Texas Winemakers Concerned about Crop Damage from New Herbicides

(Beyond Pesticides, January 5, 2017) Winegrowers in the Texas High Plains region are concerned that approval of new herbicides by the U.S. Environmental Protection Agency (EPA) will devastate their profitable industry due to chemical damage from pesticide drift. Wine producers in this region of Texas have witnessed chemical damage to their vineyards that they blame on the toxic herbicides, dicamba and 2,4-D, used on cereal crops and pastures on surrounding agricultural land. A new herbicide formulation containing dicamba, XtendiMax with VaporGrip Technology, was approved by EPA, and the agency has recently proposed to register and expand the use of Enlist Duo, a herbicide that contains 2,4-D. EPA’s final decision on registration of Enlist Duo is expected in early 2017. According to Paul Bonarrigo, owner of Messina Hof Winery in Texas, the “approval of these formulations will wind up affecting every vineyard up there.” This will have ramifications across Texas, as the wine industry contributed $1.88 billion to the state’s economy in 2013. Report Finds EPA “Sugarcoating” Effects of Hazardous Neonic Seed Coatings

(Beyond Pesticides, December 13, 2016) Net Loss, a new report released by the Center for Food Safety (CFS), indicates the use of neonicotinoid-coated seeds is exactly that, an economic drain for farmers that only results in the indiscriminate poisoning for non-target wildlife, such as pollinators. The report is a follow up to a 2014 report, Heavy Costs: Weighing the Value of Neonicotinoid Insecticides in Agriculture, which concluded  that neonic seeds bring greater costs than benefits to farmers. Later that year, a study published by the U.S. Environmental Protection Agency (EPA), which  looks specifically at the economic value of neonic coated soybeans, made similar determinations —insecticide seed coating provide little or no overall benefit in controlling insects or improving yield or quality. CFS’s new report cites  numerous new studies published over the past several years that reinforce the group’s original determination on the realized benefits pesticide-coated seeds provide to farmers. Bader Farms v. Monsanto, An Epic Duel Over Illegal Spraying of Herbicide Dicamba

(Beyond Pesticides,  December 12, 2016)   On November 23, Bill Bader of  Bader farms, Missouri’s largest peach farm with over 1,000 acres and 110,000 peach trees, filed a suit against the multinational, agrichemical giant Monsanto. Mr. Bader seeks compensation for extensive damags to his peach trees, which he blames on the illegal, or non-labeled, use of the toxic herbicide dicamba, brought on by sales of Monsanto’s new, genetically engineered (GE), dicamba-tolerant crops. Mr. Bader is projected to lose $1.5 million in revenue from the crop damage. The case was filed in the Circuit Court of Dunklin County, an area that has been hit especially hard by alleged illegal dicamba spraying. The farm’s insurance company refuses to cover damages from any illegal herbicide use. Without compensation for the damages, the farm risks going out of business. The illegal use of dicamba in this case is not an isolated incident. Arkansas Plant Board Advances Measures to Restrict Herbicide Dicamba, Linked to Crop Damage

(Beyond Pesticides, December 2, 2016) Last week, the Arkansas Plant Board voted 12-0 to push measures that would ban or limit the use of certain forms of the toxic herbicide dicamba in the state. The hearing was called to address proposals that the board released for public comment on September 30, such as banning certain formulations of dicamba outright, creating restrictions on the time of year that other formulations of the herbicide can be used, and creating buffer zones in certain situations. This decision comes on the heels of a newly registered formulation of dicamba by the Environmental Protection Agency (EPA), and widespread reports of crop damage across the Midwest and Southeast due to the illegal use of dicamba before it was registered. According to DTN Progressive Farmer, the three-hour public meeting was packed with almost 200 people, and approximately 20 of those testified. Court Knocks Down Local Pesticide Restrictions on Private Property in Hawaii, Upholds Restrictions on GE Crops

(Beyond Pesticides, November 22, 2016) Last week the 9th U.S. Circuit Court of Appeals struck down local county laws aimed at protecting residents’ health and the environment in Hawaii. The ruling, handed down by federal Circuit Judge Consuelo M. Callahan, finds that Hawaii state law is comprehensive in regulating pesticides, and “impliedly preempts” local jurisdictions from passing laws with stricter standards than the state’s. The decision represents a victory for Monsanto, Syngenta, and the agrichemical industry, and a blow to the efforts of grassroots activists that say Hawaii is “ground zero” for toxic and experimental pesticide and genetically engineered (GE) crop use. Judge Callahan’s ruling overturns a number of laws passed over the last several years on different Hawaiian Islands that all aim to protect residents, the environment, and organic farms from the toxic effects of pesticide use and drift from GE cropland. This includes Bill 2491, a measure in Kauai County that imposed common-sense buffer zones for pesticide use within 500 feet of schools and medical facilities, and within 100 feet of any park, public roadway, or shoreline that flows into the ocean. EPA Registers Dicamba for GE Crops, Adding to Growing Herbicide Resistance Issue

(Beyond Pesticides, November 11, 2016) The U.S. Environmental Protection Agency (EPA) has registered a new formulation of dicamba to control weeds in cotton and soybean crops that have been genetically engineered (GE) to tolerate the chemical. The new formulation is called Xtendimax with VaporGripâ Technology, which is claimed to be specifically designed to have lower volatility. The registration, which is time-limited, will automatically expire after two years. According to the Center for Biological Diversity, EPA ignored the legal requirement to explore threats to endangered species, approving this new formulation without considering impacts to species protected under the Endangered Species Act. This decision comes directly after EPA announced that it is reapproving the toxic herbicide mixture Enlist Duo, and proposed to expand the number of crops and states in which it can be used. Dicamba has been linked to damage of the kidney and liver, neurotoxicity, and developmental impacts. The chemical has a strong propensity to volatilize small particles of the herbicide into the air and drift far off-site. Report Says Farmers Illegally Use Herbicide Dicamba on Glyphosate/Roundup-Resistant Weeds in Genetically Engineered Crop

(Beyond Pesticides, October 26, 2016) The U.S. Environmental Protection Agency (EPA) has launched a criminal investigation at several locations in Missouri into the illegal spraying this summer of the herbicide dicamba. EPA’s investigation is ongoing and stems from widespread complaints of damage to various crops across Missouri and several other states in the Midwest and Southeast. Dicamba, a widely used herbicide, has had frequent problems with drift and subsequent crop injury. Many suspect that  farmers who planted the new dicamba-tolerant genetically engineered (GE) seeds in the region, when faced with a proliferation of pigweed this year, illegally sprayed dicamba across their fields, leading to drift and off-site crop damage to other farmers. While USDA has deregulated (approved) dicamba-tolerant crops, EPA is expected to but has not yet registered a formulations of dicamba for use on GE crops. Dicamba is highly volatile and prone to drift. Farmers Dealing with Fall-Out from Monsanto’s New GE Crops

(Beyond Pesticides, August 9, 2016) Farmers in Missouri, Arkansas, and Tennessee are confronting widespread crop damage and bracing for lower yields as a result of agrichemical giant Monsanto’s botched roll-out of new genetically engineered soybean and cotton crops. The company, whose current line of glyphosate-tolerant crops are failing to control weeds throughout the U.S. and across the globe, developed a new line of soybean and cotton with traits that make it tolerate applications of an older herbicide dicamba. However, while its seeds are available for purchase on the market, and Monsanto is encouraging farmers to grow them, the company has yet to receive EPA regulatory approval for the dicamba herbicide meant to be used with the plants. A spate of news reports over the past two  months in southern soybean growing regions finds that many farmers are illegally applying off-label dicamba-based herbicides to Monsanto’s new GE crops in an effort to control weeds resistant to glyphosate. Failure of Hawai’i to Enforce Pesticide Law Sparks Request that EPA Revoke State’s Authority

(Beyond Pesticides, August 8, 2016) Last week, the Environmental Protection Agency (EPA) received a  letter  from Earthjustice requesting that the agency notify the Hawaii State Department of Agriculture (HDOA) of its chronic failure to meet statutory duties for pesticides regulation and enforcement under the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA), and, if timely corrections are not made, to rescind HDOA’s primary enforcement authority completely. Earthjustice has asked EPA to immediately notify HDOA that it has failed to carry out its responsibilities, and, pursuant to FIFRA, to give the agency 90 days to correct its overwhelming shortcomings. If the problems, which include failure to enforce pesticide use violations and a large backlog of pesticide complaints and investigations dating back to as early as 2008, are not corrected and addressed within 90 days, Earthjustice requests that EPA revoke HDOA’s primary enforcement authority indefinitely.  In the event that HDOA’s authority to regulate is stripped, EPA would then take over the responsibility for enforcing pesticide use violations occurring within the state. Fighting Zika – Growing Concerns over Pesticide Resistance

(Beyond Pesticides, August 5, 2016) Concerned health officials in Miami, Florida are investigating suspicions that Zika-spreading mosquitoes have become resistant to the pesticides commonly used synthetic pyrethroid insecticides used in mosquito control. As the region works to contain a Zika outbreak in northern Miami, officials are beginning to recognize that broadcast pesticide applications are not effective at controlling populations, and are looking into cases in the U.S.  and in other parts of the world of mosquitoes developing resistance to chemical controls, or whether other factors are at work. At the same, the broadcasting of the pesticides by truck and plane and the resulting exposure to people and the environment also raise serious health issues. The Aedes aegypti mosquito, which has the ability to live indoors and reproduce even in tiny pools of water, is the primary way the Zika virus is spread, although there are reports that the disease can also be transmitted through sexual contact. Zika virus has been linked to cases of microcephaly, in which babies are born with underdeveloped brains. President Signs Weak Product Labeling Law on Genetically Engineered Ingredients, Preempts States

(Beyond Pesticides, August  1, 2016) As expected, President Obama signed into law an amendment to S. 764, the National Bioengineered Food Disclosure Law, which establishes a national GMO (genetically modified  organisms or genetically engineered-GE) food labeling requirement that food safety advocates say may be deceptive, preempts states from adopting stronger label language and standards, and excludes a large portion of the population without special cell phone technology. Pushed by Senators Debbie Stabenow (D-MI) and Pat Roberts (R-KS), the law is being characterized by its supporters as a compromise, stronger than the original legislation, the Biotechnology Food Labeling and Uniformity Act (S.2621), which was dubbed the Deny Americans the Right to Know (DARK) Act. That bill failed to reach cloture in the Senate in March. The U.S. Department of Agriculture, a big supporter of genetically engineered food production, will have two years to develop the standard, during which time it will assess the question of equitable access to the disclosure of ingredients. This new law will invalidate a stronger GMO labeling law that took effect in Vermont on July 1. Glyphosate Residues Found in Common Breakfast Foods

(Beyond Pesticides, April 21, 2016) A report released Tuesday by the Alliance for Natural Health (ANH) shows that glyphosate residues are widely distributed in common breakfast foods, such as bagels, cereals, creamers, and eggs. Glyphosate is a pervasive and toxic chemical found in Monsanto’s Roundup weedkiller and was classified by the International Agency for Research on Cancer (IARC) as a probable human carcinogen in 2015. The report looks at conventional and organic-certified versions of 12  popular breakfast foods and ingredients (a total of 24 items) and finds that many of the sample foods or ingredients contain detectable levels of glyphosate. Testing was done by an independent laboratory using the ELISA (enzyme-linked immunosorbent assay) method. Categories tested were: flour, corn flakes, instant oatmeal, bagels, yogurt, bread, frozen hash browns, potatoes, cream of wheat, eggs, non-dairy creamers, and dairy based coffee creamers. Of note is the finding that a sample of organic cage-free eggs contain more glyphosate than the allowable tolerance level. The lab found glyphosate residue levels of 169 parts per billion (ppb), while the allowable tolerance level is only 50ppb. Glyphosate Found to Contaminate California Wine

(Beyond Pesticides, March 25, 2016) Glyphosate is found to contaminate California wines, according to a new report from the non-profit group Moms Across America. Glyphosate is pervasive and toxic chemical found in Monsanto’s Roundup weedkiller and was classified in 2015  as a probable carcinogen  by the International Agency for Research on Cancer (IARC). The report finds that all of the ten wines tested positive for glyphosate. The highest level of glyphosate detected was nearly 30 times higher (at 18.74 parts-per-billion, or ppb) than other wines from a 2013 Cabernet Sauvignon  sourced from a conventional, chemically farmed vineyard. The lowest level (.659 ppb) was from a biodynamic and organic vineyard, a 2013 Syrah. According to the owner, the vineyard has never been sprayed, indicating the possibility of pesticide drift from conventional agriculture, which has been a real and persistent problem for organic growers. EPA has done little to protect organic growers, who often bear the burden, both economic and otherwise, of pesticides applied to nearby conventional farmlands and vineyards. Report Calls for Improved Pesticide Regulation and Assessment on Kauai, Hawai’i

(Beyond Pesticides, March 14, 2016)  According to a draft version of a report commissioned by Hawaii and Kauai County, Hawaii should dramatically improve its regulation of pesticide use and study its impacts, which the state legislature has repeatedly refused to consider. Unsurprisingly, agrichemical companies that produce genetically engineered (GE) seeds criticized the new government report, saying it “raises unfounded and unsubstantiated fears about chronic exposure and chemicals in general.” Association members include Monsanto, Syngenta, DuPont Pioneer, Dow AgroSciences and BASF, multi-billion-dollar multinational agrochemical companies that farm thousands of acres in Hawaii and produce the state’s largest export crop, seed corn. The Joint Fact Finding (JFF) report was conducted by Peter Adler of the consulting firm Accord3.0. and eight participants, including two representatives of DuPont Pioneer and Dow AgroSciences. According to the study website, it was commissioned by the  Hawaii State Department of Agriculture (HDOA)  and Kauai Mayor Bernard Carvalho in order to conduct a joint fact finding project on the island of Kauai. Fish and Wildlife Service to Assess Harm from Glyphosate and Atrazine on Endangered Species

(Beyond Pesticides, March 1, 2016) Under the terms of an agreement reached lasted month, the U.S. Fish and Wildlife Service (FWS) will begin studying the effects of four commonly used herbicides on the health of 1,500 endangered species in the United States. Based on the terms of the settlement, the result of a series of lawsuits launched by the Center for Biological Diversity (CBD), FWS must develop a  plan to mitigate the effects of glyphosate, atrazine, and its chemical cousins propazine and simazine, on any threatened or endangered species. “This agreement will result in long-overdue protections for our country’s most endangered species,” said Brett Hartl, endangered species policy director at CBD. “Once the Fish and Wildlife Service completes its analysis, and the public finally learns just how toxic and deadly these pesticides are to endangered species, we hope that the government will ultimately take most of these products off the shelf.” Under the Endangered Species Act (ESA), the Environmental Protection Agency (EPA) is required to consult with FWS and the National Marine Fisheries Service (NMFS) on the impacts of pesticides on endangered species when it registers a chemical under federal pesticide law (the Federal Insecticide Fungicide and Rodenticide Act, or […]

Monsanto’s Glyphosate (RoundUp) Reported Most Used Herbicide Globally

(Beyond Pesticides, February 5, 2016) According to a report published earlier this week, Trends in glyphosate herbicide use in the United States and Globally, glyphosate, manufactured by Monsanto and known by its product name Roundup, is the most widely and heavily applied weed-killer in the history of chemical-intensive agriculture both in the U.S. and globally. Charles Benbrook, Ph.D., author of the study, which was published in the peer-reviewed journal Environmental Sciences Europe, reports that to date 18.9 billion pounds (8.6 billion kilograms) of glyphosate have been used globally, with an estimated 19% of the use coming from the U.S. The report also points out that glyphosate use has risen almost 15-fold since “Roundup Ready” genetically engineered crops (GE) were introduced in 1996. Dr. Benbrook’s research concludes that, “Genetically engineered herbicide-tolerant crops now account for about 56 % of global glyphosate use. In the U.S., no pesticide has come remotely close to such intensive and widespread use.” According to the report, two-thirds of the total volume of glyphosate applied in the U.S. from 1974 to 2014 has been sprayed in just the last 10  years. Herbicide (Dicamba) Drift Adversely Affects Non-Target Pollinators and Plants

(Beyond Pesticides, December 10, 2015) Researchers at Pennsylvania State University (Penn State) and the Pennsylvania Association for Sustainable Agriculture published a study, which found that aerial drift of the herbicide dicamba adversely affects non-target plants and pollinator species. Dicamba is a chlorinated benzoic acid herbicide associated with neurotoxicity and reproductive effects. The study used alfalfa crops to track the flowering and floral visitation by insects, specifically pollinators, after applications of sublethal doses of dicamba. The researchers concluded, “Our results suggest that widespread non-target damage from these herbicides may adversely affect pollinator communities.” Because dicamba is “frequently responsible for sublethal, off-target damage” to plants and insects, Penn State researchers assessed the most common route of exposure: particle and vapor drift. In its  study, Effects of the Herbicide Dicamba on Nontarget Plants and Pollinator Visitation, the research team examined the crop species alfalfa (Medicago sativa), which requires insect pollination to produce seeds, and the native plant species common  boneset (Eupatorium perfoliatum), which is highly attractive to a wide range of pollinator species. Lawsuit Challenges EPA on Toxic Herbicide Cocktail for GE Crops

(Beyond Pesticides, October 27, 2015) Late Friday,  a coalition of public health, conservation and food safety groups filed their opening brief in the ongoing legal challenge to the U.S. Environmental Protection Agency’s (EPA) approval of the herbicide Enlist Duo for use on genetically engineered corn and soybeans. Enlist Duo, a blend of glyphosate and 2,4-D, was approved on October 15 for use on genetically engineered (GE) crops, despite concerns for human and environmental contamination. The challenge was originally brought in November 2014, shortly after the EPA approved the controversial herbicide for 6 Midwest states. Since then, EPA has expanded its approval to a total of 15 states, with more expected. Counsel from the Center for Food Safety (CFS) and Earthjustice are jointly representing Beyond Pesticides, Center for Biological Diversity, CFS, the Environmental Working Group, the National Family Farm Coalition, and Pesticide Action Network North America. “The Enlist Duo approval violated the laws protecting our communities, land, and farms,” said George Kimbrell, Center for Food Safety senior attorney, counsel in the case. “Regulators bowed to the chemical industry, but we are committed to holding them accountable.” The groups argue that in its approval of Enlist Duo, a combination of the herbicides […]

U.S. Senators to Advance Legislation to Stop States from Labeling GE Food

(Beyond Pesticides, October 22, 2015) With increasing consumer concern about genetically engineered (GE) food, yesterday  the U.S. Senate Committee on Agriculture, Nutrition, and Forestry held a hearing,  entitled Agriculture Biotechnology: a Look at Federal Regulation and Stakeholder Perspectives, that critics called lopsided. Most witnesses characterized GE food as safe or side-stepped the issue of safety, as government witnesses refused to distinguish GE from conventional food and opposed food labeling. “This is the first time in 10 years we’ve had a hearing on biotech. I guess we’re a little late, but we’re here,” said chair of the committee, Senator Pat Roberts (R-KS). The ranking  minority member of the committee, Senator  Debbie Stabenow (D-MI)  said,  “Biotechnology is proven to be safe, beneficial, and I believe will play a major role in helping to solve these dual global challenges of climate change and global food security,” Central to the hearing is the the issue of labeling food products containing GE crops. Senator Stabenow called for the adoption of legislation on GE food labeling, presumably with language that will preempt the authority of states to adopt more stringent labeling standards. Passage of the DARK Act Sheds Light on Next Steps for Opposition

(Beyond Pesticides, July 29 2015) The  Safe and Accurate Food Labeling Act of 2015,  H.R. 1599, often referred to as the “DARK” Act or Denying Americans the Right to Know what is in their food, passed the U.S.  House of Representatives last week by a vote of 275-150. Backed largely by House Republicans, the DARK Act makes it harder for the Food and Drug Administration (FDA) to require mandatory national labeling of genetically engineered (GE) organisms and strengthens current policies that allow companies to voluntarily label foods containing GE products, an option they rarely choose to do. The bill also continues to allow misleading “natural” claims for food that contain GE ingredients. Most concerning, however, is the prohibition  that H.R. 1599 would place  on states’ authority to require labeling of GE ingredients in food products, instituting federal  preemption of state and local authority. While the bill was being debated on the floor, co-sponsors Representatives Mike Pompeo (R-KS) and G.K.
