EPA Upholds Clean Water Act, Steps in to Add Impaired Streams to State List

(Beyond Pesticides, March 27, 2013) The U.S. Environmental Protection Agency (EPA) stepped in this week to revise a biennial report on impaired rivers and streams across West Virginia, after state officials, under pressure from industry interests, left more than 1,000 miles of polluted waterways off the list. EPA officials stated that the Clean Water Act does not allow the state to ignore evidence that streams are troubled. Water standards and plans for cleanup must be adopted for impaired waterways. EPA reprimanded West Virginia from shirking its responsibilities under the law to list all of the state’s impaired streams, in spite of industry interference. EPA Region  3 officials are now proposing to add an additional 255 waterway segments where aquatic life is impaired to the state’s 303(d) list, named for the section of the Clean Water Act that requires it be prepared. Section 303(d) requires a listing of impaired streams in the state, and the list is used for water standard development for subsequent cleanup plans and restoration of the impaired waterways. States are required to publish such lists every two years. Water Testing for Atrazine Severely Lacking in Hawaii

(Beyond Pesticides, March 8, 2013) Sugarcane and pineapple production in Hawaii is threatening aquatic life as years of atrazine applications, a pesticide regularly used for corn production too, has run off into rivers, streams, and groundwater sources. Recent reviews by Hawaiian news service Civil Beat found that water testing for the chemical is not tracked currently in the state of Hawaii, despite requirements by U.S. Environmental Protection Agency regulatory limits under the Clean Water Act. Instead, the Hawaii Department of Agriculture almost exclusively relies on label compliance, according to Thomas Matsuda, manager of its pesticide program. Monitoring problems have been compounded by understaffing, with only six inspectors for the state of Hawaii. Not surprising, close examination of atrazine sales records by Civil Beat indicate that the largest buyers of the chemical are Hawaiian seed corn companies Monsanto and Mycogen. Syngenta recently reached a class action settlement in City of Greeneville v. Syngenta Crop Protection, Inc., providing the Kaua’i Department of Water with $6,692.96 for atrazine clean-up expenses. Silver Nanoparticles in Sewage Sludge Found to Disrupt Ecosystems

(Beyond Pesticides, March 5, 2013) Low concentrations of silver nanoparticles can cause significant disruptions to natural ecosystems, find scientists at Duke University. This research, published in the journal PLOS ONE, provides a “real-world” look at the effects of this increasingly ubiquitous material in our environment. Although nanotechnology may have  great potential to provide critical breakthroughs in medicine and electronics, one specific material, silver nanoparticles or nanosilver, is particularly suspect in terms of human and environmental health due to its antimicrobial properties and a lack of thorough testing. Nanosilver is found in a  wide range of consumer products, including sun screen, children’s toys and pacifiers, toothpaste, and disinfectants. After the material is used, it often makes its way down our drains and into our wastewater treatment plants. Because of the material’s small size, treatment plants are unable to filter out the nanosilver. Fed Legislation Would Weaken Pesticide Rules to Protect Water

(Beyond Pesticides, February 4, 2013) U.S. Senators Pat Roberts (R-KS) and Mike Johanns (R-NE) re-introduced legislation that would reduce the review requirements for pesticides applied directly to water. Similar legislation was passed in the House of Representatives in March 2011. The previous Senate version of the bill, called the Reducing Regulatory Burdens Act of 2011, passed through the Senate Agriculture Committee but never reached the Senate floor because of a hold placed on the legislation by Senators Barbra Boxer (D-CA) and Benjamin L. Cardin (D-MD). This re-introduced legislation would reduce pesticide testing by ensuring that Clean Water Act (CWA) permits are not required for the application of pesticides. In 2009, the 6th Circuit Court of Appeals ruled in the case of the National Cotton Council et al. v. EPA that pesticides discharged into water are pollutants and required to be permitted under the CWA’s National Pollutant Discharge Elimination System (NPDES). This ruling overturned Bush administration policy that exempted pesticides from regulation under the CWA and applied the less protective standards of the Federal Insecticide Fungicide and Rodenticide Act (FIFRA). Triclosan and Its Toxic Breakdown Products Found Polluting Freshwater Lakes

(Beyond Pesticides, January 29, 2013) A new study has discovered the anti-bacterial chemical triclosan and several of its toxic derivatives in sediment samples taken from freshwater lakes. Research published in the journal Environmental Science and Technology reveals the chemical to be present in increasing concentrations since it was first invented in the 1960’s. The results of this study put increased pressure on lawmakers and cosmetic companies to remove this chemical from consumer products. Beyond Pesticides and other groups, which have petitioned the U.S. Food and Drug Administration (FDA) and the U.S. Environmental Protection Agency (EPA) to remove triclosan from a vast array of consumer products, continues to urge cosmetic companies to take action on the chemical in the face of inadequate regulation to protect human health and the environment. Scientists tested  eight sediment samples from freshwater lakes across Minnesota, including Lake Superior. Toxic Contamination Remains Widespread In the Chesapeake Bay

(Beyond Pesticides, January 23, 2013) A new federal report finds toxic contamination remains widespread in the Chesapeake Bay, with severe impacts in some places, which health and environmental advocates say lends support to their push in Maryland for legislative action on pesticides and other hazardous chemicals. In spite of some cleanup, the health of the Bay has not significantly improved. The report, “Technical Report on Toxic Contaminants in the Chesapeake Bay and its Watershed: Extent and Severity of Occurrence and Potential Biological Effects” is based on a review of integrated water-quality assessment reports from the jurisdictions in the Bay watershed (Delaware, Maryland, New York, Pennsylvania, Virginia, West Virginia, and Washington, D.C.), Federal and State reports, and articles in scientific journals. It notes that nearly three-fourths of the Bay’s tidal waters are “fully or partially impaired” by toxic chemicals, with people warned to limit fish consumption from certain areas. Contamination is severe in a handful of “hot spots” around the Bay, including Baltimore’s harbor, largely a legacy of past industrial and shipping activity. Oregon’s Department of Agriculture Looks to Protect Waterways from Pesticide Runoff

(Beyond Pesticides, October 16, 2012) The Oregon Department of Agriculture (ODA) is looking to revamp the way it enforces the 1993 Agricultural Water Quality Management Act in order to decrease the amount of pesticides that end up in the state’s waterways from agricultural nonpoint source pollution. The new plan, which was unveiled last December, will work by taking a firmer approach than the current plan, which on sporadic complaints for enforcement and cooperative action by residents through soil and water conservation districts. While a new plan could benefit the health of Oregon residents and its waterways, it is in danger because politicians and some farmers believe it will be overly burdensome and increase costs. Oregon is no stranger to problems with pesticide contamination of its water. The state of Oregon has a complex and diverse agricultural economy which ranges from forestry products to seed crops. Oregon also has thousands of miles of waterways. Roughly 15,000 miles of these waterways are listed as impaired, and nearly half of the 11,000-plus miles of waterways in Willamette River basin need more streamside plants, according to a 2009 state report. Local Incidents Raise National Concerns Over Safety of Sewage Sludge as Fertilizer

(Beyond Pesticides, October 9, 2012) Sewage sludge is big business in Channahon, IL, but many residents who live near fields treated with the fertilizer believe they’re the ones paying the price. Farms in the area began applying the “biosolids” in 2010, and residents say that’s when their health issues began, according to Morris Daily Herald. Biosolids, otherwise known as sewage sludge, are composed of dried microbes previously used to process wastewater in treatment plants. The material is increasingly being used in conventional agriculture, but its application is explicitly forbidden in organic production. This is because the sludge can contain high concentrations of toxic contaminants, such as pesticides, detergents, estrogenic hormones, antibiotics, dioxins, PCBs, flame retardants, and heavy metals. Past research gives credence to Channahon residents’ claims of adverse health effects as a result of living near sludge coated fields. A 2002 study revealed the material to be associated with an increased prevalence of Staphylococcus aureus infections, a condition known to cause skin rashes and respiratory problems, for people located in close proximity to biosolid application sites. “What they are doing is making a toxic dump of our area. EPA Funds Water Treatment Research

(Beyond Pesticides, September 24, 2012) In the face of widespread pesticide contamination of U.S. waterways and the lack of drinking water standards for hundreds of pesticides, the U.S. Environmental Protection Agency (EPA) has devoted a $499,778 grant towards developing low-cost water decontamination facilities serving less than 10,000 people. Though conventional water treatment facilities remove many contaminants including suspended solids, bacteria, algae, viruses, fungi, and some chemical pollutants they do not remove many pesticide or antibiotic contaminants. Led by Professor Christopher Bellona, PhD of Clarkson University Civil and Environmental Engineering Departments, research into new water treatment technologies will aim at eliminating these antibiotics and pesticides from potable water. There are currently 88 drinking water contaminants and indicators regulated under the National Primary Drinking Water Regulations which are legally enforceable for public water systems. EPA determines whether a contaminant should be regulated based on peer-reviewed science-based research, with a focus on the health impacts due to exposure. Debate Grows Over New Water Rules In California

(Beyond Pesticides, August 29, 2012) Months after a highly publicized report concluded farming is responsible for underground water contamination in Central Valley, California, the state is poised to approve new groundwater rules to monitor underground water and control discharges of contaminants, such as fertilizers and pesticides. The new regulations, which may involve drilling monitoring wells and testing water, is receiving fierce opposition from industry and farmers who object to paying for monitoring. The new rules that are scheduled for approval early next year will affect about 3,000 farms in Fresno, Tulare, Kings and Kern counties, covering more than 1.6 million acres of farmland. More than 400 farmers and agriculture industry leaders packed an informational meeting held by the Central Valley Regional Water Quality Control Board last week to air their concerns over a plan to protect the region’s groundwater from contamination. Pesticides Detected in Long Island Sound Lobsters for the First Time

(Beyond Pesticides, July 27, 2012) A Connecticut state Department of Energy and Environmental Protection study has detected residues of mosquito control pesticides in lobsters pulled from Long Island Sound. Using new testing technology that can detect small concentrations of substances, ten lobsters were tested for three common mosquito control chemicals: malathion, methoprene, and resmethrin. Positive results were found in the organ tissue of one lobster for methoprene and three lobsters for resmethrin. The results present the first scientific evidence that pesticides may be affecting lobsters in the Sound and are likely to further anger the Connecticut lobstering industry which, for years, has been pointing to mosquito pesticides as a likely cause of a serious decline in the lobster population of the Sound, but has been met with resistance. Late summer declines in the Sound’s lobster population have been alarmingly common throughout much of the last decade, devastating fishers and the local economy that depends on them. Pesticides Blamed for Fish Kill on Canadian Coast

(Beyond Pesticides, July 11, 2012) Hundreds of dead fish have been found in Prince Edward Island, Canada, the second in two years, prompting concerns about the use of pesticides in the province’s agriculture industry, and the effectiveness of mitigation measures to reduce pesticide runoff. It is believed that pesticide runoff from nearby agricultural fields after heavy rains are to blame for the massive fish kill. More than 2,000 fish have been scooped from the near two-mile stretch of Barclay Brook in Coleman since last Thursday following heavy rainfall, more than triple the amount of fish that washed up on the same shores of the brook last year, although the current discovery is concentrated in a smaller area. It is believed the actual number of dead fish is much higher, as predators and river currents would have quickly taken away the remains of other fish. Barclay Brook is part of the Trout River watershed, the scene of a devastating fish kill last July that mainly wiped out large fish. Banned Pesticides Found in Connecticut Wells

(Beyond Pesticides, July 9, 2012) Health officials in Connecticut are telling residents who drink from private wells to test their water for the banned pesticides chlordane and dieldrin, after a study from the town of Stamford, CT found at least one of the toxic chemicals in 195 out of 628 wells tested. Over half of the wells that tested positive for one of the pesticides were found to contain concentrations at levels above what the U.S Environmental Protection Agency (EPA) considers acceptable. Both of these chemicals, discussed at length in Rachael Carson’s seminal book Silent Spring, were widely used throughout the country before their ban in the late 1980s. Since then, these chemicals have revealed themselves to be pervasive in our environment. In 2007, Beyond Pesticides wrote on the discovery of chlordane on the grounds of a New Jersey middle school at levels above EPA limits. In 2009, the U.S Housing and Urban Development (HUD) and EPA conducted a survey that found chlordane in 64% of U.S households sampled. Take Action! New Farm Bill Amendments Attack Your Health and Environment

(Beyond Pesticides, June 18, 2012) Once again, attempts to repeal the Clean Water Act permits for pesticide discharges are underway in Congress. This week the 2012 Farm Bill will be introduced to the Senate floor where measures to attack environmental laws have been added unceremoniously to the bill, including the controversial H.R. 872, Reducing Regulatory Burdens Act, which seeks to undermine federal authority to monitor our nation’s waterways for pesticide contamination, as well as eroding already lax federal oversight of genetically engineered crops. Congress is working on the monumental process of altering and renewing the Farm Bill, S. 3240. This process only comes along every five years and has major impacts on how we grow our food. The last Farm Bill was passed in 2008, and expires in 2012. The bill is expected to be introduced on Senate floor on Tuesday, June 19. Hawaii’s Oversight of Pesticides Permits Scrutinized for Undue Industry Influence

(Beyond Pesticides, June 7, 2012) As Hawaii officials finalize new rules for the regulation of pesticide discharge into waterways due to the federal court ruling requiring permits for pesticide discharges, critics say the state’s draft rules are not strict enough and that stakeholders, such as the farming lobby, may have had undue influence in crafting the new permitting requirements. Now that federal rules have been finalized to require National Pollutant Discharge and Elimination System (NPDES) permits under the Clean Water Act for pesticide discharges near waterways, as a result of a 2009 federal court order instructing EPA to require permits for pesticide discharges (see Daily News coverage), many states are rolling out their own rules to regulate these discharges. In Hawaii, a meeting called by state officials on Monday to hear public input was largely a battle between pro-pesticide interests, including Alexander & Baldwin, which sprays pesticides in irrigation ditches to control weeds, and state land officials, who use chemicals to kill invasive species, as well as Monsanto, that pushed to ease the rules, and environmental groups seeking to make them more stringent. Atrazine Manufacturer To Pay $105 Million to Community Water Systems

(Beyond Pesticides, May 30, 2012) A settlement between plaintiffs and the manufacturer of the endocrine disrupting herbicide atrazine, Syngenta, will pay $105 million to settle a nearly 8-year-old lawsuit and could help reimburse community water systems (CWS) in 45 states that have had to filter the toxic chemical from its drinking water, according to news reports. It will provide financial recoveries for costs that have been borne for decades by more than 1,887 CWSs that provide drinking water more than one in six Americans across at least 45 states. “The scope of this historic settlement is enormous and its protection of the health of millions of Americans across the country is a huge benefit to the public, the environment, and the taxpayers,” the lead plaintiffs’ lawyer Stephen M. Tillery told the media. The individual amounts that eligible CWSs will recover will be calculated based on the levels of atrazine and frequency of atrazine contamination measured in the water of impacted CWSs and the population served by each CWS. Report Puts Potomac River as “Most Endangered,” Highlights Why Clean Water Protections Critical

(Beyond Pesticides, May 16, 2012) With Congress considering drastic cuts to national clean water protections, and rivers nationwide facing threats from natural gas drilling, chemical pollution, and new dams, American Rivers yesterday released its annual list of America’s Most Endangered Rivers. ® It names the Potomac River, known as ”˜the nation’s river’ as it flows through the capital, the most endangered in the country. While the Potomac is cleaner than it used to be, the river is still threatened by urban and agricultural pollution —and it could get much worse if Congress rolls back critical clean water safeguards. As the country commemorates the 40th anniversary of the Clean Water Act this year, the Potomac is emblematic of what is at stake for rivers nationwide. Private Canadian Organic Aquaculture Standard Released

(Beyond Pesticides, May 11, 2012) The Canadian General Standards Board (CGSB) has released the final version of the Canadian Organic Aquaculture Standard, a non-binding system for certifying farmed fish outside of official Canadian organic standards. The final standard is a revised form of a draft standard first proposed in 2010, which was subject to severe criticism from environmental advocates. The standard has been developed independently of Canadian organic standards for agriculture and is not currently included in official government regulations regarding organic agriculture. The release comes less than two weeks before the U.S. National Organic Standards Board (NOSB) will meet to discuss, among other topics, the ongoing process of developing a standard for organic aquaculture in the United States. The new standard was developed by under the auspices of the Canadian National Standards Board and is purely voluntary. In Canada, as in the U.S., fish are are explicitly excluded from federal organic regulations. This means that there can be no official, government-approved organic fish in either country currently. Vermont Passes First Statewide Fracking Ban

(Beyond Pesticides, May 8, 2012) On May 4, the Vermont House of Representatives voted 103-36 to give final passage to legislation that will make Vermont the first state in the nation to ban the practice of hydraulic fracturing for natural gas. EPA Publishes Human Health Benchmarks for Pesticides in Water

(Beyond Pesticides, April 18, 2012) In the face of widespread pesticide contamination of U.S. waterways and the lack of drinking water standards for hundreds of pesticides, the U.S. Environmental Protection Agency (EPA) has announced new health and environmental benchmarks for acute pesticide effects, postponing action on chronic effects to an unspecified future date. While a step forward in identifying hazards associated with pesticide use and exposure, benchmarks have been notoriously limited in fully assessing risks because of ongoing deficiencies in analyzing the complexities associated with chemical exposure, specifically a failure to evaluate the effects of chemical mixtures, synergistic effects, and health effects associated with consistent low-dose exposure. EPA notes in a newly released April 2012 factsheet, “Human Health Benchmarks for Pesticides,” that, “EPA has developed a table of human health benchmarks for approximately 350 pesticides that are currently registered for use on food crops. The benchmarks are for pesticides for which the agency has not previously issued a drinking water health advisory or set an enforceable federal drinking water standard. Fisheries Service Tells EPA to Better Protect Endangered Species from Pesticides

(Beyond Pesticides, April 16, 2012) The U.S. National Marine Fisheries Service (NMFS) has released a draft Biological Opinion finding that three commonly used herbicides are increasing the chance of extinction for threatened and endangered Pacific salmon and steelhead runs. The NMFS assessment reverses earlier assurances from the U.S. Environmental Protection Agency (EPA) that the pesticides are “not likely to adversely affect” the dwindling salmon populations. The draft Opinion also contains restrictions on applying the three pesticides near waterways in California, Washington, Oregon and Idaho that provide habitat for the threatened and endangered runs. Public comment on the draft is being accepted through April 30 and the restrictions on applying the pesticides will take effect no later than one year after the final assessment is released. NMFS prepared the draft Opinion in response to EPA’s initial assessment of the risk that current uses of the herbicides oryzalin, pendimethalin and trifluralin pose for the threatened and endangered salmon and steelhead species. California Proposes to Ease Permit Restrictions For Mosquito Spraying

(Beyond Pesticides, February 15, 2012) California mosquito control agencies are charging that new NPDES permitting regulations would eliminate West Nile virus fogging and jeopardize public health. In response, the state of California has proposed to scale-back pesticide regulations, easing rules on fumigating adult mosquitoes. This is in spite of the high risk for further degradation of already contaminated surface waters in the state, and contrary to the stipulations and protections set out in the Clean Water Act. The current federal National Pollutant Discharge Elimination System (NPDES) permit, which recently went into effect after much resistance from the pesticide and agriculture industry and intensive lobbying efforts in Congress, does not authorize the discharge of biological and residual pesticides or their degradation by-products to waters of the U.S. that are impaired by the same pesticide active ingredients or any pesticide in the same chemical family. ”˜Impaired waters’ are polluted waters, i.e. those waters not meeting water quality standards pursuant to section 303(d) of the Clean Water Act (CWA). Pesticide Toxic to Bees and Aquatic Life Contaminates Surface Waters

(Beyond Pesticides, January 24, 2012) Research published this month in the online edition of the Bulletin of Environmental Contamination and Toxicology finds that the neonicotinoid pesticide imidacloprid contaminates surface waters in agricultural regions. Imidacloprid is a systemic pesticide, meaning it is taken up by a plant’s vascular system and expressed through pollen, nectar, and gutation droplets, and is highly toxic to bees, birds and aquatic organisms. The study, “Detections of the Neonicotinoid Insecticide Imidacloprid in Surface Waters of Three Agricultural Regions of California, USA, 2010—2011,” concludes that imidacloprid commonly moves offsite and contaminates surface waters at concentrations that could harm aquatic organisms following use under irrigated agriculture conditions. Researchers at the California Department of Pesticide Regulation collected 75 surface water samples from three agricultural regions of California and analyzed them for contamination with imidacloprid. Samples were collected during California’s relatively dry-weather irrigation seasons in 2010 and 2011. Imidacloprid was detected in 67 samples (89%); concentrations exceeded the U.S. Environmental Protection Agency’s (EPA) chronic invertebrate Aquatic Life Benchmark of 1.05 ĂŽÂĽg/L (micrograms per liter) in 14 samples (19%).
