(Beyond Pesticides, February 8, 2010) The Center for Biological Diversity filed a notice of intent to sue the Environmental Protection Agency (EPA) last week. The lawsuit argues that EPA violated the Endangered Species Act when it approved 394 pesticides known to be harmful to humans and wildlife, without consulting with wildlife regulatory agencies as to the pesticides’ effects on endangered species. By registering pesticides known to harm migratory birds the EPA has also violated the Migratory Bird Treaty Act, according to the suit. The pesticides named in the suit pose a danger not only to wildlife, but to human health as well. Some of the pesticides named include 2,4-D the most commonly used pesticide in the nonagricultural sector, atrazine, triclosan, and pyrethrins. Jeff Miller, conservation advocate at the Center for Biological Diversity, said, “It’s time for the Environmental Protection Agency to finally reform pesticide use to protect both wildlife and people…Many endangered species most affected by toxic pesticides are already struggling to cope with habitat loss and rapid climate changes. (Beyond Pesticides, February 1, 2010) Public health, environmental and organic agriculture advocates are urging the public to submit comments to the U.S. Department of Agriculture (USDA) on its draft Environmental Impact Statement (EIS) on genetically engineered (GE) alfalfa by the February 16, 2010 deadline, demanding that USDA protect organic food from GE contamination and not approve Monsanto’s GE alfalfa. USDA claims in the EIS that there is no evidence that consumers care about GE contamination of organic alfalfa. But, it is not just alfalfa that is at risk. Since alfalfa is fed to dairy cows and other livestock, organic dairy and meat products could also be affected. Last week, Beyond Pesticides reported that in the ongoing battle to stop the use of GE alfalfa seeds, Monsanto v. Geerston Seed Farms will be heard by the U.S. Supreme Court. The seed is modified to be resistant to the herbicide glyphosate, sold by Monsanto under the brand name Roundup. (Beyond Pesticides, January 29, 2010) A genetically engineered (GE) variety of brinjal, or eggplant, was approved by India’s Genetic Engineering Approval Committee (GEAC) last October. As the central government decides on approval of the crop’s commercial release, farmers, environmentalists, doctors, and even several state governments have mobilized in protest. India has already approved the commercial cultivation of GE cotton, but this would be the first genetically engineered food crop. Produced by Monsanto, the Bacillus Thuringiensis (Bt) brinjal is engineered to kill insects. Bt is a soil bacteria that produces compounds toxic to certain larval insects. In Bt crops, part of the bacteria’s genome has been incorporated into the plant’s genome, causing the plant to produce these same compounds. An estimated 80% of India’s cotton crop is currently grown from Bt seeds. Concerns about the approval of Bt brinjal has lead to heated protests. While India’s central government is holding a series of public meetings this month to discuss the issue, the first of these meetings ended in a shouting match between protestors and Union Minister of State for Environment and Forests, Jairam Ramesh. (Beyond Pesticides, January 28, 2010) Scientists convening at the Pan-American Weed Resistance Conference lamented the critical issue that environmentalists have known would eventually happen, and have argued for decades: the resistance of weeds to the broadscale use of the herbicide glyphosate. The conference, hosted by Bayer Crop Science and held in Miami on January 19-21, 2010, was attended by 284 scientists and media representatives from North and South America. One of the scientists in attendance at the recent conference who offered some of the most dire outlooks on the use of glyphosate, according to The Delta Farm Press, was Stephen Powles, a professor of plant biology at the University of Western Australia, and director of the WA Herbicide Resistance Initiative (WAHRI). (Beyond Pesticides, January 27, 2009) Major fashion retailer H&M is under fire after media reports said that it has been selling organic cotton clothing tainted with genetically modified (GM) cotton imported from India. Consumer groups and environmental organizations are calling for an investigation into the matter, but the retailer insists there is no reason to believe that organic cotton used in its garments comes from GM seeds. H&M, a major European clothing store chain with scores of stores in the U.S., were named in a report last week in the German edition of the Financial Times, which claims there was major ”˜fraud’ taking place in the organic cotton sector. The Financial Times said that an independent testing laboratory found that organic cotton samples certified as “organic” were contaminated with genetically modified (GM) cotton material. According to the lab results, “30% of the tested samples” of organic cotton fabric contained GM cotton. Growing cotton from GM seeds is prohibited according to organic standards and the third-party certification bodies. (Beyond Pesticides, January 25, 2010) For the first time, a case involving a genetically engineered crop will be heard by the U.S. Supreme Court. The case, Monsanto v. Geerston Seed Farms, is the most recent development in an ongoing battle to stop the use of genetically modified alfalfa seed. The seed is modified to be resistant to the herbicide glyphosate, sold by Monsanto under the brand name Roundup. In 2006 the Center for Food Safety (CFS) and several other farming and environmental groups, including Beyond Pesticides, filed suit on behalf of Geerston Seed Farms. The suit led to a U.S. District Court ruling that the U.S. Department of Agriculture (USDA) violated the National Environmental Protection Act (NEPA) by approving the sale of GE alfalfa without requiring an environmental impact statement (EIS). Monstanto was forced to stop selling the seed until a comprehensive EIS is prepared. This was the first ever moratorium in the U.S. on a genetically engineered, or modified, crop. (Beyond Pesticides, January 22, 2010) Gardeners have long turned to parasitic wasps and other beneficial insects to control unwanted insects, and new genetic research suggests even more ways to harness these species’ potential. Scientists, led by John H. Werren, Ph.D., professor of biology at the University of Rochester, and Stephen Richards, Ph.D., at the Genome Sequencing Center at the Baylor College of Medicine, have sequenced the genomes of three parasitoid wasp species, revealing many features that could be useful as a “natural” alternative to pesticides. The study, “Functional and Evolutionary Insights from the Genomes of Three Parasitoid Nasonia Species” was published in the January 15, 2010 issue of the journal Science. (Beyond Pesticides, January 19, 2010) A study conducted by the Committee of Research and Information on Genetic Engineering (CRIIGEN) and the Universities of Caen and Rouen in France shows that three genetically modified (GM) crops have numerous adverse health effects on lab rats. The study analyzes raw data initially gathered by Monsanto to gain approval for consumption in the United States and Europe. The three crops used, NK 603, MON 810 and MON 863, are varieties of corn available in food and feed all over the world. Both MON 810 and MON863 are engineered to synthesize Bacillus Thuringiensis (Bt) toxins, a type of insecticide, and NK 603 is engineered to be resistant to the broad spectrum herbicide glyphosate, which Monsanto sells under the brand name Roundup. All three crops show varying levels of adverse health effects, primarily in the liver and kidneys, in addition to the heart, adrenal, spleen and blood cells. Researchers were assisted by Greenpeace in acquiring the data analyzed. (Beyond Pesticides, December 18, 2009) Biologists are finding that short-term, seasonal exposure to pesticides in rivers and basins limit the growth and size of wild salmon populations. Along with the widespread deterioration of salmon habitats, these findings show that exposure to commonly used pesticides continue to detriment the recovery of the salmons’ populations. The findings can be found in the study, “A fish of many scales: extrapolating sublethal pesticide exposures to the productivity of wild salmon populations,” in the December 2009 issue of the Ecological Society of America (ESA) journal, Ecological Applications. “Major efforts are currently underway to restore Pacific salmon habitats in an effort to recover depressed populations,” says David Baldwin, Ph.D., of the National Oceanic and Atmospheric Administration (NOAA), who co-authored the study with NOAA colleagues, “However, not much research has been done to determine the importance of pollution as a limiting factor of ESA-listed species.” The researchers studied the impact of pesticides, such as diazinon and malathion, on individual salmon using pre-existing data, and then devised a model to calculate the productivity and growth rate of the population. (Beyond Pesticides, December 10, 2009) Following news that the Environmental Protection Agency (EPA) is considering a higher uncertainty factor in all pesticide risk determinations, the agency is making available for comment a policy paper entitled “Revised Risk Assessment Methods for Workers, Children of Workers in Agricultural Fields, and Pesticides with No Food Uses.” The paper describes how EPA will assess pesticide risks not governed by Food Quality Protection Act (FQPA) amendments to the Federal Food, Drug and Cosmetic Act (FFDCA). EPA describes its proposal as incluing a more thorough assessment of risks to workers, including farmworkers and farm children, as well as risks posed by pesticides that are not used on food. The agency is asking the public to comment on the new approach and how best to implement the improvements. “Better information and applying these tools will strengthen EPA’s protections for farm workers exposed to these chemicals, and children living in and around the areas of highest possible exposure,” says EPA Administrator Lisa P. (Beyond Pesticides, December 1, 2009) A new study published in the November 2009 issue of Occupational and Environmental Medicine, adds rhinitis, the inflammation of the mucous lining of the nose, to the long list of ailments linked to pesticide exposure. “Rhinitis associated with pesticide exposure among commercial pesticide applicators in the Agricultural Health Study,” examined data from 2,245 Iowa commercial pesticide applicators and evaluated the association between rhinitis and 34 pesticides used in the past year. Seventy-four percent of commercial pesticide applicators in the study reported at least one episode of rhinitis in the past year (current rhinitis), compared with about 20-30% of the general population. Pesticide exposure and rhinitis were assessed at enrollment using two self-administered questionnaires. The first, completed at enrollment, obtained detailed information on use of pesticides on the market at the time of enrolment as well as smoking history, current agricultural activity and demographics. The second questionnaire, sent one month later, more detailed information on the pesticides, as well as medical history, including rhinitis, conjunctivitis, sinusitis and asthma. (Beyond Pesticides, November 24, 2009) The Environmental Protection Agency (EPA) is considering expanding to all pesticides the use of what is typically referred to as the Food Quality Protection Act (FQPA) safety factor (the allowable margin of error or the uncertainty factor in risk determinations), which is currently only applied to the agency’s pesticide evaluations for infants and children. Under the plan the increased uncertainty factor will be applied to other sensitive populations, including farmworkers. Beyond Pesticides learned of the plan through communications with the agency over the past several months. EPA officials told Beyond Pesticides that, under the Obama Administration leadership, the agency would like to apply an equal standard to all people living in the U.S. Beyond Pesticides called on the Obama Administration to protect farmworkers and their children in the Transforming Pesticide Policy document sent after the 2008 election to President Obama’s transition team and top agency officials. (Beyond Pesticides, November 18, 2009) A report released yesterday and authored by Charles Benbrook, PhD, chief scientist at The Organic Center (TOC), finds that the rapid adoption by U.S. farmers of genetically modified corn, soybeans and cotton has promoted increased use of pesticides, an epidemic of herbicide-resistant weeds, and more chemical residues in foods. The report, “Impacts of Genetically Engineered Crops on Pesticide Use in the United States: The First Thirteen Years,” explores the impact of the adoption of genetically modified (GM) corn, soybean, and cotton on pesticide use in the United States, drawing principally on data from the U.S. Department of Agriculture (USDA). The most striking finding, is that GM crops have been responsible for an increase of 383 million pounds of herbicide use in the U.S. over the first 13 years of commercial use of GE crops (1996-2008). The report identifies, and discusses in detail, the primary cause of the increase–the emergence of herbicide-resistant weeds. (Beyond Pesticides, November 9, 2009) One out of every four farmers who plants genetically engineered (GE) corn is failing to comply with at least one important insect-resistance management requirement, which increases the likelihood that pesticide-resistant bugs will threaten the future of organic crops, conventional crops and other biotech crops. That finding comes in a new report, Complacency on the Farm, by the Center for Science in the Public Interest (CSPI). According to CSPI, in 2008, 57 percent of the corn acreage in the United States was planted with corn spliced with genes from the Bacillus thuringiensis bacterium, or Bt. Those crops produce natural toxins that are harmless to humans but will kill corn rootworms and corn borers, which otherwise reduce crop yields. Farmers who plant such crops are supposed to plant a refuge of conventional corn in, adjacent to, or near the GE crop. That refuge is designed to reduce the risk that pests that survive the toxin will breed with each other and produce resistant offspring. (Beyond Pesticides, November 2, 2009) Ireland has passed a policy banning the cultivation of all genetically modified (GM) crops and introducing a voluntary GM-free label for food — including meat, poultry, eggs, fish, crustaceans, and dairy produce made without the use of GM animal feed as a way “[t]o optimize Ireland’s competitive advantage as a GM-Free country.” The policy is a part of the Renewed Programme for Government agreement that was adopted in October and is supported by many stakeholder groups, including the Irish Cattle and Sheepfarmers Association who have been working on this issue since 2004. The passage of the policy is at a time when the international market for GM-free animal produce is growing rapidly. Across Europe, hundreds of leading food brands and dozens of leading retailers now offer premium meat, fish, eggs, poultry eggs and dairy produce made without the use of GM feedstuffs. These are backed by GM-free labels and Government regulations in Austria, Italy, Germany, with France to follow later this year. (Beyond Pesticides, October 27, 2009) U.S. District Judge Paul Huck (Miami) has said a multimillion dollar judgment against U.S. food giant Dole and the Dow Chemical Company cannot be enforced because, “[T]he judgment was rendered under a system which does not provide impartial tribunal or procedures compatible with the requirements of due process of law, and the rendering court did not have jurisdiction over Defendants.” A trial court in Chinandega, Nicaragua, had awarded the money in 2005 to 150 Nicaraguan citizens who believe they were injured by exposure to the pesticide dibromochloropropoane, or DBCP, when they worked on Dole banana plantations between 1970 and 1982. This actiion was taken despite findings in the U.S. that DBCP causes sterility and regulatory action to remove it from the market. The trial court awarded Plaintiffs approximately $97 million under “Special Law 364,” enacted by the Nicaraguan legislature in 2000 specifically to handle DBCP claims. The average award was approximately $647,000 per plaintiff. According to the Nicaraguan trial court, these sums were awarded to compensate plaintiffs for DBCP-induced infertility and its accompanying adverse psychological effects. (Beyond Pesticides, October 13, 2009) In a first ever investigation of toxic chemicals found in the bodies of doctors and nurses, Physicians for Social Responsibility (PSR) in partnership with American Nurses Association (ANA) and Health Care Without Harm (HCWH) released the Hazardous Chemicals In Health Care report on October 8th. The inquiry found that all of the 20 participants had toxic chemicals associated with health care in their bodies. Each participant had at least 24 individual chemicals present, four of which are on the recently released US Environmental Protection Agency (EPA) list of priority chemicals for regulation. These chemicals are all associated with chronic illness and physical disorders. The Hazardous Chemicals in Health Care report offers preliminary indicators of what the broader health care community may be experiencing. The project tested for 62 distinct chemicals in six categories: bisphenol A, mercury, perflourinated compounds, phthalates, polybrominated diphenyl ethers, and triclosan. (Beyond Pesticides, September 28, 2009) In a case brought by Center for Food Safety (CFS) and Earthjustice representing a coalition of farmers and consumers, a federal court ruled September 23, 2009 that the Bush Administration’s approval of genetically engineered (GE) “RoundUp Ready” sugar beets was unlawful. In this case, Center for Food Safety v. Vilsack, No. C 08-00484 JSW (N.D. Cal. 2009), the court ordered the U.S. epartment of Agriculture (USDA) to conduct a rigorous assessment of the environmental and economic impacts of the crop on farmers and the environment. The decision follows on the heels of a June 2009 decision from the Ninth Circuit Court of Appeals affirming the illegality of the USDA’s approval of Monsanto’s genetically engineered alfalfa. (Beyond Pesticides, September 18, 2009) Previously documented in the Potomac River, which flows through downtown Washington, DC, the occurrence of “intersex” fish is now found to be nationwide. U.S. Geological Survey (USGS) researchers published their study, “Widespread occurrence of intersex in black basses from U.S. rivers” in the online edition of Aquatic Toxicology. USGS researchers examined 16 different species of fish across the U.S. between 1995 and 2004. The condition of intersex fish, male fish producing eggs, is most commonly found in smallmouth and largemouth bass. One third of male smallmouth bass and one fifth of the male largemouth bass are intersex. Scientists tested sites in the Apalachicola, Colorado, Columbia, Mobile, Mississippi, Pee Dee, Rio Grande, Savannah, and Yukon River basins. Research shows intersex fish in approximately one-third of all examined sites. The only site where researchers found no intersex fish is the Yukon River basin. (Beyond Pesticides, September 17, 2009) Last week, the Centers for Disease Control and Prevention (CDC) awarded $5 million to the states of California, New York and Washington to conduct biomonitoring surveys to assess public exposure to chemicals and toxic substances. This will allow the states to determine which environmental chemicals people have been exposed to and how much of those chemicals are in their bodies. Many U.S. residents carry toxic pesticides in their bodies above government assessed “acceptable” levels. Biomonitoring, which measures levels of chemicals directly in people’s blood or urine, has become increasingly helpful for assessing people’s exposure to toxic substances as well as for responding to serious environmental public health problems. The PANNA report “Chemical Trespass: Pesticides in Our Bodies and Corporate Accountability” in 2004, which compiled data from previous CDC biomonitoring surveys found that children, women and Mexican Americans carried the heaviest “pesticide body burden.” Another biomonitoring study by the World Wildlife Fund UK in 2003, revealed that chemicals, such as DDT, which have been banned for decades and are associated with cancer, immune system disorders, and other health problems, are still found in people today. “Biomonitoring measurements are considered the most health-relevant assessments of exposure because […]

(Beyond Pesticides, September, 15, 2009) On September 11, 2009, the Environmental Protection Agency (EPA) announced plans to place additional limitations on the use of three organophosphate pesticides ”” chlorpyrifos, diazinon and malathion ”” to protect endangered and threatened salmon and steelhead in California, Idaho, Oregon and Washington. The announcement comes in response to a series of lawsuits brought by Pacific Coast Federation of Fishermen’s Associations (PCFFA), the Northwest Coalition for Alternatives to Pesticides, and other salmon advocates, with legal representation from Earthjustice, aimed at removing toxic pesticides from salmon spawning streams throughout the northwest. In response to the litigation, the National Marine Fisheries Service (NMFS) in November of 2008 released a “biological opinion” that set forth a plan for protecting Pacific salmon and steelhead from three toxic organophosphate pesticides. That decision came after almost a decade of legal wrangling between salmon advocates led by Earthjustice and the federal government. The biological opinion prescribed measures necessary to keep these pesticides out of water and to protect salmon populations in Washington, Oregon, California, and Idaho. (Beyond Pesticides, September 8, 2009) Researchers at the University of Nebraska-Lincoln believe they may have determined the first causal relationship linking colony collapse disorder (CCD) to pathogens and other environmental stresses, including pesticides. CCD is a disappearance of honey bees that has beset beekeepers killing off more than a third of commercial honey bees in the U.S. in 2006-2007. Their study, “Changes in transcript abundance relating to colony collapse disorder in honey bees,” was published September 1, 2009 in the Proceedings of the National Academy of Sciences. The team also included researchers from the University of Illinois and the U.S. Department of Agriculture. In a nutshell, the researchers determined, by comparing the differences in gene expression in healthy and CCD colonies, the infected colonies had considerably more damage in their ribosomes. (Ribosomes function in the expression of the genetic code from nucleic acid into protein in all animal, plant and fungal cells.) The infected hives also had higher rates of picorna-like viruses, which damage the ribosome. The researchers believe the loss of ribosomal function leaves the bees susceptible to pesticides and other infections. (Beyond Pesticides, September 2, 2009) At least 40 small birds were found dead on Sunday in Quebec City, Canada, in what residents described as a scene out of a “Hitchcock movie.” A bird feeder, stuffed with 4-aminopyridine laced corn was the culprit. The chemical was set out on the roof of a building in effort to ward off nuisance pigeons; dozens of other birds were accidentally killed, particularly bronzed grackles. While Quebec City police purport that this pesticide is legal and no charges will be made, the Quebec Environment Ministry is investigating the incident to see if exterminators followed the proper guidelines. “The wrong type of bird ended up being targeted,” Quebec City police spokeswoman Catherine Viel said. A similar event happened in Schenectady New York in 2006, when Rentokill, Inc., a local exterminator applied 4-aminopyridine in order to ward off pigeons from a hospital. This caused a “deadly rain” of pigeons to fall from the sky, closing the hospital emergency room.
