Black Farmers Association Sues Bayer/Monsanto for Failure to Warn on Glyphosate/Roundup Hazards and Disproportionate Risk; Seeks Chemical’s Removal from Market

(Beyond Pesticides, September 11, 2020) In late August, the National Black Farmers Association filed suit against the chemical company Bayer/Monsanto, seeking to stop the sale of its ubiquitous, glyphosate-based herbicide, Roundup. According to the Midwest Center for Investigative Reporting, the lawsuit argues that Black farmers are, essentially, forced to use Roundup and incur the risks of developing non-Hodgkin Lymphoma or other cancers (or health impacts) because of the exigencies of the pesticide and biotech industry “grip” on agriculture in the U.S. The suit maintains that Bayer (which owns Monsanto, the original manufacturer of Roundup) knowingly failed, and continues to fail, to warn farmers adequately about the dangers of the pesticide. In a Labor Day Daily News post, Beyond Pesticides noted that current pesticide laws result in disproportionate impacts on workers, including agricultural workers of color. Beyond Pesticides is committed to addressing the conditions that give rise to disproportionate harm and to working in broad coalitions to correct them. Pesticide Drift from Greenhouses Adversely Affects Children Living Nearby

(Beyond Pesticides, September 4, 2020) When pesticide drift is investigated, it is most often drift from agricultural fields that is examined. A new study shows that off-target drift of pesticides from greenhouses is also a reality. This research deduced such drift of organophosphate and carbamate pesticides from crop applications done in Ecuadoran floriculture greenhouses by evaluating the acetylcholinesterase enzyme (AChE) activity, necessary to the transmission of nerve impulses, in children residing nearby. The team finds that children living in homes near greenhouses in which these insecticides (widely recognized as cholinesterase inhibitors) are used exhibit reduced activity of this enzyme and abnormal functioning of the nervous system. Beyond Pesticides has monitored the pesticide drift issue intensively, and has long advocated for far better protections for farmworkers. This new information connects those issues, and expands the “drift” concerns to include risks to people working in greenhouses, and to those, especially children, who happen to live near greenhouse-type structures in which these toxic chemicals are used. Maryland Community Opts-In to Healthy Lawns Act, Restricting Toxic Pesticide Use on Public and Private Property

(Beyond Pesticides, August 25, 2020) The City of Gaithersburg, MD has chosen to opt-in to Montgomery County’s Healthy Lawns Act, restricting toxic pesticide use on public and private property. According to the local Patch, the mayor and City Council voted to adopt the law in mid-August, and it will take effect for all residents and businesses in city on December 1. Although Montgomery County passed the Healthy Lawns Act approximately five years ago, incorporated cities within the county are required to proactively opt-in to the law for it to apply within their jurisdiction. Gaithersburg is the latest, and largest city to opt-in to the county’s law, which encourages organic practices by limiting pesticide use on lawns and landscapes to products that are certified organic or considered minimum risk by the U.S. Environmental Protection Agency. In mid-June, the Town of Garrett Park also opted in to the law, according to reports. Advocates are advocating that all cities within Montgomery County adopt the law. Take Action: Tell Lowe’s and Home Depot to Promote Organic Instead of Poisons

Pesticides pack a one-two punch against monarchs. Insecticides—particularly neonicotinoids—poison the caterpillars and butterflies as they feed. Glyphosate—the active ingredient in Bayer-Monsanto’s RoundupÂŽ — is wiping out milkweed, the only food source for monarch caterpillars. This has contributed to monarchs’ 90% decline in the past 20 years alone. They could vanish within our lifetimes. Home and garden stores like Lowe’s and Home Depot can play a huge role in ending the use of this toxic pesticide in our backyards and across the country. Already, Lowe’s is removing neonicotinoid products from its live plant offerings and store shelves, and Home Depot is eliminating use of neonicotinoids in its live plant offerings. Study Shows Organic Food Diet Reduces Residues of Glyphosate in Body

(Beyond Pesticides, August 13, 2020) Levels of the notorious herbicide compound glyphosate in the human body are reduced by 70% through a one-week switch to an organic diet, finds a new, peer-reviewed study published in August 2020 in the journal Environmental Research. This result emphasizes both the ubiquity of this compound in the human body, and diet as the primary source of exposure for most people. It also adds to the evidence for Beyond Pesticides’ assertions that: (1) chemical-intensive agriculture must be abandoned, for a variety of reasons that include human health, and (2) in the lead-up to a transition to organic and regenerative agriculture, consuming organic foods as much as is practicable is powerful protection from glyphosate, and from the assault of multiple chemical pesticides to which most people are exposed. Court Decision Highlights Systemic Failure of Federal Pesticide Law to Protect Health and the Environment, Despite a Silver Lining and a Must-Read, Powerful Dissenting Opinion

(Beyond Pesticides, August 11, 2020) Petitioners who mounted a legal challenge to the Environmental Protection Agency’s (EPA’s) registration of Enlist Duo, a relatively new and highly toxic pesticide product, recently learned of a mixed decision from the U.S. Ninth Circuit Court of Appeals in the case. The good news is that Judge Ryan D. Nelson, writing the opinion for the court, found that EPA, in registering the herbicide Enlist Duo, had failed to protect monarch butterflies, which are under consideration as a threatened species under the Endangered Species Act (ESA). On the other and disturbing hand, the court concluded that EPA registration of the product was otherwise lawful — which means that this toxic compound will for now remain on the market. As one of the plaintiffs in the case, Beyond Pesticides is adamant that this product should not be registered for use by EPA. 28 Pesticides Linked to Mammary Gland Cancer, Inadequately Reviewed by EPA

(Beyond Pesticides, August 7, 2020) Research out of the Silent Spring Institute identifies 28 registered pesticides linked with development of mammary gland tumors in animal studies. Study authors Bethsaida Cardona and Ruthann Rudel also report that many of the pesticides they investigated behave as endocrine disruptors; breast cancers in humans are significantly influenced by hormones generated by the endocrine system. The Environmental Protection Agency (EPA) acknowledges that nine of these 28 pesticide compounds cause mammary tumors, but dismisses the evidence of the other 19. The results of this research, published in the journal Molecular and Cellular Endocrinology, evince Beyond Pesticides’ long-standing argument that the risk assessment process used by EPA for its pesticide registration process is substantially inadequate to protect human health. The co-authors cite, as the catalyst for this research project, a Cape Cod resident’s outreach to the Silent Spring Institute several years ago, asking for information about the herbicide triclopyr because utility companies wanted to spray it on vegetation below local power lines. Nearly A Century of Pesticide Use Changed the Size of Australian Dingoes

(Beyond Pesticides, August 5, 2020) Regions of Australia that use a highly toxic rodenticide are home to larger dingoes than areas where the pesticide is not used, according to research published in the Biological Journal of the Linnean Society. Over the course of roughly the last century, dingoes in rodenticide-baited regions have grown by between six and nine percent. While pesticides are well known to induce changes in insect morphology as resistance is developed, this is one of the first studies to find effects on a large vertebrate carnivore. To make their determination, researchers began measuring the size of dingo skulls, which can be used as a proximate for body size, in areas where the rodenticide compound 1080 (sodium fluoroacetate) was and was not historically used. New York State Legislature Bans Glyphosate (Roundup) in Public Parks, Bill Goes to Governor for Signature

(Beyond Pesticides, July 31, 2020) On July 22, the New York State Legislature passed Senate 6502 / Assembly 732-B — a bill that would ban the use of all glyphosate-based herbicides on state properties. The bill now awaits Governor Andrew Cuomo’s signature, which would make it law effective December 31, 2021. Beyond Pesticides considers this a hopeful development in the glyphosate “saga” and has urged the governor ought to sign it. Nevertheless, such piecemeal, locality-by-locality initiatives represent mere “drops” of protection in an ocean of toxic chemical pesticides to which the U.S. public is exposed. A far more effective, protective solution is the much-needed transition from chemical-intensive agriculture and other kinds of land management to organic systems that do not use toxic pesticides. Environmental Pollutants, including Pesticides, Can Increase Susceptibility to Infectious Diseases

(Beyond Pesticides, July 24, 2020) As the novel coronavirus pandemic has heightened awareness of infectious diseases, there is increased attention to connections between environmental concerns and such diseases, including factors that may exacerbate their transmission. New research shows one such relationship: the transmission of schistosomiasis, a tropical disease caused by contact with the larvae of parasitic worms (schistosomes), is likely accelerated by the use of pesticides and other agrochemicals (such as synthetic fertilizers). The study, published in The Lancet Planetary Health, also shows that contamination of freshwater bodies with these chemicals disturbs ecological balances that can actually limit schistosome infections. This new research underscores the urgency of the needed transition, in affected tropical and subtropical areas, to agricultural approaches that do not involve synthetic agrochemicals that pollute local waterways and put people’s health at increased risk. Mexico Announces Glyphosate-Roundup Phaseout

(Beyond Pesticides, July 14, 2020) The Mexican government announced late last month that it plans to phase out the importation and use of glyphosate in the country over the next four years. The announcement means that Mexico will join other countries, such as Luxembourg, Vietnam, Germany in prohibiting the chemical and the toxic consumer products, like Roundup, that contain it as an ingredient. International watchdogs are keeping an eye on reactions from the United States, which in recent years has worked to intervene in other countries’ decision-making over toxic pesticides. The government’s announcement cites the Precautionary Principle as part of its decision-making. According to the Wingspread Statement on the Precautionary Principle, “Where an activity raises threats of harm to the environment or human health, precautionary measures should be taken even if some cause and effect relationships are not fully established scientifically.” In the case of glyphosate, there is strong evidence, per a 2015 review by the International Agency for Research on Cancer (IARC), that glyphosate is carcinogenic. Study Matches Parkinson’s Disease Risk to Zip Code, Proximity to Pesticide Use

(Beyond Pesticides, July 7, 2020) One’s zip code plays an important role in the likelihood of developing Parkinson’s disease (PD), according to data published by Louisiana State University researchers in the International Journal of Environmental Research and Public Health. With genetics and exposure to agricultural pesticide use identified as the main factors affecting PD, proximity to certain cropland and its effluent had a major impact on disease risk. As with most environmentally related diseases, this study highlights the disproportionate risk and environmental racism low income, indigenous and people of color communities endure. Researchers received access to over 23,000 PD diagnoses in Louisiana between 1999 and 2012, and mapped these data by zip code. Risk was determined calculating the number of diagnoses per 10,000 people in a given zip code, based on census data. To flesh out the role agriculture was playing in PD diagnoses, additional data derived from water quality samples taken by the Louisiana Department of Health and Hospitals, and the U.S. Geological Survey pesticide use estimates were compared against reported disease incidence. Endocrine Disrupting Chemicals, Including Pesticides, Have a Multi-Generational Impact on Commercially Beneficial Inland Silverside Fish

(Beyond Pesticides, July 2, 2020) Exposure to low levels of endocrine-disrupting chemicals commonly in waterways, including pesticides, can impact future generations of major commercial fish, despite no direct exposure to the chemicals, according to research published in the journal Frontiers in Marine Science by Oregon State University (OSU) researchers. Many studies assess the acute or chronic health implications associated with endocrine disruptors on a single generation but lack information on multi-generational impacts that can provide vital information on the fundamental survivability or fitness of many species. This study highlights the significance of understanding the implications of endocrine disruptors, even at low levels of exposure, as parental exposure can have adverse epigenetic consequences for future generations. U.S. and Brazil Trying to Force Thailand to Accept Food Coated in Hazardous Pesticides

(Beyond Pesticides, July 1, 2020) As the U.S. is subject to searing criticism for inadequately regulated hazardous pesticides domestically, administration officials are standing in the way as other countries’ work toward modest reforms. According to a report published in Reuters, the U.S. is standing alongside the corrupt Bolsonaro administration in Brazil to oppose Thailand’s efforts to protect its citizens from highly toxic pesticides used in food production. Both countries launched separate complaints to the World Trade Organization after Thailand announced it would ban imports of the brain-damaging insecticide chlorpyrifos and weedkiller paraquat, which has been strongly linked to Parkinson’s disease. On June 1, Thailand added paraquat and chlorpyrifos to its list of most hazardous substances. This listing initiated a follow-on regulation that banned the import of these substances on food, set to take effect in mid-July. Thailand has been feeling the brunt of U.S. diplomatic pressure since it first proposed restrictions on toxic chemicals late last year. Implications for Human Health: Pesticides and Other Environmental Contaminants Alter Gut Microbiome

(Beyond Pesticides, June 30, 2020) A review of scientific literature on the toxic effect of environmental contaminants—including pesticides—published in the journal Toxicological Science, “The Impact of Environmental Chemicals on the Gut Microbiome,” associates these chemicals to changes in the gut microbiome and other adverse health implications. The review, by researchers at the University of Illinois, looks at how environmental contaminants adversely effects and reinforce chemical disruption of the gut microbiome. It highlights the importance of evaluating how environmental contaminants, like pesticides, impact body regulation by gut microbiota. The study has significant implications for considerations that should be, but are not currently, a part of pesticide review and registration by the U.S. Environmental Protection Agency (EPA). Gut microbiota plays a crucial role in lifelong digestion, immune, and central nervous system regulation, as wells as other bodily functions. Through the gut biome, pesticide exposure can enhance or exacerbate, the adverse effects of additional environmental toxicants on the body. Tell USDA to Reject Bayer-Monsanto’s Multi-Herbicide Tolerant Corn—Please sign the petition by Monday, July 6, 4pm EDT

(Beyond Pesticides, June 29, 2020) Bayer’s Monsanto is requesting non-regulated status for corn that will increase the use of drift-prone and toxic herbicides. This means that the planting of a new genetically engineered (GE) variety of corn, which requires substantial weed killer use, will not be restricted in any way. The syndrome of ‘more-corn, more-pesticides, more-poisoning, more-contamination’ must stop—as we effect an urgent systemic transformation to productive and profitable organic production practices. Because USDA is proposing to allow a new herbicide-dependent crop under the Plant Protection Act, the agency must, but does not, consider the adverse impacts associated with the production practices on other plants and the effects on the soil in which they are grown. Business as usual is not an option for a livable future. Sign the petition. Tell USDA we don’t need more use of 2,4-D, Dicamba, and other toxic herbicides associated with the planting of new GE corn. These differences came into focus as a U.S. court quashed California’s decision to require cancer warning labels on glyphosate products on June 22. The ruling, by Judge William Shubb of the U.S. District Court for the Eastern District of California, bars the state from requiring labeling that warns of potential carcinogenicity on such herbicides. The World Health Organization’s International Agency for Research on Cancer (IARC) in 2015 classified glyphosate as a probable human carcinogen. At this point, Monsanto began a worldwide campaign to challenge glyphosate’s cancer classification. Bayer-Monsanto, Committed to Continued Sales of Roundup™-Glyphosate, Announces $10.9 Billion Settlement with Cancer Victims, Protects Company from Future Trials by Jury

(Beyond Pesticides, June 25, 2020) Facing approximately 125,000 lawsuits on cancer caused by the weed killer Roundup™ (glyphosate), Bayer/Monsanto announced yesterday that it will pay up to $10.9 billion to resolve current and potential future litigation. According to Bayer, the settlement will “bring closure” to approximately 75% of current Roundup™ litigation. “The company will make a payment of $8.8 billion to $9.6 billion to resolve the current Roundup™ litigation, including an allowance expected to cover unresolved claims, and $1.25 billion to support a separate class agreement to address potential future litigation,” according to Bayer’s press release. At the same time the company announced a $400 million settlement with farmers whose crops have been damaged by the weed killer dicamba and $820 million for PCB water litigation. Bayer is a German multinational pharmaceutical and chemical company that purchased Monsanto for $63 billion in 2018. Bayer’s stock price increased by 2.5% after the news of the settlements. Pollinator Week: We Protect People at Greatest Risk When We Protect Pollinators and the Environment from Toxic Pesticides

(Beyond Pesticides, June 22, 2020) In the wake of the national groundswell for equity and justice in the face of rampant inequality and police brutality against people of color, we acknowledge, during Pollinator Week, holistic actions are needed to solve systemic societal problems that cause racial disparities. Those fighting for environmental justice understand that the harms inflicted by toxic chemical production and use cause disproportionate adverse effects on people of color—from fenceline communities near chemical production plants, to the hazardous and inhumane working conditions in agricultural fields, to the elevated risk factors for black and brown people from toxic pesticide exposure patterns.  Pollinator Week reminds us that we must nurture the ecosystem, which we depend on for life, with a fierce commitment to its inhabitants and a focus on those at highest risk. Court Victory on Three Dicamba Weed Killers Underscores the Need to Reform Pesticide Law

(Beyond Pesticides, June 17, 2020) The June 3 decision in a high-profile “dicamba case” — against the U.S. Environmental Protection Agency (EPA) and for the plaintiffs, a coalition of conservation groups — was huge news in environmental advocacy, agriculture, and agrochemical circles. The federal Ninth Circuit Court of Appeals vacated EPA’s 2018 conditional registration of three dicamba weed killer products for use on an estimated 60 million acres of DT (dicamba-tolerant through genetic modification/engineering) soybeans and cotton. There is, however, a related issue that accompanies this and many other pesticide cases. When EPA decides to cancel or otherwise proscribe use of a pesticide (usually as a result of its demonstrated toxicity and/or damage during litigation), the agency will often allow pesticide manufacturers to continue to sell off “existing stocks” of a pesticide, or growers and applicators to continue to use whatever stock they have or can procure. Beyond Pesticides has opposed, covered, and litigated against this practice. Federal Court Halts Use of Drift-Prone Dicamba on Millions of Acres of GE Soy and Cotton

(Beyond Pesticides, June 9, 2020) Use of the weed killer dicamba on genetically engineered (GE) cotton and soybeans is now prohibited after a federal court ruling against the U.S. Environmental Protection Agency (EPA) last week. A coalition of conservation groups filed suit in 2018 after EPA renewed a conditional registration for dicamba’s ‘over the top’ (OTT) use on GE cotton and soy developed to tolerate repeated sprayings of the herbicide. “For the thousands of farmers whose fields were damaged or destroyed by dicamba drift despite our warnings, the National Family Farm Coalition is pleased with today’s ruling,” said National Family Farm Coalition president Jim Goodman in a press release. First registered in the late 1960s, dicamba has been linked to cancer, reproductive effects, neurotoxicity, birth defects, and kidney and liver damage. It is also toxic to birds, fish and other aquatic organisms, and known to leach into waterways after an application. It is a notoriously drift-prone herbicide. Take Action: Tell the National Organic Program that Inaction on “Inert” Ingredients Is Unacceptable

(Beyond Pesticides, June 2, 2020) During the April meeting of the National Organic Standards Board (NOSB), there was near-unanimous sentiment expressed by NOSB members and stakeholders that the failure of the National Organic Program at USDA to act on NOSB recommendations regarding so-called “inert” ingredients hurts organic producers and consumers and the environment. The NOSB has only one alternative left to force USDA action—denying relisting at the Fall meeting. Tell the National Organic Program and USDA Secretary Sonny Perdue to initiate action to begin NOSB review of “inerts” now. Dr. Asa Bradman, who summarized the issue for the NOSB at the Spring 2020 meeting, is an expert in environmental health, and as part of his day job, leads studies focusing on pesticides, flame retardants, metals, emerging pollutants, VOCs, indoor air quality and other contaminants. As he said at the meeting, “These are often active ingredients.” In fact, the ingredients not listed on a label of a pesticide product—which are not fully reviewed for their adverse effects—may be the most toxic chemicals in the formulation.
