Colorado Rancher To Be Jailed for Pesticide Drift

(Beyond Pesticides, March 11, 2016)  A judge found a Colorado rancher to be in violation of a court order that protected his neighbors, organic farmers Rosemary Bilchak and her husband Gordon MacAlpine, who suffers from leukemia, from sprayed pesticides that drifted onto their property. The decision in western Colorado’s North Fork Valley sets a precedent in protecting farmers and sensitive people from pesticides.  State Judge Jeff Herron sentenced Hopper to jail for two days ””and fined him $7,500 ”” ruling that his spraying until 2015  violated a 2012 court order  that protected his neighbors. Despite this court order, records say Mr. Hopper continued spraying through August 2015. Mr. Hopper had obtained a state license to spray pesticides in 2011 after his wife was diagnosed with West Nile virus, which is spread by mosquitoes. However, Mr. Hopper’s neighbors took him to court, claiming the pesticides were harmful to Mr. MacAlpine’s health and prevented them from expanding into organic vegetable production. Senate Democrats Introduce Bill Requiring GE Food Labeling, Includes Preemption of States

(Beyond Pesticides March 9, 2016) Last week, Senators Jeff Merkley (OR), Patrick Leahy (D-VT), Jon Tester (D-MT), and Dianne Feinstein (D-CA) introduced legislation to  require  that consumer food packaging  displays genetically engineered (GE) ingredient labeling. The Senators’ legislation, the Biotechnology Food Labeling and Uniformity Act  (S.2621), presents an alternative to the primarily Republican-backed Biotechnology Labeling Solutions Bill that recently passed the Senate Agriculture Committee on a 14-6 vote. The Biotechnology Labeling Solutions Bill, which embodies several provisions of the much opposed DARK Act, will  hide ingredient information from consumers by overturning state GE labeling laws like that of Vermont’s. “Rather than blocking consumers’ access to information they want, the U.S. Senate should move forward with a solution that works for businesses and consumers alike,” said Senator Merkley. “There is a way to give consumers the information they are asking for without placing unfair or conflicting requirements on food producers. UN Report Warns of Decline in Pollinators and Global Food Supplies

(Beyond Pesticides, March 7, 2016) A United Nation’s report, released late last month, has warns the world that many species of wild bees, butterflies and other pollinators are on a dangerous path toward extinction, and that the  food supply will suffer if the causes of these declines, many of them human-made, are not stopped. The report is based on  many different scientific studies. The scientists who led the assessment pointed to pesticides as one of the leading causes of pollinator decline, specifically, a class of toxic chemicals called neonicotinoids, which adversely affect the nervous system of insects. According to their press release, the assessment,  Thematic Assessment of Pollinators, Pollination and Food Production, is the first ever issued by the Intergovernmental Science-Policy Platform on Biodiversity and Ecosystem  Services (IPBES). IPBES was founded in 2012 with 124 member nations to “form a crucial intersection between international scientific understanding and public policy making.” Before its release, the assessment attracted some controversy for including two representatives from the agrochemical industry, including Bayer CropScience and Syngenta, as lead authors. Chlorpyrifos Reduces Memory and Learning in Exposed Bees

(Beyond Pesticides, March 4, 2016) Honey bees experience a learning and memory deficit after ingesting small doses of the insecticide  chlorpyrifos, potentially threatening their success and survival, according to a study in  New Zealand. Chlorpyrifos is a highly neurotoxic organophosphate pesticide used worldwide on crops to protect against insects and mites. The study,  Measurements of Chlorpyrifos Levels in Forager Bees and Comparison with Levels that Disrupt Honey Bee Odor-Mediated Learning Under Laboratory Conditions,  published in  Ecology, examines chlorpyrifos levels in  bees collected from 17 locations in Otago, New Zealand and compared doses of the pesticide that cause sub-lethal effects on learning performance under laboratory conditions with amounts of chlorpyrifos detected in bees in the field. Researchers found chlorpyrifos in 17% of the sites sampled and 12% of the colonies examined. Honey bees are found to experience harmful effects to smell memory and learning, and reduction in specificity of memory recall. Chlorpyrifos is just one of many pesticides that have frequently been detected in honey bees. EPA Moves to Cancel Toxic Pesticide It Allowed without Complete Review, Manufacturer, Bayer, Reneges on Agreement to Take Product Off Market

(Washington, DC, March 1, 2016) After pesticide manufacturer Bayer CropScience would not voluntarily remove from the market the insecticide flubendiamide, the U.S. Environmental Protection Agency (EPA) formally issued a Notice of Intent to Cancel the insecticide, citing its high toxicity to aquatic organisms. Bayer is embroiled in controversy over its neonicotinoid insecticides because, as systemic pesticides, they move through the entire plant and express the poison through pollen and nectar, indiscriminately killing bees and other pollinators and polluting waterways. Flubendiamide, a benzenedicarboxamide pesticide, is “locally systemic” within the plant’s leaves. EPA’s action today may take years of regulatory review and legal action while the pesticide remains on the market. EPA used the controversial conditional registration provision of federal pesticide law, when in 2008 it allowed flubendiamide on the market, despite outstanding environmental data. At the time, it struck an agreement that, if unreasonable adverse effects on the environment were found, Bayer would withdraw the chemical’s registration. Glyphosate Residues in Popular German Beers

(Beyond Pesticides, February 29, 2016) Last Thursday, the Munich Environmental Institute stated that it had found traces of glyphosate, the widely used and controversial weed-killer, in 14 of Germany’s most popular beers. These findings are a potential blow to Germany’s Beer Purity Law, which is highly regarded in German beer culture. Industry and German government immediately sought to downplay the results, saying that the levels found did not pose a risk to humans. However, according to the study’s results, all levels found were above the glyphosate residue level allowed in drinking water. Consumers have a right to be worried about the findings, as glyphosate was classified in March 2015  as a probable carcinogen by the International Agency for Research on Cancer (IARC). The results, published  in German, are broken down by beer and by micrograms per liter in picture format. The researchers cite the laboratory test results of the 14 beers, which found glyphosate levels  between 0.46 and 29.74 micrograms per liter. The highest reading is 300 times the legal limit for drinking water in Germany, which is 0.1 microgram per cubic meter. Colorado Legislature Considers Pesticide-Free Marijuana Bill

(Beyond Pesticides February 24, 2016) Last Friday, Colorado’s House Public Health Care and Human Services Committee heard a proposal to create a contaminant-free certification system for marijuana sold within the state. This program, intended to resemble the federal National Organic Program, was offered as a legislative response to protect consumers after the Colorado Department of Agriculture (CDA) failed to implement meaningful regulations to keep marijuana users within the state safe from the harms associated with unregulated pesticides use on cannabis crops. If the proposal moves forward, Colorado will becomes the first state to establish and regulate an organic label in its marijuana  industry, paving the way for other states with legalized marijuana industries to follow suit. Massachusetts and New Hampshire require that cultivation practices are consistent with USDA national organic standards. “Consumers have a right to know what they’re putting in their body,” said Colorado Rep. Jonathan Singer, co-sponsor of HB16-1079, which requires that CDA set up an independent program to certify that cannabis sold in the state is pesticide-free. Scientists Express Concern Over Widespread Use of Glyphosate-Based Herbicides

(Beyond Pesticides, February 22, 2016) A scientific review was released last week by a group of fourteen scientists in which they expressed concern over the widespread use of glyphosate-based herbicides (GBHs), the lack of understanding regarding human exposure, and the potential health impacts. Along with the reasons for concern, the scientific panel called for increased government scrutiny of glyphosate and further testing. In an excerpt from the review, the scientists’ state that,“A thorough and modern assessment of GBH toxicity will encompass potential endocrine disruption, impacts on the gut microbiome, carcinogenicity, and multigenerational effects looking at reproductive capability and frequency of birth defects.” The study, published in the journal Environmental Health, was authored by 14 health scientists mostly from universities. Pete Myers, founder and chief scientist at Environmental Health Sciences is the lead author of the report. “It’s time to call on the global science and regulatory community to step back and take a fresh look at glyphosate since everyone on the planet is or will be exposed,” said senior author Charles Benbrook, an agricultural economist and consultant at Benbrook Consulting Services. Hazards Linked to Still Unregulated Pesticide Mixtures

(Beyond Pesticides, February 19, 2016) Pesticide mixtures are more harmful than individual pesticides, according to a University of California, Los Angeles (UCLA) study that focuses on three commonly used fumigants — chloropicrin, Telone, and metam salts. The study also concludes that, while California law requires the Department of Pesticide Regulations (DPR) and county agricultural commissioners to assess these kinds of cumulative risks when regulating pesticides, they have so far failed to do so. The report, titled Exposure and Interaction — The Potential Health Impacts of Using Multiple Pesticides: A Case Study of Three Commonly Used Fumigants, was published by the Sustainable Technology and Policy Program, based in the UCLA School of Law and the UCLA Fielding School of Public Health. Congressional Reps Want EPA Review of Glyphosate-2,4-D Mixture Enlist Duo

(Beyond Pesticides, February 18, 2016) Last week, 35 members of Congress, led by Representatives Earl Blumenauer (OR-3) and Peter DeFazio (OR-4), signed a letter to Environmental Protection Agency (EPA) Administrator Gina McCarthy, challenging  EPA’s review process for the  glyphosate  and  2,4-D  herbicide mixture, known as Enlist Duo. It is produced by Dow AgroSciences for use in genetically engineered  crops. The letter requests “more information about EPA’s plan to reevaluate Enlist Duo’s health and environmental risks.” The letter comes just weeks after the 9th U.S. Circuit Court of Appeals denied a request from EPA to vacate its own decision to  approve the  toxic herbicide cocktail. Because of the court’s decision, EPA is solely responsible for the decision about Enlist Duo’s registration. “This is part of a vicious cycle that is leading to more potent, dangerous chemicals being widely used on crops across the United States,” said  Rep. Hawaii Pesticide Disclosure Bill Passes Committee

(Beyond Pesticides February 10, 2016) Last week Hawaii’s House Energy and Environmental Protection Committee, chaired by Representative Chris Lee, unanimously passed a measure to require large-scale, outdoor commercial agricultural businesses to publicly disclose outdoor application of pesticides in various environmentally sensitive areas. House Bill 2574  will  make the reporting guidelines for the voluntary Kauai program mandatory across the state and will  also establish “disclosure and public notification requirements for outdoor applications of pesticides in and in the proximity of schools, health care facilities, child care facilities, elder care facilities, and other environmentally sensitive areas,” according to the bill. The bill’s next step is the Agriculture Committee, where chair Representative Clift Tsuji has killed pesticide-related bills in the past. House Bill 2574 is the latest in a string of laws proposed by local and state governments within Hawaii to try to  protect citizens from the harms of toxic pesticides. In 2015, Hawaiian legislators proposed House Bill 1514  to establish school and hospital buffer zones. Bayer Refuses to Cancel Insecticide Toxic to Aquatic Life

(Beyond Pesticides, February 9, 2016) Last week, Bayer CropScience reneged on an agreement with the U.S. Environmental Protection Agency (EPA) to voluntarily cancel the conditionally registered insecticide flubendiamide if  the agency  received  data that  identified adverse ecological effects. Based on the data, EPA found that the chemical causes “unreasonable adverse effects” to benthic organisms living in sediment near agricultural fields. Bayer’s defiance in the face of EPA’s finding  points to  a fundamental  weakness in  the agency’s conditional pesticide registration process, which allows toxic chemicals onto the market without a complete and comprehensive assessment  of their  potential  harm, in this case to  wildlife and the vital ecosystem services they provide. In 2008, EPA granted Bayer a “conditional” registration for flubendiamide, a classification that allows a new pesticide to be registered and used in the field, despite outstanding data points on its toxicological impact. Monsanto’s Glyphosate (RoundUp) Reported Most Used Herbicide Globally

(Beyond Pesticides, February 5, 2016) According to a report published earlier this week, Trends in glyphosate herbicide use in the United States and Globally, glyphosate, manufactured by Monsanto and known by its product name Roundup, is the most widely and heavily applied weed-killer in the history of chemical-intensive agriculture both in the U.S. and globally. Charles Benbrook, Ph.D., author of the study, which was published in the peer-reviewed journal Environmental Sciences Europe, reports that to date 18.9 billion pounds (8.6 billion kilograms) of glyphosate have been used globally, with an estimated 19% of the use coming from the U.S. The report also points out that glyphosate use has risen almost 15-fold since “Roundup Ready” genetically engineered crops (GE) were introduced in 1996. Dr. Benbrook’s research concludes that, “Genetically engineered herbicide-tolerant crops now account for about 56 % of global glyphosate use. Court Rejects EPA’s Bid to Revoke Use of Dow’s 2,4-D/Glyphosate (Enlist Duo) Pesticide in GE Crops

(Beyond Pesticides, January 29, 2016) This week, the 9th U.S. Circuit Court of Appeals handed a victory to Dow Chemical Company and its  efforts to keep the toxic pesticide Enlist Duo on the market, despite new safety concerns identified by the Environmental Protection Agency (EPA).  Enlist Duo has been marketed as a “solution” for the control of glyphosate-resistant weeds in genetically engineered (GE) crops, brought on by the  widespread use of Monsanto’s  Roundup  on glyphosate-tolerant (Roundup Ready) crops over the last decade. EPA asked the court at the end of November, 2015 to vacate its 2014 approval of Enlist Duo based on new information on the  toxic effects associated with the synergistic interactions of  the chemical cocktail of 2,4-D, glyphosate, and other undisclosed ingredients in the product to plants outside the treated area, including endangered plants. The three-sentence order, which does not include  the judge’s reasoning, denied EPA’s request. Oregon Proposes Legislation to Protect Farmers and Consumers from GE Contamination

(Beyond Pesticides, January 28, 2016) Last week, Oregon Representative Paul Holyey introduced legislation that would protect traditional crops against contamination from their genetically engineered counterparts. As it stands, local governments are preempted (disallowed) from taking actions that protect traditional farmers from contamination by genetically engineered (GE) crops. With the help of advocates representing family farms and food safety, The Transgenic Contamination Prevention Bill (HB 4122) will  repeal sections of Senate-passed  Bill 863,  which  preempts local governments, and restore the  right of local jurisdictions to regulate the planting of GE  seed. The law, Bill 863, dubbed  Oregon’s Monsanto Protection Act by environmentalists, farmers and consumers, was passed in 2013 and signed into law by then-Governor John Kitzhaber. The new language in HB 4122 seeks to correct the chemical company-driven legislation of the former bill and restore protection for traditional and organic farmers. In May, 2014, the voters of Jackson and Josephine Counties, Oregon, passed a ballot initiative, Genetically Modified Organism Ban, Measure 15-119, which sparked the backlash in the state legislature. Monsanto Sues to Keep Glyphosate off California List of Carcinogens

(Beyond Pesticides, January 25, 2016) Monsanto filed a lawsuit in California last week seeking to prevent glyphosate, the main ingredient in its Roundup herbicide, from being added to California’s  list of known carcinogens under the state’s Safe Drinking Water and Toxic Enforcement Act of 1986 (Proposition 65). Glyphosate is  classified  as a probable carcinogen by the World Health Organization’s International Agency for the Research of Cancer (IARC) based on sufficient  evidence  of carcinogenicity in experimental animals. This is the highest level carcinogen based on laboratory animal studies  under  IARC’s rating system. California law requires the state to keep a list of cancer-causing chemicals to inform residents of their risks. California Office of Environmental Health Hazard Assessment (OEHHA) said in September that it planned to add glyphosate to the list after the World Health Organization’s International Agency for Research on Cancer (IARC) classified it as a probable human carcinogen last March. Monsanto has disputed the assessment, citing decades of studies deeming glyphosate safe, including a 2007 study by OEHHA that concluded the chemical was unlikely to cause cancer. Oregon, Colorado Move Forward in Regulating Pesticides on Marijuana

(Beyond Pesticides January 22, 2016) Last week, the Oregon Department of Agriculture (ODA) released a list of pesticide products available for use on marijuana cultivated within the state. The list, which contains 257 pesticide products, aligns with similar product lists published by Washington State and Colorado, and raises the same concerns over the allowance of products that violate the Federal Insecticide, Fungicide and Rodenticide Act (FIFRA) and have not been subject to health evaluations of public exposure to the pesticides used. Those concerns were on full display last week in Colorado, when the Colorado Department of Agriculture (CDA) held a public meeting to discuss amendments to its Pesticide Applicators’ Act that would allow growers to use pesticides that violate FIFRA. Additionally, in an attempt to address consumers’ concerns over the issue of unregulated pesticides in marijuana, two lawmakers in Colorado introduced a bill that would establish a program for certifying marijuana as “pesticide free” within the state. Canada Discontinues Conditional Registrations For New Pesticides

Major Supermarket Bans Bee-Toxic Pesticides in Produce Production

 (Beyond Pesticides, January 20, 2016) Aldi SĂĽd, the German supermarket chain with stores in the U.S., has become the first major European retailer to ban pesticides toxic to bees, including the neonicotinoids imidacloprid, clothianidin and thiamethoxam, from fruits and vegetables produced for their stores. Aldi has requested suppliers comply at the earliest possible time. In light of the growing pollinator crisis and due to public pressure, retailers in Europe and the U.S. are slowly beginning to make the switch away from bee-toxic pesticides. Beginning January 1, suppliers of fruits and vegetables to Aldi suppliers will have to ensure that their cultivation practices do not include the following eight pesticides identified as toxic to bees (thiamethoxam, chlorpyrifos,  clothianidin, cypermethrin, deltamethrin, fipronil, imidacloprid and sulfoxaflor) to meet  the new requirement. According to a press release from Greenpeace, the chemicals are used on various commodities in Europe  —thiamethoxam (used in lettuce and endive), chlorpyrifos, clothianidin (used in kohlrabi, herbs, Brussels sprouts, head cabbage, cauliflower and kale), cypermethrin (leek, head cabbage and leguminous vegetables), deltamethrin (cauliflower, peppers, eggplant, zucchini, cucumber, pea, head cabbage, tomato and lettuce),  imidacloprid (applied to apples, peaches, apricots and lettuce). Bayer Concurs with EPA Findings on Certain Neonicotinoid Hazards to Honey Bees

(Beyond Pesticides, January 14, 2016) Bayer CropScience, revising its stance,  has decided to concur with the  Environmental Protection Agency’s (EPA) preliminary risk assessment of neonicotinoids and acknowledge the finding of harm to honey bees in certain crops. A spokesman for Bayer CropScience said the neonic-selling giant has reviewed the assessment and found it to be “quite good and scientifically sound,” according to a news report.  The Guardian  is reporting that Bayer will be proposing new protections for pollinators, however the company has not yet announced what the new protections will be. This is a stark turnaround from  Bayer’s statement last week, which said EPA’s assessment “appears to overestimate the potential for harmful exposures in certain crops, such as citrus and cotton, while ignoring the important benefits these products provide and management practices to protect bees.” Last week, EPA released its preliminary honey bee risk assessment for one of the most widely used neonicotinoids, imidacloprid, which is  linked to severely declining honey bee populations. WA Oyster Growers Request Approval to Spray Neonicotinoid Pesticides in Bay, Despite Public Opposition

(Beyond Pesticides, January 13, 2016) Last Friday, the Willapa Grays Harbor Oyster Growers Association (WGHOGA) in Washington State sent a 71-page request to the Washington Department of Ecology (Ecology) asking state regulators to approve  a permit to  spray neonicotinoid insecticides  that are having devastating effects on the ecosystems worldwide. Yet, WGHOGA is pursuing a single-minded approach to chemically control the shrimp that are hurting their oyster crops, while using chemicals that the preponderance of science finds cause ecosystem imbalance. In  April 2015, much to the dismay of activists and concerned local residents, Ecology approved a permit for the use of imidacloprid (a neonicotinoid) to combat a growing native population of burrowing shrimp that threatens  valuable shellfish (oyster) beds in Willapa Bay and Grays  Harbor. But, with a  nationwide public outcry, the permit was withdrawn in May 2015. Campbell Soup Says GE Food Is Safe, Endorses Mandatory GE Labeling to Preempt States with Weak Language

(Beyond Pesticides, January 12, 2016) Late last week in a precedent-setting move, Campbell Soup Company announced its support for federal mandatory labeling of foods containing genetically engineered (GE) ingredients. If such labeling does not come soon, the company also indicated it is prepared to voluntarily label all products it produces that  contain GE ingredients. Agri-Pulse reported, “Campbell made clear that it still supported the use of genetic engineering in agriculture but said that there is a need for national labeling standards that would preempt state standards.” Campbell’s President and CEO Denise Morrison, ““I want to stress that we’re in no way disputing the science behind GMOs or their safety. The overwhelming weight of scientific evidence indicates that GMOs are safe and that foods derived from crops using genetically modified seedsare not nutritionally different from other foods,” Morrison wrote.” Ms. Morrison said that the company is against a patchwork of regulation across the states.  In its release Campbell issues a sample label, which states:  “Partially produced with genetic engineering. UK Researchers Find Bee-Killing Pesticide Cocktail in Hedgerows and Wildflowers

(Beyond Pesticides, January 11, 2016) Scientists at Sussex University in the United Kingdom (UK) have found that bumble bees and honey bees are exposed to a harmful chemical cocktail when collecting pollen from wildflowers and hedgerows that border neonicotinoid-treated crops in UK farmland. After testing oilseed rape croplands during blooming season, these chemical cocktails were found to be mixed with fungicides and insecticides, and at concentrations much higher than expected.  According to the Soil Association, which supported the study, “These chemical cocktails could make the impact of neonicotinoids up to 1,000 times more potent than previously realized.” With at least 121 different agrochemicals detected in hive wax and pollen samples in the Unites States, most of which include systemic pesticides, it is becoming increasingly more important to study the synergistic effects of pesticides in and outside of farm land. The study focused on “determining which mixtures of commonly used fungicides occur alongside neonicotinoids” and found that all individual oilseed rape pollen samples contained at least six neonicotinoid and fungicide residues.
