(Beyond Pesticides, January 20, 2011) Beyond Pesticides and the National Organic Coalition (NOC) are encouraging their members to contact President Obama and the U.S. Department of Agriculture (USDA) and tell them not to approve (or not deregulate) Monsanto’s “RoundUp Ready,” genetically engineered (GE) alfalfa, which contributes to genetic drift, superweeds, and the use of a hazardous herbicide glyphosate. In December, USDA completed its environmental impact statement (EIS) of GE alfalfa. Secretary of Agriculture Tom Vilsack has rejected the option to prohibit the planting (and continuing to regulate) GE Alfalfa, despite the clear recognition in the EIS that that GE contamination of organic and conventionally grown crops presents a huge problem. USDA released its 2,400 page EIS as required by a 2007 Federal District Court decision and upheld by both 2009 Ninth Circuit Court of Appeals and June 2010 U.S. Supreme Court rulings. The litigation was led by the Center for Food Safety, and joined by Beyond Pesticides, and other groups, including conventional and organic seed companies and producers. (Beyond Pesticides, December 17, 2010) Secretary of Agriculture Tom Vilsack disappointed organic farmers and consumers, as well as environmentalists when he announced December 16, 2010 that the U.S. Department of Agriculture was considering “deregulating” a genetically engineered crop that is tied to genetic drift, superweeds, and the use of a hazardous pesticide -Monsanto’s genetically-engineered (GE) Roundup (glyphosate) Ready (RR) alfalfa. The Department released a 2,400 page Environmental Impact Statement (EIS) as required by a 2007 Federal District Court decision and upheld by both 2009 Ninth Circuit Court of Appeals and June 2010 U.S. Supreme Court rulings. The litigation was led by the Center for Food Safety, and joined by Beyond Pesticides, and other groups, including organic seed companies and producers. A broad coalition of groups has previously called for USDA to deny approval of Monsanto’s genetically engineered, Roundup Ready alfalfa (GE alfalfa). (Beyond Pesticides, August 30, 2010) AquaBounty Technologies Inc.. a small biotechnology firm based in Waltham, Massachusetts, is seeking FDA approval for a genetically engineered salmon, hoping to do for aquaculture what biotech giants such as Monsanto have done for agronomy. Currently, the vast majority of US soybeans, corn, and cotton are genetically engineered, but this would be the first commercially available genetically engineered food animal. While AquaBounty argues their fish will help feed the world, many are leery of “frankenfish” being introduced into the food supply. If the proliferation of genetically engineered crops in the U.S. is any indication, the introduction of genetically engineered animals into the food supply will fail to produce an increase in yield. AquaBounty has invested $50 million over 14 years to develop AquAdvantage Fish. AquAdvantage Salmon (AAS) unlike conventional salmon grows year around reaching market weight in 18 months instead of 36, and consuming 25% less food over its lifetime. The variety was developed by inserting part of a gene from an Ocean Pout, an eel-like fish, into the growth gene of a Chinook salmon. (Beyond Pesticides, December 17, 2009) Earlier this week, the U.S. Department of Agriculture’s (USDA) Animal and Plant Health Inspection Service (APHIS) announced the availability of a Draft Environmental Impact Statement (EIS) that preliminarily concludes that there is no significant impact on the human environment due to granting nonregulated status to Roundup Ready (RR) alfalfa. Much to the dismay of environmentalists, the draft EIS outlines plans to allow unlimited commercial planting of genetically-engineered (GE) alfalfa that is resistant to the herbicide glyphosate, despite increasing evidence that GE alfalfa will threaten the rights of farmers and consumers, as well as damage the environment and the integrity of organic food. The agency prepared this draft EIS to comply with a February 2007 judgment and order by the U.S. District Court for the Northern District of California, in which Judge Charles R. Breyer found that USDA violated federal environmental law by failing to conduct an EIS on GE alfalfa seeds before deregulating them in 2005. (Beyond Pesticides, November 18, 2009) A report released yesterday and authored by Charles Benbrook, PhD, chief scientist at The Organic Center (TOC), finds that the rapid adoption by U.S. farmers of genetically modified corn, soybeans and cotton has promoted increased use of pesticides, an epidemic of herbicide-resistant weeds, and more chemical residues in foods. The report, “Impacts of Genetically Engineered Crops on Pesticide Use in the United States: The First Thirteen Years,” explores the impact of the adoption of genetically modified (GM) corn, soybean, and cotton on pesticide use in the United States, drawing principally on data from the U.S. Department of Agriculture (USDA). The most striking finding, is that GM crops have been responsible for an increase of 383 million pounds of herbicide use in the U.S. over the first 13 years of commercial use of GE crops (1996-2008). The report identifies, and discusses in detail, the primary cause of the increase–the emergence of herbicide-resistant weeds. The steep rise in the pounds of herbicides applied with respect to most GM crop acres is not news to farmers. (Beyond Pesticides, February 9, 2009) The U.S. Environmental Protection Agency (EPA) is currently soliciting comments on Monsanto’s second application to extend its experimental use permit for soybeans genetically engineered (GE) with the soil bacterium Bacillus thuringiensis (Bt). This will be the new administration’s first test on how it handles the issues surrounding GE crops. Among a number of concerns regarding GE crops, crops engineered to contain Bt threaten the long-term efficacy of Bt, which is an approved insecticide in organic farming. Monsanto’s permit on these GE soybeans was first granted by EPA in September 2007 and then extended in April 2008. Under the permit, plantings are permitted through July 31, 2009. Monsanto is requesting to extend the experimental program until December 31, 2010 and amend it by conducting tests with up to 0.466 pounds of Bt Cry1Ac protein in soybeans on 1,362 acres, according to the February 4th Federal Register notice. The testing trials will take place in Arkansas, Illinois, Indiana, Kentucky, Maryland, Missouri, North Carolina, Puerto Rico, South Carolina, and Virginia. (Beyond Pesticides, November 6, 2008) Agricultural biotech seed and chemical giant Monsanto will acquire Aly Participacoes Ltda., a Brazilian company involved in breeding sugar cane, and has already begun work to develop genetically engineered (GE) Roundup Ready (herbicide resistant) sugarcane. The deal for $290 million comes at the same time grain giant Archer Daniels Midland (ADM) is set to invest $375 million in a joint venture with a Brazilian firm to produce sugarcane-based ethanol. Amidst numerous other concerns with the widespread adoption of GE crops and the proliferation of crops grown for biofuels around the world is the threat of increased pesticide use. Roundup Ready crops, which are genetically engineered to be resistant to Monsanto’s best selling herbicide Roundup (active ingredient glyphosate https://www.beyondpesticides.org/gateway/pesticide/glyphosate.htm) have been a boon to Monsanto’s profits, but not without environmental costs. Currently grown Roundup Ready crops include soy, corn, canola, cotton, and sugar beets. (Beyond Pesticides, October 23, 2008) Researchers in Illinois have developed a genetically modified grape that is resistant to the toxic herbicide 2,4-D. The development is in response to serious losses grape growers in the Midwest have suffered as a result of the surrounding use of 2,4-D on grain crops. While the new variety may mean that Midwest grape growers can continue to grow grapes successfully, it does not address the underlying problem –excessive use of toxic herbicides that are prone to drift thereby contaminating other crops, air and water, and threatening human and environmental health. Herbicide resistant crops were first introduced in 1996 with Roundup Ready soybeans, which were engineered to enable the spraying of Roundup (active ingredient glyphosate) without harming the soybean plants. Since then other Roundup Ready varieties, such as corn, cotton, canola, and sugar beets, have been introduced and are grown in the U.S. and abroad. (Beyond Pesticides, October 7, 2008) After months of grassroots pressure by the Genetic Engineering Policy Project, Center for Food Safety and others, Governor Schwarzenegger signed AB 541, The Food and Farm Protection Act, on September 27, 2008. Under this law, farmers that are unknowingly contaminated by genetically engineered (GE) crops in California are now protected from liability. Monsanto, which has aggressively litigated to protect its seed patents, must now use a protocol to investigate farmers and sample their crops under legal standards that require notification. “We’re pleased to see that this bill will give farmers new protections from legal implications related to GE crops,” said Rebecca Spector, West Coast Director for Center for Food Safety. “While it is a compromise, it’s still an important step in the right direction.” AB 541 protects California farmers who have not been able to prevent the inevitable – the drift of GE pollen or seed onto their land and the subsequent contamination of non-GE crops. (Beyond Pesticides, September 4, 2008) On September 2, 2008, the U.S. Court of Appeals for the Ninth Circuit upheld a nationwide ban on the planting of genetically-engineered (GE) Roundup Ready alfalfa pending a full Environmental Impact Statement (EIS). The Court determined that the planting of genetically modified alfalfa can result in potentially irreversible harm to organic and conventional varieties of crops, damage to the environment, and economic harm to farmers. Beyond Pesticides is a co-plaintiff in the lawsuit. Although the suit (Geertson Seed Farms, et al. v. Johanns) was brought against U.S. Department of Agriculture (USDA), Forage Genetics and Monsanto entered into the suit as Defendant-Intervenors. In her opinion, Circuit Judge Mary M. (Beyond Pesticides, April 14, 2008) After almost a year and a half of debate on genetically engineered (GE) crops, the Maine Legislature passed a bill last week to protect farmers from genetic trespass. According to Protect Maine Farmers, the bill prevents lawsuits for patent infringement against farmers who unintentionally end up with GE material in their crops; ensures lawsuits that do occur will be held in the state of Maine; and, directs the Department of Agriculture, Food and Rural Resources to develop and implement specific practices, or Best Management Practices, for growing GE crops. One component of the bill that was supported by many Maine farmers but failed would have required all businesses selling GE seeds in Maine to report their annual sales data to the Maine Commissioner of Agriculture. “Maine’s farmers now have some substantial assurance that if they save seed that has been contaminated by [GE] varieties, they are not at risk for a lawsuit,” states Logan Perkins, the lead organizer for Protect Maine Farmers. “Hopefully, the development of these Best Management Practices will give farmers the information they need to make good decisions about how to protect themselves, their livelihoods and their neighbors when using [GE] crops.” […]

(Beyond Pesticides, May 09, 2007) In a precedent-setting decision last week, Judge Charles Breyer ordered a complete environmental review of Monsanto’s genetically-altered alfalfa, making a final ruling that the U.S. Department of Agriculture’s (USDA) 2005 approval of Monsanto’s genetically engineered (GE) “Roundup Ready” alfalfa was illegal. The judge called on USDA to ban any further planting of the GE seed until it conducts a complete Environmental Impact Statement (EIS). In the decision, Judge Breyer in the Federal Northern District of California affirmed his preliminary ruling, which echoed the Center for Food Safety (CFS), Beyond Pesticides and other co-plaintiffs’ arguments in their lawsuit against USDA, that the crop could harm the environment and contaminate natural alfalfa. The ruling also requires Forage Genetics to provide the locations of all existing Roundup Ready alfalfa plots to USDA within 30 days.
