Final Suit Routing Genetically Engineered Crops and Related Practices from Refuges

(Beyond Pesticides, March 19, 2015) A federal court ruled Monday against the use of neonicotinoid insecticides linked with destruction of bee colonies and other beneficial insects in national wildlife refuges in the Midwest region.  The ruling caps a legal campaign to end the planting of genetically engineered (GE) crops and other industrial agricultural practices on national wildlife refuges across the country. The federal lawsuit was filed by Center for Food Safety (CFS), Public Employees for Environmental Responsibility (PEER), Sierra Club, and Beyond Pesticides. The suit focused on farming contracts for five refuges in four Midwestern states (IL, IA, MN and MO) and sought to force the Fish & Wildlife Service (FWS), which operates refuges, to stop these practices until it completes rigorous analyses of their environmental impacts. Beset by this litigation, this past July FWS decided that it will phase out the use of GE crops to feed wildlife and ban neonicotinoid insecticides from all wildlife refuges nationwide by January 2016.  This new policy still allows for case-by-case exceptions. Members of Congress Call for Listing Monarch Butterfly as Threatened

(Beyond Pesticides March 18, 2015) Fifty-two members of Congress penned a letter to the White House, calling for the protection of the Monarch butterfly, which has declined by 90 percent in the last 20 years, and for listing as a ”˜threatened’ species under the Endangered Species Act (ESA). This comes on the heels of a formal  notice  of intent to sue submitted to the U.S. Environmental Protection Agency (EPA) for failing to protect threatened and endangered species, including butterflies, amphibians and birds, from flupyradifurone, a newly approved systemic insecticide. The letter sent to President Obama on Tuesday was spearheaded by Representative Chellie Pingree (D-ME), a long-time advocate for protecting monarch butterflies. In her press release, Rep. Study Shows the Benefits of Pesticide-free Pollinator Habitat

(Beyond Pesticides, March 17, 2015) Foraging bumblebees would prefer to dodge traffic rather than pesticides and other agricultural chemicals, according to the results of a new study published in the Journal of Insect Conservation. Researchers from Plymouth University in England discovered that the number of bumblebees observed foraging plants along roadsides was over twice the number located in adjacent patches facing agricultural crops. As both native and managed bees continue to decline throughout the globe, this research strengthens calls from farming and environmental groups to improve agricultural practices through increased on-farm diversity, and sharp reductions in the use of pesticides, particularly systemic chemicals such as neonicotinoids. Mick Hanley, Ph.D., lead author of the study, explains, “There have been hedgerows and field boundaries in these locations for centuries, and even if you go back 50 or 60 years, you would not have  seen this phenomenon. Bayer Attempt to Silence Critics of Its Bee-Poisonous Pesticides Rejected by Judge

(Beyond Pesticides, March 16, 2015) Last week, a judge in Duesseldorf Regional Court ruled that the German branch of Friends of the Earth (BUND) has a right to speak out against chemical company giant Bayer CropScience’s neonicotinoid pesticide, thiacloprid, regarding its potential danger to bees. The court considered the allegations put forth by BUND to be a form of free speech, a protected right. Neonicotinoids, a class of insecticides, affect the central nervous system of insects, resulting in paralysis and eventual death. These pesticides have consistently been implicated as a key issue in pollinator declines, not only through immediate bee deaths, but also through sub-lethal exposure causing changes in bee reproduction, navigation and foraging. The science has become increasingly clear that pesticides, either working individually or synergistically, play a critical role in the ongoing decline of honey bees. Pesticide exposure can impair both detoxification mechanisms and immune responses, rendering bees more susceptible to viruses, parasites and other diseases, leading to devastating bee losses. As States Legalize Marijuana, Study Finds Uneven Pesticide Use Restrictions on Growing Practices

(Beyond Pesticides, March 12, 2015) Marijuana may be legal in your state for medicinal and recreational use, but are toxic pesticides used in its production? A study released today of the 23 states and the District of Columbia that have legalized marijuana finds a patchwork of state laws and evolving policy that define allowed pesticide use and management practices in cannabis production. This variety of state law is occurring in the absence of federal registration of pesticide use for cannabis production because of its classification as a narcotic under federal law. The investigation, Pesticide Use in Marijuana Production: Safety Issues and Sustainable Options, evaluates the state laws governing pesticide use in cannabis production where it is legalized. “The use of pesticides in the cultivation of cannabis has health implications for those growing the crop, and for users who are exposed to toxic residues through inhalation, ingestion, and absorption through the skin,” said Jay Feldman, executive director of Beyond Pesticides. “The good news is that five states and DC have adopted rules that require marijuana to be grown with practices that prevent the use of pesticides. Appeals Court to Hear Case on EPA’s Registration of Bee-Toxic Chemical

(Beyond Pesticides, March 4, 2015) The 9th U.S. Circuit Court of Appeals has agreed to hear the case brought by beekeepers challenging the U.S. Environmental Protection Agency’s (EPA) approval of a toxic pesticide known to be toxic to bees. In 2013, the beekeepers filed suit against the agency, citing that the new chemical, sulfoxaflor, as further endangering bees and beekeeping and noting that their concerns were not properly addressed by EPA before registration was granted. Sulfoxaflor is a sub-class of the neonicotinoid pesticides that have been linked to global bee declines. The Court has agreed to hear the case on April 14, 2015. The case, Pollinator Stewardship Council v. EPA, which requests changes to EPA’s product label for sulfoxaflor, was first filed July 2013. The petitioners include the Pollinator Stewardship Council, the American Honey Producers Association, the National Honey Bee Advisory Board, the American Beekeeping Federation, and beekeepers Bret Adee, Jeff Anderson and Thomas Smith. The beekeeper groups are represented by Earthjustice. Partial Victory as Hershey’s Announces Move Away from GMO Ingredients

(Beyond Pesticides, March 2, 2015) Amid growing consumer backlash, Hershey’s has announced first steps toward moving to non-genetically engineered (GE) ingredients in its chocolate. The news comes in response to tens of thousands of Facebook posts, emails, and telephone calls from consumers who took part in a campaign calling on Hershey’s to move to non-GE ingredients led by GMO Inside. In a statement released February 18, Hershey’s said that it will “transition some of its most popular chocolate brands, including Hershey’s Kisses Milk Chocolates and Hershey’s Milk Chocolate Bars to simpler ingredients.” Last week, Hershey’s confirmed with GMO Inside that as part of its commitment to simpler ingredients, its two iconic products will be non-GE by the end of the year, however the company did not respond to the request to source its sugar organically. “We congratulate Hershey’s on this important move and great first step. Scientists Challenge Industry Consensus that GE Foods Are ‘Safe’

(Beyond Pesticides, February 25, 2015) The biotechnology industry behind genetically engineered (GE) foods have for years touted that their technology is safe, dismissing any attempts to challenge their science or regulate their material. However, 300 scientists, physicians and scholars assert there is no scientific consensus on the safety of GE foods and find that claims of safety are an “artificial construct that has been falsely perpetuated” through various forums and media. The statement, published in the journal Environmental Sciences Europe and entitled, “No scientific consensus on GMO safety,” cites a concerted effort by GE seed developers and some scientists, commentators and journalists to construct the claim that there is a “scientific consensus” on GE safety, and that debate on the topic is “over.” According to the 13-page statement, 300 independent scientists and researchers felt compelled to develop a document that offered a balanced account of the current state of dissent in this field, based on published evidence in the scientific literature, for both the interested public and the wider science community. House Panel Rejects Hawai’i Bill to Impose Pesticide Buffer Zones

(Beyond Pesticides, February 23, 2015) A Hawaii state House agriculture committee rejected a bill Thursday that sought to impose buffer zones for large agricultural companies that spray restricted-use pesticides near schools and other sensitive areas. The proposal, House Bill 1514, introduced by Rep. Chris Lea, stemmed from concerns about  the impact of genetically-engineered (GE) farming and its inherent dependency on increasing  pesticide use. The measure sought  to require companies’  disclosure of the pesticides used and the volume of use. The bill had strong support from the Hawaii chapter of the national nonprofit Center for Food Safety (CFS), as well as a strong backing from neighbor island residents. Maui, Kauai, and the Big Island have all passed laws recently to regulate the seed industry, but a federal  district  court judge  has ruled  that Hawaii counties do not have that power. Industry has been especially effective in obstructing the bill. USDA Approves GE Apple that Won’t Brown

(Beyond Pesticides, February 19, 2015) Last week, regulators at the United States Department of Agriculture (USDA) approved a genetically engineered (GE) apple that does not brown after slicing or bruising. The “Arctic” apple, produced by Okanagan Specialty Fruits, is engineered using a novel technique called RNA interference (RNAi). In the case of this GE apple, RNAi technology has been used to silence the genes that produce polyphenol oxidase (PPO), the enzymes responsible for the browning that results after an apple has been bruised. Government approval of this method of genetic engineering is raises serious concerns because of considerable uncertainty regarding the unintended effects of this technology. These concerns are compounded by the agrochemical industry’s future interests in using RNAi technology to control crop pests. So far, USDA has approved commercial use of Granny Smith and Golden Delicious “Arctic” apples, and the company plans to produce Gala and Fuji cultivars in the future. EPA Sued for Violating Endangered Species Act with Allowance of New 2,4-D/Roundup Pesticide

(Beyond Pesticides, February 13, 2015) With the U.S. Environmental Protection Agency’s (EPA)  nod to the pesticide industry on expanded uses of the herbicides 2,4-D and glyphosate, environmental groups are charging that the agency violated the Endangered Species Act (ESA).  Repeating a pattern of putting the environment in harm’s way through violations of  federal endangered species  law, a lawsuit filed Friday  documents   EPA’s  failure to consult with the U.S. Fish and Wildlife Service (FWS) regarding the impact of the herbicide on two endangered species —the whooping crane and the Indiana bat— with the recent approval of Dow AgroSciences’ herbicide, Enlist Duo, for use on genetically engineered (GE) crops in six midwestern states. Enlist Duo is an herbicide that incorporates a mix of  glyphosate  and a new formulation of  2,4-D, intended for use on GE Enlist Duo-tolerant corn and soybean crops. France Elevates Effort to Reduce Pesticide Use by 50%, but Delays Deadline

(Beyond Pesticides, February 11, 2015) In 2008, France announced it would voluntarily cut pesticide use by 50 percent by 2018, and emerged as the European leader in  reducing pesticide dependency. With its plan faltering, the European Union’s (EU) biggest agricultural producer and pesticide user has announced the expansion of  a network of pioneer farms experimenting with alternative techniques and mandated reductions in pesticide sales as it  delays its target reduction until 2025. The French government has pushed back to 2025 the timeline for halving pesticide use and added an intermediate target of a 25 percent fall by 2020, Agriculture Minister Stephane Le Foll said. The  2018 target was slated as voluntary, but pesticide use has actually increased, in part due to poor weather, according to French officials. As the EU’s top agricultural producer, France is trying to become less dependent on pesticides, which are known to pose various health and environmental risks. The targets for pesticide reduction remain mostly non-binding on farmers, but Minister Le Foll said his revamped plan would encourage a change in practices by expanding their focus on  alternative techniques. Neonics Harm Bees’ Brain Cells, According to Researchers

(Beyond Pesticides, February 10, 2015) Scientists at the Universities of Dundee and St. Andrews in Scotland have found evidence confirming that the levels of neonicotinoid (neonic) pesticides bees are likely to encounter in the wild impair the pollinator’s brain cells, resulting in colony declines. Bees and other wild pollinators provide services of over $125 billion globally, but are experiencing widespread and consistent losses that have the potential to increase global malnutrition and disease if not properly addressed. Although countries and regions across the globe have taken action to suspend or restrict the use of neonic pesticides in light of their threat to bees, policymakers in the U.S. continue to delay, impose inadequate changes, or even introduce new bee-toxic chemicals. The recent study, Chronic exposure to neonicotinoids increases neuronal vulnerability to mitochondrial dysfunction in the bumblebee (Bombus terrestris), published in the Journal of the Federation of American Societies for Experimental Biology, finds a mechanistic explanation for previous findings that observed poor navigation and foraging in colonies of bumblebees exposed to neonicotinoids. Monsanto’s Roundup Eradicates Milkweed, Major Food Source for Monarch Butterflies

(February 9, 2015, Beyond Pesticides) A report, Monarchs in Peril: Herbicide-Resistant Crops and the Decline of Monarch Butterflies in North America, released by Center for Food Safety (CFS) last week, reveals the devastating  impact of Monsanto’s and the nation’s biggest selling herbicide, Roundup (glyphosate), on the survival  of monarch butterflies. The herbicide is  used to treat  millions of acres of herbicide-tolerant  genetically engineered (GE) crops, eliminating the monarchs’ sole source  of food, milkweed, and approaching  a collapse of their population, which has plummeted over the past 20  years. The report cites findings that  glyphosate use on Roundup Ready  (glyphosate-tolerant) crops has nearly eradicated milkweed around farmland in the monarchs’ vital midwest breeding ground. Maui Decision Not to Defend GE Moratorium Disappoints Activists

(Beyond Pesticides, February 4, 2015)    In the face of a challenge from the chemical industry, Hawaii’s Maui County will not defend a moratorium on genetically engineered (GE) farming that was passed by county voters last fall. Seeking to have the moratorium thrown out, industry giants Monsanto, Dow-owned Agrigenetics and others sued Maui days after the measure was passed.   It was expected that the county would defend the law in the courts, but to the disappointment of many, attorneys for Maui County filed a single sentence brief with the court, stating that it “is taking no position.” In November 2014, Maui residents passed a ballot initiative prohibiting the growth, testing or cultivation of GE crops in Maui County until an environmental and public health study can show that the planting operations are safe for the community. Now residents and local groups supporting the new law are expressing outrage and disappointment over the decision by Maui County to disregard its duty to defend a law passed by its citizens, despite earlier assurances that county will implement the moratorium. Commonly Used Pyrethroid Pesticide Increases Risk of ADHD

(Beyond Pesticides, February 2, 2015) A study led by a Rutgers University research team finds that the commonly used pesticide deltamethrin increases the risk of attention deficit hyperactivity disorder (ADHD) in children, adding to a mounting body of scientific research linking pesticide exposure to the disorder. Rutgers scientists, along with colleagues from Emory University, the University of Rochester Medical Center, and Wake Forest University discovered that mice exposed to the pyrethroid insecticide deltamethrin in utero and through lactation exhibit several features of ADHD, including dysfunctional dopamine signaling in the brain, hyperactivity, working memory, attention deficits and impulsive-like behavior. The study, Developmental pesticide exposure reproduces features of attention deficit hyperactivity disorder, was published Wednesday in the Journal of the Federation of American Societies for Experimental Biology (FASEB). ADHD is estimated to affect 8—12% of school-age children worldwide. New Pesticide To Be Marketed Amid Misleading Claims That It Is ‘Safer for Bees’

(Beyond Pesticides, January 26, 2015) Last week, the U.S. Environmental Protection Agency (EPA) announced it completed the registration of a new pesticide, flupyradifurone, that would be marketed as an alternative to neonicotinoid pesticides, and “safer for bees.” A closer look at this chemical reveals that the agency is grossly misleading the public on the ecological safety of flupyradifurone since the chemical is systemic, persistent, and highly acutely toxic to adult honey bees. At a time when bees are declining, advocates say it is inappropriate for EPA to introduce yet another bee toxic chemical to the market. Flupyradifurone (“Sivanto”) is a new systemic, butenolide insecticide from Bayer CropScience that is to be used on crops such as citrus, cotton, potatoes and many others, and also as seed treatment. Note: EPA is still considering soybean seed treatment. The chemical is a neurotoxic insecticide that can inhibit nicotinic acetylcholine receptors (nAChR) in the nervous system. Iowa Farmers Group Asks for Improved Pesticide Drift Protections

(Beyond Pesticides, January 22, 2015) The Iowa Farmers Union filed  a petition yesterday with  the Iowa Department of Agriculture and Land Stewardship (IDALS) for rulemaking to improve pesticide drift incident responses, penalties, and support to farmers harmed by pesticide drift. “Pesticide  drift from nearby fields is a very real problem for farmers in Iowa,” says Jordan Scheibel, a diversified vegetable farmer from Grinnell, Iowa. “Not only can pesticide drift delay or cause a farm to lose its organic certification, it results in products that farmers – certified organic or not – may not be able to sell legally, safely, or in good conscience, and it exposes the farmers and their workers to potentially harmful pesticides.” Pesticide drift is an inevitable problem in chemical-intensive pest management strategies that rely on spray and dust pesticide formulations.There are essentially two types of drift: particle drift (off-target movement during application) and vapor drift (off-target movement when a pesticide evaporates from a sprayed surface), also known as volatilization. California Tightens Pesticide Limits on Strawberries and Other Crops

(Beyond Pesticides, January 16, 2015) The California Department of Pesticide Regulation (CDPR) announced Wednesday that it is implementing the country’s strictest limits on chloropicrin, a chemical injected into the soil where strawberries, raspberries, almonds, and other crops are grown. The soil fumigant has been linked to a litany of health effects, such as respiratory ailments, skin irritation, and headaches, due to exposure to drift in surrounding areas over recent years. The new rules set up wider buffer zones of up to 100 feet around fields where the pesticide is applied. Growers will be restricted to fumigating 40 acres a day unless they use stronger tarps to prevent pesticide drift. Growers are also required to give the state 48 hours notice before fumigating and notify surrounding homes and businesses in Spanish and English. Chloropicrin is used to control soil pathogens, nematodes, and certain weeds, and can be used alone or in combination with another fumigant, either 1,3-dichloropropene (1,3-D) or methyl bromide, both of which have also been shown to be toxic to human health and potent environmental contaminants. Member EU States Authorized to Plant GE Crops

(Beyond Pesticides, January 15, 2015) Yesterday, the European Union (EU) passed legislation meant to bridge a long-standing divide amongst EU nations (and the United States) on the planting of genetically-engineered (GE) crops by granting individual countries the authority to opt-out of EU crop approval and institute country-based legislative and regulatory restrictions. Makers of GE crops (like Monsanto) and proponents of GE crop cultivation have faced staunch and successful opposition in getting the required EU permission to plant GE crops. Opposition comes from both EU citizens and certain member states, like France, Italy, and Germany. By giving opposing countries an EU-sanctioned means to opt-out and establish individual member state restrictions, the new law may accelerate  opt-outs in those countries that do not oppose GE crop planting. Countries like France that have repeatedly fought back against GE crop cultivation welcome the new EU legislation, as do environmental advocates. “This is another nail in the coffin of genetically modified crops,” said Mute Schimpf, a campaigner for Friends of the Earth Europe, told Bloomberg. “While not perfect, this new law allows governments to shut the door on biotech crops in Europe.” Countries in favor of GE crop cultivation, like Britain, also view the action […]

Monsanto Once Again Developing Herbicide Resistant Wheat

(Beyond Pesticides, January 13, 2015) Over a decade after consumer opposition halted multinational agrichemical business Monsanto’s plans to develop genetically engineered (GE) herbicide-resistant wheat, the company is trying again. This time, Monsanto’s goal is to create wheat that is resistant to three different herbicides; glyphosate, glufosinate, and dicamba. Although over 90% of corn, soybean, and cotton grown in the United States are GE, no GE wheat is currently allowed to be planted. In 2013, a farmer in Oregon discovered the presence of Monsanto’s original Roundup-Ready wheat, developed to be resistant to glyphosate, in his field despite the company’s plans to abandon the strain and claims to have destroyed the crop  a decade earlier. The company had restarted extensive field trials back in 2011. An investigation by the U.S. Department of Agriculture (USDA) determined that the contamination was an “isolated incident.” It was unable to determine exactly how the wheat came to grow in the Oregon farmer’s field. However, shortly after the agency closed its investigation, another farmer in Montana detected the GE strain in his wheat fields. U.S. and EU Trade Proposal Threatens Human Health and Environment

(Beyond Pesticides, January 09, 2015) New closed-door international trade agreement proposals between the U.S. and EU could weaken pesticide standards and threaten the U.S. organic food industry. Set forth by European and U.S. trade associations, the proposals were met  with strong disapproval by numerous non-governmental organizations (NGO) and non-profits. Beyond Pesticides and over a hundred other European and U.S.-based organizations signed on to a letter in July 2014 calling for increased transparency of negotiating proposals and  the exclusion of chemical regulations from the entire scope of the prospective Transatlantic Trade and Investment Partnership (TTIP). The proposals are recommended by the trade associations CropLife America and the European Crop Protection Association (ECPA) —which represent major agricultural chemical manufactures like Bayer CropScience, Dow AgroSciences, and DuPont Crop Protection— with claims that the policy would help reduce or get rid of trade barriers and help promote regulatory cooperation and achieve the goals of the TTIP. Fish and Wildlife Service to Consider Federal Protection for Monarch Butterfly

(Beyond Pesticides, January 6, 2015) At the close of 2014, the U.S. Fish and Wildlife Service (FWS) announced plans to conduct a year-long status review of the monarch butterfly to determine whether the species is eligible for protection under the Endangered Species Act (ESA). FWS is taking this action as result of an August 2014 legal petition filed by health and environmental groups that presented substantial information indicating that listing under the ESA may be warranted. In November 2014, Beyond Pesticides joined over 200 environmental groups and businesses in a letter asking for federal protection for monarch butterflies in the wake of shocking declines. The North American monarch butterfly population fell by 90 percent in the past 20 years, dropping from a high of approximately  one billion in the mid-1990s to fewer than 35 million butterflies in the winter of 2013-2014— the lowest number ever recorded. Each year monarch butterflies travel over 2,000 miles between Canada, the U.S., and Mexico, across multiple generations, to reach their winter hibernation grounds in late October.
