Cargill Sues Syngenta after China Forbids the Sale of Its GE Corn

(Beyond Pesticides, September 18, 2014) After a reported $90 million loss from rejected shipments of genetically engineered (GE) corn seeds that are not approved in China, the U.S. grain company Cargill Inc. sued the biotech giant Syngenta AG. According to Cargill, since mid-November 2013, China has rejected imports of U.S. corn due to the presence of Syngenta’s MIR 162 trait because of its lack of approval for import, virtually halting U.S. corn trade with China.  The lawsuit, filed Friday in Louisiana, will ultimately decide whether responsibility for the marketplace risks and economic damage of introducing GE crops in international trade should be placed on the seed companies that develop unapproved GE traits, or the merchants who sell contaminated grain. “Unlike other seed companies, Syngenta has not practiced responsible stewardship by broadly commercializing a new product before receiving approval from a key export market like China,” said Mark Stonacek, president of Cargill Grain & Oilseed Supply Chain North America.  “Syngenta also put the ability of U.S. agriculture to serve global markets at risk, costing both Cargill and the entire U.S. agricultural industry significant damages.” Syngenta’s corn seed in question, Agrisure Viptera corn, also known as MIR 162, was deregulated by USDA […]

Nearly Half of All U.S. Adults Seek Out Organic Food

(Beyond Pesticides, August 20, 2014) According to a new Gallup poll, nearly half of all U.S. adults “actively” seek to add organic food to their diets. Many who eat and incorporate organic foods into their diet are from city areas, whereas those who eat the least organic foods are described as coming from rural areas. Those who live in the western half of the country and are middle class were also more likely to eat organic food. The poll underscores the notion that many view the benefits of organic foods as greater than the perceived drawbacks, such as higher costs or limited access. The Gallup poll, as reported by The Washington Post, polled about  1,000  adults across the country in July and found that Americans most likely to eat organic are in the West, live in a city, are 18 to 29 years old, vote Democrat or have an annual household income greater than $75,000. Those most likely to avoid organic foods are basically the opposite: those who live in the East, live in more rural parts, are age 65 or older, vote Republican or have an annual household income less than $30,000. National Refuges to Ban GE Crops and Bee-Killing Pesticides

(Beyond Pesticides, August 1, 2014) In a huge victory for environmental protection, the U.S. Fish and Wildlife Service (FWS) will phase out the use of genetically engineered (GE) crops to feed wildlife and ban neonicotinoid insecticides from all wildlife refuges nationwide by January 2016. The FWS decision, announced via internal memoranda July 17 and obtained by Center for Food Safety (CFS), follows a longstanding grassroots, legal, and policy campaign by CFS, Public Employees for Environmental Responsibility (PEER), and joined by Beyond Pesticides, to end the harmful practices. This announcement builds on the recently announced decision to eliminate neonicotinoid pesticides, linked to the decline of pollinator health, from refuges in the Pacific Region. FWS is the first federal agency to restrict the use of GE crops in farming in the U.S. and the use of neonicotinoids based on a precautionary policy. “We have demonstrated our ability to successfully accomplish refuge purposes over the past two years without using genetically modified crops, therefore, it is no longer possible to say that their use is essential to meet wildlife management objectives. EPA Denies Hazardous Pesticide Use on 3 Million Acres of Texas Cotton Fields

(Beyond Pesticides, July 24, 2014) Last week, the U.S. Environmental Protection Agency (EPA) denied an emergency application to use a hazardous pesticide, propazine, on 3 million acres of Texas cotton fields, after groups representing environmental, public health, and organic farm interests urged the agency to reject the request based on environmental effects and the predictable nature of the weed resistance to currently used chemicals. Despite determining “that an urgent and non-routine condition exists for Texas growers” when certain weed-densities are reached, EPA’s primary reasons for denying the application focused on health and environmental concerns of the pesticide. As EPA explained, “When conducting human health risk assessment for new use the Agency must first consider the risk profile for currently registered uses and determine if an additional use can be added to the cup.” This aggregate risk assessment is required under the Food Quality Protection Actand in the case of propazine, EPA found that “drinking water estimates suggest that risks from drinking water alone may lead to unacceptable risks . . . .” “While we disagree with the EPA that this meets any of the criteria for emergency exemption, we applaud the EPA for putting the health of people and the […]

Tell EPA by End of Today: Don’t Bail Out Genetically Engineered Cotton with a Toxic Pesticide

(Beyond Pesticides, July 3, 2014) It was predictable that genetically engineered (GE) cotton sprayed with the weedkiller glyphosate (Roundup) would create resistant superweeds. Now that it has, Texas GE cotton growers recently requested an emergency use of a chemical cousin to atrazine, the herbicide that is demasculinizing frogs by disrupting the endocrine system— on 3 million acres of cotton fields where the weeds have become resistant to the chemical of choice —glyphosate. Maui County Moves Forward with GE Moratorium Initiative

(Beyond Pesticides, July 1, 2014) Early last month, Maui County residents gathered enough signatures to require a county-wide vote on legislation that will put in place a moratorium on the planting of genetically engineered (GE) crops. This achievement represents the first ever citizen driven initiative in Maui County, which encompasses Maui, Molokai and Lanai islands. The petition drive was spearheaded by the SHAKA (Sustainable Hawaiian Agriculture for the Keiki and the Aina) Movement, a grassroots campaign that is “preserving paradise for future generation by reclaiming, restoring and revitalizing depleted soil, and growing healthy foods without a dependence on chemicals,” according to Mark Sheehan, a spokesman for the group. Maui’s citizen initiative is part of a growing movement on the Hawaiian Islands that seeks to protect health and the environment while strengthening local food economies and resiliency. Residents living on the Hawaiian Islands are subject to a particularly pronounced form of environmental assault, as the state’s premiere growing conditions have made it a prime target for agrichemical companies to test new, experimental forms of GE crops. Monarch Butterfly Decline Linked to GE Crops and Shrinking Habitat

(Beyond Pesticides, June 12, 2014) According to a new study in the Journal of Animal Ecology, the deficiency of milkweed plants due to the rapid spread of genetically engineered (GE) crops is one of the primary reasons for the decline in monarch butterflies. The widespread adoption of GE agriculture and the ever growing use of herbicides is contributing extensively to the loss of milkweed covered areas, which is the butterfly’s main food source and the only place where they lay their eggs. This study adds weight to previous reports linking GE crops, as well as climate change, to the decline of butterfly populations, which are at their lowest in two decades. Monarch butterflies make their way from the U.S. and Canada, usually arriving in Mexico around the beginning of November, clustering by the thousands in the boughs of fir trees. Although the same trip occurs every year, no individual butterfly makes it twice, as the butterfly’s life span is too short. How the migration route lives on in the butterflies’ collective memory is an enduring scientific mystery. Vermont Prepared for Challenges to GE Labeling Law

(Beyond Pesticides, June 11, 2014) Vermont is currently gearing up to defend against possible litigation its groundbreaking law to label genetically engineered (GE) food ingredients. The law, which is the first of its kind in the nation, was specially written so that it created  the Food Fight Fund that allows individuals to donate to defend the law if it were to be challenged in court. The Vermont law and polling data  show that consumers strongly want to know what is going into their food and are willing to stand up to industries that do not want consumers to have this right. As of the first week of June, the  Food Fight Fund raised just over $15,000, with over $$9,000 of it coming from outside the state. Most of the donations come in small amounts of less than $50, which is indicative of the grassroots structure of the GE labeling movement. The fund will be the initial money used by the Vermont attorney general’s office if the state’s GE labeling law is challenged in court. Moms Tell EPA to Ban Glyphosate After Residues Found in Breast Milk

Beyond Pesticides, May 30, 2014) This week, a group of concerned mothers and environmentalists met with U.S. Environmental Protection Agency (EPA) officials  to discuss a recent pilot study that detected glyphosate residues in breast milk. Organized by Mom’s Across of America, which is seeking to stop the sale and use of glyphosate, the meeting  underscored the limitations of EPA’s pesticide registration program in addressing  the real-life impacts of pesticides on children and the concerns of mothers surrounding the dangers of glyphosate in particular.  Glyphosate, the active ingredient in the herbicide Roundup, is the most widely applied herbicide in the U.S., with uses ranging from genetically engineered (GE) crops to lawn turf. The meeting with Moms Across America, Beyond Pesticides, Consumes Union, Organic Consumers Association,  other groups  and EPA came after Mom’s Across America’s five-day phone call campaign urging EPA to recall Roundup. Participants in the campaign made close to 10,000 calls to the agency. The pilot study, supported by Moms Across America, looked at ten breast-milk samples from across America. Australian Organic Farmer Loses GE Contamination Suit

(Beyond Pesticides, May 29, 2014) The global fight to establish better protections from genetic contamination caused  by genetically engineered (GE) crops suffered a legal setback in Australia this week. A ruling of the Supreme Court of Western Australia  found that farmer Steve March could not seek compensation after losing his organic certification as a result of a neighbor’s GE crops contaminating his organic crops. Mr. Marsh filed the lawsuit against Michael Baxter, a neighboring GE canola seed farmer, alleging that  he had suffered economic damage because of his organic decertification. The decertification had been brought on by the confirmed presence of GE canola plants and seeds on his property and Australia’s zero-tolerance organic standard concerning GE contamination on organic lands. Mr. Baxter  began farming GE canola just a few years before and was the likely source of the contamination. Argued before the court earlier this year, the litigants as well as environmental and organic advocates across the globe had anxiously awaited the court’s decision. Oregon Counties Ban Planting of Genetically Engineered Crops

(Beyond Pesticides, May 23, 2014) Residents in two Oregon counties, Jackson and Josephine, voted to ban the cultivation, production, and distribution of genetically engineered (GE) crops within the counties’ borders Tuesday.  The Jackson County measure 15-119, passed with 66 percent of the vote, while Josephine County passed with 58 percent. As noted by Reuters, the newly approved measures mandate that people “harvest, destroy or remove all genetically engineered plants” no later than 12 months after the ordinances go into effect. This is great news for farmers of organic and non-genetically engineered crops, who constantly struggle with the threat of GE contamination. Though there are less than 120,000 registered voters in Jackson County, the measure gained national attention due to the fact that opponents raised over $830,000 to advertise againstthe measure, with over 97% of the funding coming in from outside of the county, including over $450,000 from biotech giant Monsanto and five other corporations to defeat the initiative. France Bans GE Corn Cultivation, VT Passes GE Food Labeling Bill

(Beyond Pesticides, April 24, 2014) France’s lower house of parliament passed a bill last week banning the cultivation of all strains of genetically engineered (GE) corn within its borders, even those strains that might not yet be approved within the European Union (EU). The law follows a decree adopted last month, which targeted the only GE crop permitted for cultivation in the EU””Monsanto’s insect-resistant MON810 corn. Back in the U.S., Vermont became the first state to pass a  bill requiring the labeling of food containing GE ingredients  (You can read the House bill as it was introduced here and the Senate amendments to this bill here). The bill, which the Governor said he will sign, passed by large majorities in both houses of the legislature and does not contain a trigger provision similar to laws adopted in Connecticut and Maine  –with a  requirement that  similar action is taken in contiguous states before the law goes into effect. Vermont One Large Step Closer to Labeling Genetically Engineered Food

(Beyond Pesticides, April 18, 2014) Last week the Vermont state Senate voted 28-2 to authorize the mandatory labeling of foods made with genetically engineered (GE) ingredients. The bill, H.112, “An Act Relating to the Labeling of Food Produced with Genetic Engineering,” passed the Vermont House of Representatives back in May, and now goes back to the House for approval before moving to the Governor. Vermont’s legislation does not include a “trigger clause,” which is contained in  labeling bills passed last year in Maine and Connecticut  that, before  going into effect,  require other states in the New England region (including one boarding state) with an aggregate population of 20 million to pass similar laws. If the last hurdles in the state legislature are cleared and the bill is signed by Governor Peter Shumlin (D), Vermont’s labeling law would not allow manufacturers to describe any food containing GE ingredients as “all natural” or “natural.” Processed foods that contain a product or products with GE would be required to display in clear and conspicuous language the words, “partially produced with genetic engineering” or “may be partially produced with genetic engineering.” But even if passed, Vermont’s bill faces numerous challenges from the deep pockets […]

“DARK” Act Introduced to Stop the Labeling of GE Foods

(Beyond Pesticides, April 17, 2014) Rep. Mike Pompeo (R-KS) recently introduced H.R. 4432, a bill that would give full authority of  genetically engineered (GE) labeling to the Food and Drug Administration, which now favors a voluntary approach to the issue.  The bill is designed by industry to undercut a growing number of states that are taking on GE labeling by preempting state authority. The bill is being fought by environmental and food safety groups that are backing federal legislation that would label all GE ingredients. H.R. 4432, or what is being dubbed as the “Deny Americans the Right-to-Know Act” (DARK Act) by activists, would dramatically change food labeling by giving the preemptive authority of labeling GE ingredients to the Food and Drug Administration (FDA). The act will prevent states from adopting their own GE labeling laws, allow food companies to put a “natural” label on products that contain GE ingredients, and prevent the FDA from requiring companies to label GE ingredients and continue its current “voluntary” labeling policy. Public Interest Groups Intervene to Defend Kauai’s GE Law

(Beyond Pesticides, April 16, 2014) The U.S. District Court of Hawaii granted a Motion to Intervene jointly presented by Center for Food Safety (CFS) and Earthjustice on behalf of several community non-profit groups. The order allows the groups to participate in a lawsuit filed by Syngenta and other pesticide companies challenging Kauai’s County Ordinance 960, which  establishes a  county program to monitor pesticide use and genetically engineered (GE) crops. The federal order allows the groups to defend the County of Kauai’s 2013 pesticide disclosure law against the pesticide companies’ legal challenge. The non-profit groups intervening include Center for Food Safety, Surfrider Foundation, Pesticide Action Network North America, and Ka Makani Ho”˜opono. Ordinance 960 (formerly known as Bill 2491) provides residents of Kauai public access to information related to the application of pesticides used in experimental and commercial agricultural operations within the County of Kauai. Connecticut Senate Moves Forward on GE Grass Ban

(Beyond Pesticides, April 11, 2014) Connecticut State Senate bill no.443, an act that bans the sale of genetically engineered (GE) grass seeds, passed the state Senate on Wednesday by a vote of 25-11. The bill shows Connecticut legislators are taking seriously the risks that increased pesticide use in residential areas pose to the health of the states residents, especially children, and pets. The bill will ban the sale, use, and marketing of lawn or turf seeds that are genetically engineered to be resistant to pesticides. The GE grass seed that is being developed by Monsanto and Scotts is currently not available in consumer markets and is being tested by Scotts employees in their front yards. The bill may face stronger challenges from Connecticut’s House as it is unclear if the House speaker, J. Brendan Sharkey, D-Hamden, will call for a vote on the bill before the session ends May 7. Neonicotinoid Pesticides Lack Benefits, Studies Find

(Beyond Pesticides, March 27, 2014) — A report released by Center for Food Safety (CFS) this week refutes claims that a dangerous class of insecticides, neonicotinoids, bring greater benefits than costs to farmers. In the report, Heavy Costs: Weighing the Value of Neonicotinoid Insecticides in Agriculture, researchers analyzed independent, peer-reviewed, scientific literature to answer the simple question: Are neonicotinoid insecticidal seed treatment products beneficial or not? Neonicotinoids, the pesticides in question, are a class of systemic insecticides. Despite numerous studies linking these insecticides with bee kills, colony collapse, and weakened pollinator immune systems, the U.S. Environmental Protection Agency (EPA) continues to operate under an alarmingly slow pesticide registration review process, one that extends to 2018 and will most likely fail to appropriately apply the appropriate standard of review for pesticide registration. Under that standard of review, EPA should not approve a pesticide that poses unreasonable risks to “man or the environment,”  taking into account economic, social, and environmental costs and benefits.   Unfortunately, economic costs and benefits usually become the sole factor. (March 24, 2013 Beyond Pesticides) A study by an entomologist at Iowa State University in Ames Iowa found that western corn rootworm is now resistant to two varieties of Bt-incorporated genetically engineered (GE) maize and that resistant insects are likely to be cross-resistant. This study adds to the growing scientific literature that shows insect resistance to Bt crops is making certain GE technologies obsolete, which could lead to an increase in insecticide use. The study, Field-evolved resistance by western corn rootworm to multiple Bacillus thuringiensis toxins in transgenic maize, conducted by a team led by Aaron Gassmann, PhD, adds to the growing scientific literature that that finds western corn rootworm  is resistant to varieties of Bt-incorporated GE maize. In 2009, farmers in Iowa observed severe injury to Cry3Bb1 maize —one of the three varieties of Bt-incorporated GE maize- from larval western corn rootworm in the field. Subsequent laboratory assays reveal that this injury is associated with rootworm resistance to  Cry3Bb1. Colorado GMO Labeling Initiative Overcomes Challenge by Industry

(Beyond Pesticides, March 19, 2014) Ruling on a  challenge by biotech industry interests, the Colorado Supreme Court on March 13 authorized the Right to Know Colorado ballot initiative to label GMO foods, clearing the way to begin collecting over 86,000 signatures needed for a 2014 statewide ballot measure. In overturning a major challenge by the biotech industry, pesticide, and grocery interests to a statewide GMO labeling ballot initiative, the Colorado State Supreme Court affirmed Colorado consumer’s right to determine whether the presence of genetically engineered foods should be labeled on food packaging. The State Supreme Court ruling allows the Right to Know Colorado campaign, a grassroots effort established by local residents to achieve mandatory labeling of genetically engineered (GE) ingredients ( commonly known as GMOs) in foods, to begin circulating petitions for signatures to place the initiative on the November 2014 ballot. Colorado requires 86,105 valid signatures to be submitted by early August to place an initiative on the ballot. Survey Finds GE Contamination of Organic Farms

(Beyond Pesticides, March 10, 2014) New data finds that organic farmers are growing increasingly concerned with genetically engineered (GE) crops cross-pollinating and contaminating their fields. This contamination can lead to serious economic losses for organic farmers and has created tension between neighbors. The data comes at a critical time as USDA is advancing the notion that “coexistence” between GE and non-GE growers  presents no problems for the  organic market.  USDA has been widely criticized in organic circles because its decisions to deregulate numerous GE crops  place  the burden of reducing contamination on non-GE growers. A survey,released by Food and Water Watch and Organic Farmers’ Agency for Relationship Marketing (OFARM), finds that a third of U.S. organic farmers have experienced GE contamination in their fields due to the nearby use of GE crops, while over half of these growers have had loads of grain rejected because of unwitting GE contamination. These rejections can lead to big income losses for farmers, with a  median cost of approximately $2,500 per year, according to the  survey. USDA Seeks to Increase Pollinator Habitat without Focus on Pesticides and GE

(Beyond Pesticides, March 4, 2014) The United States Department of Agriculture (USDA) recently committed to providing financial assistance to farmers and ranchers in five Midwestern states to improve and create bee-friendly habitat. This project comes as American beekeepers have continued to experience rapid colony declines with losses over the winter over 30 percent per year. The creation of pollinator-friendly habitat is an important step to slowing pollinator losses, however this project does not challenge the expansion of agriculture into current pollinator habitat, the use of systemic pesticides that are linked to pollinator decline, or the widespread adoption of genetically engineered crops with elevated use of herbicides that kill habitat. USDA’s Natural Resources Conservation Service (NRCS) will provide $3 million in technical and financial assistance to farmers and ranchers to create and improve bee friendly habitat in five Midwestern states. Ranchers can qualify for assistance to reseed pastures with alfalfa, clover and other plants that bees forage.  NRCS will also assist ranchers in building fences, installing water tanks and other changes to better move cattle between pastures so as not to wear down vegetation.
