Oral Arguments Presented in Landmark Organic Lawsuit against Monsanto

(Beyond Pesticides, February 10, 2012) Federal District Court Judge Nancy Buchwald heard oral arguments on January 31 on a pre-trial motion filed by Monsanto to dismiss a lawsuit filed against it by the Public Patent Foundation (PUBPAT) on behalf of family farmers, seed businesses, organic agricultural organizations, and environmental groups. The case, Organic Seed Growers & Trade Association, et al. v. Monsanto, challenges Monsanto’s patents on genetically modified seed. The suit was originally filed on behalf of 60 plaintiffs on March 29, 2011, with 23 new plaintiffs, including Beyond Pesticides joining on June 1. The 83 plaintiffs now involved in the suit represent a combined membership in excess of 300,000 people. GMO Development in Europe Takes a Hit, Focus on U.S. Markets To Intensify

(Beyond Pesticides, January 18, 2012) Given the persistent wariness of genetically modified organisms (GMOs) in Europe, Germany’s BASF will stop developing new products targeting the European market. The group announced on January 16 that it plans to refocus its activities in the sector on more receptive regions. Unfortunately, this means BASF will redouble its efforts in the U.S. to develop new GMO products, leading to public and environmental health concerns in this country. In a statement, a BASF representative announced, “Biotechnologies are not accepted enough in many parts of Europe by the majority of consumers, farmers and political leaders. That is why it does not make sense economically to continue to invest in products aimed exclusively at this market.” BASF promotion of its GMO products has been stalled in the last couple years. BASF fought for a decade before obtaining European Union (EU) marketing authorization in 2010 for Amflora, a genetically modified high-starch potato. Shortly afterwards BASF mistakenly planted in an Amflora field in Sweden another of its GMO potatoes, Amadea, which had not received authorization from European officials. USDA Deregulates Monsanto’s Drought Resistant Corn, Opens Comment Period on 2,4-D Resistant Corn

(Beyond Pesticides, January 5, 2012) Just as everyone was getting ready for the holidays, the U.S. Department of Agriculture (USDA) approved yet another genetically modified seed by Monsanto, a drought-tolerant variety of corn, MON87460. In addition to its announcement approving Monsanto’s newest GE corn variety, USDA also opened a 60-day public comment period for two additional petitions — one for Monsanto’s GE soybean containing higher levels of an omega-3 fatty acid, that does not naturally occur in soybeans, and the other from Dow AgroSciences for corn that has been genetically engineered to resist the poisonous herbicide 2,4-D. “In 2012 the USDA is proposing approving a new GE corn variety that is resistant to a different toxic herbicide, escalating the toxic treadmill in chemical-dependent agriculture,” said Jay Feldman, Executive Director of Beyond Pesticides. “This is nothing more than a band-aid solution to a serious problem, and will only give rise to more superweeds, more herbicide pollution in our environment, more herbicide poisoning, while likely leading to the need for even more toxic herbicides a couple of years down the line. New Studies Dispel Myth of Organic â€Elitism’

(Beyond Pesticides, November 10, 2011) Two new studies released last week add further proof that the popularity of organic food is not just an elitist trend. One report by the Organic Trade Association (OTA), The 2011 U.S. Families’ Organic Attitudes and Beliefs Study, finds that 78 percent of U.S. families purchase organic food. Another study by SCALE, Inc. finds that organic food is generally cheaper at farmers markets than at grocery stores in Southeast U.S. OTA partnered with KIWI Magazine, and polled nearly 1,300 U.S. families about their attitudes and behaviors relating to organic food. The total sample reflects the target population of U.S. households with a confidence interval of +/-3% at the 95% confidence level. This is the third year the study has been conducted. According to OTA, it contains in-depth information about organic consumers’ demographics, purchase motivation, understanding of organic, willingness to substitute when organic is not available, and attitudes about genetically modified organisms (GMOs). The other study, Is Local Food Affordable for Ordinary Folks?, compares farmers markets and supermarkets throughout 19 different communities in six Southeast states, including Virginia, Tennessee, West Virginia, Kentucky, North Carolina and South Carolina. Genetically Engineered Crops to Boost Use of 2, 4-D and Dicamba

(Beyond Pesticides, November 7) Once heralded as a breakthrough for reducing the rates and toxicity of the pesticides applied by farmers, genetically engineered (GE) crops are perversely leading to renewed dependency on the very herbicides they were claimed to make obsolete. Growing recognition that pervasive planting of “Round-Up Ready” corn, soybeans and cotton is accelerating weed resistance is prompting GE seed companies to rush to market ‘stacked’ varieties that are resistant to additional herbicides, including 2, 4-D and dicamba. Farmers planting the stacked varieties will be spraying these older herbicides in addition to glyphosate, which most commodity crops have already been engineered to tolerate. Professor David A. Mortensen of Pennsylvania State University has estimated that adoption of Round-Up Ready and 2, 4-D or dicamba resistant stacked varieties in soybeans could result in a 70% increase in herbicide use in a relatively short time. The St. Louis Pots-Dispatch reported on progress that multinational chemical corporations Dow AgroSciences, BASF, and Monsanto are making to bring multi-herbicide resistant varieties to market. GMOs in Honey Banned in Europe

(Beyond Pesticides, September 14, 2011) A ruling last week by the European Court of Justice states that honey produced though cross-pollination with a genetically modified (GM) crop must be authorized as a GM product before being sold. The ruling means that the European Union (EU) will have to ban imported honey containing traces of pollen from GM crops that have not been approved for entry. Honey exports from the United States, Canada, Argentina or Brazil, countries with no regulations on the subject, will now be virtually impossible. In the ruling, which, in part, addressed the viability of GM pollen, delivered September 6, 2011, the Court observes, first, that the pollen in question may be classified as a GMO only if it is an ”˜organism’ that is a ”˜biological entity capable’ either of ”˜replication’ or of ”˜transferring genetic material.’ If the pollen in question has lost all specific and individual ability to reproduce, it should be determined whether that pollen is otherwise capable of ”˜transferring genetic material.’ taking due account of the scientific data available and considering all forms of scientifically-established transfer of genetic material. MN Court Says Pesticide Drift Is Trespass

(Beyond Pesticides, July 26, 2011) On July 25, 2011, in the case of Oluf Johnson v. Paynesville Farmers Union Cooperative Oil Company, Judge Ross of the Minnesota Court of Appeals ruled that pesticides drifting from one farm to another may constitute trespass. Organic farmers Oluf and Debra Johnson filed a civil suit alleging that the oil company sprayed a pesticide that drifted from targeted fields onto theirs, and that this prevented them from selling their crops as organic. Previously, a district court dismissed the Johnsons’ trespass claims. The victory is important for organic growers who are frequently under threat of pesticide drift from neighboring properties. Under the federal organic standards authorized by the Organic Foods Production Act (OFPA), produce may not be labeled organic if it is contaminated with pesticide residues, as a result of off-site use, o greater than five percent of the allowable pesticide tolerance levels. Groups Join Lawsuit to Protect Against Monsanto’s GE Patents

(Beyond Pesticides, June 2, 2011) New threats by Monsanto have led to the filing of an amended complaint by the Public Patent Foundation (PUBPAT) in its suit on behalf of family farmers, seed businesses, and organic agricultural organizations challenging Monsanto’s patents on genetically modified seed. Twenty-three new plaintiffs, including Beyond Pesticides, have joined with the original 60 in the amended complaint, bringing the total number represented in the case to 83. The plaintiffs in the suit, Organic Seed Growers and Trade Association (OSGATA), et al. v. Monsanto and pending in the Southern District of New York, now include 36 family farmer, food, agricultural research, food safety, and environmental organizations representing hundreds of thousands of members including several thousand certified organic, biodynamic, or otherwise non-transgenic family farmers. “Our clients don’t want a fight with Monsanto, they just want to be protected from the threat they will be contaminated by Monsanto’s genetically modified seed and then be accused of patent infringement,” said PUBPAT Executive Director Daniel B. Court of Appeals Dismisses Monsanto’s Appeal, Requires EIS for GE Sugar Beets

(Beyond Pesticides, May 24, 2011) Last Friday, the U.S. Court of Appeals for the Ninth Circuit issued a summary order upholding a landmark legal decision requiring the U.S. Department of Agriculture (USDA) to conduct an Environmental Impact Statement (EIS) before approving the planting of genetically engineered (GE) crops. The decision upholds previous court rulings in favor of farmers and conservation advocates in a case on the future commercial uses of GE sugar beets, engineered to be resistant to Monsanto’s Roundup herbicide. “Today’s order cements a critical legal benchmark in the battle for meaningful oversight of biotech crops and food,” said Center for Food Safety (CFS) attorney George Kimbrell. “Because of this case, there will be public disclosure and debate on the harmful impacts of these pesticide-promoting crops, as well as legal protections for farmers threatened by contamination.” CFS, Organic Seed Alliance, High Mowing Organic Seeds, and the Sierra Club, represented by CFS and Earthjustice, challenged the USDA approval in 2008. Monsanto Renews Efforts for Genetically Engineered Wheat

(Beyond Pesticides, May 11, 2011) In what seems like a quest to control much of the world’s food supply, industry giant Monsanto is renewing its efforts to develop genetically modified wheat. Over the past two years, the agricultural biotechnology giant has renewed its interest in wheat, committing more resources to creating new traits and seed varieties. Genetically modified (GM) varieties of soy, corn and alfalfa have already been developed. Recent efforts by the company to have GM crops deregulated by the U.S. government -so that they can be widely grown without restriction- have been successful. In the past two years, Monsanto has renewed its efforts into research for GM wheat. The company has built a ‘seed chipper” for wheat -a proprietary and prohibitively expensive machine that speeds the process of identifying beneficial crop traits. In 2009, the company paid $45 million to buy WestBred, a Montana-based wheat seed company. Monsanto says its efforts will focus on biotechnology and traditional breeding to achieve a drought-tolerant trait and increased yield. Lawsuit Seeks Protection Against Monsanto’s GE Seed Patents

(Beyond Pesticides, March 31, 2011) In an effort to protect them from patent infringement in the event of drift contamination by Monsanto’s genetically engineered (GE) seed, 60 family farmers, seed businesses and organic agricultural organizations preemptively filed suit against the agribusiness giant. The case, Organic Seed Growers and Trade Association, et al. v. Monsanto, was filed in federal district court in Manhattan on behalf of Public Patent Foundation (PUBPAT) on Tuesday, March 29, 2011. Plaintiffs in the suit represent a broad array of family farmers, small businesses and organizations from within the organic agriculture community who are increasingly threatened by genetically modified seed contamination despite using their best efforts to avoid it. The plaintiff organizations have over 270,000 members, including thousands of certified organic family farmers. EU Panel Votes to Import Genetically Engineered Material in Animal Feed

(Beyond Pesticides, February 28, 2010) The European Union (EU) standing committee on Tuesday decided to allow a 0.1 percent contamination threshold for unauthorized Genetically Engineered (GE) products in animal feed imports that would change the bloc’s zero-tolerance attitude toward biotech food. The EU Commission and Parliament are expected to accept the rule by this summer. If the vote is allowed through by the European Parliament and Council, those shipments could contain GE seeds that are authorized in their home country but may not even have been tested in Europe. Groups to Sue USDA Over GE Alfalfa as Agency Announces Partial Deregulation of GE Sugar Beets

(Beyond Pesticides, February 9, 2011) Last Friday the U.S. Department of Agriculture (USDA) announced plans to allow the U.S. sugar beet industry to continue growing Monsanto’s “Roundup Ready,” genetically engineered (GE) sugar beets, despite the incompletion of an environmental impact statement (EIS). This comes one week after USDA decided to fully deregulate GE alfalfa seed, despite the risks it poses to both organic and conventional farmers. On Monday, Center for Food Safety, Beyond Pesticides, Sierra Club and Cornucopia Institute formally filed a 60-day notice of intent to sue the agency concerning its decision to allow unrestricted deregulation of GE alfalfa. The 60-day notice of intent to sue, filed February 7, 2011, officially notifies USDA’s Animal and Plant Health Inspection Service (APHIS) of the groups’ intent to sue pursuant to the citizen suit provision of the Endangered Species Act (ESA), citing APHIS’ violation of Section 7 of the ESA in failing to ensure that the deregulation of GE alfalfa is not likely to jeopardize threatened or endangered species and their habitat. Coalition Letter Opposes USDA GE Alfalfa Decision, Calls for Action

(Beyond Pesticides, February 1, 20011) On January 31, 2011, a coalition of organic companies and environmental organizations, including Beyond Pesticides, released an open letter and call to action on the U.S. Department of Agriculture’s (USDA) January 27 decision to deregulate “RoundUp Ready” (glyphosa te-tolerant) genetically engineered (GE) alfalfa, allowing its unrestricted cultivation and threatening organic and non-GE conventional farmers. It sets a precedent for future deregulation of GE crops. The letter encourages individuals to write to President Obama opposing the decision and asking that the administration reconsider its position. (Beyond Pesticides, January 28, 2011) Environmental and public interest groups are extremely disappointed with the announcement late Thursday that the U.S. Department of Agriculture (USDA) plans to fully deregulate genetically engineered (GE) alfalfa seed, despite the risks it poses to both organic and conventional farmers. Among those upset with the announcement are the cosponsors of the original Organic Foods Productions Act, Senator Patrick Leahy (D-Vt.) and Representative Peter DeFazio (D-OR), who have weighed in with their criticism of USDA’s decision. This decision follows the agency’s completion of the court-mandated environmental impact statement (EIS) for GE alfalfa. Take Action – Tell the President and USDA: Do Not Approve GE Alfalfa

(Beyond Pesticides, January 20, 2011) Beyond Pesticides and the National Organic Coalition (NOC) are encouraging their members to contact President Obama and the U.S. Department of Agriculture (USDA) and tell them not to approve (or not deregulate) Monsanto’s “RoundUp Ready,” genetically engineered (GE) alfalfa, which contributes to genetic drift, superweeds, and the use of a hazardous herbicide glyphosate. In December, USDA completed its environmental impact statement (EIS) of GE alfalfa. Secretary of Agriculture Tom Vilsack has rejected the option to prohibit the planting (and continuing to regulate) GE Alfalfa, despite the clear recognition in the EIS that that GE contamination of organic and conventionally grown crops presents a huge problem. USDA released its 2,400 page EIS as required by a 2007 Federal District Court decision and upheld by both 2009 Ninth Circuit Court of Appeals and June 2010 U.S. Supreme Court rulings. Ruling Strengthens Case for Organic Farmers Impacted by Pesticide Drift

(Beyond Pesticides, January 12, 2011) A Santa Cruz, California, organic herb grower has the right to sue neighboring farm for ‘pesticide drift’. This according to a California’s 6th District Court of Appeal in San Jose which upheld Jacobs Farm/Del Cabo’s right to sue the pesticide applicator, Western Farm Service, and let stand the $1 million damage award a jury handed Jacobs Farm two years ago. The ruling makes it clear that pesticide users can be held liable for pesticide drift. The decision is significant, agriculture and law experts say, because it strengthens the case for organic farmers or anyone else harmed by pesticides to seek legal recourse – even if the pesticide is legally applied. The county’s deputy agricultural commissioner, Lisa LeCoump, said the court decision against Western Farm Services changes the ground rules, making it clear that a sprayer can now be held liable even if no law is broken. While California state law restricts pesticides from being sprayed on neighboring properties, the law doesn’t deal specifically with pesticides that disperse into the air after application and end up someplace else. Methyl Iodide Use Challenged by Farmworkers, Environmental Groups

(Beyond Pesticides, January 6, 2011) On Monday, a coalition of farmworkers, community activists and environmental health organizations announced a lawsuit challenging the approval of the toxic fumigant methyl iodide for use on California’s strawberry fields, urging the new Governor Jerry Brown to reverse the decision. The groups also submitted comments from over 52,000 members of the public urging Gov. Brown to act quickly to prevent the use of methyl iodide in California’s fields. USDA Considers Future of Genetically Engineered Crops, Groups Call for Ban

(Beyond Pesticides, December 17, 2010) Secretary of Agriculture Tom Vilsack disappointed organic farmers and consumers, as well as environmentalists when he announced December 16, 2010 that the U.S. Department of Agriculture was considering “deregulating” a genetically engineered crop that is tied to genetic drift, superweeds, and the use of a hazardous pesticide -Monsanto’s genetically-engineered (GE) Roundup (glyphosate) Ready (RR) alfalfa. The Department released a 2,400 page Environmental Impact Statement (EIS) as required by a 2007 Federal District Court decision and upheld by both 2009 Ninth Circuit Court of Appeals and June 2010 U.S. Supreme Court rulings. The litigation was led by the Center for Food Safety, and joined by Beyond Pesticides, and other groups, including organic seed companies and producers. A broad coalition of groups has previously called for USDA to deny approval of Monsanto’s genetically engineered, Roundup Ready alfalfa (GE alfalfa). In March, more than 200,000 people submitted comments to USDA critiquing the substance and conclusions of its Draft EIS on GE Alfalfa. One Million Petition EU To Halt GM Crops

(Beyond Pesticides, December 14, 2010) A petition of more than a million signatures was presented to the European Commission last week, demanding a halt to approvals of new genetically modified (GM) crops and the establishment of up a new scientific body to study the impact of the technology and determine regulations. Greenpeace led the effort. The petition is seen as a test case for the “European citizen’s initiative,” introduced under the European Union’s new constitutional treaty, which enables a million or more people to jointly ask the European Commission to change EU legislation. FTC to Revise Green Marketing Guidelines, Public Comment Invited Until December 10, 2010

(Beyond Pesticides, October 12, 2010) In an effort to reduce confusion among consumers trying to decipher the wide variety of green claims, the Federal Trade Commission (FTC) is revising its “Green Guides,” guidelines for companies seeking to promote their products as environmentally friendly. As consumers have become more aware of the environmental effects of the products they use, “green” marketing claims have become more prevalent. When a product carries the organic label, consumers can be confident that it has met strict standards and was certified by an independent organization, but many other labels are simply attempts at “green washing” conventional products to charge a premium to environmentally conscience consumers. Market research has shown that consumers often misunderstand the intentions of some green claims. Some labels make claims that are too broad and difficult to quantify. The revised guidelines advise producers not to make such broad claims on labels such as “environmentally friendly,” because according to an FTC consumer perception study, consumers often assume the product has far reaching environmental benefits. “What companies think green claims mean and what consumers really understand are sometimes two different things,” said FTC Chairman Jon Leibowitz. European Farmers Defend Their Right To Produce GMO-Free Food

This, according to the International Federation of Organic Agriculture Movements (IFOAM)— EU Regional Group, which responded to a presentation by EU Commissioner for Health and Consumer Protection John Dalli on “best practice document” for genetically modified (GM) maize. The best practice document outlines voluntary guidelines for the coexistence of genetically modified crops with conventional and organic farming, but fails to address the economic and social impacts on contaminated non-GMO farms. Commissioner Dalli presented to the Farm Council proposals on GMO cultivation, as well as a new “best practice document” for maize. “Commissioner Dalli is trying to snake his way through crucial GMO policies by attempting to satisfy all conflicting parties with his proposals to the Farm Council this morning. Genetically Altered Corn Contaminates Midwest Streams

(Beyond Pesticides, October 1, 2010) A new study by University of Notre Dame ecologist Jennifer Tank, PhD and colleagues reveals that streams throughout the Midwest are contaminated with transgenic materials from corn crop byproducts, even six months after harvest. The transgenic corn has been genetically engineered (GE) to produce its own insecticide, a toxin from the soil bacterium Bacillus thuringiensis (Bt). In a 2007 paper in the Proceedings of the National Academy of Science (PNAS), Dr. Tank and a group of researchers demonstrated that transgenic materials from corn (pollen, leaves, cobs) do, in fact, enter streams and can be subsequently transported to downstream water bodies. In a paper, “Occurrence of maize detritus and a transgenic insecticidal protein (Cry1Ab) within the stream network of an agricultural landscape,” published in the September 27, 2010 edition of PNAS, the researchers write about their nvestigation of the fate and persistence of the material and its associated Cry1Ab insecticidal protein, using a synoptic field survey of 217 stream sites in northwestern Indiana six months after crop harvest. “We found that corn crop byproducts were common in agricultural streams and that 86 percent of sites contained corn leaves, cobs, husks and/or stalks in the active stream […]
