Take Action: Legislation Introduced To Protect Migratory Birds

(Beyond Pesticides, May 19, 2025) The Trump administration has removed crucial protections established under the Migratory Bird Treaty Act (MBTA), including those that protect birds from pesticide poisoning. The Migratory Bird Protection Act (MBPA), introduced in May by Rep. Jared Huffman (D-CA) and Rep. Brian Fitzpatrick (R-PA), will restore protections against an “incidental take.” Beyond Pesticides is calling for the protection of migratory birds and the restitution of funds to implement the law. This is not the first time that President Trump has reduced protection for migratory birds. In his first term (2017), the Department of the Interior issued a policy that relieved industries of the requirement to protect birds, and they will no longer be held accountable for bird deaths. In addition, the agency is expected to propose rules to make this policy change permanent. >> Tell your U.S. Representative to cosponsor the Migratory Bird Protection Act (H.R. 3188).  MBTA was passed in 1918 to protect migratory birds soon after the last Passenger Pigeon died in captivity, followed by the last Carolina Parakeet. Groups Ask States To Reject Immunity from Lawsuits when Chemical Companies Fail to Warn of Product Hazards

(Beyond Pesticides, May 5, 2025) With North Dakota on April 24 being the first state to enact chemical industry legislation that blocks poisoning victims from suing manufacturers for their failure to warn about their products’ hazards, a national fight over accountability and compensation has escalated. Legislation to quash lawsuits against chemical manufacturers because of their “failure to warn” about the hazards of their pesticide products is being pushed through state legislatures. Failure-to-warn claims serve as the basis for the overwhelming majority of pesticide injury litigation of the past decade, according to legal professionals, including Brigit Rollins, JD, staff attorney at the National Agriculture Law Center. Study Finds Synergistic Convergence of Global Warming, Pesticide Toxicity, and Antibiotic Resistance

(Beyond Pesticides, May 1, 2025) Pesticides by themselves are a grave threat to global health. As is global warming. As is antibiotic resistance. Each of these problems has to be analyzed in its own silo to reveal the mechanisms driving its dynamics. But eventually, it must be acknowledged that they actually converge. A common soil arthropod has clearly illustrated how this convergence creates synergistic effects: warming increases pesticide toxicity; pesticide toxicity triggers antibiotic resistance; antibiotic resistance spreads through horizontal gene transfer (movement through the environment to people) and predation. The consequences, not yet fully understood, are nevertheless emerging from accumulating research. A study published in the Journal of Hazardous Materials by scientists at six Chinese universities and research centers examines the convergence in springtails (Folsomia candida)—tiny insect-like animals that live in soils worldwide and are commonly used as laboratory subjects. The researchers exposed springtails to the neonicotinoid insecticide imidacloprid at three concentrations and three temperatures. In addition to measuring the springtails’ direct mortality, the researchers also investigated the microbes in the animals’ guts, checking for expression of genes involved in antibiotic resistance. Sampling Finds Pesticides Throughout Environment with Toxic Mixtures from Agricultural Use

(Beyond Pesticides, March 28, 2025) The Rhine Valley in southwestern Germany is renowned for the agricultural bounty it has provided for centuries. Today, the area is home to dense wine, vegetable, fruit, and cereal cultivation. However, a study shows that current regulation of pesticides, even in the relatively progressive European Union, is inadequate to protect humans and all the other organisms that produce the environment necessary for human life and civilization.  The study goal was to determine how far—and which—pesticides traveled beyond the croplands of vegetables, fruit orchards, and cereals, as well forested lands, into nontarget areas that should serve as refugia for plants, animals, and invertebrates not considered pests. Based at the Landau Institute for Environmental Sciences at the University of Kaiserslautern-Landau, the researchers used innovative methods to measure the types, concentrations, and distribution of pesticides. They took samples from three landscape categories—vegetation, topsoil, and surface water—at 78 sites distributed along six transects, each reaching from the valley floor to the tops of the mountains on either side. Can FDA Step In When EPA Fails to Ensure Safety from Pesticide Mixtures in Food?

(Beyond Pesticides, March 17, 2025) When Secretary of Health and Human Services Robert F. Kennedy, Jr. announced last week that he is directing the U.S. Food and Drug Administration (FDA) to explore rulemaking to review substances in food affirmed by the food companies to be Generally Recognized as Safe (GRAS), he said he is “committed to promoting radical transparency to make sure all Americans know what is in their food.” The issue of independent review of the food industry’s GRAS declarations has long been the subject of critiques raising public health concerns. As this issue emerged, on another food safety issue, Beyond Pesticides is asking  FDA to use its broad authority under the Federal Food, Drug, and Cosmetic Act to “ensur(e) that human foods and animal feeds are safe” from residues of pesticide mixtures, in light of new troubling scientific data. Catastrophic Harm to Women from Pesticides Drives Call for Their Elimination

(Beyond Pesticides, March 10, 2025) Following International Women’s Day, celebrated on March 8, 2025, the poignant findings on women, gender, and hazardous substances in a United Nations report raise critical issues of concern and cause for urgent action to phase out petrochemicals. The Report of the Special Rapporteur on the implications for human rights of the environmentally sound management and disposal of hazardous substances and wastes, by Marcos Orellana, was delivered to the 79th Session of the United Nations General Assembly in July 2024. Excerpts from the report follow: “Women make up roughly 60 to 70 per cent of the agricultural labour force in developing countries where pesticides and pesticide handling are especially poorly regulated. In Zambia, for example, two thirds of the labour force is engaged in agriculture, and 78 per cent are women farmers and peasants. Elevated Pesticide Hazards from Plastic Contamination Focus of International, State, and Local Action

(Beyond Pesticides, March 3, 2025) When the United Nations (UN) adjourned the fifth session of the Intergovernmental Negotiating Committee to develop an international legally binding instrument on plastic pollution, including in the marine environment, Inger Andersen, executive director of the United Nations Environment Programme (UNEP), said, “The world’s commitment to ending plastic pollution is clear and undeniable.” She continued, “Here in Busan [Korea], talks have moved us closer to agreeing on a global legally binding treaty that will protect our health, our environment, and our future from the onslaught of plastic pollution.” In March 2022, the UN Environment Assembly adopted UNEA Resolution 5/14 entitled “End plastic pollution: Towards an international legally binding instrument.”  With the Trump Administration shutting down environmental programs and exiting from collaborative international environmental agreements, the work of the world community has taken on elevated importance, given the urgency of health, biodiversity, and environmental crises; so, too, has the work going on at the state level and in local communities across the United States. State Bill Supports Organic Transition as Trump Administration Ignores Mounting Crises

(Beyond Pesticides, February 18, 2025) With petrochemical pesticides and fertilizers linked to the climate crisis and extraordinary threats to health and biodiversity, recent actions by the Trump administration are highlighting the critical importance of local and state action to mitigate the hazards. Mechanism for Escalating Antibiotic Resistance in Agriculture Detailed in Study, as Crisis Grows

(Beyond Pesticides, January 2, 2025) Adding to the body of scientific literature on the fast escalating antibiotic resistance crisis is a study published by Chinese scientists in Environmental Science & Technology, which shows that antibiotic resistance genes (ARGs) in soils move up through trophic levels via predation. Gut microbiomes of soil fauna have been found to be reservoirs of ARGs. How this process operates in soils is vital, because what happens in soil microbes does not stay there. If bacteria altered in soils move up trophic levels, ARGs may strengthen the multicellular agricultural pests the industry is trying to kill—insects, fungi, plants—not to mention bringing their libraries of resistant genes into the microbiomes of vertebrates, including humans. Antibiotic resistance is a natural phenomenon, but human activity has greatly increased its presence in ecosystems the world over, including in one of the ecological niches of greatest concern to the future of food and human health: soils. Deadly Poisoning of Dozens of Children in South Africa Highlights Global Pesticide Threat to Human Life  

(Beyond Pesticides, December 19, 2024) As The New York Times reported last month, the government in South Africa declared a national emergency—23 children died and nearly 900 people were sickened from pesticide poisoning in Johannesburg’s Soweto township. The illnesses and fatalities have been traced to small amounts of highly neurotoxic pesticides, including the insecticides terbufos and aldicarb, found in local food items. These chemicals, described by South African President Cyril Ramaphosa as “street pesticides,” are being increasingly used (legally and illegally) for pest infestations in the townships and informal settlements of South Africa’s poorest communities, where poverty and inadequate waste collection exacerbates the pest management challenges. Without formal electricity, running water, or municipal garbage collection, many residents rely on highly toxic pesticides for pest infestations in their homes and makeshift markets, resulting in food inadvertently being contaminated with pesticides.  The announcement highlights the dangers of allowing these highly toxic agricultural chemicals to be used in farming, with tragic consequences for vulnerable communities when they are diverted for use in urban settings. EPA’s Registration of Herbicide under New Framework Puts Endangered Species at Elevated Risk, Advocates Say

(Beyond Pesticides, December 13, 2024) In October, the U.S. Environmental Protection Agency (EPA) approved the registration applications of BASF Corporation and Mitsui Chemicals Crop & Life Solutions, Inc. for the use of different formulations of the L-isomer of glufosinate (also known as “L-glufosinate” and “glufosinate-P”) as new active herbicidal ingredients. This decision marks one of the first times that EPA has employed its new Herbicide  Strategy Framework to determine the level of mitigation necessary to protect listed species and critical habitat under the Endangered Species Act (ESA). Glufosinate is an organophosphate, with known neurotoxic, reproductive/developmental effects, toxic to aquatic life, and mobile in soils (see Beyond Pesticides Gateway). Scientists have found that formulated glufosinate is generally more toxic to aquatic and terrestrial animals than the technical grade active ingredient. Manufacturers are introducing newer glufosinate products as alternatives for glyphosate-based herbicides, like Bayer/Monsanto’s ‘Roundup’ and dicamba. Amid the Health, Biodiversity, and Climate Crises, Nominee to EPA Head Walks in Lockstep with Trump Denialism

(Beyond Pesticides, November 18, 2024) With the reported appointment of former U.S. Representative Lee Zeldin (R-NY) to the position of Administrator of the U.S. Environmental Protection Agency (EPA), Senate confirmation hearings will be an important process that is intended to shine a light on individual nominations, the policies of an administration, and the science (or lack thereof) behind them. There have been reports in the media that the Trump administration may attempt to circumvent the “advice and consent” rule of the U.S. Senate by making recess appointments. Alexander Hamilton wrote in the Federalist Papers: No. 76 that Senate confirmation hearings act as a safeguard against the appointment of “unfit” officials. Evaluation of EPA Safety Data on Neonicotinoid Insecticides Identifies Scientific Failures

(Beyond Pesticides, November 5, 2024) Published in the journal Frontiers in Toxicology, a recent study uncovers serious flaws in the pesticide registration process at the U.S. Environmental Protection Agency (EPA) with an in-depth evaluation of the agency’s failure to protect the public from the harmful effects of five neonicotinoid (neonic) insecticides—as mandated by the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA) and amendments, including Food Quality Protection Act (FQPA) of 1996. This coincides with EPA’s ongoing review to renew their approval for the next 15 years (set to be announced in 2025). The report is based on the first comprehensive assessment of unpublished rodent-based Developmental Neurotoxicity (DNT) studies, conducted between 2000-2003 and submitted by pesticide manufacturers as part of the registration process. All five neonicotinoids evaluated—acetamiprid, clothianidin, imidacloprid, thiacloprid, and thiamethoxam—are associated with significant shrinkage of brain tissue at the highest dosage, according to EPA data reports (see acetamiprid, clothianidin, imidacloprid, thiacloprid, and thiamethoxam). Deadly Endocrine Disrupting Pesticides Subject to EPA Proposals that Fall Far Short, According to Advocates

(Beyond Pesticides, November 4, 2024) The U.S. Environmental Protection Agency (EPA) last week opened a public comment period on the regulation of endocrine-disrupting pesticides, a proposal that lays out a drawn-out 10-year process that is narrow in evaluating the underlying mechanism that causes endocrine disruption. The proposal, published in the Federal Register as a partial settlement agreement and consent decree, responds to a lawsuit filed by farmworker and health groups challenging the agency’s failure to test and regulate endocrine-disrupting pesticides. Earlier in the year, after over 25 years of delay following the 1996 Congressional mandate to determine whether pesticides disrupt the endocrine system of humans and other organisms, EPA issued a proposal for modifying its approach to the implementation of the Endocrine Disruptor Screening Program (EDSP).  The National Institutes of Environmental Health Sciences explains endocrine disruptors this way: “Endocrine-disrupting chemicals (EDCs) are natural or human-made chemicals that may mimic, block, or interfere with the body’s hormones, which are part of the endocrine system. Bill Proposes Holistic Protection of Children from Contaminated School Lunches, Advances Organic

(Beyond Pesticides, October 28, 2024) STARTS WEDNESDAY—NATIONAL FORUM: IMPERATIVES FOR A SUSTAINABLE FUTURE. As scientific articles and regulatory reviews by the U.S. Environmental Protection Agency (EPA) focus on individual pesticides or families of pesticides and specific health outcomes associated with exposure, legislation introduced by U.S. Senator Cory Booker (D-NJ), S. 5084, Safe School Meals Act (SSMA), proposes a holistic response to the protection of children by banning pesticides in school lunches. While focused on the elimination of certain individual pesticides and other chemicals of known concern, the bill unilaterally allows children to be served food from certified organic farms. The overwhelmingly large body of scientific findings on the adverse effects of pesticides in the food that children eat in schools and generally. American Academy of Pediatrics and United Nations Issue Alerts on Antibiotic Resistance Crisis

(Beyond Pesticides, October 7, 2024) American Academy of Pediatrics (AAP) released a newly revised technical report describing how antibiotic use in animal agriculture contributes to the development of antibiotic resistance in medical use and can adversely affect child health— in the context of this fast-emerging threat to U.S. and global health. This AAP finding comes just as the United Nations (UN) held its second High-Level Meeting on Antimicrobial Resistance (AMR) on September 26 (the first was held in 2016) at which global leaders committed “to a clear set of targets and actions, including reducing the estimated 4.95 million human deaths associated with bacterial antimicrobial resistance (AMR) annually by 10% by 2030.” The release from the UN, “World leaders commit to decisive action on antimicrobial resistance,” states, ”The Food and Agriculture Organization of the United Nations (FAO), the United Nations Environment Programme (UNEP), the World Health Organization (WHO) and the World Organisation for Animal Health (WOAH), known as the Quadripartite, welcome the declaration. EU Risk Assessment Fails to Predict Limits of Personal Protective Equipment (PPE)

(Beyond Pesticides, September 19, 2024) An article published in the journal Science of the Total Environment finds that the European Union’s (EU) risk assessment process, required for registration, fails to accurately or reliably predict pesticide exposure rates, sometimes by several orders of magnitude. Pesticide registration in the EU leverages the Agricultural Operator Exposure Model (AOEM)—a predictive model developed in 2014 to estimate expected non-dietary pesticide exposure levels for operators [pest control operators in the U.S.] based on a very limited set of data generated by the pesticide industry. Models that predict real-world exposure and underestimate field data raise critical questions about the efficacy of risk assessment reviews that determine product labels and allowed level of harm. By comparing the dermal exposure measured during a field study conducted in a nonagricultural area with the corresponding values estimated by AOEM, researchers in France add to the body of scientific literature indicating that the fossil fuel and petrochemical pesticide industry data cannot be relied upon as a benchmark to ensure public health and safety. Increased Pesticide Use and Infant Deaths Tied to Decline of Bats; Importance of Organic Cited

(Beyond Pesticides, September 9, 2024)  Comments are due by 11:59 PM EDT on September 30, 2024. With the opening of the public comment period on organic standards that determine the integrity, strength, and growth of the organic agricultural sector, a study was released last week that shows degradation of the ecosystem linked to increased infant mortality associated with higher pesticide use by chemical-intensive farmers compensating for losses in bat populations. It is well known that bats, among other wildlife including birds and bees, provide important ecosystem services to farmers by helping to manage pest populations and increase plant resilience and productivity. While degradation of ecosystems is attributable to many factors, pesticide use accounts for an important element in harm to bats and biodiversity. On Labor Day, Occupational Hazards of Pesticides and Poor Surveillance of Health Threats Call for Action

(Beyond Pesticides, August 30, 2024) There is no more compelling reason to embrace a precautionary pesticide poisoning standard this Labor Day than the need to protect workers. In fact, the Occupational Safety and Health Administration (OSHA) says on its website, Transitioning to Safer Chemicals, that the best way to protect workers is to  “eliminate or reduce hazardous chemicals at the source.” While some try to employ product substitution with “safer” chemicals, Beyond Pesticides urges decision makers to embrace alternative systems, such as organic management systems, that embrace management techniques to meet disease and infestation management goals and use only organic compatible substances. According to OSHA: “In chemical management, [the industrial hygiene principle, known as the hierarchy of controls] guides employers and workers to eliminate or reduce hazardous chemicals at the source by substituting them with safer alternatives. Beyond Pesticides Rallies Public to Ban Weed Killer Atrazine with Standard EPA Used Earlier to Ban Dacthal

(Beyond Pesticides, August 26, 2024) In July, the U.S. Environmental Protection Agency (EPA) announced it was raising the allowable levels of the highly toxic weed killer atrazine in the nation’s waterways from the 2016 level of 3.4 to 9.7 micrograms per liter (µg/L), which scientists and environmental advocates say is a serious threat to aquatic plants, fish, invertebrates, and amphibians, in addition to people who recreate in waterways or eat food from them. With EPA’s August 7 decision to ban the weed killer Dacthal (or DCPA–dimethyl tetrachloroterephthalate), Beyond Pesticides is rallying public support for the removal of atrazine from the market under the same standards of harm, inability to mitigate hazards, and the availability of alternatives. As Beyond Pesticides points out in its 2022 atrazine comments (2020 and 2016 comments included) to EPA, the agency in November 2021 released the final Biological Evaluation (BE) assessing risks to listed species from labeled uses of atrazine (in the triazine chemical family). Modes of Action of Persistent Pesticides Documented, with Ongoing Poisoning and Multigenerational Effects

(Beyond Pesticides, August 20, 2024) A study published online in the journal Environmental Toxicology and Pharmacology raises continuing concern about residual exposure to organochlorine pesticides (OCPs) and the disruption that they and their metabolites and isomers cause to biological systems. For the most part, OCPs, including dichlorodiphenyltrichloroethane (DDT), are no longer used worldwide, but the legacy of their poisoning and contamination persists. A 2022 article in Environmental Science & Technology cites California condors and marine mammals along California’s coast contaminated with several dozen different halogenated organic compounds (hazardous, often-chlorinated chemicals) related to DDT, chlordane, and other now-banned legacy chemicals. Other research finds DDT in deep ocean sediment and biota. And, more research finds multigeneration effects from DDT exposure with grandmothers’ exposure to DDT increasing granddaughters’ breast cancer and cardiometabolic disorder risk. This study may be the first compilation of research regarding the modes of action for distinct types of organochlorine pesticides (OCPs). Study Shows Value of Soil Microbiome, Nurtured in Organic Farming, Harmed by Chemical-Intensive Ag

(Beyond Pesticides, August 9, 2024)​​ A study in the journal Biology and Fertility of Soils has confirmed once again that organic agriculture contributes significantly to soil health, improving ecological functions that are harmed by conventional, chemical-intensive farming practices. Organic soil amendments (fertilizers) that feed soil organisms increase beneficial protistan predators and support sustainable predator-prey relationships within the soil microbiome. [‘Protist’ is a catch-all term that describes ancient lineages of eukaryotes—organisms with a nucleus—that are neither a true plant, animal, or fungus.] The study shows that organic farming creates a healthy ecosystem able to support a balance of life forms in the soil. Moreover, the study finds that the use of chemical fertilizers for agricultural management disrupt the stable biological relationship between protistan predators and their bacterial prey in soils, adding to the argument for transitioning away from conventional systems that lean on toxic inputs.   Healthy soil contains millions of living species that form the microbiome. EPA’s Momentous Decision to Ban the Weed Killer Dacthal/DCPA: An Anomaly or a Precedent?

(Beyond Pesticides, August 8, 2024) With the use of its emergency authority—not used in nearly 40 years, the U.S. Environmental Protection Agency (EPA) on August 7 banned a pesticide (the weed killer Dacthal or DCPA—dimethyl tetrachloroterephthalate) under the “imminent hazard” clause of the federal pesticide law. At the same time, the agency is exercising its authority to prohibit the continued use of Dacthal’s existing stocks, a provision that EPA rarely uses. EPA identified serious concerns about fetal hormone disruption and resulting “low birth weight and irreversible and life-long impacts to children [impaired brain development, decreased IQ, and impaired motor skills] exposed in-utero” and finds that there are no “practicable mitigation measures” to protect against these hazards. The last time EPA issued an emergency action like this was in 1979 when the agency acknowledged miscarriages associated with the forestry use of the herbicide 2,4,5-T—one-half of the chemical weed killer Agent Orange, sprayed over people to defoliate the landscape of Vietnam in the war there—with the most potent form of dioxin, TCDD (2,3,7,8-Tetrachlorodibenzo-p-dioxin).
