Maps were created by allocating county-level use estimates to agricultural land within each county. A graph accompanies each map, which shows annual national use by major crop for the mapped pesticide for each year during the period. These pesticide use estimates are suitable for evaluating national and regional patterns and trends of annual pesticide use. EPA Sets New Rules for Antimicrobial Pesticides

(Beyond Pesticides, May 10, 2013) The U.S. Environmental Protection Agency (EPA) published on May 8 a final rule to revise and update use patterns and data requirements for antimicrobial pesticides. Though the new rule is the first revision to EPA data requirements for antimicrobial pesticide registrations since 1984,   remaining inconsistencies among data submissions and data gaps, these new rules are a step in the right direction when it comes to regulating antimicrobial pesticides, considering the proliferation of consumer products that contain these chemicals. However, even with these new rules in place, certain antimicrobial pesticides that are already in consumer products, such as triclosan, will  still present serious hazards for  human and environmental health. More than 5,000 antimicrobial products are currently registered with EPA. Initially designed for hospitals and clinics, many antimicrobial pesticides are found in products ranging from household cleaners to mattresses and bedding, cosmetics, toys, toothpaste and even chopsticks. Antibacterial products are being marketed to the health conscious without firm evidence of real benefits and amid growing concern about unintended externalities. Take Action: Senators Work with Industry on Yet Another Bill to Strip Water Protections

(Beyond Pesticides, May 1, 2013) Last week, U.S. Senator Kay Hagan, (D-NC), and Larry Wooten, president of the North Carolina Farm Bureau, announced new legislation that will be introduced to eliminate Clean Water Act permits required for certain applications of pesticides on or near waterways. The bill to be introduced by Sens. Hagan and Mike Crapo (R-ID) is called “The Sensible Environmental Protection Act (SEPA).” This is the latest in a string of attacks lobbied by industry to remove Clean Water Act protections for streams receiving pesticide discharges. Take Action: Urge your Senators Not to Support This Bill The bill, The Sensible Environmental Protection Act (S-EPA), announced last Monday by Senators Hagan and Crapo is said to be a bipartisan effort to remove so-called “redundant, unnecessary and costly regulation” on farmers and local governments.  According to Senator Hagan, the Clean Water Act does not provide any additional health benefits.  S-EPA, not to be confused with the School Environment Protection Act  (a real effort to protect children from pesticides),  will clarify that Clean Water Act permits are not required for pesticide applications in or near water. EPA Upholds Clean Water Act, Steps in to Add Impaired Streams to State List

(Beyond Pesticides, March 27, 2013) The U.S. Environmental Protection Agency (EPA) stepped in this week to revise a biennial report on impaired rivers and streams across West Virginia, after state officials, under pressure from industry interests, left more than 1,000 miles of polluted waterways off the list. EPA officials stated that the Clean Water Act does not allow the state to ignore evidence that streams are troubled. Water standards and plans for cleanup must be adopted for impaired waterways. EPA reprimanded West Virginia from shirking its responsibilities under the law to list all of the state’s impaired streams, in spite of industry interference. EPA Region  3 officials are now proposing to add an additional 255 waterway segments where aquatic life is impaired to the state’s 303(d) list, named for the section of the Clean Water Act that requires it be prepared. Section 303(d) requires a listing of impaired streams in the state, and the list is used for water standard development for subsequent cleanup plans and restoration of the impaired waterways. States are required to publish such lists every two years. New Legislation and Sequestration Will Limit Pesticide Oversight

(Beyond Pesticides, March 11, 2013) Recent sequester cuts and new proposed Congressional legislation could dramatically affect the safety of American waterways. According to a February 25 email, the White House Council on Environmental Quality estimates that the recent sequester could reduce federal funding for state environmental programs by $154 million. These cuts, which kicked in March 1, impact all states, with California losing the most funding totaling $12.4 million. The email also contains estimates that grants to federal fish and wildlife programs would be cut by $46.2 million. As these cuts begin to take effect, U.S. Representative Bob Gibbs (R-OH) introduced the Reducing Regulatory Burdens Act of 2013 (H.R. 935) on March 4. This bill, which is similar to a piece of legislation that was passed in the house in 2011, will eliminate the requirement for pesticide applicators to file Clean Water Act (CWA) permits for applications where pesticides could be discharged into water. The recent sequester has led to losses in “environmental funding to ensure clean water and air quality, as well as prevent pollution from pesticides and hazardous waste,” according to the White House Council on Environmental Quality. Water Testing for Atrazine Severely Lacking in Hawaii

(Beyond Pesticides, March 8, 2013) Sugarcane and pineapple production in Hawaii is threatening aquatic life as years of atrazine applications, a pesticide regularly used for corn production too, has run off into rivers, streams, and groundwater sources. Recent reviews by Hawaiian news service Civil Beat found that water testing for the chemical is not tracked currently in the state of Hawaii, despite requirements by U.S. Environmental Protection Agency regulatory limits under the Clean Water Act. Instead, the Hawaii Department of Agriculture almost exclusively relies on label compliance, according to Thomas Matsuda, manager of its pesticide program. Monitoring problems have been compounded by understaffing, with only six inspectors for the state of Hawaii. Not surprising, close examination of atrazine sales records by Civil Beat indicate that the largest buyers of the chemical are Hawaiian seed corn companies Monsanto and Mycogen. Syngenta recently reached a class action settlement in City of Greeneville v. Syngenta Crop Protection, Inc., providing the Kaua’i Department of Water with $6,692.96 for atrazine clean-up expenses. Atrazine is used nationwide to kill broadleaf and grassy weeds primarily in corn crops. Minnesota State Agencies Will No Longer Purchase Products Containing Triclosan

(Beyond Pesticides, March 6, 2013) The Minnesota Pollution Control Agency announced on March 3rd that state agencies have been ordered by Governor Mark Dayton to stop buying products that contain triclosan, a synthetic, broad-spectrum antimicrobial agent that has become ubiquitous in consumer products ranging from face-washes to fabrics. This ban, which will go into effect in June, comes as the debate over the efficacy and necessity of triclosan intensifies in the Minnesota State legislature. A bill banning triclosan’s use outside of medical settings is expected to be introduced this week, and the legislature conducted a hearing Tuesday on the possible human health and environmental consequences of the chemical. The state government, about 100 school districts, and local governments together currently buy about $1 million worth of cleaning products annually through joint purchasing contracts. Many of these products contain triclosan, but the U.S. Food and Drug Administration concluded in 2010 that products containing triclosan are no more effective than plain old-fashioned soap and water. “There are alternatives, and they are at the same price,” said Cathy Moeger, sustainability manager for the Minnesota’s Pollution Control Agency. “If it has an environmental benefit, why not do it?” Triclosan has been used for over […]

Fed Legislation Would Weaken Pesticide Rules to Protect Water

(Beyond Pesticides, February 4, 2013) U.S. Senators Pat Roberts (R-KS) and Mike Johanns (R-NE) re-introduced legislation that would reduce the review requirements for pesticides applied directly to water. Similar legislation was passed in the House of Representatives in March 2011. The previous Senate version of the bill, called the Reducing Regulatory Burdens Act of 2011, passed through the Senate Agriculture Committee but never reached the Senate floor because of a hold placed on the legislation by Senators Barbra Boxer (D-CA) and Benjamin L. Cardin (D-MD). This re-introduced legislation would reduce pesticide testing by ensuring that Clean Water Act (CWA) permits are not required for the application of pesticides. In 2009, the 6th Circuit Court of Appeals ruled in the case of the National Cotton Council et al. v. EPA that pesticides discharged into water are pollutants and required to be permitted under the CWA’s National Pollutant Discharge Elimination System (NPDES). This ruling overturned Bush administration policy that exempted pesticides from regulation under the CWA and applied the less protective standards of the Federal Insecticide Fungicide and Rodenticide Act (FIFRA). Toxic Contamination Remains Widespread In the Chesapeake Bay

(Beyond Pesticides, January 23, 2013) A new federal report finds toxic contamination remains widespread in the Chesapeake Bay, with severe impacts in some places, which health and environmental advocates say lends support to their push in Maryland for legislative action on pesticides and other hazardous chemicals. In spite of some cleanup, the health of the Bay has not significantly improved. The report, “Technical Report on Toxic Contaminants in the Chesapeake Bay and its Watershed: Extent and Severity of Occurrence and Potential Biological Effects” is based on a review of integrated water-quality assessment reports from the jurisdictions in the Bay watershed (Delaware, Maryland, New York, Pennsylvania, Virginia, West Virginia, and Washington, D.C.), Federal and State reports, and articles in scientific journals. It notes that nearly three-fourths of the Bay’s tidal waters are “fully or partially impaired” by toxic chemicals, with people warned to limit fish consumption from certain areas. Contamination is severe in a handful of “hot spots” around the Bay, including Baltimore’s harbor, largely a legacy of past industrial and shipping activity. Pesticide Exposure Linked to Rising Food Allergies in U.S

(Beyond Pesticides, December 6, 2012) A study published in the December issue of Annals of Allergy, Asthma and Immunology finds that exposure to dichlorophenols may be associated food allergies. Dichlorophenols are used as an intermediary in the manufacturing of some of the most commonly used pesticides, such as 2,4-D, and are also used to chlorinate drinking water. This study may help explain in part why food allergies are on the rise in the U.S. and already affect 15 million Americans. Lead researcher Dr. Elina Jerschow and her associates analyzed the urine of 10,348 Americans who were participants in the U.S. National Health and Nutrition Examination Survey (NHANES) of 2005-2006. Of the over 10,000 surveyed, 2,548 had detectable amounts of dichlorophenols in their urine, and 2,211 of those participants were included in the study. Out of these 2,211 people, 1,427 were found to have some form of either food or environmental allergy. Participants with higher levels of dichlorophenols are more likely to have allergies then those with low levels present in their urine. FDA Allows Lindane Use to Continue Despite Health Risks and Calls for a Ban

(Beyond Pesticides, December 3, 2012) The Food and Drug Administration (FDA) has denied a 2010 petition filed by the National Resources Defense Council (NRDC) and Pesticide Action Network North America (PAN) to ban the insecticide lindane, which is harmful to human health and ineffective in controlling lice and scabies. Pressure had been mounting on FDA to halt the pharmaceutical use of lindane as, in addition to this petition, Congressman Edward J. Markey (D-Mass.), senior member of the Energy and Commerce Committee, asked FDA to stop the pharmaceutical use of lindane this past summer. Because of FDA’s decision, lindane is still an active ingredient in pharmaceutical insecticide products such as lice shampoos and lotions. Lindane was formerly used in agricultural insecticides until it was banned by the Environmental Protection Agency (EPA) for use on crops in 2006. FDA regulates pharmaceuticals that contain insecticides and pesticides, such as triclosan, that are in cosmetics. Over 160 countries including the United States have signed on to the Stockholm Convention on Persistent Organic Pollutants (POPs) in 2001 which aims to eliminate or restrict the production and use of persistent organic polluntants. Unfortunately, there are a host of pesticides, genetically engineered materials, and others in conventional Thanksgiving foods that not only impact human health, but threaten the environment. Read below for some easy tips and suggestions for a healthful Thanksgiving day feast. Organic, free-range, and local turkeys The turkey is the symbol of a traditional Thanksgiving meal. However, turkeys are often fed grains treated with pesticides, medicated with antibiotics, and engorged with steroids and hormones. Additionally, turkeys are often fed an inorganic arsenic, a known carcinogen, which is used to promote growth and for pigmentation. In order to avoid all these, your best bet is to invest in an organic free-range turkey (pictured right), which is free of hormones, steroids or antibiotics. Want to forgo the turkey altogether? Oregon’s Department of Agriculture Looks to Protect Waterways from Pesticide Runoff

(Beyond Pesticides, October 16, 2012) The Oregon Department of Agriculture (ODA) is looking to revamp the way it enforces the 1993 Agricultural Water Quality Management Act in order to decrease the amount of pesticides that end up in the state’s waterways from agricultural nonpoint source pollution. The new plan, which was unveiled last December, will work by taking a firmer approach than the current plan, which on sporadic complaints for enforcement and cooperative action by residents through soil and water conservation districts. While a new plan could benefit the health of Oregon residents and its waterways, it is in danger because politicians and some farmers believe it will be overly burdensome and increase costs. Oregon is no stranger to problems with pesticide contamination of its water. The state of Oregon has a complex and diverse agricultural economy which ranges from forestry products to seed crops. Oregon also has thousands of miles of waterways. Roughly 15,000 miles of these waterways are listed as impaired, and nearly half of the 11,000-plus miles of waterways in Willamette River basin need more streamside plants, according to a 2009 state report. Despite IPM Law, New York City Applied Roundup to Public Spaces Nearly 500 Times in 2011

(Beyond Pesticides, September 25, 2012) According to a report from New York City’s Department of Health, Roundup, Monsanto’s most popular and widely used product is also the most frequently applied herbicide in the city. This has occurred in violation of the spirit and intent of the 2005-passed the Pesticide Useage Law (Local Law 37), which put New York City on track to eliminate dependency on hazardous pesticides, and submit a city integrated pest management (IPM) plan to the mayor every January. The report, Pesticide Use by New York City Agencies in 2011, indicates that over 500 gallons of Roundup in various formulations was applied to city ground in the year 2011. EPA Funds Water Treatment Research

(Beyond Pesticides, September 24, 2012) In the face of widespread pesticide contamination of U.S. waterways and the lack of drinking water standards for hundreds of pesticides, the U.S. Environmental Protection Agency (EPA) has devoted a $499,778 grant towards developing low-cost water decontamination facilities serving less than 10,000 people. Though conventional water treatment facilities remove many contaminants including suspended solids, bacteria, algae, viruses, fungi, and some chemical pollutants they do not remove many pesticide or antibiotic contaminants. Led by Professor Christopher Bellona, PhD of Clarkson University Civil and Environmental Engineering Departments, research into new water treatment technologies will aim at eliminating these antibiotics and pesticides from potable water. There are currently 88 drinking water contaminants and indicators regulated under the National Primary Drinking Water Regulations which are legally enforceable for public water systems. EPA determines whether a contaminant should be regulated based on peer-reviewed science-based research, with a focus on the health impacts due to exposure. They then propose an enforceable standard in the form of a Maximum Contaminant Level (MCL), taking into account the risks of exposure and availability of technologies to remediate the contaminant. Drinking Water in Several Oregon Schools Found To Be Contaminated with Multiple Pesticides

(Beyond Pesticides, September 10, 2012) Traces of pesticides in drinking water were found in eleven rural elementary schools in Oregon, according to a U.S. Department of Agriculture (USDA) study released on August 30. The study shows a disturbing variety of pesticides that when combined could have dramatic impacts on the health of the children that consume this water on a daily basis. The study found traces of several different types of pesticides in the drinking water of Dixie and Fairplay, the elementary schools that service Corvallis, Oregon. Some of the pesticides that were found in the Dixie school water include atrazine, bromacil, diuron, imidacloprid, metolachlor, norflurazon, and simazine. In the nine other schools that were found to have pesticides in their drinking water, seven different pesticides were found in the water at Applegate Elementary in Eugene, and multiple pesticides were also found in the drinking water of Ontario’s Pioneer and Cairo elementary. Children face unique hazards from pesticide exposure. They take in more pesticides relative to their body weight than adults in the food they eat and air they breathe. Safer Options Available for Tackling West Nile Virus Mosquito Management

(Beyond Pesticides, August 20, 2012) Given the number of West Nile virus (WNv) cases, including 26 deaths, it is important to focus attention on mosquito management methods that are the most effective and do not introduce additional short- and long-term public health hazards with the use of toxic pesticides, public health advocates say. It is understandable that local, state, and federal officials want to act decisively, but that does not mean that the widespread use of hazardous pesticides is the best course of action, according to Beyond Pesticides, a national information and advocacy organization on pesticides and alternatives based in Washington, DC. According to Beyond Pesticides’ executive director, Jay Feldman, “Communities that are most successful and smart about mosquito control engage in aggressive efforts to reduce and eliminate mosquito breeding areas in standing water around homes and buildings and throughout the community.” Mosquito breeding can take place in stagnant water, from very small to larger pools —bottle caps, discarded automobile tires, planters, containers, rain gutters, drains, or under piles of leaves. Johnson and Johnson to Phase Out Triclosan, Regulators Remain Unresponsive

(Beyond Pesticides, August 17, 2012) Part of an increasing trend, health care and cosmetics giant Johnson and Johnson has announced that it will soon begin phasing out a number of potentially dangerous chemicals from its personal care brands, including the antibacterial triclosan. Beyond Pesticides and other groups, which have petitioned the U.S. Food and Drug Administration (FDA) and the U.S. Environmental Protection Agency (EPA) to remove triclosan from a vast array of consumer products, have urged companies like Johnson and Johnson to take action on the pesticide in the face of inadequate regulation to protect human health and the environment. Along with other chemicals such as formaldehyde and 1,4 dioxane, the company cites consumer concern over the safety of triclosan as among its reasons for the alteration in its products. While the company downplayed any need for concern over the safety of triclosan, it also hinted that it was uncomfortable with growing body of science linking triclosan to a number of health concerns. U.S. to Clean Up Sites in Vietnam Contaminated with Agent Orange

(Beyond Pesticides, August 15, 2012) After decades of denying Vietnamese requests for assistance in a cleanup, the United States launched its first major effort to address environmental contamination brought on by its use of Agent Orange in the Vietnam War, this according to the New York Times. Condominium Residents Win Fight Against Pesticide Use

(Beyond Pesticides, August 8, 2012) Residents of a large condominium in New Jersey have won their fight against the use of pesticides on the complex’s lawn. The homeowner’s association agreed with residents’ pleas to alter its treatment of lawns, instituting an integrated pest management (IPM) policy to avoid using toxic pesticides.In June, several residents at the Society Hill complex in Bernardsville, New Jersey, went public in challenging their homeowners’ association’s decision to use pesticides for lawn care, saying the chemicals have left their children with skin rashes, have sickened, and even killed family dogs. They took their pleas to the Environmental Commission, the Township Committee, The Bernardsville News and even New Jersey 101.5 FM radio. Officials from the Environmental Commission said they could only encourage, not force, private homeowner associations to use organic lawn treatments. Last week, the residents won their battle when the association decided to enact a new pesticide policy. The policy applies integrated pest management (IPM) that avoids pesticides when possible. The association plans to put IPM in all future maintenance contracts so as to maintain consistency. Large Aerial Mosquito Spraying in Massachusetts Lacks Permit and Adequate Monitoring

(Beyond Pesticides, July 24, 2012) This past weekend, the State of Massachusetts undertook what is thought to be its largest aerial spraying of pesticides covering nearly 400,000 acres and 21 communities. By using the pretext of a new emergency, the state improperly evaded Clean Water Act protections according to Public Employees for Environmental Responsibility (PEER). PEER has asked for a federal investigation. The massive spraying was triggered by the trapping of mammal-biting mosquitos which tested positive for Eastern Equine Encephalitis (EEE) on July 9th. On July 17th, the state Department of Public Health declared a pest emergency to justify aerial spraying over Bristol and Plymouth Counties through September 30, 2012. The spraying took place July 20th, 21st, and 22nd. Typically, aerial spraying of pesticides requires a federal pollution discharge permit but the permit may be dispensed with if the application is done “less than ten days after identification of the need for pest control” — a requirement violated in this case. Banned Pesticides Found in Connecticut Wells

(Beyond Pesticides, July 9, 2012) Health officials in Connecticut are telling residents who drink from private wells to test their water for the banned pesticides chlordane and dieldrin, after a study from the town of Stamford, CT found at least one of the toxic chemicals in 195 out of 628 wells tested. Over half of the wells that tested positive for one of the pesticides were found to contain concentrations at levels above what the U.S Environmental Protection Agency (EPA) considers acceptable. Both of these chemicals, discussed at length in Rachael Carson’s seminal book Silent Spring, were widely used throughout the country before their ban in the late 1980s. Since then, these chemicals have revealed themselves to be pervasive in our environment. In 2007, Beyond Pesticides wrote on the discovery of chlordane on the grounds of a New Jersey middle school at levels above EPA limits. In 2009, the U.S Housing and Urban Development (HUD) and EPA conducted a survey that found chlordane in 64% of U.S households sampled. Take Action! New Farm Bill Amendments Attack Your Health and Environment

(Beyond Pesticides, June 18, 2012) Once again, attempts to repeal the Clean Water Act permits for pesticide discharges are underway in Congress. This week the 2012 Farm Bill will be introduced to the Senate floor where measures to attack environmental laws have been added unceremoniously to the bill, including the controversial H.R. 872, Reducing Regulatory Burdens Act, which seeks to undermine federal authority to monitor our nation’s waterways for pesticide contamination, as well as eroding already lax federal oversight of genetically engineered crops. Congress is working on the monumental process of altering and renewing the Farm Bill, S. 3240. This process only comes along every five years and has major impacts on how we grow our food. The last Farm Bill was passed in 2008, and expires in 2012. The bill is expected to be introduced on Senate floor on Tuesday, June 19.
