EPA Recognizes Pesticide Drift Poisoning, Responds with Assessments, but Limited Action

(Beyond Pesticides, July 30, 2024) The U.S. Environmental Protection Agency (EPA) announced on July 15 what it described as a new process for evaluating the risks of spray drift—the migration of pesticides from their target area to off-site zones. According to a statement by EPA Chemical Safety and Pollution Prevention Assistant Administrator Michal Freedhoff, PhD in an Oregon Public Broadcasting story, the agency took the step so that “people don’t have to wait years for the protections they deserve and need.” However, EPA states, “The Agency is not making any changes to its chemical-specific methodology outlined in [its] 2014 document but has decided to extend the chemical-specific spray drift methodology to certain registration actions.” EPA has said, “Spray drift is governed by a variety of factors which govern how much of the pesticide application deposits on surfaces where contact with residues can eventually lead to indirect exposures (e.g., children playing on lawns that are next to treated fields and where residues have deposited).” The new policy will add spray drift evaluation to occasions when the agency receives an application for a new pesticide and when a registered pesticide is intended for a new use or applied to a new crop. Oregon Court of Appeals Overturns Monsanto-Bayer Trial Victory, Protects Failure-to-Warn Claims

(Beyond Pesticides, July 25, 2024) On July 10, the Oregon Court of Appeals ruled that the Federal Insecticide, Fungicide and Rodenticide Act (FIFRA) does not preempt pesticide exposure victims’ state law claims against pesticide manufacturers, based on reporting from The New Lede. This decision builds on years of judicial precedent from the Supreme Court of the United States (SCOTUS) that protects individuals’ right to use failure-to-warn claims against producers of toxic pesticides, including Bayer-Monsanto. The importance of judicial review is critical to protecting the public against public health impacts of toxic pesticide use in the context of last month’s SCOTUS decision ending Chevron Doctrine, and with it the end of deferring to federal regulatory agencies on ambiguities in statutory mandates. A growing coalition of environmental and public health advocates, organic farmers, trial attorneys, farmworkers, and physicians are united in pushing back against a concerted effort by industry and its allies to attack victims’ ability to sue under “failure-to-warn” through the Farm Bill, state legislatures, and the proposed federal budget for Fiscal Year 2025. Enhanced Bioavailability and Contamination of Neonicotinoid Pesticides Linked to Microplastics in Soil

(Beyond Pesticides, July 23, 2024) In analyzing the interactions between neonicotinoid pesticides (NNPs) and microplastics (MPs), a recent study in The Science of The Total Environment finds that neonicotinoids such as thiacloprid (THI) become more bioavailable in soils containing traditional and biodegradable plastics. Increased bioavailability, which quantifies the extent to which organisms are exposed to chemicals in soil or sediment, puts soil microbiota at risk and leaves all consumers susceptible to adverse effects in contaminated food crops. This study raises a grave deficiency, among others, in the pesticide registration and regulatory review process, which currently ignores interactions of pesticides with other contaminants, like microplastics, in the environment when conducting health and ecological effects assessments.   The researchers, from China University of Geosciences, Beijing Academy of Agriculture & Forestry Sciences, Chinese Academy of Agricultural Sciences, and University of Swat in Pakistan, chose to study thiacloprid as an example of NNPs to explore “the adsorption-desorption process and mechanism of NNPs on MPs,” as well as the main factors affecting adsorption, since these are two contaminants of concern in agricultural environments.  Adsorption [clinging to the surface] and desorption [releasing after adsorption] of thiacloprid by both traditional and biodegradable MPs, and the impact of MPs […]

Developmental Neurotoxic Effects of Widely Used Neonicotinoid Insecticide Underestimated by EPA

(Beyond Pesticides, July 18, 2024) A recent study in The Journal of Toxicological Sciences shows that a single dose of the neonicotinoid insecticide clothianidin (CLO) induces behavioral abnormalities, predominantly in female mice, throughout key stages of development. In testing mice at various ages, sex-specific changes were identified that highlight not only varied effects on males and females but also how pesticide exposure at a young age can cause lasting impacts throughout adulthood in mammalian species.  The researchers, at the Laboratory of Animal Reproduction and Development at Tohoku University in Japan, “utilized murine [mouse] models to compare the sex-specific differences in behavioral effects following CLO exposure at different developmental stages. [They] orally administered CLO to male and female mice as a single high-dose solution (80 mg/kg) during the postnatal period (2-week-old), adolescence (6-week-old), or maturity (10-week-old), and subsequently evaluated higher brain function.”   As the authors remark, “Most studies on the neurotoxicity of CLO have targeted only males, with limited insights regarding the neurodevelopmental toxicity in females. Neonicotinoid Insecticides Contribute to Honey Bee Vulnerability to Parasitic Varroa Mites

(Beyond Pesticides, July 10, 2024) An article last month in Entomology Today, a publication of the Entomological Society of America, highlights the important findings of a study published earlier this year in the Journal of Insect Science. While there has been debate on whether neonicotinoid (neonic) insecticides or Varroa mites (Varroa destructor) are more detrimental to the survival of bees, evidence suggests that neonicotinoids are not only harmful individually but can increase vulnerability to parasitism from mites in western honey bees (Apis mellifera). The Entomology Today article reads: “Some researchers and organizations have pointed to neonics as directly harming bees. Others have pointed to other issues, like Varroa mite infestation, as more hazardous to honey bee populations.” There is scientific evidence supporting each claim, as both cause stress to bee species that can lead to population decline. The study in the Journal of Science, however, is “the first experimental field demonstration of how neonicotinoid exposure can increase V. destructor populations in honey bees and also demonstrates that colony genetic diversity cannot mitigate the effects of neonicotinoid pesticides.”  As the article states, “The researchers were not looking for impacts on Varroa mites at first. Pollinator Week Ends; Pollinator Decline and Biodiversity Collapse Continue with Inadequate Restrictions

(Beyond Pesticides, June 24, 2024) National Pollinator Week ended last week, but the crisis associated with pollinator decline and biodiversity collapse continues. If there were not enough data to prove that regulators are woefully behind the curve in protecting pollinators, yet another study was published during Pollinator Week that reminded regulators, elected officials, farmers, gardeners, all eaters, and lovers of nature that federal, state, and local environmental laws in place have been an abject and unconscionable failure in protecting the biodiversity that supports all life. The study, “Insecticides, more than herbicides, land use, and climate, are associated with declines in butterfly species richness and abundance in the American Midwest,” published in PLOS ONE, cries out as a further warning that the U.S. Environmental Protection Agency’s (EPA) “mitigation measures,” which tinker with limited pesticide restrictions, represent a catastrophic disregard for the scientifically documented facts, according to environmental advocates. Literature Review Analyzes Pesticide Sensitivity in Bee Species on a Molecular Level

(Beyond Pesticides, June 21, 2024) A recent review of the scientific literature, published in Science of The Total Environment, analyzes multiple species of bees on a molecular level to better understand the poisoning mechanisms that could, as the authors see it, inform chemical risk assessments with more precision. The mechanisms “implicated in the tolerance of bees to specific pesticides, and thus as determinants of insecticide sensitivity, … include metabolic detoxification, insecticide target proteins, the insect cuticle and bee gut microbiota,” the authors write. This review references more than 90 studies performed over the last 30+ years, with most being published in the last 5-10 years, as the understanding and importance of molecular determinants of bee sensitivity has emerged. Pollinators, such as bees, provide crucial ecosystem services by pollinating both wild plants and essential crops. The exposure these insects are subjected to threatens their existence, which occurs through pesticide contamination that can lead to impacts on growth and development or even colony collapse.    “While bees have only been exposed to human-made pesticides over the recent past (last 80 years) they have co-evolved with plants and fungi which produce a range of xenobiotics, including plant allelochemicals and mycotoxins,” the authors state. EPA “Mitigation Menu” Called Complex, Raising Doubts about Required Endangered Species Protection

(Beyond Pesticides, June 18, 2024) As part of its update to the proposed U.S. Environmental Protection Agency (EPA) Endangered Species Act (ESA) Workplan, the agency held a public webinar on June 18, 2024, which provided an overview of the agency’s “Mitigation Menu Website” for “reducing pesticide exposure to nontarget species from agricultural crop uses.” [Check back to see webinar when posted by EPA.] After court decisions forced EPA to develop a strategy to meet its statutory responsibility to protect endangered species from pesticide use, the agency recognized that it is, in its own words, “unable to keep pace” with its legal obligations. Despite this acknowledgement, the agency said it would “provide flexibility to growers to choose mitigations that work best for their situation.” In this spirit, a range of people, including grower groups, gathered earlier in the year for a series of workshops in the Pacific Northwest to discuss possible mitigation measures. Study Confirms Serious Flaws in EPA’s Ecological Risk Assessments, Threatening Bees and Other Pollinators

(Beyond Pesticides, June 13, 2024) A study published in Conservation Letters, a journal of the Society for Conservation Biology, exposes critical shortcomings in the U.S. Environmental Protection Agency’s (EPA) ecological risk assessment (ERA) process for modeling the risks that pesticides pose to bees and other pollinators. For the study, “Risk assessments underestimate threat of pesticides to wild bees,” researchers conducted a meta-analysis of toxicity data in EPA’s ECOTOX knowledgebase (ECOTOX), an EPA-hosted, publicly available resource with information on adverse effects of single chemical stressors to certain aquatic and terrestrial species. The meta-analysis found that the agency’s approach, which relies heavily on honey bee data from controlled laboratory studies, drastically underestimates the real-world threats from neonicotinoid insecticides (and likely other pesticides) to native bees and other pollinators. Study Shows Value of Organic Practices in Lowering Environmental Impact of Agriculture

(Beyond Pesticides, May 23, 2024)  A study recently published in the journal Nature compared the impact of organic and conventional food production using eight environmental health indicators and found that organic food has a significantly lower environmental impact than conventional food production for six of the eight indicators, including a lower potential for contributing to acidification of the environment, energy use, and biodiversity loss. For the analysis, scientists reviewed 100 different “life cycle assessments” (LCA) of organic and conventionally grown food products from cradle-to-farm gate.    LCA is a commonly used methodology to estimate food production system impacts on the environment through resource depletion and pollutant emissions. The results—that organic food production is less impactful on the environment—add to the robust body of research that underscores the importance of organic farming to the development of a sustainable global food system while addressing climate change. EPA Proposes to Stop Most Uses of Highly Toxic Insecticide in Food and Water, But Open to Negotiating

(Beyond Pesticides, May 8, 2024) In an unexpected turnaround, the U.S. Environmental Protection Agency (EPA) announced at the end of April a Proposed Interim Decision (PID) to discontinue all but one application of the insecticide acephate. Acephate is an organophosphate pesticide, a well-known neurotoxicant, widely banned globally, including in the European Union. Under the proposal, all uses would end except for the injection of trees that do not produce fruit or nuts. In its proposed action, EPA asks the manufacturer to offer the agency a voluntary settlement, a process that typically compromises the health of the public, workers, and the environment. Acephate, an organophosphate (OP) pesticide, is approved for use in both agricultural settings, including crops like cotton and soybeans, and nonagricultural applications, such as injections for forestry trees. Acephate affects the nervous system by inhibiting the acetylcholinesterase (AChE) enzyme. Importantly, chronic, low levels of exposure can cause a range of adverse human health outcomes, from cancer to birth defects, reproductive and developmental problems, and learning disabilities. EPA Draft Herbicide Strategy Update Further Weakens Plan to Protect Endangered Species

(Beyond Pesticides, April 24, 2024) On April 16, 2024, the U.S. Environmental Protection Agency (EPA) posted an “update” to the Draft Herbicide Strategy Framework (Draft Herbicide Strategy Framework to Reduce Exposure of Federally Listed Endangered and Threatened Species and Designated Critical Habitats from the Use of Conventional Agricultural Herbicides) that was released last summer, weakening aspects of the agency’s efforts to “protect” endangered species from herbicide use. The update outlines three types of modifications to the Draft Strategy, including “simplifying” its approach, increasing growers’ “flexibility” when applying mitigation measures, and reducing the mitigation measures required in certain situations. By reducing the stringency of the Strategy, advocates are again questioning EPA’s commitment to fulfilling legal requirements under the Endangered Species Act (ESA) or protecting endangered species and their habitats in the midst of an unprecedented rate of global extinction. ESA is celebrated as one of the most far-reaching conservation laws globally, credited with preventing the extinction of 99 percent of those species the government targets for protection, according to the U.S. Fish and Wildlife Service (USFWS). EPA Inspector General Report Cites Agency Failures in Cleanup of Wood Preservatives at Superfund Site

(Beyond Pesticides, April 23, 2024) The Office of Inspector General for the U.S. Environmental Protection Agency (EPA) released a report last week finding that the agency has failed to establish “institutional controls” at the American Creosote Works Superfund Site in Pensacola, Florida, leading to continuous groundwater and soil contamination that “leav[es] the public at risk of exposure.” The 1980 Comprehensive Environmental Response, Compensation and Liability Act (CERCLA) established the Superfund program, codified under 42 U.S.C. Chapter 103, to clean up contaminated sites with tax money from polluting industries. The OIG made eight recommendations for the regional EPA administrator and one for the assistant administrator “for Land and Emergency Management to improve the institutional controls at American Creosote Works Superfund Site.” There are three main determinations found in the results section of the OIG report: first, the institutional controls to prevent potential exposure were either “insufficient or unimplemented;” second, the EPA missed its mark in communicating associated risks to the public in areas surrounding this Superfund site; and third, the full administrative record for this site was not available at the time of inspection. California Bill Would Ban Deadly Weedkiller, Paraquat, Linked to Parkinson’s Disease in Face of EPA Inaction

(Beyond Pesticides, April 16, 2024) Citing serious health issues associated with its use, including Parkinson’s disease, and inaction by the U.S. Environmental Protection Agency (EPA), the weed killer paraquat would be banned through legislation introduced in the California Assembly (AB 1963). Assemblymember Laura Friedman (D-Burbank), in the Assembly’s leadership, chair of the bicameral Environmental Caucus, and a self-described “steadfast advocate for the environment [and] sustainable communities,” introduced the legislation to phase out and ban the use of paraquat across all uses, including agriculture, by the end of 2025. The introduction of this bill follows a long history of scientific documentation of the pesticide’s hazards, fits and starts in the regulatory process, and previous efforts to ban the herbicide through legislative action. In 2018, U.S. Representative Nydia Velasquez (D-NY) introduced legislation (Protect Against Paraquat Act) to ban paraquat. Private Capital Invests in “Regenerative Organic” Agriculture

(Beyond Pesticides, April 2, 2024) There is a nascent capital investment effort in the transition to certified organic agriculture beginning to take hold across the U.S., something advocates say is critically needed to meet the current and escalating existential health threats, biodiversity decline, and climate emergency. Mad Agriculture has received early commitments from the Rockefeller Foundation, Builders Vision, and nearly a dozen other investors to contribute to the $50 million Perennial Fund II (PFII), to advance the growth of “regenerative organic” agriculture. Forbes is reporting that PFII’s primary objective is to jumpstart the organic land transition, given that this slice of U.S. agriculture makes up less than one percent of total farmland in the country relative to the European Union’s nearly 10 percent of total farmland. “We commend the work of Mad Agriculture in harnessing the spirit of organic agriculture and mobilizing the private sector to invest in farmers who engage in regenerative organic agricultural practices,” said Max Sano, organic program associate at Beyond Pesticides. Inspector General Finds Widely Used Flea Collars Still Not Fully Evaluated by EPA

(Beyond Pesticides, March 6, 2024) With over 2,500 pet deaths and 900 reports of adverse effects to people, an Office of Inspector General (OIG) report, published on February 29, 2024, reveals multiple systemic failures by the U.S. Environmental Protection Agency’s (EPA) Office of Pesticide Programs (OPP), citing inadequate safety reviews of Seresto pet collars. The report, The EPA Needs to Determine Whether Seresto Pet Collars Pose an Unreasonable Risk to Pet Health, concludes, “The EPA’s response to reported pesticide incidents involving Seresto pet collars has not provided assurance that they can be used without posing unreasonable adverse effects to the environment, including pets.” At the time the animal effects made headlines in 2021, the agency defended the product’s registration, telling the media that, despite these incidents, EPA deemed Seresto collars “‘eligible for continued registration’ based on best available science, including incident data… No pesticide is completely without harm, but EPA ensures that there are measures on the product label that reduce risk.” Despite the scathing criticism, EPA maintains the position that it conducted an adequate review of the two active insecticide ingredients in the pet collars—the neurotoxic insecticide flumethrin, and the notorious neonicotinoid imidacloprid—proven to have adverse effects on the endocrine system as […]

Take Action: Federal Food Program Asked to Stop Feeding Children Pesticides that Contribute to Obesity

(Beyond Pesticides, March 4, 2024) With 14.7 million children and adolescents in the U.S. recognized as obese by the Centers for Disease Control and Prevention (CDC) and the established connection with endocrine disrupting contaminants, including many pesticides, Beyond Pesticides is calling on federal food assistance programs to go organic. The problem of childhood obesity is higher in people of color and, as a result, is an environmental justice issue. According to CDC, the prevalence of childhood obesity is “26.2% among Hispanic children, 24.8% among non-Hispanic Black children, 16.6% among non-Hispanic White children, and 9.0% among non-Hispanic Asian children.” While childhood obesity is recognized as a serious problem, the National School Lunch Program of the U.S. Department of Agriculture (USDA)—although improved by the Healthy, Hunger-Free Kids Act of 2010—still provides lunches laced with obesogenic pesticides. To take meaningful steps against childhood obesity, school lunches must be organic. The program served 4.9 billion meals in fiscal year 2022 in over 100,000 public and nonprofit schools, grades Pre-Kindergarten-12. State Legislation Popping Up to Limit Liability of Pesticide Manufacturers

(Beyond Pesticides, Feb 22, 2024) The Idaho Senate failed to pass SB 1245 last week which would have provided legal protection to pesticide manufacturers from “failure-to-warn” liability. This legal framework has been pivotal not only for plaintiffs, who are typically users of a toxic product, seeking redress from exposure to glyphosate-based herbicide products such as Roundup, but can also potentially extend to any toxic pesticide products. USDA Pesticide Data Program Continues to Mislead the Public on Pesticide Residue Exposure

(Beyond Pesticides, February 15, 2024) The latest U.S. Department of Agriculture (USDA) pesticide residue report, the 32nd Pesticide Data Program (PDP) Annual Summary report, released in January, finds that over 72 percent of tested commodities contain pesticide residues (27.6 percent have no detectable residues), mostly below the level the U.S. Environmental Protection Agency (EPA) has set for tolerances (allowable residues) whose safety standards have been called into question by advocates. USDA spins its report findings as a positive safety finding because, as the Department says, “[m]ore than 99 percent of the products sampled through PDP had residues below the established EPA tolerances.” USDA continues, “Ultimately, if EPA determines a pesticide use is not safe for human consumption, EPA will mitigate exposure to the pesticide through actions such as amending the pesticide label instructions, changing or revoking a pesticide residue tolerance, or not registering a new use.” As Beyond Pesticides reminds the public annually when USDA uses the report to extol the safety of pesticide-laden food, the tolerance setting process has been criticized as highly deficient because of a lack of adequate risk assessments for vulnerable subpopulations, such as farmworkers, people with compromised health or preexisting health conditions, children, and perhaps, […]

Amid Damning Criticism of Its Scientific Integrity, EPA Takes Public Comments on Updated Policy

As the U.S. Environmental Protection (EPA) takes public comments on its updated scientific integrity policy (until February 23, 2024), Beyond Pesticides issued an action and reminds the agency that when it fails to carry out its mission to protect health and the environment—by allowing use of pesticides that are known to be hazardous and not fairly and scientifically evaluated, it is responsible for a toxic tragedy that has debilitating and deadly consequences for people and the ecosystems critical to sustaining life. Key to the recommendations Beyond Pesticides is urging EPA to consider are the following: (i) incorporate independent and emerging science into its chemical reviews; (ii) Update protocol to keep pace with new science; (iii) address vulnerabilities of those at highest risk, including those with preexisting health conditions; (iv) consider safer alternatives in calculating unreasonable risk; (v) disclose uncertainties associated with agency science or data gaps, and (vi) establish criminal penalties for EPA staff integrity violations. Take Action: EPA Accepting Public Comments on Seeds and Paint that Contain Pesticides

(Beyond Pesticides, February 9, 2024) EPA is accepting public comments through today, Friday February 9, on its long-held policy of exempting “treated objects,” including seeds and paint, from pesticide registration. Although EPA does not ask the most important question—“Should pesticide-treated seeds and paint be exempt from the scrutiny given pesticide products?”—this comment period offers an opportunity to respond to EPA’s questions and express concern about hazards associated with chemical use and product ingredients. Despite exposure patterns associated with the use of pesticides in treated objects that are linked to environmental contamination and human poisoning, EPA is focused on labeling and not regulation. Consumers Left High and Dry: Public Health Issues Persist with Cannabis Products and Production Practices

(Beyond Pesticides, February 7, 2024) Sun + Earth Certified (SEC), a West Coast third-party regenerative organic certifier of cannabis products, approved the first certification for an East Coast farm in Brattleboro, Vermont – Rebel Grown. The expansion of independent certifications amidst the ongoing legalization of recreational and medicinal marijuana usage raises questions on the regulation of toxic petrochemical pesticides found in a range of cannabis products. SEC does establish, in its standards, the use of “biopesticides…[o]nly if the product brand name is approved for use in certified organic farming.” Additionally, the label goes beyond the stringency of the National Organic Program in its policy on potassium bicarbonate as an approved input. EPA’s Proposed Endocrine Disrupting Pesticide Review Called Deficient

The U.S. Environmental Protection Agency (EPA) never completed protocol for testing pesticides that disrupt the fundamental functioning of organisms, including humans, causing a range of chronic adverse health effects that defy the common misconception that dose makes the poison (“a little bit won’t hurt you”)—when, in fact, minuscule doses (exposure) wreak havoc with biological systems. After a nearly two decade defiance of a federal mandate to institute pesticide registration requirements for endocrine disruptors, EPA has now opened a public comment period ending February 26, 2024 and advocates are criticizing the agency’s proposed evaluation as too narrow.
