Vermont Leverages New York Limits on Neonic Insecticides with Deference to Chemical-Intensive Agriculture

(Beyond Pesticides, July 3, 2024) In June, the Vermont legislature officially passed H.706 into law – a bill that narrows and reduces the use of neonicotinoid insecticides and neonicotinoid-treated seeds. The legislature came together to override a veto of the bill issued by Governor Phil Scott (R). Gov. Scott said the bill’s language had “the potential to produce severe unintended environmental and economic consequences–—particularly for Vermont’s dairy farmers.” The advocacy in support of the legislation called for a holistic, systems change approach to legislative priorities that considers economic, ecological, public health, and climate resilience. The Vermont legislation builds on New York legislation, which in turn is inspired by Quebec’s “verification of need” prescription model (a.k.a. emergency exemptions) that has proven to dramatically reduce the use of certain neonicotinoids, yet enables the continued use of toxic pesticides and a legacy of pesticide dependency in land management and crop production. Canada Proposes to Phase-out Pesticides Linked to Bee Decline, Aquatic Risks

(Beyond Pesticides, August, 20, 2018) Health Canada’s Pest Management Regulatory Agency (PMRA) has announced a plan to phase out the outdoor use of two neonicotinoid insecticides — thiamethoxam and clothianidin — over three to five years, due to concerns about their effects on aquatic invertebrates. This comes after their 2016 proposal to phase out another neonicotinoid, imidacloprid, for the same concerns, but the proposal has not been finalized. In April, the European Union (EU) voted to ban the most widely used neonicotinoids, citing risks to bees. Earlier this year, PMRA proposed to phase out a number of uses of neonicotinoids in order to mitigate risks to pollinators. And now, after the Canadian agency initiated a special review based on a preliminary analysis of available information on the concentrations and frequency of detection of clothianidin in aquatic environment, the agency has proposed another round of phase-outs. The agency’s review focused on assessing potential risk to aquatic invertebrates exposed to clothianidin applied as a seed, foliar or soil treatment. Health Canada Proposing to Phase Out Certain Uses of Neonicotinoids

(Beyond Pesticides, June 7, 2018) Health Canada is proposing to phase out a number of uses of neonicotinoids in order to mitigate risks to pollinators. The agency has completed its review of clothianidin and thiamethoxam — two neonicotinoids that have been linked to pollinator decline and finds risks of concern for bees. However, these measures do not go as far as those recently made in the European Union, but further than label restrictions issued by the U.S. Environmental Protection Agency (EPA). Health Canada concluded its Pollinator Re-evaluation for clothianidin and thiamethoxam after examining hundreds of laboratory and outdoor field studies that examined the possible effects on bees from wide-ranging situations. The agency finds that uses of these neonicotinoids have “varying degrees of effects on bees,” and that some uses “may pose a risk of concern to bees.” However, instead of a complete ban of the neonicotinoids, the agency is proposing mitigation measures to minimize potential exposure to bees, which includes the phase-out of many uses and certain additional product label statements. Pesticides Contaminate Fish Farms, Fish Farm Fined

(Beyond Pesticides, May 16, 2018) Northern Harvest Sea Farms, an ocean-based fish farm in New Brunswick, Canada, was appeared in court yesterday to answer legal charges stemming from the off-label use of an unnamed pesticide added to its operations to combat severe sea lice outbreaks. The company holds nine licenses for farmed Atlantic salmon cages on the Bay of Fundy, as well as for fish farms off the Newfoundland coast. Sea lice outbreaks are a common at over-crowded, ocean-based fish farms because such facilities afford the optimum conditions for rapidly reproducing and spreading lice. In response, some companies have turned to using illegal and off-label pesticide applications to stave off the problem, which causes huge farmed salmon kills. The company was issued a $12,000 fine that was challenged as inadequate by the Grand Manan Fishermen’s Association. Bonnie Morse, project manager for the association told Canadian Broadcasting Corporation (CBC) news, “I think any time there’s a fine that’s a deterrent to illegal activity, it should be an actual deterrent to the activity,” said Morse. “When you’re looking at $1.5 million worth of fish, their actions speak for themselves.” Maria Recchia, the executive director of the Fundy North Fishermen’s Association, questioned the allowance of fish […]

Canadian Beekeeper’s Class Action Neonicotinoid Lawsuit Moves Ahead

(Beyond Pesticides, April 25, 2018)  A class-action lawsuit against two manufacturers of neonicotinoid insecticides is moving ahead in Quebec, Canada after an appeal to block the case by the Canadian government and the chemical companies, Bayer and Syngenta, was dismissed. In February 2018, the case, brought by a beekeeper, was allowed to proceed to trial by the Quebec Superior Court. Quebec queen bee breeder, Steve Martineau, conducted tests on water and his dead and dying bees and found traces of neonicotinoids. His suit alleges that Bayer and Syngenta were negligent in the manufacture and sale of neonicotinoids in Quebec, and are responsible for damages that he and other class members suffered under Article 1457 of the Quebec Civil Code. Bayer and Syngenta challenged the application on a number of grounds including the assumption that they had manufactured the neonicotinoids which killed Martineau’s bees. The class in this case was authorized for all persons in Quebec who own or owned bees in the affected area since 2006. EPA’s Assessments of Seeds Coated with Neonicotinoid Insecticides Confirm Dangers to Birds and Aquatic Organisms

(Beyond Pesticides, January 4, 2018) Last month, the U.S. Environmental Protection Agency (EPA) released the preliminary ecological (non-pollinator) assessments for the neonicotinoids (neonics); clothianidin, thiamethoxam, dinotefuran, and the terrestrial ecological assessment for imidacloprid, finding that these pesticides pose both acute and chronic risks to aquatic life and birds. Treated seeds are identified as posing the highest dietary risks to birds, confirming previous research that neonics are highly hazardous not only to bees, but to birds, aquatic life, and other non-target organisms. Released December 15, 2017, EPA opened the public comment period for these assessments until February 20, 2018. Along with the risks identified in the assessments, the agency is specially requesting feedback on the benefits of continued use of the neonics in cotton and citrus crops identified in last year’s pollinator assessments as posing risks to honey bees. EPA states, “We believe early input from the public will be helpful in developing possible mitigation options that may be needed to address risks to bees.” This despite evidence of long-term systemic exposures to non-target organisms that support a phase-out of these pesticides. Canada To Impose Fines Up to $1 Million for Cannabis Growers Using Banned Pesticides

(Beyond Pesticides, January 3, 2018) Companies licensed to grow cannabis in Canada will be required to submit to mandatory testing and will receive fines of up to $1 million if their product contains banned pesticides. The new measures announced by Health Canada come as the country prepares to launch its recreational market in July 2018, and reports from national news outlets are sounding the alarm over widespread contamination of the ongoing medical cannabis market. Canada’s move is being closely watched by growers and regulators in the United States, where 29 states currently allow some form of medical or recreational cannabis to be sold, each with different pesticide rules. Health Canada, the primary pesticide enforcement agency in the country, had previously indicated that fines were unlikely because, as regulators told The Globe and Mail, companies were aware that banned pesticides were illegal and disallowed. Canadian Food Inspection Agency Finds Residues of Glyphosate in One-Third of Food Products Tested

(Beyond Pesticides, April 17, 2017) The Canadian Food Inspection Agency (CFIA) published a report on glyphosate testing last week, finding traces of the chemical in about one-third of food products and residue levels above the acceptable limits in almost four percent of grain products. These findings come on the heels of the U.S. Department of Agriculture’s (USDA) decision to abandon plans for testing the U.S. food supply for glyphosate residues. In light of this, Beyond Pesticides is again urging USDA to test for glyphosate residues in U.S. food. According to the CFIA report: “In 2015-2016, 3188 samples of domestic and imported food products were collected and tested for glyphosate residues in three programs: Testing of 482 samples of fresh and processed fruits and vegetables as part of the National Chemical Residue Monitoring Program (NCRMP); Retail survey of 2497 samples of grains (barley, buckwheat, and quinoa), beverages, bean, pea, lentil, chickpea and soy products; A survey of over 209 retail samples of infant foods as part of the 2015-2016 Children’s Food Project.” Out of the 3,188 products tested, glyphosate residues are detected in 29.7% of samples. Study Shows Impact of Neonicotinoids in Amphibians

(Beyond Pesticides, March 6, 2017) A study published last month by Canadian researchers finds that exposure to the neonicotinoid insecticide imidacloprid at environmentally relevant levels results in slight delays in metamorphosis in the tadpoles of the wood frog. While the authors find that this slight delay is not necessarily a cause for concern from an ecological perspective, sublethal effects of pesticide mixtures and a variety of stressors in the environment play a role in extending juvenile periods in frogs, which can increase mortality and population decline. Because neonicotinoids are so widely use, the authors recommend further research on their impact on declining frog populations. The study, published in Environmental Toxicology and entitled, “Sublethal effects on wood frogs chronically exposed to environmentally relevant concentrations of two neonicotinoid insecticides,” looks at the chronic exposure effects of the neonicotinoids imidacloprid and thiamethoxam on the wood frog (Lithobates sylvaticus). The wood frog was chosen because it is native to North America and has a wide distribution across the continent. Online Pesticide Sales Circumvent Pesticide Restrictions in Canada and U.S. States

(Beyond Pesticides, February 22, 2017) The Pest Management Regulatory Agency (PMRA) of Health Canada, which regulates pesticides in the country, recently proposed changes to regulations under the Canada’s Pest Control Products Act (PCPA) that will curtail the ability of individuals living within the country to import pesticide products that do not meet Canada’s regulatory standards. Designed to address an existing loophole in the country’s law, the policy seeks to eliminate the practice of purchasing pesticide products from international online retailers that circumvent Canada’s more stringent pesticide regulations. While U.S. law does not contain a similar loophole, U.S. states that restrict pesticide sale and use more stringently than the federal government face a similar legal quagmre. Current PCPA regulations establish a Personal Use Import Exemption that allows individuals to bring in small quantities of pest control products that are not registered for use in Canada, but do not pose an “unacceptable risk.” According to the Canadian government, the original intent of the exemption was to allow travelers to bring small quantities of pest control products, such as insect repellent, into Canada without “legally undermining the regulatory regime” under PCPA. Health Canada Proposes to Ban Most Uses of the Toxic Insecticide Imidacloprid

(Beyond Pesticides, November 29, 2016) Last week, Health Canada announced its intent to cancel nearly all uses of the neonicotinoid insecticide imidacloprid after determining that the chemical poses unacceptable risks to the environment. Although imidacloprid and other pesticides in the neonicotinoid chemical class are  notorious for their harmful impact to pollinators, Health Canada’s decision to eliminate most uses of the chemical is based primarily on the danger it poses to aquatic insects. Environmental groups throughout the world are praising the proposal, but cautioning against the long, three to five year phase out period proposed by the agency. There is concern that the phase out  will permit continued environmental damage, and provide time for other toxic insecticides with similar systemic properties to replace imidacloprid. Advocates are urging U.S. Environmental Protection Agency (EPA) to complete its full assessment of imidacloprid and follow Canada’s lead in eliminating this toxic chemical. Imidacloprid  breaks down slowly in the environment and has a strong propensity to move through soil and into ground and surface water.
