EPA Opens Public Comment Period on Uncertainty Factor in Pesticide Risk Analyses

(Beyond Pesticides, December 10, 2009) Following news that the Environmental Protection Agency (EPA) is considering a higher uncertainty factor in all pesticide risk determinations, the agency is making available for comment a policy paper entitled “Revised Risk Assessment Methods for Workers, Children of Workers in Agricultural Fields, and Pesticides with No Food Uses.” The paper describes how EPA will assess pesticide risks not governed by Food Quality Protection Act (FQPA) amendments to the Federal Food, Drug and Cosmetic Act (FFDCA). EPA describes its proposal as incluing a more thorough assessment of risks to workers, including farmworkers and farm children, as well as risks posed by pesticides that are not used on food. The agency is asking the public to comment on the new approach and how best to implement the improvements. “Better information and applying these tools will strengthen EPA’s protections for farm workers exposed to these chemicals, and children living in and around the areas of highest possible exposure,” says EPA Administrator Lisa P. Study Links Rhinitis to Pesticide Exposure

(Beyond Pesticides, December 1, 2009) A new study published in the November 2009 issue of Occupational and Environmental Medicine, adds rhinitis, the inflammation of the mucous lining of the nose, to the long list of ailments linked to pesticide exposure. “Rhinitis associated with pesticide exposure among commercial pesticide applicators in the Agricultural Health Study,” examined data from 2,245 Iowa commercial pesticide applicators and evaluated the association between rhinitis and 34 pesticides used in the past year. Seventy-four percent of commercial pesticide applicators in the study reported at least one episode of rhinitis in the past year (current rhinitis), compared with about 20-30% of the general population. Pesticide exposure and rhinitis were assessed at enrollment using two self-administered questionnaires. The first, completed at enrollment, obtained detailed information on use of pesticides on the market at the time of enrolment as well as smoking history, current agricultural activity and demographics. The second questionnaire, sent one month later, more detailed information on the pesticides, as well as medical history, including rhinitis, conjunctivitis, sinusitis and asthma. EPA Considers Higher Uncertainty Factor in All Pesticide Risk Determinations

(Beyond Pesticides, November 24, 2009) The Environmental Protection Agency (EPA) is considering expanding to all pesticides the use of what is typically referred to as the Food Quality Protection Act (FQPA) safety factor (the allowable margin of error or the uncertainty factor in risk determinations), which is currently only applied to the agency’s pesticide evaluations for infants and children. Under the plan the increased uncertainty factor will be applied to other sensitive populations, including farmworkers. Beyond Pesticides learned of the plan through communications with the agency over the past several months. EPA officials told Beyond Pesticides that, under the Obama Administration leadership, the agency would like to apply an equal standard to all people living in the U.S. Beyond Pesticides called on the Obama Administration to protect farmworkers and their children in the Transforming Pesticide Policy document sent after the 2008 election to President Obama’s transition team and top agency officials. Report Finds GM Crops Increase Pesticide Use and Resistant Weeds

(Beyond Pesticides, November 18, 2009) A report released yesterday and authored by Charles Benbrook, PhD, chief scientist at The Organic Center (TOC), finds that the rapid adoption by U.S. farmers of genetically modified corn, soybeans and cotton has promoted increased use of pesticides, an epidemic of herbicide-resistant weeds, and more chemical residues in foods. The report, “Impacts of Genetically Engineered Crops on Pesticide Use in the United States: The First Thirteen Years,” explores the impact of the adoption of genetically modified (GM) corn, soybean, and cotton on pesticide use in the United States, drawing principally on data from the U.S. Department of Agriculture (USDA). The most striking finding, is that GM crops have been responsible for an increase of 383 million pounds of herbicide use in the U.S. over the first 13 years of commercial use of GE crops (1996-2008). The report identifies, and discusses in detail, the primary cause of the increase–the emergence of herbicide-resistant weeds. Growers of Genetically Engineered Corn Violate EPA Planting Restrictions

(Beyond Pesticides, November 9, 2009) One out of every four farmers who plants genetically engineered (GE) corn is failing to comply with at least one important insect-resistance management requirement, which increases the likelihood that pesticide-resistant bugs will threaten the future of organic crops, conventional crops and other biotech crops. That finding comes in a new report, Complacency on the Farm, by the Center for Science in the Public Interest (CSPI). According to CSPI, in 2008, 57 percent of the corn acreage in the United States was planted with corn spliced with genes from the Bacillus thuringiensis bacterium, or Bt. Those crops produce natural toxins that are harmless to humans but will kill corn rootworms and corn borers, which otherwise reduce crop yields. Farmers who plant such crops are supposed to plant a refuge of conventional corn in, adjacent to, or near the GE crop. That refuge is designed to reduce the risk that pests that survive the toxin will breed with each other and produce resistant offspring. Ireland Passes Policy to Become Genetically Modified Crop-Free

(Beyond Pesticides, November 2, 2009) Ireland has passed a policy banning the cultivation of all genetically modified (GM) crops and introducing a voluntary GM-free label for food — including meat, poultry, eggs, fish, crustaceans, and dairy produce made without the use of GM animal feed as a way “[t]o optimize Ireland’s competitive advantage as a GM-Free country.” The policy is a part of the Renewed Programme for Government agreement that was adopted in October and is supported by many stakeholder groups, including the Irish Cattle and Sheepfarmers Association who have been working on this issue since 2004. The passage of the policy is at a time when the international market for GM-free animal produce is growing rapidly. Across Europe, hundreds of leading food brands and dozens of leading retailers now offer premium meat, fish, eggs, poultry eggs and dairy produce made without the use of GM feedstuffs. These are backed by GM-free labels and Government regulations in Austria, Italy, Germany, with France to follow later this year. U.S. Court Reverses Judgment Against Dole and Dow Chemical for Sterile Banana Workers

(Beyond Pesticides, October 27, 2009) U.S. District Judge Paul Huck (Miami) has said a multimillion dollar judgment against U.S. food giant Dole and the Dow Chemical Company cannot be enforced because, “[T]he judgment was rendered under a system which does not provide impartial tribunal or procedures compatible with the requirements of due process of law, and the rendering court did not have jurisdiction over Defendants.” A trial court in Chinandega, Nicaragua, had awarded the money in 2005 to 150 Nicaraguan citizens who believe they were injured by exposure to the pesticide dibromochloropropoane, or DBCP, when they worked on Dole banana plantations between 1970 and 1982. This actiion was taken despite findings in the U.S. that DBCP causes sterility and regulatory action to remove it from the market. The trial court awarded Plaintiffs approximately $97 million under “Special Law 364,” enacted by the Nicaraguan legislature in 2000 specifically to handle DBCP claims. The average award was approximately $647,000 per plaintiff. According to the Nicaraguan trial court, these sums were awarded to compensate plaintiffs for DBCP-induced infertility and its accompanying adverse psychological effects. Biomonitoring Study Detects Toxic Chemicals in Health Care Professionals

(Beyond Pesticides, October 13, 2009) In a first ever investigation of toxic chemicals found in the bodies of doctors and nurses, Physicians for Social Responsibility (PSR) in partnership with American Nurses Association (ANA) and Health Care Without Harm (HCWH) released the Hazardous Chemicals In Health Care report on October 8th. The inquiry found that all of the 20 participants had toxic chemicals associated with health care in their bodies. Each participant had at least 24 individual chemicals present, four of which are on the recently released US Environmental Protection Agency (EPA) list of priority chemicals for regulation. These chemicals are all associated with chronic illness and physical disorders. The Hazardous Chemicals in Health Care report offers preliminary indicators of what the broader health care community may be experiencing. The project tested for 62 distinct chemicals in six categories: bisphenol A, mercury, perflourinated compounds, phthalates, polybrominated diphenyl ethers, and triclosan. The chemicals tested in the investigation are used in products common to the health care setting, from baby bottles, hand sanitizer, and medical gauges, to industrial paints, IV bags and tubes and stain-resistant clothing. Genetically Engineered Beets Unlawful

(Beyond Pesticides, September 28, 2009) In a case brought by Center for Food Safety (CFS) and Earthjustice representing a coalition of farmers and consumers, a federal court ruled September 23, 2009 that the Bush Administration’s approval of genetically engineered (GE) “RoundUp Ready” sugar beets was unlawful. In this case, Center for Food Safety v. Vilsack, No. C 08-00484 JSW (N.D. Cal. 2009), the court ordered the U.S. epartment of Agriculture (USDA) to conduct a rigorous assessment of the environmental and economic impacts of the crop on farmers and the environment. The decision follows on the heels of a June 2009 decision from the Ninth Circuit Court of Appeals affirming the illegality of the USDA’s approval of Monsanto’s genetically engineered alfalfa. The federal district court for the Northern District of California ruled that the USDA’s Animal and Plant Health Inspection Service (APHIS) violated the National Environmental Policy Act (NEPA) when it failed to prepare an Environmental Impact Statement (EIS) before deregulating sugar beets that have been genetically engineered (GE) to be resistant to glyphosate herbicide, marketed by Monsanto as Roundup. U.S. Geological Survey Identifies Intersex Fish Nationwide

(Beyond Pesticides, September 18, 2009) Previously documented in the Potomac River, which flows through downtown Washington, DC, the occurrence of “intersex” fish is now found to be nationwide. U.S. Geological Survey (USGS) researchers published their study, “Widespread occurrence of intersex in black basses from U.S. rivers” in the online edition of Aquatic Toxicology. USGS researchers examined 16 different species of fish across the U.S. between 1995 and 2004. The condition of intersex fish, male fish producing eggs, is most commonly found in smallmouth and largemouth bass. One third of male smallmouth bass and one fifth of the male largemouth bass are intersex. Scientists tested sites in the Apalachicola, Colorado, Columbia, Mobile, Mississippi, Pee Dee, Rio Grande, Savannah, and Yukon River basins. Research shows intersex fish in approximately one-third of all examined sites. The only site where researchers found no intersex fish is the Yukon River basin. Biomonitoring Funding Awarded to Three States

(Beyond Pesticides, September 17, 2009) Last week, the Centers for Disease Control and Prevention (CDC) awarded $5 million to the states of California, New York and Washington to conduct biomonitoring surveys to assess public exposure to chemicals and toxic substances. This will allow the states to determine which environmental chemicals people have been exposed to and how much of those chemicals are in their bodies. Many U.S. residents carry toxic pesticides in their bodies above government assessed “acceptable” levels. Biomonitoring, which measures levels of chemicals directly in people’s blood or urine, has become increasingly helpful for assessing people’s exposure to toxic substances as well as for responding to serious environmental public health problems. The PANNA report “Chemical Trespass: Pesticides in Our Bodies and Corporate Accountability” in 2004, which compiled data from previous CDC biomonitoring surveys found that children, women and Mexican Americans carried the heaviest “pesticide body burden.” Another biomonitoring study by the World Wildlife Fund UK in 2003, revealed that chemicals, such as DDT, which have been banned for decades and are associated with cancer, immune system disorders, and other health problems, are still found in people today. “Biomonitoring measurements are considered the most health-relevant assessments of exposure because […]

Under Legal Pressure, EPA Announces New Plan to Protect Salmon from Pesticides

(Beyond Pesticides, September, 15, 2009) On September 11, 2009, the Environmental Protection Agency (EPA) announced plans to place additional limitations on the use of three organophosphate pesticides ”” chlorpyrifos, diazinon and malathion ”” to protect endangered and threatened salmon and steelhead in California, Idaho, Oregon and Washington. The announcement comes in response to a series of lawsuits brought by Pacific Coast Federation of Fishermen’s Associations (PCFFA), the Northwest Coalition for Alternatives to Pesticides, and other salmon advocates, with legal representation from Earthjustice, aimed at removing toxic pesticides from salmon spawning streams throughout the northwest. In response to the litigation, the National Marine Fisheries Service (NMFS) in November of 2008 released a “biological opinion” that set forth a plan for protecting Pacific salmon and steelhead from three toxic organophosphate pesticides. That decision came after almost a decade of legal wrangling between salmon advocates led by Earthjustice and the federal government. The biological opinion prescribed measures necessary to keep these pesticides out of water and to protect salmon populations in Washington, Oregon, California, and Idaho. Researchers Link Viruses, Genes and Pesticides to Bee Colony Collapse

(Beyond Pesticides, September 8, 2009) Researchers at the University of Nebraska-Lincoln believe they may have determined the first causal relationship linking colony collapse disorder (CCD) to pathogens and other environmental stresses, including pesticides. CCD is a disappearance of honey bees that has beset beekeepers killing off more than a third of commercial honey bees in the U.S. in 2006-2007. Their study, “Changes in transcript abundance relating to colony collapse disorder in honey bees,” was published September 1, 2009 in the Proceedings of the National Academy of Sciences. The team also included researchers from the University of Illinois and the U.S. Department of Agriculture. In a nutshell, the researchers determined, by comparing the differences in gene expression in healthy and CCD colonies, the infected colonies had considerably more damage in their ribosomes. (Ribosomes function in the expression of the genetic code from nucleic acid into protein in all animal, plant and fungal cells.) The infected hives also had higher rates of picorna-like viruses, which damage the ribosome. Pesticide for Pigeons Kills Dozens of Other Birds

(Beyond Pesticides, September 2, 2009) At least 40 small birds were found dead on Sunday in Quebec City, Canada, in what residents described as a scene out of a “Hitchcock movie.” A bird feeder, stuffed with 4-aminopyridine laced corn was the culprit. The chemical was set out on the roof of a building in effort to ward off nuisance pigeons; dozens of other birds were accidentally killed, particularly bronzed grackles. While Quebec City police purport that this pesticide is legal and no charges will be made, the Quebec Environment Ministry is investigating the incident to see if exterminators followed the proper guidelines. “The wrong type of bird ended up being targeted,” Quebec City police spokeswoman Catherine Viel said. A similar event happened in Schenectady New York in 2006, when Rentokill, Inc., a local exterminator applied 4-aminopyridine in order to ward off pigeons from a hospital. This caused a “deadly rain” of pigeons to fall from the sky, closing the hospital emergency room. Pesticide-Contaminated Well Water Linked to Increased Risk of Parkinson’s

(Beyond Pesticides, August 7, 2009) A recent study published in the journal Environmental Health Perspectives has added to evidence that certain pesticides significantly increase one’s risk of developing Parkinson’s disease (PD). Researchers found that rural residents who drank private well water within 500 meters of fields sprayed with certain pesticides had an increased – up to 90 percent – risk of developing PD, and those with Parkinson’s “were more likely to have consumed private well water, and had consumed it on average 4.3 years longer.” The study evaluated more than 700 people, including carefully chosen controls, in Fresno, Kent, and Tulare counties. 17 percent reported drinking private well water between 1974 and 1999. Researchers focused on wells’ proximity to agricultural fields sprayed with pesticides, since private wells are not regulated, and many are shallow enough to be contaminated by pesticides seeping into groundwater. American Bird Conservancy Petitions EPA to Ban Import of Food Containing Deadly Pesticide Residues

(Beyond Pesticides, August 6, 2009) American Bird Conservancy has petitioned the U.S. Environmental Protection Agency (EPA) to ban the import of crops containing any residues of 13 pesticides that are banned or restricted for use in the United States. These pesticides are highly toxic to birds, but are commonly used on crops throughout Latin America where many species of U.S. migratory birds spend the winter months. In addition to the environmental risks to birds, several of these chemicals also pose a risk to agricultural workers. “Allowing residues of these hazardous pesticides on imported food gives tacit U.S. approval to foreign countries to use chemicals that are known to be deadly to U.S. migratory birds,” said Dr. Michael Fry, American Bird Conservancy’s Director of Conservation Advocacy. “EPA has an obligation under Executive Order 13186, the Migratory Bird Treaty Act, and the Endangered Species Act to ensure that migratory birds are not harmed.” Many Latin American countries that currently use these pesticides export coffee, bananas, citrus crops, and other fruits and vegetables to the United States. Report Implicates Pesticides in Chesapeake Bay’s Decline

(Beyond Pesticides, July 31, 2009) A group of advocates and experts is warning that pesticide pollution from farm fields and households is contributing to the Chesapeake Bay’s decline, and may well be linked to declines in frogs across the region and intersex fish seen in the Potomac River. In a report released yesterday, the group calls on federal, state and local government to accelerate research into what threats pesticide contamination may pose to the bay, and to step up efforts to reduce such toxic pollution. “The thing that alarms us the most are the endocrine disruptors and the findings that have come out about intersex fish and frogs with reproductive problems,” said Robert SanGeorge, director of the Pesticides and the Chesapeake Bay Watershed Project. Endocrine disruptors are chemicals that mimic the natural hormones in humans or animals and can disrupt their growth and reproduction. Whole Foods Brands Will Carry “Non-GMO” Labeling

(Beyond Pesticides, July 24, 2009) Whole Foods Market, a leading natural and organic grocery chain, recently announced a commitment to the Non-GMO Project, a non-profit collaboration of manufacturers, retailers, processors, distributors, farmers, seed breeders and consumers, to use the Non-GMO Project’s Product Verification Program (PVP) in connection with Whole Foods Market’s private label products. The 365 Every Day Value and Whole Foods Market brands will be enrolled in the program, with the first products arriving on shelves this Fall. While Federal law requires organic producers to comply with certain non-genetically engineered (GE) requirements identified in the USDA organic standards, there is no standard for labeling them in non-organic products. Pesticide Drift from Fields Impact Amphibian Populations

(Beyond Pesticides, July 23, 2009) A new study published in the August 2009 issue of Environmental Toxicology and Chemistry found that insecticides used in highly populated agricultural areas of California’s Central Valley affect amphibians that breed in the Sierra Nevada Mountains to the east. This study adds to the increasing evidence that pesticides impact areas and wildlife species that are miles from sources of pesticide application. Researchers from the Cooperative Wildlife Research Laboratory, Southern Illinois University and U.S. Geological Survey (USGS) examined the chronic toxicity of two of the insecticides most commonly used in the Central Valley- chlorpyrifos and endosulfan, to larval Pacific treefrogs (Pseudacris regilla) and foothill yellow-legged frogs (Rana boylii), the amphibians with declining populations that live and breed in meadows surrounding the Sierra Nevada. The results are discussed in “Toxicity of Two Insecticides to California, USA, Anurans and Its Relevance to Declining Amphibian Populations.” The study used laboratory testing to examine how the insecticides affected the two frogs at environmentally realistic concentrations. Take Action: Stop Proposal to Exclude Farmworkers from Health Care Coverage

(Beyond Pesticides, July 14, 2009) With language to exclude farmworkers from coverage, on July 10, 2009, Senator Kay Hagan (D-NC) introduced Senate Amendment 200 to the Affordable Health Choices Act, the health care reform bill being considered in the Senate Committee on Health, Education, Labor and Pensions (HELP). According to the advocacy group Farmworker Justice, her amendment would exclude from the definition of “employees” any “temporary or seasonal agricultural workers ”¦ for the purposes of determining the size of an employer.” Agricultural employers of seasonal farmworkers would not be required to participate in the system because they would be considered to be too small. Seasonal farmworkers would be denied health care coverage. “There can be no good explanation for why Senator Hagan thinks it would be a good idea to exclude seasonal farmworkers from access to affordable health care coverage, other than that she is pandering to agricultural employers and upholding the long tradition of excluding some of America’s lowest paid and hardest working employees from the benefits that other workers receive,” said attorney Kate Woomer-Deters of the North Carolina Justice Center. Lawsuit to Challenge EPA for Pesticide Impacts on Polar Bears

(Beyond Pesticides, July 10, 2009) The Center for Biological Diversity notified the U.S. Environmental Protection Agency (EPA) earlier this week of its intent to file suit against the agency for failing to consider impacts to the polar bear and its Arctic habitat from toxic contamination resulting from pesticide use in the U.S. Pesticides registered by EPA for use in the U.S. are known to be transported to the Arctic via various atmospheric, oceanic, and biotic pathways. Such pesticides are biomagnified with each step higher in the food web, reaching some of their greatest concentrations in polar bears, the apex predators of the Arctic. A body of literature demonstrates the far-reaching effects of commonly used pesticides that are suspected endocrine disruptors and persistent organic pollutants, such as atrazine, 2,4-D, lindane, endosulfan, and permethrin, on global ecosystems. These pesticides, among others, and related contaminants have been linked to suppressed immune function, endocrine disruption, abnormalities in reproductive organs, hermaphroditism, and increased cub mortality in polar bears. EPA Proposes Pesticides Restrictions in Endangered Species Settlement

(Beyond Pesticides, July 6, 2009) Last week, the U.S. Environmental Protection Agency (EPA) proposed to formally evaluate the harmful effects of 74 pesticides on 11 endangered and threatened species in the San Francisco Bay Area over the next five years, and to impose interim restrictions on use of these pesticides in and adjacent to endangered species habitats. The proposal stems from a settlement agreement with the Center for Biological Diversity, which sued EPA in 2007 for violating the Endangered Species Act by registering and allowing the use of toxic pesticides in Bay Area endangered species habitats without determining whether the chemicals jeopardize those species’ existence. “Tens of millions of pounds of toxic and poisonous chemicals, known to be deadly to endangered species and harmful to human health, including proven carcinogens and endocrine disruptors, are applied in the Bay Area each year, and many of those find their way through runoff or drift into our soil, creeks and rivers, San Francisco Bay, and sensitive wildlife habitats,” said Jeff Miller, conservation advocate with the Center. “The toxic stew of pesticides in the Bay-Delta has played a major role in the collapse of native fish populations, and pesticides are a leading cause of […]
