(Beyond Pesticides, July 30, 2012) The U.S. Environmental Protection Agency (EPA) has opened a 60-day public comment period on the agency’s decision to deny the request by beekeepers to immediately suspend the use of clothianidin, a pesticide that poses harm to pollinators. The legal petition was filed earlier this year by 25 beekeepers and environmental organizations, and cites significant acute and chronic bee kills across the United States linked to neonicotinoid pesticides, particularly clothianidin. On Thursday, Senator Kirsten Gillibrand (D-NY), a member of the Senate Agriculture Committee, called for an expedited review of pesticides that could be inadvertently decimating honey bee populations. The letter is also signed by Senators Patrick Leahy (D-VT) and Sheldon Whitehouse (D-RI). EPA is not expected to complete its review until 2018, and any implementation plans could take years beyond that to complete. (Beyond Pesticides, July 20, 2012) On Thursday, July 19, the U.S. Environmental Protection Agency (EPA) announced it had formally refused to recognize that honey bees face an “imminent hazard” and denied a request by beekeepers to immediately suspend the use of pesticides that pose harm to pollinators. The decision comes in response to a legal petition filed earlier this year by twenty-five beekeepers and environmental organizations, citing significant acute and chronic bee kills across the United States linked to neonicotinoid pesticides, particularly clothianidin. “We’re disappointed. EPA has signaled a willingness to favor pesticide corporations over bees and beekeepers,” said Steve Ellis, a petitioner and owner of Old Mill Honey Co, with operations in California and Minnesota. “This decision puts beekeepers, rural economies and our food system at risk. And the injury we are sustaining this year will be unnecessarily repeated.” This spring and summer, beekeepers from New York to Ohio and Minnesota, are reporting extraordinarily large bee die-offs, due, in part, to exposure to neonicotinoid pesticides. (Beyond Pesticides, July 19, 2012) The Alaska Department of Environmental Conservation (ADEC), along with Alaska Governor Sean Parnell, has proposed drastic changes to state pesticide regulations that will eliminate public participation for pesticide use, undermining the democratic process and affecting public and environmental health. Earlier this week, Representative Les Gara (D-Anchorage) expressed concern about the proposal. “If someone’s plans risk poisoning our drinking water or fishing streams, Alaskans should have a say,” said Rep. Gara. “Alaskans have a right to fish our streams, drink our water, and hunt without fear that our resources will be contaminated by toxic pesticides. If the Parnell administration blocks public comment, it would rob Alaskans of their fundamental right to speak on potential damage to fish and wildlife, and dangers to our children and drinking water.” In his official comments, Rep. (Beyond Pesticides, July 12, 2012) The Council of the District of Columbia passed a pesticide reform act Tuesday strengthening pesticide restrictions in our nation’s capital. To ensure the rules are enacted, Beyond Pesticides is calling on supporters to take action and urge D.C. Mayor Vincent C. Gray to sign the legislation into law. The Pesticide Education and Amendment Control Act of 2012, introduced by Chairwoman Mary Cheh of the Environment, Transportation and Public Works Committee, is a step forward in the fight to keep schools and other public spaces free from unnecessary chemical applications. The bill protects children and their parents by restricting the application of pesticides at schools and day care centers, on public property, and near waterways. It also establishes publicly available courses on pesticides at the University of the District of Columbia. The passage of this Act adds to the growing movement across the country calling for increased restrictions on the use of dangerous chemicals in the public sphere. (Beyond Pesticides, July 5, 2012) After a 2006 cancellation of uses due to unreasonable risks to farmworker health and the environment, and a 6-year phase out scheduled to conclude this September, the U.S. Environmental Protection Agency (EPA) is conducting a risk-benefit analysis to make a determination whether to keep in place or amend the cancellation order for the organophosphate azinphos-methyl (AZM), citing new information on the economic costs of using alternatives. In 2001, EPA found that insecticides azinphos-methyl (AZM) posed unacceptable risks to farmworkers and announced that 28 crop uses were being canceled, seven crop uses were to be phased-out over four years, and eight crop uses were to be allowed to continue under a “time-limited” registration for another four years. Farmworker advocates challenged that decision in federal court citing that EPA failed to take into account the costs of poisoning workers, exposing children, and polluting rivers and streams. A settlement agreement effectively stayed the legal challenge pending EPA’s reconsideration of the “time limited” uses of AZM. (Beyond Pesticides, June 25, 2012) The Canadian governmental authority responsible for pesticide registration has expanded its re-evaluation of neonicotinoid pesticides to include two additional compounds linked to honey bee deaths and Colony Collapse Disorder (CCD). Health Canada’s Pest Management Regulatory Agency (PMRA) announced on June 12 that it has added clothianidin and thiamethoxam and their associated products to its ongoing re-evaluation of imidacloprid. The re-evaluation of these pesticides will focus on resolving issues related to environmental risk and specifically the potential effects of neonicotinoids on pollinators. The re-evaluation will consider all agricultural uses of neonicotinoid insecticides, including soil applications, seed treatment, as well as foliar and greenhouse uses. The Canadian announcement follows France’s decision earlier this month to initiate its own review for thiamethoxam that could result in the cancelation of allowances for using the pesticide. Neonicitinoids are highly toxic to a range of insects, including honey bees and other pollinators. (Beyond Pesticides, June 19, 2012) A senior U.S. Environmental Protection Agency (EPA) official stated recently that the agency is prepared to exercise is long-neglected authority under the Toxic Substances Control Act (TSCA) to ban or restrict hazardous chemicals. In reference to TSCA, EPA Acting Assistant Administrator for Chemical Safety and Pollution Prevention Jim Jones was quoted as saying that, “We will try and exercise some muscle we have not exercised for decades.” In fact, EPA has not sought to use this authority under TSCA since 1991, when the U.S. Court of Appeals for the Fifth Circuit overturned the agency’s attempt to ban asbestos. Speaking on June 7 to a forum convened by The Environmental Council of the States, Mr. Jones was further quoted as expecting a decision from EPA on the matter “in the near future.” Section 6 of TSCA requires that EPA prove it has substantial evidence that a chemical poses an unreasonable risk before it can ban, restrict, or take other actions to manage that risk. (Beyond Pesticides, April 12, 2012) The U.S. Environmental Protection Agency (EPA) announced Monday that it has rejected a petition to ban the widely used herbicide 2,4-D, dismissing epidemiologic studies that link the pesticide to cancer, endocrine disruption, and other human health effects. In its announcement, EPA also responded to comments that Beyond Pesticides submitted in 2009, dismissing two studies that evaluate the relationship between the use of the chemical on lawns and the incidence of malignant lymphoma in pets. The petition was initially filed in 2008 by the Natural Resources Defense Council (NRDC). 2,4-D has been used in the U.S. since the 1940s, and as such is one of the oldest registered herbicides in the country. It made up roughly half of the herbicide known as Agent Orange, which was used to defoliate forests and croplands in the Vietnam War. According to EPA, 2,4-D is currently found in approximately 600 products registered for agricultural, residential, industrial, and aquatic uses. (Beyond Pesticides, March 28, 2012) The Canadian government is set to declare the bacteria killer found in many toothpastes, mouthwashes and anti-bacterial soaps as toxic to the environment, a move which could see the use of the chemical curtailed sharply in Canada. Triclosan, the chemical in question, has been linked to numerous human and environmental health effects and has been the subject of petitions calling for its ban from consumer products. Health Canada has been probing the effects of triclosan on the body’s endocrine system and whether the antibacterial agent contributes to the development of antibiotic resistance along with the effect of widespread use on the environment. The draft risk assessment finds triclosan to be toxic to the environment but but does not find enough evidence to say it is hazardous to human health. The formal proposal to list the chemical as toxic to the environment will be published Friday. Triclosan exploded on to the marketplace in hundreds of consumer products ranging from antibacterial soaps, deodorants, toothpastes, cosmetics, fabrics, toys, and other household and personal care products. (Beyond Pesticides, March 1, 2012) A legislative proposal to strengthen the District of Columbia’s pesticide restrictons, with a specific focus on protecting children’s health, is moving forward after a hearing that brought together supporters of the effort –physicians, a toxicologist, environmental advocates, a pest management practitioner, and the head of District’s Department of the Environment. Introduced in January by Chairwoman Mary Cheh, of the Environment, Transportation and Public Works Committee of the DC Council, the Pesticide Education and Amendment Control Act of 2012 (Act) would, among other provisions, restrict the application of pesticides at schools and day care centers, on public property and near waterways and establish publicly available courses on pesticides at the University of the District of Columbia. With targeted improvement, this legislation has the potential to make a comprehensive approach to integrated pest management the foundation for pesticide regulation in the nation’s capital and place the burden of proof for allowing toxic pesticides on the companies seeking to market such products. (Beyond Pesticides, February 27, 2012) For the first time since its initial evaluation almost 30 years ago, the U.S. Environmental Protection Agency (EPA) has revised, despite objections from the chemical industry, its dioxin exposure assessment for acute human health risks –setting an “acceptable” level of 0.7 picograms per kilogram per day. Environmentalists said EPA’s estimated average exposure, currently at 0.5—3 picograms per kilogram per day, puts a portion of the population above the EPA danger threshold. Work on updating the health assessment began in 1991 and was partially completed with the February 12 release of the Final Non-Cancer Dioxin Science Assessment. While EPA characterized the findings as showing that “generally, over a person’s lifetime, current exposure to dioxins does not pose a significant health risk,” the Assessment establishes a daily “acceptable” exposure threshold, or reference dose, which the agency says is comparable to levels which people routinely experience. (Beyond Pesticides, February 17, 2011) Beyond Pesticides is urging the U.S. Environmental Protection Agency (EPA), during a public comment period (closing February 23) on its review of the neonicotinoid pesticide, clothianidin, to take swift action to cancel the chemical’s registration. Groups are joining together with comments to EPA, citing the extensive science that shows clothianidin’s toxic effects on honey bees. Beyond Pesticides has drafted comments that it will submit to EPA outlining serious concerns regarding clothianidin. The agency is accepting public comments through February 21, 2012. (Beyond Pesticides, February 8, 2012) The U.S. Environmental Protection Agency missed a deadline to release federal guidelines on the dangers of excess dioxin chemicals in the food supply and environment, giving ammunition to critics who are urging the agency to change course. EPA was scheduled to release standards in January 2012 that would for the first time set a maximum human-exposure level for dioxins. The delay comes amid criticism and pressure by food and chemical industries that argue the guidelines are too strict. The January 31, 2012 cut-off was part of a reassessment process that has stretched out for 20 years, but the agency has promised to finalize its guidelines “as expeditiously as possible,” although it gave no new deadline. In August 2011, EPA announced a plan for moving forward to complete the dioxin Reanalysis, Volume 1, which is to contain an evaluation of all the scientific literature on dioxin dose-response, including information published since the release of a previous draft Reassessment, and post it by the end of January 2012. (Beyond Pesticides, January 31, 2012) The Environmental Protection Agency (EPA) has proposed an expansion in pyrethrins/pyrethroid insecticide uses as part of its cumulative risk assessment for this neurotoxic class of chemicals. In the cumulative risk assessment, EPA concludes that pyrethroids “do not pose risk concerns for children or adults,” ignoring a wealth of independent data that links this class of chemicals to certain cancers, respiratory and reproductive problems, and the onset of insect resistance. It went as far as to state that its cumulative assessment supports consideration of registering additional new uses of these pesticides, potentially opening the flood gates for manufacturers to bombard the market with more pyrethroid pesticides, endangering the health of the public. (Beyond Pesticides, January 27, 2012) The National Research Council (NRC) released a report on Wednesday, finding that, despite extensive investment in nanotechnology and increasing commercialization over the last decade, insufficient understanding remains about the environmental, health, and safety aspects of nanomaterials. Just one day later, a lawsuit was filed in court by the Natural Resources Defense Council challenging approval by the U.S. Environmental Protection Agency (EPA) of a particular nanomaterial, nanosilver, citing the lack of scientific grounding. The suit, filed in the 9th U.S. Circuit Court of Appeals in San Francisco, seeks to block EPA from allowing nanosilver on the market without legally-required data about its suspected harmful effects on humans and wildlife. Starting in December 2011, EPA allowed the company HeiQ Materials to sell nanosilver used in fabrics for the next four years as the company generates the required data on toxicity to human health and aquatic organisms. (Beyond Pesticides, January 25, 2012) Apple growers in Michigan are seeking a Section 18 emergency exemption from the U.S. Environmental Protection Agency (EPA) for an unregistered pesticide to curb fire blight on 10,000 acres of apples trees that are susceptible to a deadly disease. Even though Section 18 exemptions from federal pesticide law are only to be used in ”˜emergency conditions,’ this request has been petitioned and granted over the past three years, leading to questions on the of the “emergency” that triggered the section 18 exemption request. In December 2011, the Michigan Department of Agriculture (MDA) asked EPA to grant the use of the antibiotic, kasugamycin, to control streptomycin-resistant strains of Erwinia amylovora, the causal pathogen of fire blight, maintaining that there are no available chemical alternatives and effective control practices. The agency has requested comments until February 6, 2012 at www.regulations.gov, docket number EPA—HQ—OPP—2011—1016. Kasugamycin is not registered for use in the U.S. under the Federal Insecticide, Fungicide and Rodenticide Act (FIFRA), but has import tolerances for residues on food imported. (Beyond Pesticides, January 20, 2012) A California Superior Court Judge has questioned whether the California Department of Pesticide Regulation (CDPR) complied with its legal obligation to consider alternative options before approving use of the toxic fumigant methyl iodide in 2010. Judge Frank Roesch raised the concern in comments from the bench during a January 13 hearing involving a lawsuit filed by farm worker and environmental organizations against CDPR and the Arysta LifeScience Corporation, which manufactures the methyl iodide products used in the state. The California Environmental Quality Act (CEQA) requires that state agencies consider alternative options to a regulatory action that meets the definition of a “project.” Projects include an action undertaken by a public agency which may cause either a direct physical change in the environment or a reasonably foreseeable indirect change in the environment. A project may not be approved as submitted if feasible alternatives or mitigation measures are able to substantially lessen the significant environmental effects of the project. (Beyond Pesticides, January 12, 2012) The U.S. Food and Drug Administration (FDA) says it will step up testing for a fungicide not registered for use in the U.S. that has been found in low levels in orange juice. The fungicide, carbendazim, does not have any food tolerances and thus its presence in orange juice is unlawful under the Federal Food, Drug, and Cosmetic Act. Despite this, FDA does not intend to take action to remove from domestic commerce orange juice containing the reported low levels of carbendazim, but will deny future imports. FDA said in a letter to the Juice Products Association that an unnamed juice company contacted the agency in late December and said it had detected low levels of carbendazim, a fungicide, in the company’s own orange juice and also its competitors’ juice. Carbendazim is not currently approved for use on citrus in the U.S., but is used in Brazil, which exports orange juice to the U.S. Testing found levels up to 35 parts per billion (ppb) of the fungicide, far below the European Union’s maximum residue level of 200 ppb. (Beyond Pesticides, January 3, 2012) A coalition of six consumer safety groups filed suit against the U.S. Food and Drug Administration (FDA) on December 21, 2011, citing the FDA’s chronic failure to regulate materials derived from nanotechnology (nanomaterials) used in sunscreens, cosmetics and drugs. The lawsuit demands that FDA respond to a May 2006 petition the coalition filed calling for regulatory actions, including nano-specific product labeling, health and safety testing, and an analysis of the environmental impacts of nanomaterials in products regulated by FDA. The lawsuit cites numerous studies and reports published since 2006 that establish significant data gaps concerning nanomaterials’ potential effects on human health and the environment. Led by the International Center for Technology Assessment (ICTA), the coalition is calling for FDA to take immediate action to assess the actual risks from nanomaterials and implement appropriate protective measures for consumers. (Beyond Pesticides, December 16, 2011) A group of U.S. Senators has drafted and sent a letter to the offices of Senate Majority Leader Harry Reid (D-NV) and Minority Leader Mitch McConnell (R-KY) in an attempt to convince them to set aside time in the Senate schedule for consideration of the Reducing Regulatory Burdens Act of 2011, H.R. 872. ACTION IS NEEDED to show Senators Reid and McConnell that the public does not want this bill and that pesticides should not be exempted from critical safety and environmental protections. Consideration of this bill would take valuable time out of the Senate’s schedule to debate a bill that would weaken important policies that protect human health and the natural environment. (Beyond Pesticides, December 14, 2011) The U.S. Environmental Protection Agency (EPA) is conditionally registering a pesticide product containing nanosilver as a new active ingredient. The antimicrobial pesticide product, HeiQ AGS-20, a silver-based product for use as a preservative for textiles to help control odors, is being granted registration despite a long list of outstanding studies that have yet to be submitted and reviewed by EPA. As a testament to EPA’s flawed registration process, the agency will now require additional data on the product after it has entered the marketplace to confirm its assumption that the product will not cause ”˜unreasonable adverse effects on human health or the environment,’ the general standard for registration under the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA). HeiQ AGS-20 is a nanosilver-silica composite with nanosilver particles that are incorporated into textiles and release of silver ions to suppress the growth of bacteria, which cause textile odors, stains, and degradation. (Beyond Pesticides, November 28, 2011) The U.S. Environmental Protection Agency (EPA) recently released Pesticide Chemical Search, a new database that allows users to easily access information related to pesticide active ingredients, including regulatory and scientific information. Pesticide Chemical Search is designed to consolidate information from the Office of Pesticide Program’s website and several other important sources. Though the database makes searching for pesticide information more user-friendly, it does not offer additional information on chemical adverse effects. The new application collects existing web pages on specific chemicals on EPA’s Office of Pesticide Program’s website and allows users access to this information through a single portal. Users will also be able to quickly find the current status of a chemical and where it is in the review process. Another key feature is the ability to determine if there are any dockets open for public comment for a given chemical. (Beyond Pesticides, November 16, 2011) On November 9, 2011, the U.S. Environmental Protection Agency (EPA) issued its cumulative risk assessment for the pyrethroid class of insecticides, concluding that these pesticides “do not pose risk concerns for children or adults,” ignoring a wealth of independent data that links this class of chemicals to certain cancers, respiratory and reproductive problems, and the onset of insect resistance. The agency went as far to state that its cumulative assessment supports consideration of registering additional new uses of these pesticides, potentially opening the flood gates for manufacturers to bombard the market with more pyrethroid pesticides, endangering the health of the public. EPA issued the final pyrethins/pyrethroid cumulative risk assessment in the Federal Register and is requesting comment until January 9, 2011, including information that may be used to further refine the assessment. Pyrethroids are a widely used class of insecticides used for mosquito control and various insects in residential and agricultural settings. However pyrethroids are highly neurotoxic and have been linked to cancer, endocrine disruption, suppression of the immune system, and various reproductive effects.
