Environmentalists and Beekeepers Give EPA Legal Notice to Protect Threatened and Endangered Species

(Beyond Pesticides, September 7, 2012) Yesterday, Beyond Pesticides joined with the Center for Food Safety and the Sierra Club, along with beekeepers from around the country, to file a 60-Day Notice letter with the Environmental Protection Agency (EPA) announcing the intent to jointly sue the agency for Endangered Species Act (ESA) violations. The potential lawsuit highlights EPA’s continuing failure to ensure, through consultation with the U.S. Fish and Wildlife Service, that its numerous product approvals for the neonicotinoid insecticides clothianidin and thiamethoxam are not likely to jeopardize any federally-listed threatened or endangered species. “EPA has failed to uphold the clear standards of the Endangered Species Act,” said Peter Jenkins, attorney at the Center for Food Safety. “By continuing to ignore the growing number of reports and studies demonstrating the risks of neonicotinoids to honey bees and a large number of already threatened and endangered species, the EPA is exposing these already compromised populations to potentially irreversible harm.” The Notice of Intent to Sue follows a legal petition previously filed by several environmental organizations and more than two dozen beekeepers requesting that EPA immediately suspend use of the chemical clothianidin that poses fatal harm to pollinators. U.S. Representative Markey Calls on EPA to Step Up Protections for Pollinators

(Beyond Pesticides, August 24, 2012) U.S. Representative Edward Markey, (D-MA) has sent a letter to the U.S. Environmental Protection Agency (EPA) urging it to investigate a possible link between the use of common pesticides and reductions in honey bee populations. The letter comes as EPA is accepting public comments on a legal petition filed by beekeepers and environmental groups seeking to suspend the use of the neonicotinoid pesticide clothianidin, which has been linked to serious pollinator health concerns. In his letter to the EPA, Rep. Markey asks the agency to respond to questions, including: ӢHas the EPA investigated the impacts of the class of pesticides on honey bees and other pollinators? EPA Asks for Public Comment on Petition to Ban Pesticide Deadly to Bees, Senators Urge Expedited Action

(Beyond Pesticides, July 30, 2012) The U.S. Environmental Protection Agency (EPA) has opened a 60-day public comment period on the agency’s decision to deny the request by beekeepers to immediately suspend the use of clothianidin, a pesticide that poses harm to pollinators. The legal petition was filed earlier this year by 25 beekeepers and environmental organizations, and cites significant acute and chronic bee kills across the United States linked to neonicotinoid pesticides, particularly clothianidin. On Thursday, Senator Kirsten Gillibrand (D-NY), a member of the Senate Agriculture Committee, called for an expedited review of pesticides that could be inadvertently decimating honey bee populations. The letter is also signed by Senators Patrick Leahy (D-VT) and Sheldon Whitehouse (D-RI). EPA is not expected to complete its review until 2018, and any implementation plans could take years beyond that to complete. EPA Denies Imminent Hazard Exists in Partial Response to Beekeeper Petition

(Beyond Pesticides, July 20, 2012) On Thursday, July 19, the U.S. Environmental Protection Agency (EPA) announced it had formally refused to recognize that honey bees face an “imminent hazard” and denied a request by beekeepers to immediately suspend the use of pesticides that pose harm to pollinators. The decision comes in response to a legal petition filed earlier this year by twenty-five beekeepers and environmental organizations, citing significant acute and chronic bee kills across the United States linked to neonicotinoid pesticides, particularly clothianidin. “We’re disappointed. EPA has signaled a willingness to favor pesticide corporations over bees and beekeepers,” said Steve Ellis, a petitioner and owner of Old Mill Honey Co, with operations in California and Minnesota. “This decision puts beekeepers, rural economies and our food system at risk. DuPont’s Liability for Toxic Herbicide Mounting

(Beyond Pesticides, July 6, 2012) The agribusiness conglomerate DuPont has received more than 30,000 damage claims arising from its sale of a pesticide that resulted in death and injury to hundreds of thousands of evergreen trees, particularly Norway spruce and white pine. DuPont marketed the pesticide, sold under the trade name Imprelis, based on a conditional registration that the U.S. Environmental Protection Agency (EPA) granted in 2010. Soon after Imprelis became commercially available the next spring, EPA began receiving widespread reports of tree death and injury from landscapers and residential users who had applied the pesticide according to its label conditions. EPA issued an immediate stop sale order for Imprelis on August 11, 2011 after DuPont submitted reports of more than 7,000 reports of tree damage. The New York Times reports that DuPont has set aside $225 million for claims that have already been submitted, and that the payout could ultimately reach $575 million. These figures do not include costs related to a class-action lawsuit filed by thousands of homeowners, landscapers and others, consolidated in federal court in Philadelphia. Bee-Killing Neonicotinoid Pesticide Thiamethoxam Banned in France

(Beyond Pesticides, July 2, 2012) The French Ministry of Agriculture has issued a ban on the neonicotinoid pesticide thiamethoxam due to concerns over the chemical’s impacts on pollinators, especially honey bees. The pesticide product containing thiamethoxam, Cruiser OSR, is manufactured by Swiss chemical giant Syngenta and has been used as a seed treatment on canola seed. The French Agriculture Minister, Stephane Le Foll, had announced in June that his agency was considering a ban on the pesticide and asked Syngenta to submit any new data the company had on the chemical. Apparently finding this data insufficient evidence that thiamethoxam was safe for pollinators, the agency withdrew the permit for Cruiser OSR last Friday. The ban is expected to take effect at the start of the next canola planting season in late summer. Thiamethoxam is a neonicotinoid insecticide used to coat seeds prior to planting. When the seed germinates, the plant that grows from it takes the chemical up through its vascular system and expresses it through pollen, nectar, and guttation droplets from which bees forage and drink. International Scrutiny of Pesticide Link to Honey Bee Deaths Intensifies

(Beyond Pesticides, June 25, 2012) The Canadian governmental authority responsible for pesticide registration has expanded its re-evaluation of neonicotinoid pesticides to include two additional compounds linked to honey bee deaths and Colony Collapse Disorder (CCD). Health Canada’s Pest Management Regulatory Agency (PMRA) announced on June 12 that it has added clothianidin and thiamethoxam and their associated products to its ongoing re-evaluation of imidacloprid. The re-evaluation of these pesticides will focus on resolving issues related to environmental risk and specifically the potential effects of neonicotinoids on pollinators. The re-evaluation will consider all agricultural uses of neonicotinoid insecticides, including soil applications, seed treatment, as well as foliar and greenhouse uses. The Canadian announcement follows France’s decision earlier this month to initiate its own review for thiamethoxam that could result in the cancelation of allowances for using the pesticide. France Considers Ban on Pesticide Linked to Colony Collapse Disorder

(Beyond Pesticides, June 4, 2012) France’s Agriculture Minister Stephane Le Foll announced plans on Friday to cancel Swiss manufacturer Syngenta’s registration to treat canola seed with the neonicotinoid insecticide thiamethoxam, a chemical cousin of the bee-killing pesticide clothianidin, in a move to protect honey bees from Colony Collapse Disorder (CCD). When honey bees are exposed to thiamethoxam, it breaks down in their bodies to, clothianidin, which Beyond Pesticides is petitioning the Environmental Protection Agency (EPA) to ban due to a preponderance of adverse effects data and inadequate registration safety testing. Both pesticides have been shown in numerous scientific studies to play a key role in CCD. As France acts to protect its pollinators from pesticides, the U.S. continues to allow the uses of theses highly toxic chemicals to continue. Environmental Groups Cite White House for Delay in Nanotechnology Regulations

(Beyond Pesticides, May 29, 2012) An industry newsletter has quoted representatives from two Washington, DC-based environmental organizations working on nanotechnology policy who blame the Obama Administration for impeding oversight of the largely unregulated technology. On May 23, Chemical Regulation Reporter quoted Richard Denison, PhD, a senior scientist with the Environmental Defense Fund, and Jaydee Hanson, senior policy analyst at the Center for Food Safety, as stating that two pending nanotechnology regulations have been placed on hold by the Office of Management and Budget (OMB). The delayed regulations involve separate proposed rules issued by the U.S. Environmental Protection Agency (EPA) that address engineered nanoparticles used as pesticides and chemicals, respectively. The article reported that Dr. Denison had spoken with EPA officials who told him that they do not expect any regulations for engineered nanoscale pesticides or chemicals to be approved by OMB. Research Shows Imidacloprid Depresses Honey Bee Feeding and Communication

(Beyond Pesticides, May 25, 2012) Biologists at the University of California at San Diego (UCSD) have discovered that a small dose of the commonly used neonicotinoid crop pesticide imidacloprid turns honey bees into “picky eaters” and affects their ability to recruit their nestmates to otherwise good sources of food. The results of the experiments, detailed in this week’s issue of the Journal of Experimental Biology (abstract), shed light on one of the main culprits suspected to be behind the recent declines in honey bee colonies and detail the particular ways that the substance impedes the functions of the colony. Since 2006, beekeepers in North America and Europe have lost about one-third of their managed bee colonies each year due to “colony collapse disorder.” While the exact cause is unknown, researchers believe pesticides have contributed to this decline. Farmers, Scientists, and Advocates Concerned About Lack of Pesticide-Free Seeds

Farmers across the Midwest have called on federal officials this week to provide greater access to seeds without pesticide treatments. The request comes as scientists and beekeepers highlight the nearly pervasive use of neonicotinoids as seed treatments on corn as a critical factor in recent bee die-offs, including colony collapse disorder (CCD). Beekeepers from Minnesota to Ohio to Canada report large losses after their hives forage near treated cornfields. Scientists from Purdue University and a multi-year series of studies from Italy point to toxic dust, or neonicotinoid-contaminated powder from recently planted corn fields as key pesticide exposure pathways for bees. Two Studies Link Pesticides to Bee Health, Strengthen Case for Ban

These two studies, one French, one British, add to a growing body of scientific literature and strengthen the case for removing pesticides toxic to bees from the market. The British research finds that pesticides prevent bumble bees from collecting enough food to produce new queens. Take Action: Tell Congress to Protect Pollinators from Pesticides

(Beyond Pesticides, March 27, 2012) On March 21, Beyond Pesticides joined beekeepers and environmental groups, Center for Food Safety and Pesticide Action Network North America in filing an emergency legal petition that calls on the Environmental Protection Agency (EPA) to suspend registration of Bayer’s controversial bee-killing pesticide, clothianidin. Because Congress has the authority to exercise oversight over federal agencies like EPA, the organizations are now calling on the public to ask Congress to protect honey bees and wild pollinators from clothianidin and other pesticides known to be toxic to bees. Bees and other pollinators are still dying off at catastrophic rates —commercial beekeepers lost an average of 36% of their hives last year, according to USDA. Honey bees pollinate one in every three bites of our food and, as indicator species, they serve as sentinels whom we ignore at our peril. Beekeepers and Environmentalists Petition EPA to Stop Pesticide Linked to Bee Deaths

(Beyond Pesticides, March 22, 2012) Yesterday, commercial beekeepers and environmental organizations filed an emergency legal petition with the U.S. Environmental Protection Agency (EPA) to suspend use of a pesticide that is linked to honey bee deaths, urging the agency to adopt safeguards. The legal petition, which specifies the pesticide clothianidin, is supported by over one million citizen petition signatures, targets the pesticide for its harmful impacts on honey bees. “EPA has an obligation to protect pollinators from the threat of pesticides,” said Jeff Anderson of California Minnesota Honey Farms, a co-petitioner. “The Agency has failed to adequately regulate pesticides harmful to pollinators despite scientific and on-the-ground evidence presented by academics and beekeepers.” Over two dozen beekeepers and beekeeper organizations from across the country, from California and Minnesota to Kansas and New York, filed the legal petition with the EPA today. Consumer Safety Groups Sue Food and Drug Administration Over Lax Nanotechnology Review

(Beyond Pesticides, January 3, 2012) A coalition of six consumer safety groups filed suit against the U.S. Food and Drug Administration (FDA) on December 21, 2011, citing the FDA’s chronic failure to regulate materials derived from nanotechnology (nanomaterials) used in sunscreens, cosmetics and drugs. The lawsuit demands that FDA respond to a May 2006 petition the coalition filed calling for regulatory actions, including nano-specific product labeling, health and safety testing, and an analysis of the environmental impacts of nanomaterials in products regulated by FDA. The lawsuit cites numerous studies and reports published since 2006 that establish significant data gaps concerning nanomaterials’ potential effects on human health and the environment. Led by the International Center for Technology Assessment (ICTA), the coalition is calling for FDA to take immediate action to assess the actual risks from nanomaterials and implement appropriate protective measures for consumers. EPA Grants Conditional Registration to Nanosilver Product Before Reviewing Pertinent Data

(Beyond Pesticides, December 14, 2011) The U.S. Environmental Protection Agency (EPA) is conditionally registering a pesticide product containing nanosilver as a new active ingredient. The antimicrobial pesticide product, HeiQ AGS-20, a silver-based product for use as a preservative for textiles to help control odors, is being granted registration despite a long list of outstanding studies that have yet to be submitted and reviewed by EPA. As a testament to EPA’s flawed registration process, the agency will now require additional data on the product after it has entered the marketplace to confirm its assumption that the product will not cause ”˜unreasonable adverse effects on human health or the environment,’ the general standard for registration under the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA). HeiQ AGS-20 is a nanosilver-silica composite with nanosilver particles that are incorporated into textiles and release of silver ions to suppress the growth of bacteria, which cause textile odors, stains, and degradation. DuPont To Issue Recall of Pesticide Linked to Tree Deaths

(Beyond Pesticides, August, 8, 2011) In a move that highlights serious concerns regarding the pesticide registration process, DuPont has announced that it plans to issue a total recall of its new herbicide, Imprelis, following widespread evidence and complaints that the product has caused the deaths of trees around the country. After originally giving conditional approval to the new pesticide, the U.S. Environmental Protection Agency (EPA) has now stated that it is preparing to issue a “Stop Sale” order to halt any further use of the product. According to a letter posted on DuPont’s website Imprelis-Facts.com, the company is implementing a “voluntary suspension” of Imprelis sales. It intends to ask distributors to collect all Imprelis containers, even those partially used, that they have sold and return them to the company for a refund. New Lawn Chemical Suspected in Mysterious Deaths of Trees

The product, Imprelis, a new herbicide manufactured by DuPont, is suspected by State officials and lawn care professionals who say they think Imprelis may be attacking pines and spruces. Once again, this new incident exposes the deficiencies in the registration process for new pesticides put onto the market without a full data set. EPA May Reduce “Conditional Registrations” of Pesticides after Finding Process Flawed

(Beyond Pesticides, May 4, 2011) According to a U.S. Environmental Protection Agency (EPA) internal review of pesticide registrations under special circumstances, also known as “conditional registration,” the agency may reduce its use of this “imprecise” category, whilch allows widespread use of toxic chemicals not fully tested. Conditional registration of pesticides allows market entry for a product in the absence of certain data. Recent reports have found that certain conditionally registered pesticides known to be hazardous to pollinators were allowed to used by EPA without a full data set. In an April 25, 2011 post on its website, EPA provides details on its recently completed internal review on the use of conditional registration for pesticide products. The agency has come under scrutiny recently since it was revealed that the conditionally registered pesticide, clothianidin, did not at the time it allowed the pesticide to be widely used have pertinent field data required on honeybees, even though the pesticide is known to pose risks to these vulnerable pollinators. EPA Rejects Immediate Action On Pesticide Toxic To Bees

(Beyond Pesticides, February 23, 2011) In response to a request by beekeepers and environmentalists to remove a pesticide linked to Colony Collapse Disorder (CCD), the U.S. Environmental Protection Agency (EPA) in a letter, defended the pesticide clothianidin and the scientific study in question which was identified by beekeepers as a critically flawed study. EPA states that it does not intend to suspend or cancel clothianidin, even though independent studies have linked this chemical and others in its class to bee decline. Beyond Pesticides, as a part of a group of environmentalists and beekeepers, broke the news last December that a core study underpinning the registration of the insecticide clothianidin was unsound, citing leaked EPA memos which discloses the critically flawed scientific study and its reclassification as a “core” study on which clothianidin’s conditional registration was contingent on, to a “supplemental” study. EPA Asked to Pull Pesticide Linked to Bee Kills

(Beyond Pesticides, December 9, 2010) Beekeepers and environmentalists called on the U.S. Environmental Protection Agency (EPA) December 8, to remove a pesticide linked to Colony Collapse Disorder (CCD), citing a leaked EPA memo that discloses a critically flawed scientific support study. The November 2nd memo identifies a core study underpinning the registration of the insecticide clothianidin as unsound after EPA quietly re-evaluated the pesticide just as it was getting ready to allow a further expansion of its use. Clothianidin (product name “Poncho”) has been widely used as a seed treatment on many of the country’s major crops for eight growing seasons under a “conditional registration” granted while EPA waited for Bayer Crop Science, the pesticide’s maker, to conduct a field study assessing the insecticide’s threat to bee colony health. Bayer’s field study was the contingency on which clothianidin’s conditional registration was granted in 2003. As such, the groups are calling for an immediate stop-use order on the pesticide while the science is redone, and redesigned in partnership with practicing beekeepers. Report Reviews Links between Breast Cancer and Environmental Exposures

(Beyond Pesticides, October 5, 2010) A new report by the Breast Cancer Fund, a national organization working to eliminate the environmental causes of breast cancer, presents a summary of the scientific data on the environmental causes of the disease. The report catalogs the growing evidence linking breast cancer to, among other factors: synthetic hormones in pharmaceuticals, cosmetics and meat; pesticides in food; solvents in household cleaning products; BPA in food containers; flame retardants in furniture; and radiation from medical treatments. The report also highlights impacts on the most vulnerable populations (including infants, pregnant women, African-American women and workers), and outlines the policy initiatives required to develop a national breast cancer prevention plan. Nanosilver Particles Can Stop Sperm Cells from Growing

(Beyond Pesticides, September 3, 2010) New research shows that silver nanomaterials, which are used in a number of consumer products as antimicrobial agents, can interrupt important cell signaling within male reproductive sperm cells, causing them to stop growing. In previous studies, scientists reported how smaller-sized silver nanoparticles — in the 10 – 25 nanometer range — decrease the growth of male stem cells when they are exposed at concentrations greater than 10 micrograms per milliliter (ĂŽÂĽg/ml). This new study, on the other hand, is the first to identify how the silver nanoparticles stop the sperm stem cells from growing, with the biggest effects from the smallest-sized nanoparticles tested. Like many other studies on the effects of nanotechnology, this study raises important questions about the potential hazards to human health due to the prolific use of silver nanoparticles in the market. Researchers tested the effects of different sizes, concentrations and coatings of silver nanoparticles on cell growth of mouse sperm cells.
