Growers of Genetically Engineered Corn Violate EPA Planting Restrictions

(Beyond Pesticides, November 9, 2009) One out of every four farmers who plants genetically engineered (GE) corn is failing to comply with at least one important insect-resistance management requirement, which increases the likelihood that pesticide-resistant bugs will threaten the future of organic crops, conventional crops and other biotech crops. That finding comes in a new report, Complacency on the Farm, by the Center for Science in the Public Interest (CSPI). According to CSPI, in 2008, 57 percent of the corn acreage in the United States was planted with corn spliced with genes from the Bacillus thuringiensis bacterium, or Bt. Those crops produce natural toxins that are harmless to humans but will kill corn rootworms and corn borers, which otherwise reduce crop yields. Farmers who plant such crops are supposed to plant a refuge of conventional corn in, adjacent to, or near the GE crop. That refuge is designed to reduce the risk that pests that survive the toxin will breed with each other and produce resistant offspring. EPA Proposes New Pesticide Labeling to Control Spray Drift

(Beyond Pesticides, November 5, 2009) The U.S. Environmental Protection Agency (EPA) has rolled out proposed guidance for new pesticide labeling in an effort to reduce off-target spray and dust drift. According to EPA, the actions detailed in the draft Pesticide Registration (PR) Notice on Pesticide Drift Labeling, when implemented, are projected to help improve the clarity and consistency of pesticide labels and help prevent harm from spray drift. The agency is also requesting comment on a petition to evaluate children’s exposure to pesticide drift. Last month, a petition filed by Earthjustice and Farmworker Justice asked EPA to set safety standards protecting children who grow up near farms from the harmful effects of pesticide drift. The groups also asked the agency to adopt an immediate no-spray buffer zone around homes, schools, parks and daycare centers for the most dangerous and drift-prone pesticides. According to the agency, the new instructions are said to prohibit drift that could cause “adverse health or environmental effects,” by evaluating scientific information on risk and exposure based on individual product use patterns on a pesticide-by-pesticide basis. Scientists Again Raise Health Concerns about Use of Toxic Fumigant Methyl Iodide

(Beyond Pesticides, October 28, 2009) Transcripts released last week from an external peer review panel convened in September to evaluate California’s Department of Pesticide Regulation’s (DPR) risk assessment of the fumigant methyl iodide show that the panel’s leading scientists have serious concerns about this chemical. Methyl iodide is currently being considered for use on California’s crops, especially strawberries. The scientific panel held a public workshop, entitled “Methyl Iodide External Peer Review Panel Workshop,” on September 24-25, 2009 in Sacramento, CA as part of an additional, external peer review for methyl iodide. Previously planned public and scientific review processes were subject to cancellation or postponement by the Governor’s office. Led by John Froines, Ph.D., director of the Center for Occupational and Environmental Health at the University of California, Los Angles, the panel consisted of eight experts in various scientific fields. The scientists expressed concern over inadequate buffer zones, ground water contamination and drinking water exposures, body burden, neuro-degeneration, reproductive toxicity and carcinogenicity that are associated with methyl iodide use and exposures. EPA Announces New Scientific Evaluation of Atrazine

(Beyond Pesticides, October 8, 2009) The U.S. Environmental Protection Agency (EPA) announced that it will launch a comprehensive new evaluation of the pesticide atrazine to determine its effects on humans this fall. At the end of this process, the agency will decide whether to revise its current risk assessment of the pesticide and whether new restrictions are necessary to better protect public health. This announcement follows recent scrutiny and findings that the current EPA regulation of atrazine in water is inadequate. In August this year, the Natural Resources Defense Council (NRDC) published a report, Poisoning the Well which found that the commonly used herbicide atrazine can spike at extremely high levels which go undetected by regular monitoring. Concurrently, The New York Times published an investigative piece based on the NRDC findings and confirmed that the public is not informed when reports of these spikes of atrazine in drinking water occur. One of the most widely used agricultural pesticides in the U.S., atrazine can currently legally be applied before and after planting to control broadleaf and grassy weeds. EPA Announces Greater Public Participation In Pesticide Registrations

(Beyond Pesticides, October 7, 2009) The U.S. Environmental Protection Agency (EPA) is establishing a new transparent process that will allow the public to review and comment on risk assessments and proposed registration decisions for pesticides. This expanded process will apply to all new pesticide active ingredients and first food uses, first outdoor uses, and first residential uses. It is not clear at this writing whether the agency will at the same time release the underlying test data on potential adverse health effects that companies submit for product registration. Starting October 1, 2009, the public will be able to review and comment on the risk assessments and proposed registration decisions for certain pesticide registration actions. Upon receiving a complete application for registration for a new pesticide active ingredient or a new use of an already registered active ingredient, EPA will publish a Federal Register Notice of Receipt, establish a case docket in regulations.gov, and open an initial 30-day public comment. Following the comment period, EPA will publish its decision and a response-to-comment document. Genetically Engineered Beets Unlawful

(Beyond Pesticides, September 28, 2009) In a case brought by Center for Food Safety (CFS) and Earthjustice representing a coalition of farmers and consumers, a federal court ruled September 23, 2009 that the Bush Administration’s approval of genetically engineered (GE) “RoundUp Ready” sugar beets was unlawful. In this case, Center for Food Safety v. Vilsack, No. C 08-00484 JSW (N.D. Cal. 2009), the court ordered the U.S. epartment of Agriculture (USDA) to conduct a rigorous assessment of the environmental and economic impacts of the crop on farmers and the environment. The decision follows on the heels of a June 2009 decision from the Ninth Circuit Court of Appeals affirming the illegality of the USDA’s approval of Monsanto’s genetically engineered alfalfa. The federal district court for the Northern District of California ruled that the USDA’s Animal and Plant Health Inspection Service (APHIS) violated the National Environmental Policy Act (NEPA) when it failed to prepare an Environmental Impact Statement (EIS) before deregulating sugar beets that have been genetically engineered (GE) to be resistant to glyphosate herbicide, marketed by Monsanto as Roundup. Utility Company Sued Over Pollution from Toxic Wood Poles

(Beyond Pesticides, September 21, 2009) In a federal lawsuit filed in San Francisco earlier this month, the environmental watchdog group Ecological Rights Foundation (ERF) claims that dioxin is being discharged from Pacific Gas and Electric Company’s (PG&E) utility poles into the San Francisco Bay, violating both the Clean Water Act and the Resource Conservation and Recovery Act. Dioxin is a contaminant in the wood preservative pesticide pentachlorophenol (penta), the chemical used to treat more than one million PG&E utility poles in Northern California. Dioxin is a known human carcinogen. It also causes birth defects at extremely low levels. The ERF suit asks the court to stop PG&E from discharging dioxin from its utility poles, a move that could eventually lead to wide scale replacement of the ubiquitous penta-treated wood poles. “These are the common, I guess you could say ‘classic,’ brown wood poles you see holding up wires on practically every street,” says ERF attorney Bill Verick. Nanotech Enabled Consumer Products Continue to Grow

Over 1,000 nanotechnology-enabled products have been made available to consumers around the world, according to the Project on Emerging Nanotechnologies (PEN). The most recent update to the group’s three-and-a-half-year-old inventory reflects the increasing use of the tiny particles in everything from conventional products like non-stick cookware, to antibacterial clothing and sporting supplies. Health and fitness items continue to dominate the PEN inventory, representing 60 percent of products listed. More products are based on nanoscale silver””used for its antimicrobial properties””than any other nanomaterial; 259 products (26 percent of the inventory) use silver nanoparticles. “The use of nanotechnology in consumer products continues to grow rapidly,” says PEN Director David Rejeski. “When we launched the inventory in March 2006 we only had 212 products. If the introduction of new products continues at the present rate, the number of products listed in the inventory will reach close to 1,600 within the next two years. Pesticide-Chemical Mixtures Affect Sex Organ Development

(Beyond Pesticides, July 28, 2009) A new study by researchers at the National Food Institute, Technical University of Denmark shows that exposure to a mixture of pesticides and other chemicals has a synergistic effect on the development of male sex organs. Synergy occurs when the effect of multiple chemicals is greater than the sum of the individual effects. The study, “Synergistic Disruption of External Male Sex Organ Development by a Mixture of Four Antiandrogens,” was published July 15, 2009 in the online edition of Environmental Health Perspectives. The researchers designed their study to determine the consequences of simultaneous exposure to multiple “antiandrogens.” An antiandrogen, or androgen antagonist, is any of a group of hormone receptor antagonist compounds that are capable of preventing or inhibiting the biologic effects of androgens, male sex hormones, on normally responsive tissues in the body. Disrupting the action of androgens during gestation, certain chemicals present in food, consumer products and the environment can induce irreversible malformations of sex organs among male offspring. California Governor Could Force Methyl Iodide Registration

(Beyond Pesticides, July 13, 2009) With the stroke of a pen, Governor Arnold Schwarzenegger could bow to industry interests and force the California Department of Pesticide Regulation to register a new fumigant pesticide, methyl iodide. Highly toxic, and not approved for use in California, this chemical has been given a comprehensive review by the state’s own Department of Pesticide Regulation (DPR) and found to be one of the riskiest pesticides in existence. Scientists familiar with methyl iodide are asking Mr. Schwarzenegger to let science, rather than political pressure, guide this decision. “Methyl iodide is so toxic that scientists working with it in the laboratory take extreme precautions when handling it, using a ventilation hood, gloves, and special equipment for transferring it so it does not escape to the air,” notes Susan Kegley, Ph.D., a chemist and consulting scientist for Pesticide Action Network North America. “This degree of protection is not possible in an agricultural setting where the pesticide would be applied at rates of 175 pounds per acre in the open air. EPA Proposes Pesticides Restrictions in Endangered Species Settlement

(Beyond Pesticides, July 6, 2009) Last week, the U.S. Environmental Protection Agency (EPA) proposed to formally evaluate the harmful effects of 74 pesticides on 11 endangered and threatened species in the San Francisco Bay Area over the next five years, and to impose interim restrictions on use of these pesticides in and adjacent to endangered species habitats. Pesticide Exposure Increases Risk to Multiple Myeloma

(Beyond Pesticides, June 16, 2009) A study involving 678 individuals who apply pesticides, culled from a U.S. Agricultural Health Study of over 50,000 farmers, recently found that exposure to certain pesticides doubles one’s risk of developing an abnormal blood condition called MGUS (monoclonal gammopathy of undetermined significance) compared with individuals in the general population. The disorder, characterized by an abnormal level of a plasma protein, requires lifelong monitoring as it is a pre-cancerous condition that can lead to multiple myeloma, a painful cancer of the plasma cells in the bone marrow. Will Deadly Pesticide’s Continued Use with Limitations Protect an Endangered Species?

(Beyond Pesticides, May 6, 2009) The U.S. Environmental Protection Agency (EPA), in consultation with the U.S. Fish and Wildlife Service (USFWS), is imposing use restrictions for the insecticide methoxyfenozide on cranberries in Wisconsin because of its potential effect on the Karner Blue butterfly. The Karner Blue butterfly is a federally listed endangered species. It remains to be seen whether, short of a ban, the complex and difficult to enforce restrictions on use and application methods will adequately protect the endangered species. The limitations for methoxyfenozide are contained in a series of county-specific Endangered Species Protection Bulletins (Bulletins) as part of EPA’s Endangered Species Protection Program (ESPP). EPA entered into consultation with USFWS after determining that use of methoxyfenozide on cranberries in Wisconsin may affect the listed Karner Blue butterfly. USFWS recommended a number of use limitations that, when implemented, should result in use that is not likely to adversely affect the Karner Blue butterfly, according to the bulletin. Germany Bans Monsanto’s GE Corn

(Beyond Pesticides, April 15, 2009) Stating that it represents a danger to the environment, Germany’s Federal Minister for Nourishment, Agriculture and Consumer Protection, Ilse Aigner, announced an immediate ban on Monsanto’s MON810 genetically engineered (GE) maize yesterday. Claiming the decision is based on science and is an individual case, not a broad banning of all GE crops, Ms. Aigner stated, “Genetic engineering must include a complete guarantee of the security for person, animal, plant and environment.” Environmentalists, scientists and farmers opposed to GE crops have argued that the corn, which confers resistance to pests, could pollute other crops and pose a threat to the environment and human health. The debate over the use of GE crops in Europe has been ongoing for at least a decade. MON810 maize, brand name YieldGard, is the only GE crop currently cultivated in the European Union (EU). Under EU laws, countries are allowed to ban individual GE crops for environmental and health reasons. Currently, Hungary, France, Austria, Greece and Luxembourg ban MON810 maize. Take Action: Support Chemical Security Reform

(Beyond Pesticides, April 9, 2009) On April 2, 2009, Greenpeace USA, joined by Beyond Pesticides and others, sent a letter (Senate, House) urging Congress to pass comprehensive chemical security reform. Beyond Pesticides believes chemical security is an important step, but only one piece of larger chemical reform, which would ban toxic chemical production when safer products and practices exist. According to the coalition, U.S. pesticide and other chemical plants remain one of the sectors of America’s infrastructure most vulnerable to accidents and terrorist attacks. The Department of Homeland Security (DHS) has identified approximately 7,000 high-risk U.S. chemical facilities. However, unless Congress replaces a flawed temporary law with a comprehensive chemical security program, millions of Americans will remain at risk. The statute Congress passed in 2006 temporarily authorized “interim” regulations that are wholly inadequate to protect communities. Furthermore these rules expire on October 4, 2009 leaving the 111th Congress only six months to enact truly protective legislation. Congress must pass comprehensive legislation before the temporary law expires. USGS Survey Finds Pesticides, Fertilizers in Well Water

(Beyond Pesticides, March 31, 2009) More than 20 percent of private domestic wells sampled nationwide contain at least one contaminant at levels of potential health concern, according to a study by the U.S. Geological Survey (USGS). About 43 million people – or 15 percent of the Nation’s population – use drinking water from private wells, which are not regulated by the federal Safe Drinking Water Act. USGS scientists sampled about 2,100 private wells in 48 states and found that the contaminants most frequently measured at concentrations of potential health concern were inorganic contaminants, including radon and arsenic. These contaminants are mostly derived from the natural geologic materials that make up the aquifers from which well water is drawn. Nitrate was the most common inorganic contaminant derived from man-made sources””such as from fertilizer applications and septic-tanks””that was found at concentrations greater than the federal drinking-water standard for public-water supplies (10 parts per million). Nitrate was greater than the standard in about four percent of sampled wells. Federal Court Stops GE Crop Planting on Wildlife Refuges

(Beyond Pesticides, March 27, 2009) A federal court has ordered the U.S. Fish & Wildlife Service to stop planting genetically engineered (GE) crops on its Prime Hook National Wildlife Refuge in Delaware. While the ruling is limited to Prime Hook, the lawsuit may serve as a model for similar litigation at more than 80 other national wildlife refuges now growing GE crops across the country. European Union Completes 16-Year Review of Pesticides

(Beyond Pesticides, March 20, 2009) On March 12, the European Commission said it made an important step forward in its efforts to ensure improved protection of human health and the environment, as it completed the review of existing pesticides that were on the market before 1993. This program concerned about 1,000 substances contained in tens of thousands of products that were on the market in 1993. All reviewed pesticides have undergone a detailed risk evaluation with respect to their effects on humans and on the environment. The review is a joint effort by the Commission, the European Food Safety Authority (EFSA) and the EU Member States. EU Health Commissioner Androulla Vassiliou said: “Today represents a milestone in our effort to ensure improved protection of human health and the environment. The review of existing pesticides has lead to the removal from the market of more than two thirds of these substances. EPA Releases Database on Environmental Chemicals, Exposes Data Gaps

(Beyond Pesticides, March 18, 2009) The U.S. Environmental Protection Agency (EPA) has released a new online database that collects information on more than 500,000 synthetic chemicals from over 200 public sources. The Aggregated Computational Toxicology Resource (ACToR) database provides access to hundreds of data sources in one place, enabling easy access for environmental researchers, scientific journalists and the public. However, more than half of these chemicals do not have any detailed testing data. ACToR, which is actually a collection of databases, was developed to support the ToxCast program of the EPA National Center for Computational Toxicology (NCCT). European Union Backs Austrian and Hungarian Bans on GM Crops

(Beyond Pesticides, March 17, 2009) Earlier this month, European Union environment ministers overwhelmingly rejected a European Commission proposal to force Austria and Hungary to lift their bans on the controversial cultivation of varieties of genetically modified (GM) corn. Over 20 member states voted against the Commission proposal. Hungary can maintain its ban on Monsanto’s GM maize MON810, and Austria on MON810 and Bayer’s T25. “This is a victory for the environment, farmers and consumers, and a major embarrassment for the Commission. For the fourth time, EU governments have rejected a Commission proposal to lift national bans on GM crops. What part of ‘no’ does the Commission not understand?” said Marco Contiero, Greenpeace EU GMO policy director. Austrian and Hungarian scientific authorities have recently supplied new evidence supporting their national bans showing that MON810 maize – the only GMO currently cultivated in the EU – is likely to have harmful environmental effects. Data Supports Eating Organic for a Safer Diet and Environment

(Beyond Pesticides, March 12, 2009) An updated database on pesticide residues on chemically-produced food released by the Environmental Working Group (EWG) supports one of the important benefits of eating organically produced and processed food –a safer diet. At the same time, consumers choosing organic food support production practices that: (i) ensure cleaner air and water; (ii) improve soil health and sustainability; (iii) reduce escalating global warming; (iv) protect bees and other pollinators; and, (v) create safer workplaces for those who grow and harvest food. When organic foods are not easily accessible due to cost or availability, Beyond Pesticides recommends that consumers buy organically produced commodities for those foods they eat most often (e.g. children’s juice) and for those foods that contain the greatest amount of pesticides. EWG’s recently released 5th edition Shopper’s Guide to Pesticides is a tool to help individuals avoid produce containing the highest amount of pesticides. However, research indicates that regulators know much less than they should and do not collect residue data on most of pesticides’ toxic breakdown products (metabolites), inert ingredients, and contaminants. Pesticides in Combination Shown to Increase Endangered Salmon Threat

(Beyond Pesticides, March 5, 2009) A new study published in the March 2009 issue of Environmental Health Perspectives finds that pesticide combinations cause more harm to endangered salmon than ndividual pesticide exposure. This means that single-pesticide risk assessments required by the Environmental Protection Agency (EPA) inadequately assess hazards. Mixtures of organophosphate and carbamate pesticides are commonly detected in freshwater habitats that support threatened and endangered species of Pacific salmon. According to the researchers from the National Oceanic and Atmospheric Administration (NOAA) Fisheries and Washington State University, these pesticides inhibit the activity of acetylcholinesterase (AChE) and thus have potential to interfere with behaviors that may be essential for salmon survival. The researchers measured brain AChE inhibition in juvenile coho salmon exposed to sublethal concentrations of the organophosphates diazinon, malathion, and chlorpyrifos, as well as the carbamates carbaryl and carbofuran. The pesticides were tested individually and in combination. They plotted AChE levels on a curve to determine whether the toxicologic responses to binary mixtures were additive, antagonistic (lesser than additive) effect, or synergistic (greater than additive). EPA Fines Importer For Selling Illegal Pesticide Products

(Beyond Pesticides, February 26, 2009) On February 24, the U.S. Environmental Protection Agency settled with an Oakland, California, importer for $61,000 for allegedly selling and distributing illegal mothballs, a violation of federal pesticide laws. The importer is accused of distributing unregistered naphthalene mothballs from imported from Taiwan. Venquest Trading, imported unregistered naphthalene mothballs from Taiwan and distributed them to retailers in California and the Pacific Northwest on 241 separate occasions. EPA’s Pacific Northwest region first discovered the company’s violations during a marketplace initiative to uncover illegal pesticide products. The agency’s Pacific Southwest office later conducted an inspection and uncovered violations at Venquest’s Oakland warehouse. “Without proper labeling and registration, these illegal pesticides pose a serious threat to human health, particularly children’s health, who can mistake the mothballs for candy,” said Katherine Taylor, associate director of the EPA’s Communities and Ecosystems Division for the Pacific Southwest region. “Importing unregistered pesticides is a serious violation, as the registration process ensures we know what the pesticide contains, and that it is properly labeled with precautionary statements and directions for use.” EPA has fined more than a dozen companies over the last several years for selling illegally imported mothballs.
