Endangered Species Status Proposed for Rusty Patched Bumble Bee

(Beyond Pesticides, September 23, 2016) The U.S. Fish and Wildlife Service (FWS) has proposed listing the rusty patched bumble bee as an endangered species under the Endangered Species Act (ESA). This is a victory for environmental groups who have fought to protect the rusty patched bumble bee from widespread threats such as habitat loss and pesticide use. The FWS proposal opens a 60-day public comment to allow agencies, groups and interested people to comment and provide new information. The public comment period is open through November 21, 2016. You can submit comments soon by visiting the docket, here. According to FWS, the rusty patched bumble bee was once widespread across the United States and parts of Canada, but declined dramatically in the 1990s. Their populations dwindled and have declined by 91 percent. FWS acknowledged  that the bumble bee populations considered for this proposal have not been reconfirmed since the early 2000s, meaning that currently there may be even less of the species left. Threats to the rusty patched bumble bee include diseases introduced by commercial bumble bees that are not free of pathogens and are released near wild populations. FDA Bans Antibacterial Pesticide Triclosan in Soaps, While EPA Allows Its Use in Common Household Products and Toys

(Beyond Pesticides,  September 6, 2016) “The Food and Drug Administration (FDA) decision today to remove the antibacterial triclosan, found in liquid soaps (toothpaste use will remain), is a long time coming,” Jay Feldman, Executive Director of Beyond Pesticides, said today. He continued: “The agency’s failure to regulate triclosan for near two decades, as the law requires, put millions of people and the environment at unnecessary risk to toxic effects and elevated risk to other bacterial diseases. Now, FDA should remove it from toothpaste and EPA should immediately ban it from common household products from plastics to textiles.” Many companies had decided under consumer pressure to remove triclosan from its liquid soap products years ahead of the FDA decision today. FDA’s announcement today indicates that soaps containing the antibacterial ingredient triclosan do not have substantiated germ-killing health benefits. Beyond Pesticides raised concerns about the health effects of triclosan in 2004 in its piece The Ubiquitous Triclosan, and petitioned the agency to ban the chemical in 2005. Pesticides Found in Turtles in Sequoia National Park

(Beyond Pesticides, April 29, 2016) Traces of pesticides, including the long-banned organochlorine chemical DDT, have been found in Western pond turtles, insects, and soil sediment at Sequoia National Park, according to a study.  The study, entitled Organic contaminants in western pond turtles in remote habitat in California  and published in the journal Chemosphere, surveys a suite of 57 current- and historic-use pesticides, polychlorinated biphenyls (PCBs), and polycyclic aromatic hydrocarbons (PAHs) in the western pond turtle, along with their potential prey items and habitat. California study sites include Sequoia National Park, Whiskeytown National Recreation Area, and Six Rivers National Forest, all of which are downstream of undeveloped watersheds and varied in distance from agricultural and urban pollution sources. Researchers found that organic pollutants are widespread in the western pond turtle, which has conservation status; that pesticides are prominent in Sequoia National Park, which is downwind of heavy agriculture; and that the legacy  pesticides and PCB concentrations indicate that bioaccumulation is occurring. EPA Finds 97% of Endangered Species Threatened by Common Pesticides

(Beyond Pesticides, April 12, 2016) Two commonly used pesticides are “likely to adversely affect” 97% of species listed under the Endangered Species Act (ESA), according to a first of its kind national assessment by the U.S. Environmental Protection Agency (EPA). The determination is part of a settlement reached by EPA and the Center for Biological Diversity, which requires the agency to complete a review of the impact of organophosphate pesticides chlorpyrifos, malathion, and diazinon by December 2017, and two carbamate class pesticides, methomyl and carbaryl, by the end of 2018. Under ESA Section 7, any agency action that it  authorizes, funds, or carries out must find that it  “is not likely to jeopardize the continued existence of any endangered species or threatened species or result in the destruction or adverse modification of habitat.” Under ESA, EPA is required to consult with the U.S. Fish and Wildlife Service (FWS) and National Marine Fisheries Service (NMFS) when registering a pesticide, in order to mitigate risks to endangered species. Fish and Wildlife Service to Assess Harm from Glyphosate and Atrazine on Endangered Species

(Beyond Pesticides, March 1, 2016) Under the terms of an agreement reached lasted month, the U.S. Fish and Wildlife Service (FWS) will begin studying the effects of four commonly used herbicides on the health of 1,500 endangered species in the United States. Based on the terms of the settlement, the result of a series of lawsuits launched by the Center for Biological Diversity (CBD), FWS must develop a  plan to mitigate the effects of glyphosate, atrazine, and its chemical cousins propazine and simazine, on any threatened or endangered species. “This agreement will result in long-overdue protections for our country’s most endangered species,” said Brett Hartl, endangered species policy director at CBD. “Once the Fish and Wildlife Service completes its analysis, and the public finally learns just how toxic and deadly these pesticides are to endangered species, we hope that the government will ultimately take most of these products off the shelf.” Under the Endangered Species Act (ESA), the Environmental Protection Agency (EPA) is required to consult with FWS and the National Marine Fisheries Service (NMFS) on the impacts of pesticides on endangered species when it registers a chemical under federal pesticide law (the Federal Insecticide Fungicide and Rodenticide Act, or […]

Court Rejects EPA’s Bid to Revoke Use of Dow’s 2,4-D/Glyphosate (Enlist Duo) Pesticide in GE Crops

(Beyond Pesticides, January 29, 2016) This week, the 9th U.S. Circuit Court of Appeals handed a victory to Dow Chemical Company and its  efforts to keep the toxic pesticide Enlist Duo on the market, despite new safety concerns identified by the Environmental Protection Agency (EPA).  Enlist Duo has been marketed as a “solution” for the control of glyphosate-resistant weeds in genetically engineered (GE) crops, brought on by the  widespread use of Monsanto’s  Roundup  on glyphosate-tolerant (Roundup Ready) crops over the last decade. EPA asked the court at the end of November, 2015 to vacate its 2014 approval of Enlist Duo based on new information on the  toxic effects associated with the synergistic interactions of  the chemical cocktail of 2,4-D, glyphosate, and other undisclosed ingredients in the product to plants outside the treated area, including endangered plants. The three-sentence order, which does not include  the judge’s reasoning, denied EPA’s request. Monsanto Sues to Keep Glyphosate off California List of Carcinogens

(Beyond Pesticides, January 25, 2016) Monsanto filed a lawsuit in California last week seeking to prevent glyphosate, the main ingredient in its Roundup herbicide, from being added to California’s  list of known carcinogens under the state’s Safe Drinking Water and Toxic Enforcement Act of 1986 (Proposition 65). Glyphosate is  classified  as a probable carcinogen by the World Health Organization’s International Agency for the Research of Cancer (IARC) based on sufficient  evidence  of carcinogenicity in experimental animals. This is the highest level carcinogen based on laboratory animal studies  under  IARC’s rating system. California law requires the state to keep a list of cancer-causing chemicals to inform residents of their risks. California Office of Environmental Health Hazard Assessment (OEHHA) said in September that it planned to add glyphosate to the list after the World Health Organization’s International Agency for Research on Cancer (IARC) classified it as a probable human carcinogen last March. Monsanto has disputed the assessment, citing decades of studies deeming glyphosate safe, including a 2007 study by OEHHA that concluded the chemical was unlikely to cause cancer. Canada Discontinues Conditional Registrations For New Pesticides

(Beyond Pesticides, January 21, 2016) The Pest Management Regulatory Agency (PMRA) of Health Canada announced Tuesday that it intends to discontinue the granting of new conditional registrations under the Pest Control Products Act. In the U.S., conditional registrations have been controversial because they allow pesticide use  without complete data, as was the case with the neonicotinoid insecticide chlothianidin, linked to the decline in bee health. A startling number of pesticides, nearly 65% of the more than 16,000 pesticides now on the market, were first approved by the process of “conditional registration,” a loophole in which EPA allows new pesticides on the market without the full range of legally mandated toxicity tests.   Currently, the Pest Control Products Regulations grants conditional registration for pesticides only when “the review of the scientific data and information is sufficient to determine that the risks of a pesticide are acceptable, but PMRA requires additional information, such as monitoring data after a product registration, to confirm the results of models used in the risk assessment.” Because this change will only affect new registration applications and less than  one percent of all existing pesticide registrations in Canada are conditional, this action is unlikely to have a large […]

WA Oyster Growers Request Approval to Spray Neonicotinoid Pesticides in Bay, Despite Public Opposition

(Beyond Pesticides, January 13, 2016) Last Friday, the Willapa Grays Harbor Oyster Growers Association (WGHOGA) in Washington State sent a 71-page request to the Washington Department of Ecology (Ecology) asking state regulators to approve  a permit to  spray neonicotinoid insecticides  that are having devastating effects on the ecosystems worldwide. Yet, WGHOGA is pursuing a single-minded approach to chemically control the shrimp that are hurting their oyster crops, while using chemicals that the preponderance of science finds cause ecosystem imbalance. In  April 2015, much to the dismay of activists and concerned local residents, Ecology approved a permit for the use of imidacloprid (a neonicotinoid) to combat a growing native population of burrowing shrimp that threatens  valuable shellfish (oyster) beds in Willapa Bay and Grays  Harbor. But, with a  nationwide public outcry, the permit was withdrawn in May 2015. EPA Revokes Registration of Toxic Pesticide Central to Genetically Engineered Agriculture

(Beyond Pesticides, November 25, 2015) In response to a lawsuit filed by environmental groups, the U.S. Environmental Protection Agency (EPA) yesterday revoked the registration of the toxic herbicide “Enlist Duo,” which contains the cancer causing 2,4-D and is central to future uses of genetically engineered (GE) crops in chemical-intensive agriculture. The marketing of this chemical in genetically engineered agriculture has become integral to the chemical industry’s response to weed resistance to the widely used herbicide glyphosate (Roundup), also identified as cancer causing this year by the International Agency for Research on Cancer (IARC). “Instead of looking for genetically engineered silver bullets that result in crop failure, we should be expanding organic agricultural systems that are productive and profitable, protect public health and the environment and slow global climate change,” said Jay Feldman, executive director of Beyond Pesticides. California Study Links Glyphosate Use and Environmental Injustice

(Beyond Pesticides November 4, 2015) On Monday, the Center for Biological Diversity, the Center for Environmental Health, El Quinto Sol de America, Californians for Pesticide Reform, the Center for Food Safety and the Pesticide Action Network released a report with findings that that more than half of the commercial glyphosate sprayed in California is applied in the state’s eight most impoverished counties. Glyphosate is a phosphanoglycine herbicide that inhibits an enzyme essential to plant growth.  Commonly known as Roundup, glyphosate is classified as a probable carcinogen by the World Health Organization’s International Agency for the Research of Cancer (IARC), based on sufficient evidence of carcinogenicity in experimental animals, and is currently under review to receive a similar designation from the state under California’s Safe Drinking Water and Toxic Enforcement Act of 1986 (Proposition 65). The report,  Lost in the Mist:  How Glyphosate Use Disproportionately Threatens California’s Most Impoverished Counties, found that 54 percent of glyphosate spraying in California is applied in eight counties, many of which are located in the southern part of the Central Valley. EPA Continues Trend of Pesticide Approval without Adequate Review

(Beyond Pesticides, November 2, 2015) The Center for Biological Diversity (CBD) submitted a formal notice last week for intent to sue the Environmental Protection Agency (EPA) for approving benzovindiflupyr, a fungicide that is highly toxic to fish and aquatic invertebrates. CBD asserts that EPA recognized that benzovindiflupyr could harm wildlife and critical habitat protected by the Endangered Species Act (ESA), but approved it for use without consulting with expert wildlife agencies as required by the act. This is  not the first time that EPA has approved toxic chemicals without fully understanding the consequences. On August 28, 2015, EPA granted broad approval for use of benzovindiflupyr on most crops, including cereals, corn, vegetables, fruits, turf grass and ornamentals. The agency’s own data show that benzovindiflupyr is highly persistent in the environment and will build up in waterways due to runoff from treated fields. Lawsuit Challenges EPA on Toxic Herbicide Cocktail for GE Crops

(Beyond Pesticides, October 27, 2015) Late Friday,  a coalition of public health, conservation and food safety groups filed their opening brief in the ongoing legal challenge to the U.S. Environmental Protection Agency’s (EPA) approval of the herbicide Enlist Duo for use on genetically engineered corn and soybeans. Enlist Duo, a blend of glyphosate and 2,4-D, was approved on October 15 for use on genetically engineered (GE) crops, despite concerns for human and environmental contamination. The challenge was originally brought in November 2014, shortly after the EPA approved the controversial herbicide for 6 Midwest states. Since then, EPA has expanded its approval to a total of 15 states, with more expected. California to List Glyphosate (Roundup) as Cancer-Causing

(Beyond Pesticides, September 10, 2015) Last week, California Environmental Protection Agency’s Office of Environmental Health Hazard Assessment (OEHHA) announced that it intended to list glyphosate (Roundup) and three other chemicals as cancer-causing chemicals under California’s  Safe Drinking Water and Toxic Enforcement Act of 1986 (Proposition 65). Glyphosate  is a phosphanoglycine herbicide that inhibits an enzyme essential to plant growth. Under California law, Proposition 65 requires that certain substances identified by the International View postAgency for Research on Cancer (IARC) be listed as known cancer-causing chemicals. In March, a study by the IARC classified glyphosate as a Group 2A material, which means that the chemical is carcinogenic based on sufficient evidence of carcinogenicity in experimental animals. The agency considered the findings from an EPA Scientific Advisory Panel report, along with several recent studies in making its conclusion. However, industry supporters of glyphosate all over the globe are conducting their own studies to attempt to prove that it is not a carcinogen. Colgate-Palmolive Pays $2mil to Settle Litigation on Lack of Efficacy of Its Triclosan Soaps

(Beyond Pesticides, July 1, 2015) — SoftSoap manufacturer, Colgate-Palmolive Co., has agreed to pay $2 million to settle a class action suit that alleged  the company misled consumers into thinking its brand of Softsoap Antibacterial liquid hand soaps killed most common germs, when in fact they do not, according to documents filed in New Hampshire federal court. After years in court, Colgate Palmolive decided to settle “in order to avoid the cost and uncertainty of continued litigation.” Triclosan’s use in hand soap has been shown to be no more effective than regular soap and water. Its links to public health hazards, including endocrine disruption, antibacterial resistance, and water contamination, has raised the question of its necessity in over the counter consumer products, given the hazards. Triclosan, an antimicrobial pesticide used in many “antibacterial” hand soaps, as well as thousands of other consumer goods, such as toothpaste, cosmetics, and treated plastics and textiles, has been marketed as a ”˜germ killer.’ However, its efficacy has been called into question by several agencies and independent studies. EPA Solicits Public Input on Protecting Monarchs from Herbicide Impacts

(Beyond Pesticides, June 30, 2015) As the Monarch butterfly suffers serious decline, the U.S. Environmental Protection Agency (EPA) is considering  the role of  herbicides in killing the iconic species’ food source, milkweed, and developing an action plan that may fall short. The agency identified possible action that it may take to slow the Monarchs’ decline in a document released last week entitled Risk Management Approach to Identifying Options for Protecting the Monarch Butterfly (Monarch Approach document). EPA’s approach to Monarch conservation comes shortly after the White House released its National Pollinator Health Strategy, intended to “reverse pollinator losses and help restore populations to healthy levels.” The U.S. Fish and Wildlife Service is also in the midst of conducting a review of the Monarch butterfly to determine whether the species is eligible for protection under the Endangered Species Act. The number of Monarchs reaching their winter breeding grounds in Mexico has fallen by 90% in less than 20 years. This year’s population was the second lowest since surveys began two decades ago. EU To Ban Triclosan, While EPA and FDA Reject Calls for U.S. Ban

(Beyond Pesticides, June 26, 2015) The agency responsible for chemical oversight in the European Union announced today that the antibacterial pesticide, triclosan, is toxic and bioaccumulative, and will be phased-out for hygienic uses and replaced by more suitable alternatives. According to the European Chemicals Agency (ECHA), “[N]o safe use could be demonstrated for the proposed use of Triclosan.” This decision has renewed calls for the U.S. Food and Drug Administration (FDA) and U.S. Environmental Protection Agency (EPA) to remove the chemical from the consumer market. EPA in May rejected a consumer petition that asked the agency to ban triclosan. “We applaud this step to protect public health and the environment,” said Jay Feldman, executive director, Beyond Pesticides. The ECHA opinion states that, “Risk was identified for both surface water and for the non-compartment specific effects relevant to the food chain (secondary poisoning).” ECHA believes that any further risk mitigation for triclosan is “not considered realistic.” Triclosan is an antimicrobial pesticide used in cosmetics, personal care products and treated plastics and textiles. It has been linked to hormone disrupting effects, bacterial and antibiotic resistance, cancer, and impacts on aquatic organisms. Atrazine and Glyphosate To Be Analyzed by EPA for Impacts on 1,500 Endangered Species

(Beyond Pesticides, June 25, 2015) The U.S Environmental Protection Agency (EPA) announced Tuesday that it will analyze the effects of two of the most commonly used pesticides in the United States, glyphosate and atrazine, along with atrazine chemical-cousins propazine and simazine, for their impacts on 1,500 endangered plants and animals. The announcement marks an agreement between EPA and Center for Biological Diversity (CBD) on a proposed settlement amending a 2010 court order that  established a schedule to complete effects determinations for 75 chemicals on 11 species in the San Francisco (SF) Bay Area. According to EPA, 59 of the 75 pesticides have been evaluated and subject to  effects determinations, however for the remaining 16 pesticides, EPA and CBD agreed that it would be more efficient and environmentally significant to complete nationwide effects determinations, rather than limit their focus to the SF bay area listed species. The agency has committed to completing the assessments by June 2020. Groups’ Petition to Ban Harmful Antibacterial Pesticide Rejected by EPA

(Beyond Pesticides, May 15, 2015) ­ ­ ­In a response that took over five years, yesterday the Environmental Protection Agency (EPA) issued its long-awaited response to a Citizen Petition filed by Beyond Pesticides and Food & Water Watch, denying the request to cancel registered products that contain the antibacterial pesticide triclosan, often sold under the trade name microban. The decision allows this toxic substance to continue to be sold nationwide in common household products, from toys, cutting boards, hair brushes, sponges, computer keyboards to socks and undergarments. The agency did, however, grant one request, and will evaluate and conduct a biological assessment of the potential for effects on listed species under the Endangered Species Act (ESA) in the ongoing triclosan registration review. Toxic Imidacloprid To Be Sprayed on Oyster Beds in Washington Bays

(Beyond Pesticides, April 29, 2015) Much to the dismay of activists and concerned local residents, the Washington Department of Ecology (Ecology) approved a permit for the use of imidacloprid (a neonicotinoid) to combat a growing native population of burrowing shrimp that threatens valuable shellfish (oyster) beds in Willapa Bay and Grays Harbor in Washington state. Imidacloprid is known to be toxic to bees but is also toxic to aquatic organisms, raising questions on the impacts of its use on the long-term ecological health of the bays. The shellfish industry is important to the Pacific Northwest, injecting an estimated $270 million or more into the region’s economy, and providing jobs for many. Washington’s tidelands, especially those in Willapa Bay, have been particularly productive for more than 100 years. However, according to shellfish growers, the burrowing shrimp (ghost shrimp, Neotrypaea californiensis,  and mud shrimp, Upogebia pugettensis) undermines the industry. The creatures burrow into shellfish beds, making the beds too soft for shellfish cultivation. Their burrowing churns the tidelands into a sticky muck, smothering the oysters. Members of Congress Call for Listing Monarch Butterfly as Threatened

(Beyond Pesticides March 18, 2015) Fifty-two members of Congress penned a letter to the White House, calling for the protection of the Monarch butterfly, which has declined by 90 percent in the last 20 years, and for listing as a ”˜threatened’ species under the Endangered Species Act (ESA). This comes on the heels of a formal  notice  of intent to sue submitted to the U.S. Environmental Protection Agency (EPA) for failing to protect threatened and endangered species, including butterflies, amphibians and birds, from flupyradifurone, a newly approved systemic insecticide. The letter sent to President Obama on Tuesday was spearheaded by Representative Chellie Pingree (D-ME), a long-time advocate for protecting monarch butterflies. In her press release, Rep. Over 125 Groups Urge President Obama to Protect Bees and Other Pollinators from Pesticides

(Beyond Pesticides, March 3, 2015) Over 125 conservation, beekeeping, food safety, religious, ethnic and farming advocacy groups are urging President Obama and the Environmental Protection Agency (EPA) to take swift and meaningful action to protect honey bees and other pollinators from toxic pesticides. Groups, including Beyond Pesticides, raised their voice through a letter sent in advance of a pending report from the White House Pollinator Task Force, which was established last June by the President with the goal to “reverse pollinator losses and help respond populations to healthy levels.” Last October the White House announced it would miss its self-assigned deadline, delaying the urgent action that is needed to address this crisis. The letter urges President Obama and executive agencies to take action against a class of pesticides called neonicotinoids, systemic poisons that are devastating bee populations. New Research Links Bee-Killing Insecticide to Monarch Butterfly Deaths

(Beyond Pesticides, February 27, 2015) New research from the University of Minnesota presents some of the first evidence linking the bee-killing insecticides known as neonicotinoids to monarch butterfly deaths. The study finds that milkweed plants, which monarch butterflies need to survive, may also retain neonicotinoids from nearby plants, making milkweed toxic to monarchs. Monarch population numbers have fallen by 90% in less than 20 years. This year’s population was the second lowest since careful surveys began two decades ago. The critical driver of monarch decline  is the loss of larval host plants in their main breeding habitat, the midwestern Corn Belt. Monarchs lay eggs exclusively on plants in the milkweed family, the only food their larvae will eat. University of Minnesota entomologist Vera Krischik, Ph.D. fed butterflies milkweed plants treated with the neonicotinoid insecticide known as imidacloprid in amounts that might typically be found on backyard plants. While adult monarchs and painted lady butterflies were not affected, which, according to Dr. Krischik, indicates the ability of the adults to detoxify, the larvae of both species of butterflies died.
