Agency Sued for Failure to Protect Endangered Species from Pesticides

(Beyond Pesticides, January 24, 2011) Citing the U.S. Environmental Protections Agency’s failure to protect over 200 endangered species from pesticides under the Endangered Species Act (ESA), two national environmental groups filed on January 20, 2011 a lawsuit to force agency implementation of the act. In what is penned by the groups, the Center for Biological Diversity and Pesticide Action Network North America (PANNA), as the most comprehensive legal action ever brought under ESA, the lawsuit specifically challenges EPA’s failure to consult with the U.S. Fish and Wildlife Service (FWS) and National Marine Fisheries Service on the impacts of hundreds of EPA-registered pesticides that are known to be harmful to endangered and threatened species. “For decades, the EPA has turned a blind eye to the disastrous effects pesticides can have on some of America’s rarest species,” said Jeff Miller, a conservation advocate with the Center. “This lawsuit is intended to force the EPA to follow the law and ensure that harmful chemicals are not sprayed in endangered species habitats.” According to EPA, the Endangered Species Act requires federal agencies, in consultation with FWS and/or the NOAA Fisheries Service, “to ensure that actions they authorize, fund, or carry out are not likely […]

Group Plans to Sue Agencies over Threatened Amphibian

(Beyond Pesticides, December 16, 2010)The Center for Biological Diversity notified the U.S. Fish and Wildlife Service (USFWS) and U.S. Environmental Protection Agency (EPA) December 15 of its intent to sue the agencies for failing to study and act on threats posed by more than 60 pesticides to the threatened California red-legged frog. A 2006 legal settlement secured by the Center required the EPA to assess the impacts of pesticides on the frog, then consult with the U.S. Fish and Wildlife Service (USFWS) under the Endangered Species Act to address those impacts, by 2009. The completed assessments were submitted to the Wildlife Service between March 2007 and October 2009. Although EPA determined that 64 registered pesticides are likely to harm the frogs, the Service has not completed any consultations or adopted protective measures. “The EPA acknowledges that scores of pesticides may be dangerous to California’s rare red-legged frogs, but nothing’s been done about it,” said Jeff Miller, a conservation advocate with the Center. “This three-year delay violates the Endangered Species Act and jeopardizes the future of the largest native frog in California.” Historically abundant throughout California, red-legged frogs have declined in numbers over 90 percent and have disappeared from 70 percent […]

Estrogenic Compounds in Water Come From Agricultural, Industrial Sources

(Beyond Pesticides, December 8, 2010) A new study finds that oral contraceptives are not the main culprit in estrogenic pollution of U.S. rivers and drinking water. Instead, the contribution of contraceptives is quite small compared to other human, industrial and agricultural sources, including pesticides. Recent observed feminization of aquatic animals has raised concerns about estrogenic compounds in water supplies and the potential for these chemicals to reach drinking water. Public perception frequently attributes this feminization to oral contraceptives (OCs) in wastewater and raises concerns that exposure to OCs in drinking water may contribute to the recent rise in human reproductive problems. Studies have suggested that long-term exposure to low levels of estrogens in water may adversely affect human health. This new information eases concerns that contraceptives are a major factor contributing to feminized fish and frogs. This study, “Are Oral Contraceptives a Significant Contributor to the Estrogenicity of Drinking Water?” reviews the literature regarding various sources of estrogens, in surface, source and drinking water, to determine whether OCs were the source of estrogen in surface waters, with an emphasis on the active molecule that comes from OCs. Alaska Supreme Court Issues Restraining Order on Herbicide Spraying By Railroad

(Beyond Pesticides, July 21, 2010) Alaska’s Supreme Court halted plans to use glyphosate to kill weeds along track owned by the Alaska Railroad, which is believed to be the only herbicide-free stretch of rail in the country. This decision is in response to an emergency petition filed by Alaska Community Action on Toxics (ACAT) and others against the Alaska Department of Environmental Conservation and the Alaska Railroad Corporation (ARC) who requested the use of glyphosate for weed control. On June 2, 2010, ACAT joined with other community groups in challenging a permit that would allow the Alaska Railroad to spray toxic herbicides along the railbelt from Seward to Indian for the first time in 26 years. On July 14, 2010, the court ordered a temporary temporary restraining order and prelminary injunction for the planned spray program, in response to an emergency petition (and memorandum of points and authorities) filed by Alaska Community Action on Toxics, Alaska Center for the Environment, Alaska Survival, Cook InletKeeper and the Native Village of Eklutna. Industry Responds to Agency, Environmentalists on Atrazine Review

(Beyond Pesticides, July 15, 2010) Swiss chemical manufacturing giant Syngenta, one of the makers of the commonly used and heavily scrutinized pesticides atrazine, are speaking out against anti-pesticide activists and the U.S. Environmental Protection Agency’s (EPA) review of atrazine. Despite mounting peer-reviewed scientific literature and research, Syngenta refuses to acknowledge the dangers of atrazine and, according to Legal Newsline, claims that the review is “redundant,” and merely “an unprecedented war on agriculture by anti-pesticide activists.” The company, which made over $11 billion in sales in 2009 even accuses the Natural Resources Defense Council (NRDC), which has spearheaded a campaign to persuade EPA to initiate reviews, of being “slick” and “well-funded.” Other critics of the agency’s decision include the American Council on Science and Health (ACSH), a group that has in the past received funding from Monsanto and Union Carbide (according to the group Center for Science in the Public Interest, ACSH stopped disclosing corporate donors in the early 1990’s). Supreme Court Ruling Offers Some Protection from GE Crops

(Beyond Pesticides, June 23, 2010) The Supreme Court ruling in Monsanto v Geersten Seed Farms on June 21, 2010 appears to favor the St. Louis-based biotech giant, but may offer some protection from genetically engineered (GE) crops. In a 7 to 1 decision, the high court overturned a lower court injunction on the planting of GE alfalfa, yet planting the crop still remains illegal until USDA completes assessing its environmental review. Interestingly, Justice Steven G. Breyer recused himself because his brother District Judge Charles Breyer had issued the original ruling, while Justice Clarence Thomas did not recuse himself despite having worked as a Monsanto attorney for two years. In 2006, the Center for Food Safety (CFS) and several other farming and environmental groups, including Beyond Pesticides, filed suit on behalf of Geerston Seed Farms. The suit led to a U.S. District Court ruling that the U.S. Department of Agriculture (USDA) violated the National Environmental Protection Act (NEPA) by approving the sale of GE alfalfa without requiring an environmental impact statement (EIS). USGS Finds Atrazine Herbicide Adversely Affects Fish Reproduction

(Beyond Pesticides, June 1, 2010) Atrazine, one of the most commonly used herbicides in the world, has been shown to affect reproduction of fish at concentrations below U.S. Environmental Protection Agency’s (EPA) water-quality guideline, according to a new U.S. Geological Survey (USGS) study. “Concentrations of atrazine commonly found in agricultural streams and rivers caused reduced reproduction and spawning, as well as tissue abnormalities in laboratory studies with fish,” said USGS scientist Donald Tillitt, Ph.D., the lead author of the study, “Atrazine Reduces Reproduction in Fathead Minnow (Pimephales promelas)” published in Aquatic Toxicology. Fathead minnows were exposed to atrazine at the USGS Columbia Environmental Research Center in Columbia, Missouri, and observed for effects on egg production, tissue abnormalities and hormone levels. Fish were exposed to concentrations ranging from zero to 50 micrograms per liter of atrazine for up to 30 days. All tested levels of exposure are less than the EPA Office of Pesticides Aquatic Life Benchmark of 65 micrograms per liter for chronic exposure of fish. Bill Introduced in U.S. House to Ban Atrazine

(Beyond Pesticides, April 27, 2010) On April 22, 2010, Representative Keith Ellison (D-MN) introduced H.R.5124, legislation to prohibit the use, production, sale, importation, or exportation of any pesticide containing atrazine. The bill’s introduction coincides with an Environmental Protection Agency (EPA) Scientific Advisory Panel (SAP) meeting this week to reevaluate the human health effects of the popular endocrine disrupting herbicide. Environmentalists point to the 2003-2006 reregistration of atrazine as a prime example of the broken system of pesticide regulation in the U.S. and call on EPA to reassess atrazine fairly and for consumers to support an end to all unnecessary pesticide use by supporting organic whenever possible. “On this 40th Anniversary of Earth Day, I can think of no better tribute to our planet and our people than protecting it from known harmful chemicals,” Rep. Towns Sue Atrazine Manufacturer for Drinking Water Contamination

(Beyond Pesticides, April 20, 2010) Communities from six states filed a lawsuit last month in the U.S. District Court for the Southern District of Illinois against Swiss chemical giant Syngenta AG and its American counterpart Syngenta Crop Protection, Inc., the makers of Atrazine. The 16 municipalities in the states of Kansas, Illinois, Indiana, Ohio, Missouri, and Iowa want Syngenta to pay for the expensive carbon filters needed to remove atrazine from their drinking water supply. The United States’ largest private water utility, American Water Company, has also joined the suit, representing 28 additional communities. Atrazine is used to control broad leaf weeds and annual grasses in crops, golf courses, and even residential lawns. It is used extensively for broad leaf weed control in corn. The herbicide does not cling to soil particles, but washes into surface water or leaches into groundwater, and then finds its way into municipal drinking water. It has been linked to a myriad of health problems in humans including disruption of hormone activity, birth defects, and cancer. Atrazine is also a major threat to wildlife. Spring Planting Brings New Urgency to Atrazine Contamination

(Beyond Pesticides, April 2, 2010) On Monday, Tyrone Hayes PhD, researcher and professor at University of California Berkley gave a speech at Illinois State University urging the U.S. Environmental Protection Agency (EPA) to ban atrazine completely. Though atrazine has been the go to broad leaf weed killer for America’s corn growers since the 1950’s, evidence continues to build that atrazine is an unacceptable danger to humans and wildlife, and controversy continues as spring planting looms. In response to mounting scientific research, EPA announced last October it would review atrazine’s registration status, and last month announced plans to overhaul drinking water regulations regarding atrazine and numerous other chemicals known to harm human health. Dr. Hayes is one of the preeminent researchers on the effects of atrazine on amphibians. He compares the current loss of amphibians to the bird die-offs in the 1960’s due to DDT. More Research Links Atrazine to Sexual Abnormalities in Amphibians

(Beyond Pesticides, March 3, 2010) A recently published study in the Proceedings of the National Academy of Sciences finds that male frogs exposed to the herbicide atrazine can become so completely female that they can mate and lay viable eggs. This latest study adds to the growing scientific evidence which shows that atrazine, one of the most common herbicides used in the U.S., disrupts the development and behavior of aquatic animals, and negatively effects their immune, hormone, and reproductive systems. The study, “Atrazine induces complete feminization and chemical castration in male African clawed frogs (Xenopus laevis),” led by Tyrone Hayes, PhD, at the University of California, Berkeley, demonstrates the reproductive consequences of atrazine exposure in adult amphibians. Dr. Hayes and other researchers examined a group of 40 African clawed frogs, all of which carried male chromosomes. As tadpoles, the frogs were put in water with 2.5 parts per billion (ppb) of atrazine — a concentration within federal drinking water standards. Herbicide Atrazine Linked to Rare Birth Defect

(Beyond Pesticides, February 10, 2009) Living near farms that use the weed killer atrazine increases the risk of a rare birth defect, according to a study presented February 5, 2010 at the annual meeting of the Society for Maternal-Fetal Medicine in Chicago. Gastroschisis, a rare birth defect in which an infant’s intestines stick out of the body through a defect on one side of the umbilical cord, affects 1 in 5000 babies born in the U.S. each year. Babies with this condition have problems with movement and absorption in the gut, because the unprotected intestine is exposed to irritating amniotic fluid. Surgery is required to repair this defect. The rate of gastroschisis has risen 2- to 4-fold over the last three decades, especially in areas where agriculture is the primary industry, according to Sarah Waller, PhD, of the University of Washington, Seattle, and colleagues. EPA Sued for Failure to Protect Endangered Species from Pesticides

(Beyond Pesticides, February 8, 2010) The Center for Biological Diversity filed a notice of intent to sue the Environmental Protection Agency (EPA) last week. The lawsuit argues that EPA violated the Endangered Species Act when it approved 394 pesticides known to be harmful to humans and wildlife, without consulting with wildlife regulatory agencies as to the pesticides’ effects on endangered species. By registering pesticides known to harm migratory birds the EPA has also violated the Migratory Bird Treaty Act, according to the suit. The pesticides named in the suit pose a danger not only to wildlife, but to human health as well. Some of the pesticides named include 2,4-D the most commonly used pesticide in the nonagricultural sector, atrazine, triclosan, and pyrethrins. Increasing Documented Cases of Glyphosate Resistance Discussed by Scientists

(Beyond Pesticides, January 28, 2010) Scientists convening at the Pan-American Weed Resistance Conference lamented the critical issue that environmentalists have known would eventually happen, and have argued for decades: the resistance of weeds to the broadscale use of the herbicide glyphosate. The conference, hosted by Bayer Crop Science and held in Miami on January 19-21, 2010, was attended by 284 scientists and media representatives from North and South America. One of the scientists in attendance at the recent conference who offered some of the most dire outlooks on the use of glyphosate, according to The Delta Farm Press, was Stephen Powles, a professor of plant biology at the University of Western Australia, and director of the WA Herbicide Resistance Initiative (WAHRI). Agency Petitioned to Regulate Endocrine Disruptors

(Beyond Pesticides, January 14, 2010) Stating that current water-quality criteria does not reflect the latest scientific knowledge, The Center for Biological Diversity petitioned the U.S. Environmental Protection Agency (EPA) to establish new water-quality criteria for numerous endocrine-disrupting chemicals (EDC) under the Clean Water Act. If adopted, it will be a big step in regulating and eliminating persistent and widespread chemicals that damage reproductive functions in wildlife and humans. The Center for Biological Diversity formally requested that the EPA publish water quality criteria and information taking into account overwhelming science about the effects of EDC pollution on January 11. It says that under the Clean Water Act, EPA has a duty to periodically update water quality criteria to reflect the latest scientific knowledge. Endocrine Disrupting Chemicals Bill Introduced in Congress

(Beyond Pesticides, December 21, 2009) Earlier this month, Congressman Jim Moran of Northern Virginia and Senator John Kerry of Massachusetts introduced legislation to explore linkages between hormone disrupting chemicals in the environment and everyday products and the dramatic increase of autism, hyperactivity, diabetes, obesity, breast cancer, prostate cancer and other hormone related disorders. After the identification of endocrine disruptors, the legislation requires federal agencies with regulatory authority to report to Congress on the action it plans to take. For years, scientists have noted strange anomalies in fish and wildlife in locations where endocrine disrupting chemicals (EDCs) are found. A recent study found that an astounding 100 percent of small mouth bass in certain sites of the Potomac River basin have exhibited both male and female organs, a characteristic linked to EDCs. Comments Needed: USDA To Allow Deregulation of GE Alfalfa Again

(Beyond Pesticides, December 17, 2009) Earlier this week, the U.S. Department of Agriculture’s (USDA) Animal and Plant Health Inspection Service (APHIS) announced the availability of a Draft Environmental Impact Statement (EIS) that preliminarily concludes that there is no significant impact on the human environment due to granting nonregulated status to Roundup Ready (RR) alfalfa. Much to the dismay of environmentalists, the draft EIS outlines plans to allow unlimited commercial planting of genetically-engineered (GE) alfalfa that is resistant to the herbicide glyphosate, despite increasing evidence that GE alfalfa will threaten the rights of farmers and consumers, as well as damage the environment and the integrity of organic food. The agency prepared this draft EIS to comply with a February 2007 judgment and order by the U.S. District Court for the Northern District of California, in which Judge Charles R. Breyer found that USDA violated federal environmental law by failing to conduct an EIS on GE alfalfa seeds before deregulating them in 2005. Atrazine Exposure Triggers Release of Stress Hormone

(Beyond Pesticides, December 15, 2009) Exposure to the endocrine-disrupting herbicide atrazine triggers the release of stress hormones in rats, according to a new study published in the December 2009 issue of the journal Toxicological Sciences. The researchers believe this may explain how the popular weed killer produces some its harmful reproductive effects. The study, “Characterization of the Hypothalamic-Pituitary-Adrenal Axis Response to Atrazine and Metabolites in the Female Rat,” was conducted by the Environmental Protection Agency’s (EPA) National Health and Environmental Effects Research Laboratory. According to a December 4 analysis by Environmental Health Sciences, a foundation-funded journalism organization, the researchers discovered that female rats fed atrazine at the time of ovulation released a flow of stress hormones that are known to interfere with hormones essential for reproduction. The findings reveal one way atrazine may impact female reproduction. Elevated stress hormones can disrupt the hormone signals that spur ovulation. Such a stress response to atrazine could partially explain why previous studies find that the herbicide inhibits reproduction. (Beyond Pesticides, October 8, 2009) The U.S. Environmental Protection Agency (EPA) announced that it will launch a comprehensive new evaluation of the pesticide atrazine to determine its effects on humans this fall. At the end of this process, the agency will decide whether to revise its current risk assessment of the pesticide and whether new restrictions are necessary to better protect public health. This announcement follows recent scrutiny and findings that the current EPA regulation of atrazine in water is inadequate. In August this year, the Natural Resources Defense Council (NRDC) published a report, Poisoning the Well which found that the commonly used herbicide atrazine can spike at extremely high levels which go undetected by regular monitoring. Concurrently, The New York Times published an investigative piece based on the NRDC findings and confirmed that the public is not informed when reports of these spikes of atrazine in drinking water occur. Review Confirms Atrazine Harms Fish and Amphibians

(Beyond Pesticides, October 5, 2009) An analysis of more than 100 scientific studies conducted on atrazine, published in the online edition of Environmental Health Perspectives, demonstrates the toxicity of atrazine to aquatic animals. Biologists at the University of Southern Florida (USF) have found evidence that atrazine harms fish and frogs. Atrazine is disruptive to the development and behavior of aquatic animals, and negatively effects their immune, hormone, and reproductive systems, according to the studies done by USF assistant professor Jason R. Rohr and postdoctoral fellow Krista A. McCoy. Atrazine is commonly used on lawns, golf courses, and sugarcane fields in Florida, and has recently been the topic of much controversy. While atrazine typically does not kill amphibians and freshwater fish, the USF report says it did: Ӣ Reduce the size of amphibians at or near metamorphosis in 19 of 19 studies. Ӣ Make amphibians and fish more active in 12 of 14 studies but reduced behaviors used to evade predators in six of seven studies. Groups Say Science on Glyphosate Disqualifies It for Reregistration

(Beyond Pesticides, September 23, 2009) On September 21, 2009, Beyond Pesticides, joined by 32 other groups and individuals, submitted comments to the U.S. Environment Protection Agency (EPA) showing new and emerging science which illustrates that glyphosate and its formulated products pose unreasonable risk to human and environmental health, and as such should not be considered eligible for continued registration. EPA opened up the Glyphosate Registration Review for comments on July 22, 2009 with a window for submitting comments extending to September 21, 2009. Beyond Pesticides does not believe that glyphosate should be eligible for registration on the grounds that: human exposures to glyphosate pose unacceptable risks; Roundup formulations are toxic, yet go unevaluated; Food Quality Protection Act (FQPA) 10x (additional margin of safety) factor must be reinstated; Polyethoxylated Tallowamine (POEA) surfactant; glyphosate and Roundup threaten water quality and aquatic life; glyphosate and Roundup-ready crops lead to increasing resistance; and human incidents are too high. U.S. Geological Survey Identifies Intersex Fish Nationwide

(Beyond Pesticides, September 18, 2009) Previously documented in the Potomac River, which flows through downtown Washington, DC, the occurrence of “intersex” fish is now found to be nationwide. U.S. Geological Survey (USGS) researchers published their study, “Widespread occurrence of intersex in black basses from U.S. rivers” in the online edition of Aquatic Toxicology. USGS researchers examined 16 different species of fish across the U.S. between 1995 and 2004. The condition of intersex fish, male fish producing eggs, is most commonly found in smallmouth and largemouth bass. One third of male smallmouth bass and one fifth of the male largemouth bass are intersex. Scientists tested sites in the Apalachicola, Colorado, Columbia, Mobile, Mississippi, Pee Dee, Rio Grande, Savannah, and Yukon River basins. Research shows intersex fish in approximately one-third of all examined sites. The only site where researchers found no intersex fish is the Yukon River basin. Report Finds Inadequate EPA Regulation of Pesticides in Water

(Beyond Pesticides, August 26, 2009) The commonly used herbicide atrazine can spike at extremely high levels which go undetected by regular monitoring, according to new report by the Natural Resources Defense Council (NRDC), Poisoning the Well. Currently, the U.S. Environmental Protection Agency (EPA) considers an annual average atrazine level of below 3 parts per billion to be acceptable for human consumption, although studies have shown adverse health impacts below EPA’s “safe” levels. The analysis by NRDC discovered that in the 139 municipal water systems from which EPA collected data on a biweekly basis in 2003 and 2004, atrazine is found 90% of the time. Furthermore, 54 of these water systems have at least one spike above 3 parts per billion. “The data shows that EPA is unable to adequately regulate atrazine and protect the public from this hazardous herbicide in our drinking water,” said Jay Feldman, executive director of Beyond Pesticides. “With studies showing hormonal and other adverse effects at extremely low levels, any level of atrazine in our drinking water is dangerous and spikes above EPA’s 3 ppb threshold are completely unacceptable.
